Attn:Kurt Ahrensfeld 2707 Colby Avenue,Ste 900 Everett,WA 98201 RE: Perteet Response to ICON S/N 014 Lum.Conflicts w/Powerlines on Garden Ave. South Lake Washington Roadway Improvements Project No.CAG 12-021 Dear Mr.Ahrensfeld: After reviewing your letter dated 12/18/12 in response to ICON Letter 014 regarding the luminaire height conflicts,you are advised that ICON Materials rejects your responses made to our requests for additional costs and time associated with this change. Our reasons are as follows: You state there is no provision in the contract for paying for extended overhead. That is the reason for change orders, Standard Specification 1-04.4,to pay for items that weren't originally in the contract. If the City does not want to issue a change order for extended overhead,they can increase Bid Item 8 Mobilization and Bid Item 10 Traffic Control Supervisor at a per day rate. BI 8: 8279,000/80 contract days=$3,487.50/day. 131 10:$42,000/80 contract days=$525/day, This comes out to$52,162.50 for the 13 days we are requesting for this change order. You requested backup information including detailed estimates and invoices for other requests for compensation. We provided a breakdown of the TCS/Site Maintenance costs in ICON Letter 014. It is attached again for reference. Also, attached as requested is a breakdown of TSI's lump sum amount of$8,282.30. During review of their original letter and the break down for this letter,TSI discovered that they mistakenly asked for 10 additional working days instead of 13. I have revised ICON's extended overhead costs to reflect 13 days. If there is anything else that you need,you will have to be specific as to what additional backup information beyond this you are looking for so you can review and evaluate these requests. You state that, "While we acknowledge that installation of the luminaire foundations could not proceed until the clearance issues were resolved,there were other items which could have been worked on but were not at the choice of TSI." TSI did in fact work on other contract items until the clearance issues were resolved,but not as efficiently. They are asking for working days due to inefficiencies caused while the clearance issues were being resolved and they are asking for working days due to not being able to install the luminaires in conjuncture with any other contract items during the original contract time period because this change has pushed out the fabrication of the poles and delayed installation until after the original contract time period expired. Compounded with the delay from the unforeseen conditions encountered on Garden outlined in ICON letter 013,Skyline was forced to have to demobilize the project and remobiihi7e once the foundations are complete. ICON requested compensation for Skyline's$1,800 remobilization cost to be compensated in ICON letter 013. ICON has no preference to whether the $1,800 remobilization cost is compensated in the Luminaire Powerlines Conflict change order or the Unforeseen Conditions change order. The City can decide. If the City prefers to approach this change order as compensation for demobilization and remobilization, please refer to the rd paragraph of this letter for a daily breakdown of BI 8 and BI 10. Your letter states that,"There was no CPM schedule submitted for approval after our first review." That statement is false. ICON submitted the original CPM schedule with Transmittal No.00001 dated April 27,2012. After your first review of the schedule,ICON submitted a revised schedule with Transmittal No. 00020 on June 18,2012. Per Standard Specification'1-08.3(2)8, "The Engineer will evaluate the Type B Progress Schedule and approve or return the schedule for corrections within 15-calendar days of receiving the submittal." To date,ICON has not received any response regarding Transmittal No.00020. On 12/20/12,I asked you for an explanation of this. In e-mails from you on 12/21/12, 12/22/12 and 12/26/12 you then state that the,"baseline schedule on June 18th was reviewed and immediately commented on... since this schedule was erroneous and inadequate." Please provide a copy of returned Transmittal No.00020 with comments as ICON did not receive it the first time. You have only provided meeting minutes from 6/21/12 that indicate that the base line schedule was distributed along with notes of a discussion regarding Schedule Updates, Standard Specification 1-08.3(3),which occur after the baseline schedule is approved. In this meeting you asked if I would provide a schedule update with the pay estimate 42 cut off. I agreed that I would provide a schedule update once I received the reviewed baseline schedule (Transmittal No.00020). ICON Materials and TSI are requesting a Change order in the amount of$34,081.02 and 13 working days for this issue. If the City prefers to proceed with an increase to BI 8 and BI 10 as outlined above for net contract increase of$52,162.50 instead,that is acceptable. Dear Darci, I would like to respond to the City of Renton letter dated 12-18-12,relating to the power line conflicts on Garden Avenue for the street lights. I am requesting equitable adjustment to the contract to cover the period of time we were being delayed from finishing our street light foundations due to unresolved power line conflicts. We did not know if the street light foundations would be relocated to avoid the power line conflicts,and ultimately had to wait for an answer before we could continue. There was a period of time that we were directed to stop work on this portion of the project In the attached e-mail correspondence,it indicates we were not to proceed "until the clearance and elevations issues have been resolved". Therefore,we are requesting equitable adjustment for the time period that we were directed to stop performing the installation of the street light foundations due to the overhead power line conflicts. In our letter dated 11-25-12,we provided a time line of events that caused this delay. It was a total of 13 days that we were delayed from starting this portion of the project. The attachment demonstrates our daily overhead costs associated with this project and 13 days delayed equates to$8,282.27 per our original request. While we were working on other items at the same time we were waiting for direction we were however running out of work to be efficient. These light pole foundations were the last item of work for us before we could request a shut down and wait for the light poles to be manufactured and arrive on site for installation. In Mr.Ahrensfeld's letter,he states that we did not provide any record of when the luminaire poles were ordered. Our luminaire poles were ordered on May 1,2012,well within the prescribed 30 calendar days for-critical purchase orders required by the contract. As his letter states there are long lead times on acquiring materials and we agree. In fact,the City has made several changes to these poles that have caused the manufacturer to delay production. This is beyond our control,and there has been documentation that city representative has been working behind'the scenes on changes without our knowing. The power lines caused the poles to go through another review process as some of poles were shortened to avoid the power lines. Due to conflicts with the power lines,the pole heights for luminaires#7413 had to be revised.This revision caused the installation of all luminaire poles on the project to be delayed until approximately March. Because of this delay the luminaires will not be installed at the same time as the signal or any other work,requiring extra working days for the installation. This delay will also require that the suspended jobsite be maintained until the luminaires are installed. Without the change to the luminaire heights,the luminaire poles would have been delivered in October with the signal poles. Without this change order and the Highlands to Landing change order that changed some signal components,it is reasonable to assume that the signal and luminaires could have been installed in November. These changes have caused ICON to have to maintain the suspended jobsite for approximately 3 months, if the luminaires are installed in March. The conflicts ended up changing the luminaire pole heights and foundations. Therefore,we are seeking additional days be added to the contract,and an equitable adjustment to the contract to cover the extended overhead duration of the project. Originally,the poles were specified to be 25 feet and 35 feet tall. While construction was underway,the issue of the power lines along Garden Avenue came into discussion as to whether ornot the lines would be in the clearance zone required by the RCW/WAC codes. The following is a timeline for the instruction of how the City would like to proceed with construction. • • 1. September 24,2012,an RFI was submitted in regards to the potential power line conflict. 2. September 26,2012,the RFI was answered and we were directed to stop construction on luminaire foundations 9,10, 11, 12,and potentially 13 while a determination was being developed. 3. 10 Days later on October 5,2012,we received direction as how the City would Bike to proceed with bases 1 to 6. 4. 3 Days later on October 8,2012,Field Directive 4 explained what the City would like to have constructed for luminaire foundations 9, 10, 11, 12,and I3. 5. Field Directive 4 gave instructions to shorten the poles and raise the foundations to alleviate slope issues. 6. Installation time will not be concurrent with any other activities. We need a full 10 days to wire,stand poles and fixtures,and turn on. As the timeline above indicates,we were delayed a total of thirteen days from the day we submitted the request for information to the day we received the final field directive. This does not include our behind the scenes work to determine what the new bolt circle maybe on the revised luminaire poles 9 to 13. This added several days to our ability to continue with our work while we were working with determining if the existing bolt circle templates could be utilized or if we would have to re-order new anchor bolts and bolt circle templates. These are much deeper luminaire foundations than typically installed and we were not exactly sure if the light pole bolt circle would change,thus we had to wait until we had these answers before we could proceed with the luminaire foundations. Therefore,we are seeking equitable adjustment to the contract to cover the additional days required to construct the luminaire poles and fixtures on the foundations and expenses for overhead and management. The additional days requested is 10 days,while the extended cost request is set at the lump sum amount of$8,282.30. This work will be well after the majority of the work is complete and is based upon the shipment dates of the luminaire poles for the project. This does not include any future cost increases for the pole revisions. These would be submitted with a separate request once the price is determined with our supplier. It does not appear that there is sufficient space for a 10' clear zone between the luminaire poles on Garden and the aerial utility lines. To construct the block walls around the four luminaires,a vertical cut at the edge of existing sidewalk will have to be made down to top of curb grade. This cut will wipe out the existing irrigation system entirely,take out a couple of trees,require that band rail be added to the existing sidewalk to protect pedestrians from the drop offs and possibly undermine the sidewalk. There is not as much room as Sheet 7A indicates. Has KPG verified that installing the luminaires per plan will allow for the required 10'clear zone with the utility lines? Has KPG verified that excavating for the block walls detailed on Sheet 7A won't undermine the existing sidewalk? The PSRC has included this project on the list of recipients once additional stimulus funding is provided by Congress. The timing of additional stimulus fund is totally based on the economy and the priorities of Congress to try to do something about again. We have heard this is still on the table but the timeline is unknown to us. Our experience on the last stimulus project is that it will have strict guidelines on once the funding is placed that construction must start immediately on a project. It will take about 2 months(from bid advertisement to contract execution)for the City to get a contractor started once we get the go ahead,so if Congress passes the funding in the next 1-4 months we would be in construction in the next 4-6 months. The project will be constructed whether with the stimulus funding or whether the City will seek after another source of funding. Understanding we all have budgets and priorities, but the poles will need to be eventually moved and could be done at any time prior to our work. To answer your question about how to get the engineering done, we would need to engineer the pole relocation, not Potelco. Our group does all the design of PSE's high voltage system,and keeps all the records of those lines. Potelco designs most of the lower voltage distribution lines on our system. In order to proceed with engineering,we'll need to get an electronic copy of the City's road plans,and 3 hi-line orders created(11101 xxxx, 1.0800xxxx,and 59300xxxx). The PSRC has included this project on the list of recipients once additional stimulus funding is provided by Congress. The timing of additional stimulus fund is totally based on the economy and the priorities of Congress to try to do something about again. We have heard this is still on the table but the timeline is unknown to us. Our experience on the last stimulus project is that it will have strict guidelines on once the funding is placed that construction must start immediately on a project. It will take about 2 months(from bid advertisement to contract execution)for the City to get a contractor started once we get the go ahead,so if Congress passes the funding in the next 1-4 months we would be in construction in the next 4-6 months. The project will be constructed whether with the stimulus funding or whether the City will seek after another source of funding. The first email attachment is a discussion between myself and Kathy about the light poles and if they would conflict with the power lines and she said they would request the transmission poles to be taller(for the 2 pole relocations south of the Lowe's driveway)to accommodate the 28.5'street light poles. Further down in the same attachment is an email from Dale Easley of PSE, dated December 23,2009, 11:25AM,4th paragraph, where he also mentions PSE would need the final plans and"any new street light height information to avoid conflicts with new hi-line pole heights." I did follow through and provided PSE with both hardcopy and electronic versions of the 90%plans as well as met with the PSE transmission engineer onsite(Vu Luu)to discuss the relocation work(see second attachment). From my past emails,it looks like Vu Luu of PSE started designing the pole relocations in the middle of 2010,and then later in2010the project was put on hold because of lack of funding. A year later in late 2011,the project picked back up again with TIB funding and PSE went forward with their pale relocation design and relocated the poles in early 2012. The third email attachment from Vu Luu again mentions the street light poles and clearance to their power lines. I just wanted to let you know that we did address this issue and coordinated with PSE during design. It does not appear that there is sufficient space for a 10' clear zone between the luminaire poles on Garden and the aerial utility lines. To construct the block walls around the four luminaires,a vertical cut at the edge of existing sidewalk will have to be made down to top of curb grade. This cut will wipe out the existing irrigation system entirely,take out a couple of trees,require that hand rail be added to the existing sidewalk to protect pedestrians from the drop offs and possibly undermine the sidewalk. There is not as much room as Sheet 7A indicates. Has KPG verified that installing the luminaires per plan will allow for the required 10' clear zone with the utility lines? It was noted that the luminaire installations south of Lowe's driveway(#1-#8)do not appear to have installation and maintenance clearance issues from the power lines. This email is intended to direct you to proceed with installation of the luminaire foundations south of Lowe's driveway on the east side of Garden Ave. N. (luminaires#1-#8) per plan. We anticipate being able to give you further direction on the foundation installations north of Lowe's driveway for luminaires#9,#10,#11, #12 and#13 shortly. Please do not proceed with these foundations at this time. It does not appear that there is sufficient space for a 10' clear zone between the luminaire poles on Garden and the aerial utility lines. To construct the block walls around the four luminaires,a vertical cut at the edge of existing sidewalk will have to be made down to top of curb grade. This cut will wipe out the existing irrigation system entirely,take out a couple of trees,require that hand rail be added to the existing sidewalk to protect pedestrians from the drop offs and possibly undermine the sidewalk. There is not as much room as Sheet 7A indicates. Has KPG verified that installing the luminaires per plan will allow for the required 10' clear zone with the utility lines? Has KPG verified that excavating for the block walls detailed on Sheet 7A won't undermine the existing sidewalk? Is the City aware that trees on Garden Ave.will need to be removed and more hand rail will need to be added to the contract? Please review the questions and concerns listed above and direct us how to proceed. Until we receive a response,we will continue with work as planned.
