Home My WebLink AboutS_Maintenance and Defect Agreement Signed C21004930_20230920_V1CITYOFRENTONIPERMITCENTERMAINTENANCEANDDEFECTAGREEMENT(TWOYEARS)FORPUBLICROADS,PUBLICANDPRIVATELANDSCAPING,DRAINAGEFACILITIESANDOTHERPUBLICIMPROVEMENTSThisagreementismadeandenteredintothis‘dayofS’C.i1WY,202,betweentheCityofRenton,hereinaftercalledtheCITY,andtheabovenamedapplicant,hereinaftercalledAPPLICANT.BASISFORAGREEMENTWHEREAS,theundersignedAPPLICANThasconstructedpublicroads,publicandprivatelandscaping,drainagefacilitiesand/orotherpublicimprovementstobedeededtotheCITYinconnectionwiththeabove-referencedproject;andWHEREAS,theAPPLICANThasagreedtosecurethesuccessfulmaintenanceandoperationofsaidimprovementsforthereferencedprojectpursuanttoRMC4-6-030andRMC9-10-5.NOWTHEREFORE,theAPPLICANTherebyagreesandbindsitselfanditslegalrepresentatives,successors,andassignsasfollows:TERMSOFTHEAGREEMENT1.TheimprovementsconstructedbytheAPPLICANTorhisrepresentativeshallsuccessfullyoperateandshallremainfreeofdefectsindesign,workmanship,andmaterialsforaperiodoftwo(2)yearsfromthedateofsatisfactorycompletionoftheimprovementsorfinalplatapproval,whicheverislater.AsusedinthisAGREEMENT,theterm“defects”includesbutisnotlimitedto,damageresultingfromconstructionactivitiesand/oruseduringthetwo(2)yearperiod.2.TheAPPLICANTisresponsibleformaintenanceofthepublicroad,publicandprivatelandscaping,drainagefacilitiesandotherpublicimprovements,includingtheroadwaysurfaceforthetwo(2)yearperiodfromthedateofsatisfactoryconstructionapprovalorfinalplatapproval,whicheverislater.3.Intheeventofanyfailureoftheimprovementstosatisfactorilyoperateorintheeventofadefectindesign,workmanship,ormaterials,theAPPLICANTshallpromptlyandadequatelyrepairand/orcorrectthefailureordefect.4.TheCITYwillperformmaintenanceinspectionsduringthetwo(2)yearperiod.5.Duringthetwo(2)yearperioduponnotificationbytheCITY,theAPPLICANTshallcorrectand/ormakerepairstotheright-of-wayimprovementswithinthetimeperiodspecifiedbytheCITYwhendefectsinthedesign,workmanship,ormaterialsoccur.6.IntheeventtheCITYdeterminesthatrepairsmustbeperformedimmediatelytopreventrisktoperson(s)andproperty,theCITYmaymakenecessaryrepairsandthecostsofthoserepairsshallbepaidbytheAPPLICANTupondemand.7.TheAPPLICANTshallpayallrequiredfeesinaccordancewithRentonMunicipalCode.APPLICANT’SNAME:StraightArrowHomesLLCMAILINGADDRESS:PCBox3946,Bellevue,WA98009PHONE:425-443-5458PROJECTNO./PERMITNO.:C21004930PROJECTNAME:905N32ndStfrontageSITELOCATION:905N32ndStGUARANTEEDEPOSITAMOUNT:$9,592.24rentonwa.gov/permitcenterII425-430-72402/24/2023IPage1of2 SURETY—MAINTENANCEANDDEFECTAGR8.Attheendofthetwo(2)yearperiod,theAPPLICANTshallcleanthedrainspection.9.If,attheconclusionofthetwo(2)yearperiod,theCITY,atitssolediscretnotadequatelymaintained,theAPPLICANTshallperformpromptmaintereventthismaintenanceisnotperformedwithinthetimeperiodspecifiecenforcementprocessesfoundinRMCChapter1-3.10.AnyfailurebytheAPPLICANTtocomplywiththetermsofthisAGREEMEdefault.AnyactionorinactionbytheCITYfollowinganydefaultinanyternnotbedeemedtowaiveanyrightsoftheCITYpursuanttothisAGREEMENT11.TheAPPLICANTshallindemnifyandholdtheCITYanditsagents,employshalldefendatitsownexpenseallclaims,damages,suitsatlaworequit’whatsoeverkindornature,broughtagainsttheCITYfornegligencearisingatheexecutionofthisAGREEMENTand/ortheAPPLICANT’sperformancecAGREEMENT.Provided,however,thatifsuchclaimsarecausedbyorresAPPLICANTandtheCITY,itsagents,employeesand/oroffices,thisprovisioitheextentofthenegligenceoftheAPPLICANT,andprovidedfurther,APPLICANTtoholdharmlessordefendtheCITYfromanyclaimarisingIagents,employeesand/orofficers.12.IntheeventthatanypartdeemsitnecessarytoinstitutelegalactionaobligationunderthisAGREEMENT,thepartiesheretoagreethatanysuchaacourtofcompetentjurisdictionsituatedinKingCounty,Washington.13.TheAPPLICANTisgrantedtherighttoaccessCITYright-of-way,tracts,andepurposeofperformingworkrequiredbythisMaintenanceandDefectreleased.ReleaseRequirements:ThisAGREEMENTshallremaininforceandeffectandthisAGREEMENThavebeencompletedtothesatisfactionoftheCITY.INWITNESSTHEREOF,thepartiesheretohaveexecutedthisAGREEMENTasoftAPPLICANT:/(PrintName)/(Signature)rentonwa.gov/permitcenterIdevelopmentengineering@rentonwa.govI425-430-7240
