Backeround
The City of Renton submitted a revised contained-in determination to the Department of Ecology for approximately 2,040
tons of contaminated soil that would be generated during the construction of the Rainier Avenue South(SR 167)project.The
Department of Ecology provided a letter with the new contained-in determination for soils contaminated with listed
dangerous waste on September 20,2012.This letter replaced Ecology's previous determination dated,April 19,2012.
The Contract originally provided for the disposal of solvent contaminated excavation and disposal,including haul,under Bid
Item A36,per Special Provision Specification 2-05.This bid item will be utilized to measure and pay for approximately 1,615
tons of contaminated soils with F002 listed waste constituents at concentrations that do not warrant management as
dangerous wastes.This Change Order does not materially change the nature of work described in Bid Item A36.
Description of Chanee
The Contract Documents did not provide a bid item for measurement and payment for approximately 425 tons of hazardous
waste(soils managed as F002 listed dangerous waste).
Description of Work
Based on the Department of Ecology's Contained-in Determination for Soils Contaminated with Listed Dangerous Waste
Constituents at the Former Scott's Dry Cleaner Site in Renton Washington,dated September 20,2012,the Contractor shall
perform the following measures:
1. The 425 tons of contaminated soils to be excavated in the vicinity of TP-6,TP-9 and TP-11(hatched yellow in the
attached)shall be managed as F002 listed dangerous waste.These contaminated soils shall be sent to the Subtitle C
Landfill in Arlington,Oregon.Contractor shall provide the Resident Engineer a copy of the manifest signed by the final
receiving facility,within 3 days of your receipt.
III • Do not consolidate these contaminated soils with other soils that do not pertain to this contained in
determination;
• Plastic line the delivery truck,and cover all loads;
• Take measures to prevent unauthorized contact with these soils at all times;
• During transport,take adequate measures to prevent spills and dispersion due to wind erosion;
• Provide instructions to the landfill operator that these soils are not to be used for daily,intermediate,or final
cover;
• Provide copies of all soil analytical data to the landfill operator,upon request;
• Provide copies of all signed solid waste landfill receipts or a certificate of disposal issued by the receiving landfill
for these contaminated soils to the Resident Engineer,within 3 days of your receipt.
• Dispose of these contaminated soils at a solid waste landfill listed above by December 31,2012.
• Ensure no standing water is present within each of the drums/containers/roll off boxes holding the F002
contaminated soils.All water must be removed to the maximum extent possible from each of the
drums/containers/roll off containers and managed as F002 listed dangerous wastes;without exception.
Material
No new materials will be incorporated into the project as a part of this Change Order.

Dear Mr.Perteet:
This letter replaces the April 19,2012 Ecology contained-in determination letter(Reference 1)for
contaminated soils at the former Scott's Dry Cleaner site in Renton, Washington.
The Washington State Department of Ecology(Ecology)received a revised contained-in
determination request for approximately 2,040 tons of contaminated soils to be generated at the
former Scott's Dry Cleaner site in conjunction with street improvements along Rainier Avenue
South, between the BNSF Railroad right-of-way and South 4"'Place, in Renton, Washington
(Reference 2). Analytical data and the supplemental information for the contaminated soils
(References 2 and 3)were submitted to Ecology to determine if these soils contaminated with
listed dangerous waste constituents(F002) should be managed as dangerous wastes according to
the"Contained-In Policy."
Based on the information received and reviewed, Ecology's decision is two-fold:
(1) The 425 tons of contaminated soils to be excavated in the vicinity of TP-6,TP-9 and TP-
11 (hatched yellow in the figure attached) shall be managed as F002 listed dangerous waste.
These contaminated soils shall be sent to the Chemical Waste Management of Northwest Subtitle
C Landfill in Arlington, Oregon as proposed(Reference 2). You or your environmental
consultant, GeoEngineers shall submit a copy of the manifest signed by the final receiving
facility to Ecology, attention of Byung Maeng,within 15 days of your receipt.

(2) The 1,615 tons of soils to be generated from the blue hatched area(see the attached.figure)
are contaminated with the FO02 listed waste constituents at concentrations that do not warrant

management as dangerous wastes. Ecology understands that these contaminated soils do not
designate under federal characteristics (WAC 173-303=090) or State-only criteria(WAC 173-303-
100). Ecology will not require disposal of these soils as listed dangerous wastes at a RCRA —
Subtitle C permitted treatment, storage and disposal(TSD)facility,provided that all of the
following conditions are implemented. You or your environmental consultant, GeoEngineers shall:
• Directly deliver the 1,615 tons of contaminated soils to Waste'Management's Greater
Wenatchee Landfill in Wenatchee,Washington or Columbia Ridge Landfill in Arlington,
Oregon as proposed (Reference 2). ). Transloading/reloading of the soil containers at any
temporary staging area is not allowed;
• Do not consolidate these contaminated soils with other soils that do not pertain to this
contained in determination;
• Plastic line the delivery truck, and cover all loads;
• Take measures to prevent unauthorized contact with these soils at all times;
• During transport, take adequate measures to prevent spills and dispersion due to wind erosion;
• Provide instructions to the landfill operator that these soils are not to be used for-daily,
intermediate, or final cover;
• Provide copies of all soil analytical data to the landfill operator,upon request;
• Provide copies of all signed solid waste landfill receipts or a certificate of disposal issued by
the receiving landfill for these contaminated soils to Ecology,attention of Byung Maeng,
within 15 days of your receipt. This is an important verification step for you and your
environmental consultant, GeoEngineers to follow in order for this Ecology decision to be
valid;
s Do not send these contaminated soils to any incinerator, thermal desorption unit or recycling
facility unless that facility is a RCRA Subtitle C TSD facility;
• Dispose of these contaminated soils at a solid waste landfill listed above by December 31,
2012. This contained-in determination letter is no longer valid after December 31,2012, and
the contaminated soils must be managed as F002 listed dangerous wastes after this date;and
• Ensure no standing water is present within each of the drums/containers/roll off boxes
holding the F002 contaminated soils. All water must be removed to the maximum extent
possible from each of the drums/containers/roll off containers and managed as F002 listed
dangerous wastes,without exception.
This contained-in determination applies to the contaminated soils only, and does not pertain to
contaminated water. The F002 listed contaminated groundwater or infiltrated surface water shall
be removed from the soils prior to shipment to the landfill. Contaminated water cannot be
disposed of into a Subtitle C or D landfill directly.

Ecology issued this determination based on the information provided and reviewed to
date. This written decision does not apply to any other area or other media. Local
agencies may have the authority to impose additional requirements on this waste stream.
This letter is not a No Further Action(NFA)letter and not written approval for any
cleanup action plan you may have submitted. Instead, this letter only addresses the
procedures for disposal of the contaminated soils according to the Washington State
Dangerous Waste Regulations(Chapter 173-303 WAC). Regulatory decisions regarding
the cleanup action, applicable soil and groundwater cleanup levels and any other cleanup
issues must comply with the requirements under Ecology Model Tonics Control Act
(Chapter 173-340 WAC).

If you fail to comply with the terms of this letter,Ecology may issue an administrative order
and/or penalty as provided by the Revised Code of Washington, Sections 70.105.080 and/or.095
(Hazardous Waste Management Act).
