Jonathan I believe we been through this a few times already. Shall I confirm with Chip as this is not my understanding that HD has any

Luis,
If KC Metro cannot fund their project for construction, we need to assure that the improvements are still constructed by the developers
per Title 4. As it stands now, Kc Metro has submitted the 90% design for review. We still have not approved or issued them a construction
permit.

I am confused; if Metro is in charge of all Talbot ROW improvements, including street trees and lights, why are we having to show these
items on our deferral cost estimate?

The surety has to be cash. I apologize, I’m being briefed on this in live time. I’m not in the loop as to the conversations you are having with
Chip.
As I ’ve been told: cash surety of the deferred improvements, 3 years of allowed deferral to be looked at each year.

Ok what is the security device … Bond? How is the deferral renewed .. can we get 4 years or somehow allowed extensions?

Dan,
The way the deferral works is you submit the application with the quantities and plans, and a justification narrative for us to review. We
will issue you the deferral permit and an approval letter (w/ conditions, if any) and request bonding from you, for the deferred
improvements.
Let me know if that make sense. I’ve attached an example from one of my previous projects, for reference only.
