HomeMy WebLinkAboutAdden 1 4-10-092, Adden #1-13 ADDENDUM #1 TO SECOND MEMORANDUM OF AGREEMENT REGARDING CEDAR RIVER ACCESS FACILITY AND BROODSTOCK COLLECTION Between CITY OF RENTON and CITY OF SEATTLE This addendum ("Addendum # 1") is agreed to on this '��'`'' day of 2013 ("Effective Date"), by and between the City of Renton, a noncharter code city under RCW 35A, and a municipal corporation under the laws of the State of Washington ("Renton") acting by and through its Community Services Department, and the City of Seattle, a municipal corporation under the laws of the State of Washington ("Seattle"), acting • by and through its„Public Utilities Department ("SPU"). Renton and Seattle, collectively referred to as the "Parties", mutually agree to amend the Second Memorandum of Agreement Regarding Cedar River Access Facility and Broodstock Collection ("MOA"), entered into by the Parties on July 12, 2010, to extend the Agreement for 10 years. NOW, THEREFORE; in consideration of the mutual terms and covenants in this MCA previously exchanged and to be exchanged in the future, the Parties agree to the following: SECTION 1. Section 13.1 (Term) of the MOA is edited to the extent required to change the expiration date. Thus, the language-of this section shah remain the same except for the following change: The language "and will remain in effect through August 21, 2013" shall be replaced with "and will remain in effect through August 21, 2023". The remaining language in this subsection shall remain the same. 1 I SECTION 2. Section D.1 (Annual Installation of Weir) of the MOU is deleted in its entirety and replaced with the following language: At any time on or after the third day after Labor Day, for each year during the term, unless the MOA has been terminated before the date provided in Section B.1, Seattle may enter Renton's property solely for the purpose of installing a resistance board weir and traps in the river in the general location depicted on Exhibit A and as described in the Access Plan (Exhibit C). IN WITNESS WHEREOF, the Parties agree that this addendum, once executed takes effect on the Effective Date noted above.
