Pre-application conference held (highly recommended for major projects) . DE RNI 2 . Application received. BG DBi 3 . Front office staff stamps date application received and collects appropriate application P/C DBi fees. (Still not happening! ! ) 4. Decision made on whether or not project is I BG DBi categorically exempt under SEPA. 5. Application reviewed by assigned planning staff • person for completeness: a. Application compared to handout on required documentation and plans for complete applica- JL BG tion. Review includes indication of compliance with zoning, other code requirements, and/or covenants or Examiner's conditions as well as completeness of environmental checklist. b. If application is complete, reviewer prepares letter of acceptance and fills out review BG DB sheets (except for dates) and goes to next step (see Appendix 'A' ) . c. If application incomplete, reviewer prepares ==_ letter to the applicant requesting additional BG DBI information (see Appendix 'B' ) . When new material received, reviewer repeats Steps a. and b. 1 i d. Project and application presented to Zoning Administrator for group discussion of issues sBG DB ! (at least weekly) . 6. Preparation of application for routing to include: a. Project assigned file numbers and logged into log book. 1BG DB I 'SEPA/LAND USE APPLICATION PROCESSING PROCEDURES PAGE 2 b. Tentative dates established by assigned DE BG : planning staff person for Environmental 1 Review Committee review and, if needed, c Hearing Examiner public hearing and this j information placed on review sheets and the j scheduling sheets in Zoning Administrator's office. I c. Project placed on "Project Routing Board" (by {, BG BG Senior Planner's desk) . d. Tentative dates added to routing sheets and BG DB transmitted to File Clerk if project does not i include site plan review or shorelines permit. e. Prepare posters and notices when required to adjacent property owners for site plan review DB BG and posters for all shoreline applications i and transmit to File Clerk. § I � 7 . Building and Zoning technician receives and handles routing folder. a. File folder routed to Don Monaghan for review of legal description, rezone, plats, and PUD. DB BG b. Comments from reviewing departments checked for completeness. BG JL c. Environmental and Site Plan review sheets placed in appropriate yellow file folder, DB BG d. Review sheets logged into logbook. DB BG e. Folders returned by reviewing departments given to File Clerk for filing. 1 SS DB 10. File clerk files routing folders. SS DB a. Place returned routed material in brown expanding file. (Reviewers should keep own files until project signed off on. ) • b. If new expanding file used, place label on front of file with project name and/or SS DB applicant and file number. c. Place used yellow routing folders in appropriate bin in work counter by copy SS DB machine for future use. 11. Photographs and/or video taken, as needed. JL BG 12 . ERC agenda prepared for subject applications (check item 6.c. ) and distributed to ERC members DB BG Friday p.m. before meeting. 13 . ERC staff reports and recommendations prepared for subject application and ;submitted to Zoning BG/ BG Administrator for his review by Monday noon JL preceding ERC meeting. 14 . Staff analysis and recommendations presented to ERC by Zoning Administrator. DE BG 15. Preliminary environmental determination (DNS- Mitigated or DS) issued by ERC. Page 1 of 3 • 4. It is understood and agreed that Permittee will operate and maintain the permit area in a clean, safe and orderly condition at all times. Permittee may improve the surface of the permit area with an asphalt surfacing at Permittee's own cost and expense. However, as a condition of the issuance of this permit, Permittee shall , at Permittee's own cost and expense, provide and maintain a dust-free surface upon the permit area and provide for the disposal of the surface storm drainage water from the permit area into the City of Renton's storm drainage system. Permittee further agrees to comply with any and all ordinances and requirements of the City of Renton with regard to Permittee's use of the permit area. 5. Permittee agrees that no change in the existing grade of the permit area shall be made, and that no buildings, structures, pipes, cables, conduits, light standards , fences, walls, planters, signs or other facilities shall be erected, installed or permitted to remain within the permit area except with prior approval in writing from the Superintendent of Water. 6. The City shall at all times have free access to the permit area for the operation, maintenance and repair of its water pipeline or for any other purpose, and Permittee agrees that the City shall not be responsible for the restoration or repair of any of Permittee's improvements destroyed or damaged during such operation, repair, maintenance or other purposes, and Permittee shall not be entitled to payment for damages for any loss of use of the permit area during such operation, maintenance and repair, other than a pro-rata credit for prepaid rent. 7. Permittee agrees upon receiving a bill therefor from the City to promptly pay for any loss or damage to the City's pipeline, the pipeline right of way, or other City facilities caused by or resulting from the use by Permittee or anyone else of the permit area, and further agrees at all times to protect and save harmless the City from all claims , actions, suits, or damages of every kind and description yhich may accrue to or be suffered by any person or persons by reason of the use or occupancy of said permit area, and incase any action or suit shall be instituted or begun against the City for damages arising out of or by reason of such occupancy, Permittee shall upon notice to it upon commencement of such action, or suit, defend the same .at its sole cost and expense, and in case judgment shall be rendered against the City in any such actions or suits, shall fully pay and satisfy such judgment within ninety days after such action or suit shall have been finally determined. 8. Permittee agrees at all times to maintain for the protection of the City a liability insurance policy, such policy and the insurer to be subject to approval by the City, naming the City as an additional insured, with minimum limits of $300,000 for injury to one person and $1,000,000 in the aggregate for injury to any number of persons in any one accident, and $100,000 property damage, insuring against loss or damage arising oit of or resulting from the use and occupancy of-the permit area by Permittee, or from any defect or condition upon such permit area or in maintenance of the permit area, and to furnish the City's Superintendent of Water with certificates evidencing that such policies are in effect, and that the coverage afforded the City of Seattle under such policy shall not be reduced, terminated or cancelled until (10) days after receipt of notice thereof by the Superintendent of Water. Should such insurance policy not be maintained in effect or be cancelled, the Superintendent of Water may revoke this permit immediately. 9. Permittee has inspected and examined the physical condition of the permit area including improvements thereon, and accepts the permit area in its present condition , and any expense incurred in mutually agreed upon alterations , improvements or repairs , in said permit area shall be borne by the Permittee. Permittee covenants that no representations, statements or warranties, express or implied, have been made by or on behalf of City with respect to the condition of the permit area or the use or occupancy that may be made thereof, and that the City shall in no event be or become liable to Permittee for latent or patent defects in the permit area. 10. Permittee shall be liable for, and pay throughout the term of this permit, the State Leasehold Excise Tax, all taxes on the property of the Permittee installed , operated and maintained on the City's property, any taxes on any property interest deemed by the King County Assessor, or other official of the State of Washington, King County or other taxing entity responsible therefor, created by this permit and shall otherwise fulfill all fiscal obligations required by law. 11 . This permit is not transferable without written permission from City's Superintendent of Water. 12. This permit is revokable upon thirty days' notice by either the City's Superintendent of Water or Permittee. His inventory only included replacement trees where existing tree holes were cut in the sidewalks. I suggested to him that there are other areas along the street where no previous trees were planted that may be suitable for the english oak trees; ie: the areas along side Denny's Restaurant. He agreed that this would be a good idea so that we should then have Taco Time replace trees where missing in front of their proposed building. Their office has a detail of how they should be planted that we will want to give to the developer. As part of their proposal, Lake Avenue South, currently an unbuilt street R.O.W. , will be constructed. In order to build this street, two City street trees (Columnan English Oaks) are proposed to be removed. In reviewing the landscaping plans submitted with this project, it is apparent that there is a gap of approximately 90 feet between street trees in the sidewalk in front of the building. As the project is currently going through site plan approval, this allows us an excellent opportunity to fill in this gap as well as to add trees by the existing restaurant if we wish. I would appreciate hearing, at your earliest convenience, your opinion on replacing them with two new similar or identical trees further to the west where the existing gap occurs. COMMUNITY NEED The Taco Time business has long been established as a thriving business in the city. The subject site is situated in the middle of a major commercial center , and is served by 2nd Avenue and Rainier Avenue South which are quite capable of providing vehicular support without adverse impact upon them. The subject site is adjacent to a Safeway store which has operated successfully for years, our proposed use will generate far less traffic than Safeway . EFFECT ON ADJACENT PROPERTIES • 1 . Lot coverage - The site is covered by (2) buildings, ( 1 ) the proposed office/warehouse building (7,960 sq . ' ft . ) and (2) and existing Taco Time Restaurant (2,690 sq . ft . ) and the balance is parking or planting . Total impervious coverage is 40,800 sq . ft . 2. Yards - All required yards are maintained . 3.
