King County Metro does have preliminary approval to locate the sidewalk directly behind the curb due to the lack of sufficient existing right of way and they do not trigger the requirements for complete streets. Home depot, however, would trigger RMC 4-6-060 complete streets, requiring a minimum 8-foot wide planter and an 8-foot wide sidewalk behind the proposed curb that will be constructed by King County Metro. It is likely that Home Depot improvements will be constructed prior to the King County I-Line. Home Depot will need to build the sidewalk as if the King County Metro’s proposed curb is already constructed. Right of way dedication would need to be located 2’ from back of sidewalk. As a note, there are existing trees within the right of way along Talbot that will need to be saved and located within the proposed planter strip. This may require an increased planter strip width at this location. This does not meet City code. The 8-foot landscape planter is required to be between the curb and sidewalk, if you would like to proceed with the plans as submitted, we could add this as a condition of approval that would be addressed later. The landscape planting plan appears to be incomplete, the proposed landscape plan would need to demonstrate compliance with the 10-foot onsite landscape strip along the abutting street frontages (RMC 4-4-070F.1), as well as the surface parking lot landscaping requirements (RMC 4-4-070F.6). Plan revised to include street buffer as well as landscape islands within the HD lot. 3. It appears that the proposed site plan does not include the required pedestrian walkways through the parking lot as required in the Urban Design Regulations (RMC 4-3-100E.3): “Pathways within parking areas shall be provided and differentiated by material or texture (i.e., raised walkway, stamped concrete, or pavers) from abutting paving materials (illustration below). Permeable materials are encouraged. The pathways shall be perpendicular to the applicable building facade and no greater than one hundred fifty feet (150') apart.” Pedestrian pathway added to plan per request. 4. The proposed lot layout appears to impact the layout of the surface parking of the Home Depot parking lot with some of the lot lines impacting parking spaces and drive aisles. The proposed parking lot layout would need to be revised to accommodate the eventual redevelopment of the proposed out lots while maintaining the surface parking needed for Home Depot. See Phase Site Plan for future improvements. 5. The proposed site plan and conceptual civil plans do not show the required frontage improvements along the S Grady Way and Talbot Rd S frontages. I noticed that revisions were not made to the site plan and landscape plan to address the comments in my email to Dan sent on January 11th (see comments below). We are willing to begin the official review of the submitted application materials, provided you understand that it is likely the comments from my January 11th email will become conditions of approval and/or result in the review of the project being placed on hold at a later date if it is determined that these comments would require substantial changes to the submitted site and/or landscape plan. 1. I have enough to determine the application complete and send an Acceptance Letter, however there are a few outstanding items that will need to be submitted before a formal review of the application can begin. You will need to submit the following additional information: 1. A SEPA Checklist, which may be downloaded here; 2. Title Report; 3. A Construction Mitigation Description: A written narrative addressing each of the following: i. Proposed construction dates (begin and end dates); ii. Hours and days of operation; iii. Proposed hauling/transportation routes; iv. Measures to be implemented to minimize dust, traffic and transportation impacts, erosion, mud, noise, and other noxious characteristics; v. Any special hours proposed for construction or hauling (i.e. weekends, late nights); and vi. Preliminary traffic control plan. Note:If your project requires the use of cranes, please contact the City’s Airport Manager at 425-430-7471 to determine whether Federal Aviation Administration (FAA) notification will be required. 4. Urban Design Regulation Overlay Report (see attached report that will need to be completed and submitted for review); 5. Affidavit of Installation of Public Information Sign and Public Outreach Sign (see attached affidavits to be completed and submitted); 6. A Critical Areas memo: I am assuming that you would anticipate making the justification that your project is exempt from complying with our critical areas regulations as it meets the criteria for a “Site Separated from Critical Areas” (RMC 4-3-050B.1.g). If that is the case, you would need to have your wetland/stream biologist prepare a memo with a justification on how your project meets this requirement. 7. A Street Modification Justification: A modification to our street standards would be required to retain the existing pavement width along S Grady Way and Talbot Rd S and reduce the required right-of-way dedication. Please submit a narrative that addresses the following decision criteria: Whenever there are practical difficulties involved in carrying out the provisions of this Title, the Department Administrator may grant modifications for individual cases provided he/she shall first find that a specific reason makes the strict letter of this Code impractical, that the intent and purpose of the governing land use designation of the Comprehensive Plan is met and that the modification is in conformity with the intent and purpose of this Code, and that such modification: a. Substantially implements the policy direction of the policies and objectives of the Comprehensive Plan Land Use Element and the Community Design Element and the proposed modification is the minimum adjustment necessary to implement these policies and objectives; b. Will meet the objectives and safety, function, appearance, environmental protection and maintainability intended by the Code requirements, based upon sound engineering judgment; c. Will not create substantial adverse impacts to other property(ies) in the vicinity; d. Conforms to the intent and purpose of the Code; and e. Can be shown to be justified and required for the use and situation intended; In addition, once we complete a formal review of the submitted application, we may have additional comments that will need to be addressed prior to holding a public hearing.
