Jill in regards to items:
1. I am OK with it, the hold harmless is associated with performing a concurrent plan check to
our entitlements. We are just asking for concurrent review
2. Home Depot is acceptable to the discussion along Grady with the understanding we would be
condition to either bond to do the improvement along the outlot within a certain time frame.
More than likely we will elect to do the improvements with our project along the outlot. In
regards to Talbot, Home Depot is acceptable to the dedication as discussed for the Metro
Project provided that Metro complete their project within a reasonable timeframe. We can
discuss that timeframe further as draft conditions are produced for review. Should Metro not
proceed with their project our project does not want to be burdened with their project and
do not want any of the Metro project noted on our conditions.
Please let me know if that is what you need or if we need to have another discussion.

Dan,
The plans from King County show the correct pavement width and curb location for their proposed
project, however the sidewalk location is incorrect. The reason the sidewalk location is incorrect is
because there is not existing sufficient right-of-way width to accommodate the code required 8-foot
wide planter between the curb and sidewalk as well as the sidewalk and clear space behind the
sidewalk.
The correct cross section would show the pavement and curb location as proposed by King County,
followed by an 8-foot wide landscape planter with street trees, an 8-foot wide sidewalk, and a 2-foot
clear area behind the sidewalk. Right-of-way dedication would be required along Talbot for the
current Home Depot application to accommodate these improvements. It is my understanding that
Home Depot will be required to dedicate the right-of-way for these improvements, but that we
expect the improvements to be constructed by King County. At this point we need to see the correct
right-of-way location show on the plans so that we may be able to coordinate effectively with King
County regarding their project.

Jill, I am reviewing with staff however we are going back and forth on Talbot. I am obviously not
understanding. I thought the last direction was to show the Metro alignment. I cant do both as
Metro does not have the planter strip like you are stating. I suggest I go back to what we were
showing previously .. which does mean .. I will no longer be showing the metro alignment again.
Please confirm I know have the direction correct.

Dan,
We have discussed the Home Depot resubmittal internally and have the following comments that
should be addressed before we take the project off hold and continue our review:
1. Please remove any future building footprints and parking configurations from the out lots.
Any development on the out lots would be reviewed at a future date and are not subject to
the current project under review.
2. Regarding frontage improvements:
a. Along Talbot Rd S, please show the correct right-of-way dedication so that the street
tree planting strip and sidewalk can be accommodated within the right-of-way (all plan
sheet should be updated showing the correct right-of-way dedication). It would be
helpful if the plans also showed the 8-foot street tree planter strip and sidewalk in their
correct location for reference so that we can ensure the area of right-of-way dedication
is correct.
b. Along Grady, please show the correct the plans to show the 8-foot street tree planting
strip behind the curb with the sidewalk behind the planter strip and the correct right-
of-way dedication along the full frontage.
c. The construction of the frontage improvement may be deferred for up to one year
after a Certificate of Occupancy is issued, however all plan sheets need to include the
correct frontage improvement cross section.
3. The public plaza proposed at the intersection of Talbot and Grady needs to be shown on all
plan sets. The construction of the plaza may be deferred for up to one year after Certificate of
Occupancy is issued.
4. A Conceptual Landscape plan needs to be submitted that shows the 10-foot onsite perimeter
parking lot landscape strip along the site’s Grady Way frontage and along the Talbot frontage.
The 10-foot onsite landscape strip would need to include a mix of trees, shrubs, and ground
cover. The installation of the perimeter parking lot landscaping along the frontages of the out
lots may be deferred up to one year after a Certificate of Occupancy is issued as these
landscaped areas could be impacted during the construction of frontage improvements.
The Perimeter Parking Lot Landscaping shall be at least ten feet (10') in width as measured
from the street right-of-way. Standards for planting shall be as follows:
a. Trees shall be two-inch (2") caliper for multi-family, commercial, and industrial uses at
an average minimum rate of one tree per thirty (30) lineal feet of street frontage. Trees
shall be one-and-one-half-inch (1.5") caliper for low impact development stormwater
management facilities associated with any land use.
b. Shrubs at the minimum rate of one per twenty (20) square feet of landscaped area. Up
to fifty percent (50%) of shrubs may be deciduous.
c. Ground cover in sufficient quantities to provide at least ninety percent (90%) coverage
of the landscaped area within three (3) years of installation.
5. The Conceptual Landscape plan needs to demonstrate compliance with the interior parking
lot landscaping requirements for parking lots with 100 or more parking spaces, 35 sq. ft. of
landscaping is required per parking space. Any interior parking lot landscaping area shall be
sized to dimensions of at least eight feet (8') by twelve feet (12'). Perimeter parking lot
landscaping does not count towards the required interior parking lot landscaping.
Landscaping shall be dispersed throughout the parking area and shall include a mixture of
trees, shrubs, and groundcover as follows:

a. Trees shall be two inches (2") in diameter at breast height (dbh) for multi-family,
commercial, and industrial uses. At least one tree for every six (6) parking spaces within
the lot interior shall be planted.
b. Shrubs at the minimum rate of one per twenty (20) square feet of landscaped area
shall be planted. Up to fifty percent (50%) of shrubs may be deciduous.
c. Ground cover shall be planted in sufficient quantities to provide at least ninety percent
(90%) coverage of the landscaped area within three (3) years of installation.
d. There shall be no more than fifty feet (50') between parking stalls and an interior
parking lot landscape area

Jill, once you give us a new link we can upload the revised plans. I have attached herewith a
response letter to comments and I would like to set a time to review them with you.
I have also copied herewith Kenneth who is HD Land Use council, who is assisting in relation to
comment 5. As noted in the response, we are not in agreement that the setback existing today
under existing conditions and therefore need to discuss this item further
We believe the buffer section does not apply to development “proposed on sites that are separated
from critical areas by pre-existing, intervening, and lawfully created structures, roads, or other
substantial existing improvements.” RCC 4-3-050B(1)(g). As such we have an existing road along with
substantial existing improvement with the utility corridor within that section.
At this time we are requesting not to show this and it would need to be evaluated with the outlot 2
development and their proposed improvements if the buffer is affected.
