THE CONTRACT IS MODIFIED AS FOLLOWS:
Background
Per Request for Information 088,the Contractor needed clarification due to the Contract plans having conflicting information
regarding the planter subgrade depth. In a meeting held on April 24,2013,The City,engineering team,and the Contractor
agreed that the Contract Documents were sufficiently ambiguous with regards to the planter's depth and that the
Contractor's bidding error was justified to a degree.This excavation of landscape planters was a slower labor production rate
and required different equipment than the standard excavation bid items for this Contract.Therefore,the City shall
compensate the Contractor for the actual of work performed based on Johansen timecards and certified payrolls. No
overhead,profit or any other additional compensation shall be granted for this work per the meeting's negotiations.
Description of Change
Additional excavation depth is required for the planter areas to meet the clarification provided in RFI 088,to a depth of 14"
from 8". The change in construction methods for this type of work,due to the state of project completion at the time of the
clarification,required.additional labor and equipment to satisfy the contract requirements.
New Material
No new material shall be incorporated into the project via this Change Order.
