The hearing opened on Tuesday,November 4, 1997,at 11:30 a.m.in the Council Chambers on the second floor of the Renton Municipal Building. Parties wishing to testify were affirmed by the Examiner. City of Renton Washington State P-1 Drainage Channel P-1 Rezone File No.:LUA-97-117,R November 24, 1997 Page 2 City project manager,DONALD ERICKSON,P/B/PW Special Projects,City of Renton,200 Mill Avenue South,Renton,Washington 98055,presented the staff report. He explained that when the City prepared its Comprehensive Plan in 1993 it deferred making changes to the Public Use(P-1)zone to allow more time to study existing P-1 uses. Originally,the P-1 zone was intended to recognize public ownership and to provide a process that would expedite development. The study found that the City's new zoning allows the same public uses in virtually every zone. It was also found that a relatively high percentage of actual public uses are not located in the P-1 zones. For example,City Hall and the Fire Station are in the commercial zone and schools and parks are generally located in single family zones. Staff proposed to the City Council's Planning and Development Committee that the City should either assimilate all public uses in P-1 zones or allow for public uses in all other zones. The City Council chose the latter recommendation since there are adequate provisions in other zones to accommodate public uses and it would be more consistent with the Growth Management Act. Therefore,the current proposal is part of a series of 40 proposed rezones of publicly held properties. An ordinance adopted in June 1995 and referred to as"P"suffix zoning,was incorporated to protect the public interest by identifying publicly-held properties. It also requires public notification if there is to be a change in tenancy,use,or ownership of any of these properties. All of these P-i rezones will be identified with a"P" suffix. The property which is the subject of this hearing is approximately 9,086 square feet in size and is located in the area north of Monster Road SW and south of the outflow from the King County pump station across from properties under City of Renton ownership on the north side of the P-1 Channel,at approximately 556 Monster Road SW. The applicant has requested the site be rezoned from P-1 to RC which is the Resource Conservation 'Zone. According to the Comprehensive Plan Land Use Map,the area adjacent to this property is zoned RC. In conclusion,Mr.Erickson recommended that the Washington State P-1 Drainage Channel be rezoned from P-1 to RC with a"P"suffix attached for the following reasons: that the rezone is consistent with the Comprehensive Land Use Map designation for this parcel;it is consistent with City policy that encourages flexibility in the regulatory processes by allowing for a variety of zone designations in the Employment Area- Valley designation,the provision and maintenance of surface water management drainage systems to minimize impacts on natural systems and protect public properties,to protect and enhance water quality of surface water resources; and the rezone is consistent with previous rezones of other nearby properties along the drainage channel to the Resource Conservation Zone in 1993. The Examiner called for further testimony regarding this project. There was no one else wishing to speak,and no further comments from staff. The City of Renton filed requests for approval of a series of forty(40)separate rezones involving a series of separate properties generally owned by public agencies including the City,King County and the Renton School District. The City proposes phasing out its P-1 Zone,a zone that in the past was designed to accommodate public and quasi-public uses. Each of the proposals requests that the new zoning be changed to closely,if not exactly match,surrounding zoning districts and the goals of the Comprehensive Plan. 3. The yellow file containing the staff report,the State Environmental Policy Act(SEPA)documentation and other pertinent materials was entered into the record as Exhibit#1. 4. The Environmental Review Committee(ERC),the City's responsible official,issued a Declaration of Non-Significance(DNS)for the subject proposal. 5. The subject proposal was reviewed by all departments with an interest in the matter. 6. While the background information on the study and proposed abolition of the P-1.zone will be the same for each report,each site will receive separate attention and a separate decision. 7. The P-1 (Public/QuasiPublic)Zone was established in the early 1950's to accommodate governmental facilities as well as certain private uses such as private medical clinics and private hospitals,as well as private schools,museums and the like that accommodated the public. The permitted uses were expanded over the years to accommodate an even wider range of uses while other zoning districts also broadened their range of respective uses,in effect,duplicating the permitted uses in the P-1 zone. The current zoning categorization generally appears to accommodate most,although not all,of the uses the current P-1 zone permits. The City Council directed staff to make a recommendation as to the continued need for a distinct P-1 zone. A result of that study was presented to the Planning Commission(May 4, 1994 Report). The Planning Commission recommended the assimilation of the P-1 zone. The City Council then directed that individual parcels be assimilated into nearby,compatible zones after appropriate public hearings. The current action is the result of those decisions. 8. The subject site consists of approximately 9,810 square feet of property owned by the State of Washington. The site is an irregularly shaped parcel located north of Monster.Road SW where it curves to the east after dropping off the hill. The address would be approximately 556 Monster Road SW. ' 9. The City proposes designating the site RC(Resource Conservation). This zoning would match the zoning attached to the nearby property that includes the P-1 Channel and forebay pond. The City has attached a special designation to any public property which carries so-called"normal"zoning designations. This special,designation is a"P"or P-suffix,permitting those who view the Zoning Map to determine that the property is publicly owned. This designation also carries with it a requirement for public notice of any further change of use or zoning. 110. The map element of the Comprehensive Plan designates the area in which the subject site is located as suitable for the development of employment generating uses where appropriate,but does not mandate such development without consideration of other policies of the Plan. The area including the pond and Black River channel is currently undeveloped and supports wildlife habitat. 11. The adjacent King County site to the east-northeast is also the subject of a similar rezone request. A series of industrial districts are located west,northwest and south of the subject site. Most of the areas east of the site are zoned RC, the category requested for the subject site. CONCLUSIONS: 1. The proponent of a rezone must demonstrate that the request is in the public interest,that it will not impair the public health,safety and welfare,and in addition complies with at least one of the criteria found in Section 4-8-14,which provides in part that: a. The subject site has not been considered in a previous area-wide rezone or land use analysis;or b. The subject site is potentially designated for the new classification per the Comprehensive Plan;or c. There has been a material and substantial change in the area in which the subject site is located since the last rezoning of the property or area. The requested classification is justified and should be approved. 2. The P-1 district and its associated properties were removed from the city-wide reclassification effort to study the basis for the zone itself. This site as well as the other P-1 properties were segregated for special review. The public hearing that preceded this recommendation is the first analysis since that study demonstrated that there is no reason to maintain the P-1 zones. 3. The Comprehensive Plan designates the area as suitable for very generic employment generating uses but permits public.utilities and storm water management to protect the public health,safety and welfare. The proposed zoning matches the zoning of surrounding property. 4. While changes to the area have not been substantia,the Comprehensive Plan and Zoning code have themselves undergone a profound change. The need for a separate holding zone for public and quasi- public uses has been questioned for a long time and the adoption of these new land use provisions just provided the impetus to review the P-1 zone. The proposed zoning is an appropriate alternative for the current P-1 zone. PUBLIC HEARING: In accordance with Section 4-8-14(C)(2),the Hearing Examiner shall determine if a change of zone classification is advisable, in the public interest,tends to further the preservation and enjoyment of any substantial property rights of the petitioner, is not materially detrimental to the public welfare or the properties of other persons located in the vicinity thereof,and is in harmony with the purposes and effect of the Comprehensive Plan. In such event,the Hearing Examiner may recommend that the City Council approve the change of the zone classification. The hearing opened on Tuesday,November 4, 1997,at 11:30 a.m. in the Council Chambers on the second floor of the Renton Municipal Building. Parties wishing to testify were affirmed by the Examiner. City of Renton Washington State P-1 Drainage Channel P-1 Rezone File No.: LUA-97-117,R November 24, 1997 Page 2 City project manager,DONALD ERICKSON,P/B/PW Special Projects,City of Renton,200 Mill Avenue South,Renton,Washington 98055,presented the staff report. He explained that when the City prepared its Comprehensive Plan in 1993 it deferred making changes to the Public Use(P-1)zone to allow more time to study existing P-1 uses. Originally,the P-1 zone was intended to recognize public'ownership and to provide a process that would expedite development. The study found that the City's new zoning allows the same public uses in virtually every zone. It was also found that a relatively high percentage of actual public uses are not located in the P-1 zones. For example,City Hall and the Fire Station are in the commercial zone and schools and parks are generally located in single family zones. Staff proposed to the City Council's Planning and Development Committee that the City should either assimilate all public uses in P-1 zones or allow for public uses in all other zones. The City Council chose the latter recommendation since there are adequate provisions in other zones to accommodate public uses and it would be more consistent with the Growth Management Act. Therefore,the current proposal is part of a series of 40 proposed rezones of publicly held properties. An ordinance adopted in June 1995 and referred to as "P" suffix zoning,was incorporated to protect the public interest by identifying publicly-held properties.. It also requires public notification if there is to be a change in tenancy,use, or ownership of any of these properties. All of these P-1 rezones will be identified with a"P" suffix. The property which is the subject of this hearing is approximately 9,086 square feet in size and is located in the area north of Monster Road SW and south of the outflow from the King County pump station across from properties under City of Renton ownership on the north side of the P-1 Channel,at approximately 556 Monster Road SW. The applicant has requested the site be rezoned from P-1 to RC which is the Resource Conservation Zone. According to the Comprehensive Plan Land Use Map,the area adjacent to this property is zoned RC. In conclusion,Mr.Erickson recommended that the Washington State P-1 Drainage Channel be rezoned from P-1 to RC with a"P"suffix attached for the following reasons: that the rezone is consistent with the Comprehensive Land Use Map designation for this parcel; it is consistent with City policy that encourages flexibility in the regulatory processes by allowing for a variety of zone designations in the Employment Area- Valley designation,the provision and maintenance of surface water management drainage systems to minimize impacts on natural systems and protect public properties,to protect and enhance water quality of surface water resources; and the rezone is consistent with previous rezones of other nearby properties along the drainage channel to the Resource Conservation Zone in 1993. The Examiner called for further testimony regarding this project. There was no one else wishing to speak, and no further comments from staff. The hearing closed at 11:45 a.m. FINDINGS,CONCLUSIONS &RECOMMENDATION Having reviewed the record in this matter,the Examiner now makes and enters the following: FINDINGS: ' Having reviewed the record in this matter,the Examiner now makes and enters the following: 1. The applicant,City of Renton, filed a request to reclassify the subject site from P-1 (Public/Quasi- public)to RC(Resource Conservation). The City of Renton filed requests for approval of a series of forty(40)separate rezones involving a series of separate properties generally owned by public agencies including the City,King County and the Renton School District. The City proposes phasing out its P-1 Zone,a zone that in the past was designed to accommodate public and quasi-public uses. Each of the proposals requests that the new zoning be changed to closely, if not exactly match, surrounding zoning districts and the goals of the Comprehensive Plan. • 3. The yellow file containing the staff report,the State Environmental Policy Act(SEPA)documentation and other pertinent materials was entered into the record as Exhibit#1. 4. The Environmental Review Committee(ERC),the City's responsible official, issued a Declaration of Non-Significance(DNS)for the subject proposal. 5. The subject proposal was reviewed by all departments with an interest in the matter. 6. While the background information on the study and proposed abolition of the P-1 zone will be the same for each report,each site will receive separate attention and a separate decision. 7. The P-1 (Public/QuasiPublic)Zone was established in the early 1950's to accommodate governmental facilities as well as certain private uses such as private medical clinics and private hospitals,as well as private schools,museums and the like that accommodated the public. The permitted uses were expanded over the years to accommodate an even wider range of uses while other zoning districts also broadened their range of respective uses, in effect,duplicating the permitted uses in the P-1 zone. The current zoning categorization generally appears to accommodate most,although not all,of the uses the current P-1 zone permits. The City Council directed staff to make a recommendation as to the continued need for a distinct P-1 zone. A result of that study was presented to the Planning Commission(May 4, 1994 Report). The Planning Commission recommended the assimilation of the P-1 zone. The City Council then directed that individual parcels be assimilated into nearby,compatible zones after appropriate public hearings. The current action is the result of those decisions. 8. The subject site consists of approximately 9,810 square feet of property owned by the State of Washington. The site is an irregularly shaped parcel located north of Monster Road SW where it curves to the east after dropping off the hill. The address would be approximately 556 Monster Road SW. 9. The City proposes designating the site RC(Resource Conservation). This zoning would match the zoning attached to the nearby property that includes the P-1 Channel and forebay pond. The City has attached a special designation to any public property which carries so-called "normal"zoning designations. This special designation is a"P" or P-suffix,permitting those who view the Zoning Map to determine that the property is publicly owned. This designation also carries with it a requirement for public notice of any further change of use or zoning. 10. The map element of the Comprehensive Plan designates the area in which the subject site is located as suitable for the development of employment generating uses where appropriate,but does not mandate such development without consideration of other policies of the Plan. The area including the pond and Black River channel is currently undeveloped and supports wildlife habitat. 11. The adjacent King County site to the east-northeast is also the subject of a similar rezone request. A series of industrial districts are located west,northwest and south of the subject site. Most of the areas east of the site are zoned RC, the category requested for the subject site. CONCLUSIONS: 1. The proponent of a rezone must demonstrate that the request is in the public interest,that it will not impair the public health, safety and welfare, and in addition complies with at least one of the criteria found in Section 4-8-14,which provides in part that: a. The subject site has not been considered in a previous area-wide rezone or land use analysis;or b. The subject site is potentially designated for the new classification per the Comprehensive Plan; or c. There has been a material and substantial change in the area in which the subject site is located since the last rezoning of the property or area. The requested classification is justified and should be approved. 2. The P-1 district and its associated properties were removed from the city-wide reclassification effort to study the basis for the zone itself. This site as well as the other P-1 properties were segregated for special review.• The public hearing that preceded this recommendation is the first analysis since that study demonstrated that there is no reason to maintain the P-1 zones. 3. The Comprehensive Plan designates the area as suitable for very generic employment generating uses but permits public utilities and storm water management to protect the public health,safety and welfare. The proposed zoning matches the zoning of surrounding property. 4. While changes to the area have not been substantial,the Comprehensive Plan and Zoning code have themselves undergone a profound change. The need for a separate holding zone for public and quasi- public uses has been questioned for a long time and the adoption of these new land use provisions just provided the impetus to review the P-1 zone. The proposed zoning is an appropriate alternative for the current P-1 zone. RECOMMENDATION: The City Council should approve the reclassification of the subject site from P-1 to RC with the P- suffix as proposed. This public communication permits all interested parties to know the contents of the communication and would allow them to openly rebut the evidence. PROJECT DESCRIPTION/BACKGROUND The current proposal is part of a series of six(6)proposed rezones of publicly held properties begun by the City of Renton in 1995. .These rezones would change the Public Use (P-1) zoning designation on the subject properties to zoning usually already in the area. Such zoning typically allows the type of uses found on these existing P-1 zoned properties. Occasionally existing zoning may have to be amended to allow some uses that may not have been anticipated,but this has been the rare exception. The current P-1 rezone is part of a series of approximately fifty (50) rezones, more than forty (40) of which have already occurred,that will be necessary to assimilate out all P-1 zoned properties in the City. This consolidation of the City's zoning is based in part upon an extensive staff report that was prepared in November, 1993 the findings of which are summarized in staff's May 4, 1994, Staff Report to the Planning and Development Committee on the issue of the relevance of the Public Use Zone. Given the number of uses provided for within Renton's new zoning codes adopted in June, 1993, and the fact that the P-1 Zone had not been consistently applied to all public uses over the years,the Council in 1994 directed that the P-1 Zone's uses be assimilated into the City's other zones(see Exhibit`B'). 2. ENVIRONMENTAL REVIEW Pursuant to the City of Renton's Environmental Ordinance and SEPA(RCW 43.21C, 1971, as amended), on September 23, 1997 the Environmental Review Committee issued a Determination of Non-significance for this proposed rezone. 3. COMPLIANCE WITH ERC CONDITIONS Because no mitigation measures were imposed on this non-project action, there were no ERC conditions that the applicant was required to comply with. STAFF REVIEW COMMENTS Because this rezone is a non-project action under SEPA as well as a part of a package of City sponsored P-1 rezones,no negative impacts were received from other reviewers. 5. CONSISTENCY WITH REZONE APPROVAL CRITERIA Section 4-8-14.0 "In the case where a change of the zone classification of property is recommended,at least one of the following circumstances shall be found to apply:" GENERAL CRITERIA: a) Previously Not Considered Zoning Reclassification That substantial evidence was presented demonstrating the subject reclassification appears not to'have been specifically considered at the time of the last area land use analysis and area zoning; or The subject site was not specifically considered at the time of the last area land use analysis and area rezoning in June, 1993 since it was understood that Staff were studying the P-1 Zone and were preparing recommendations to the Planning Commission and City Council on whether this special purpose zone should be retained, or, assimilated into the City's other new zoning classifications. Properties to the north and east were rezoned in June; 1993 to the Resource Corporation (RC) Zone and, properties to the west were rezoned to the Industrial Medium (IlVI) Zone. The subject site was not included in these rezones because the City was waiting for the Council's resolution as to how the Public (P-1) Zone would be handled. In June of 1994, the Council directed staff to proceed with the assimilation of the P-1 Zone into the city's other new zones. b) Consistency with the Comprehensive Plan, Its Elements and Policies That the property is potentially classified for the proposed zone being requested pursuant to the policies set forth in the Comprehensive Plan and conditions have been met which would indicate the change is appropriate; or The subject site has been determined to be potentially classified for the proposed Resource Conservation Zone based upon the fact that it is designated on the City's Comprehensive Land Use Map as Employment Area -Valley. Under this designation a variety of zoning classifications are allowed in order to provide regulatory flexibility. Objective LU-EE states:Provide flexibility in the regulatory processes by allowing for a variety of zone designations in the Employment Area-Valley designation. The proposed rezone is also consistent with Objectives U-F and EN-B since it will not change any of the uses in the existing drainage system and in fact the proposed RC Zone allows much less development than would normally be allowed under the existing P-1 Zone. Exhibit D is a comparative matrix of the two zones. This is because there are a whole array of different uses allowed under the P-1 Zone,and building heights are 50 feet and,with administrative approval, can be increased up to 90 feet. Allowed uses range from wastewater(sewage)treatment plants and airports to schools and hospitals. The proposed rezone is timely because in June, 1995,the City adopted new zoning provisions to protect the public trust that implemented Public Facilities Policies LU-229, LU-230, and LU-231. These provisions, which ensure early notification for nearby residents and property owners whenever there is a change of use, ownership, or major tenancy of any publicly owned property, allowed the City to move ahead with its P-1 rezones and their assimilation to other zones. H. Project Summary The subject rezone proposal is one of approximately 50 City sponsored rezones of publicly held in the Cityof Renton that are currentlyzoned Public Use properties (P-1)a zoning classification that the City has decided to get rid of. Reasons for not keeping this zoning classification include: 1.._it allows too large an array of uses (every thing from public hospitals and schools to museums,offices,and libraries to fire stations,municipal airports and park and ride lots for transit patrons). In addition,uses such as heliports,major medical office buildings,and buildings over 50 feet in height are allowed as conditional uses; 2. such zones are often"spot"zones where there is only one lot or one owner for the area designated;and, 3. such zones are often subject to legal challenge because they are"spot"zones and do not represent a class or group of lots or multiple owners within a given area. 4. not all publicly held sites are zoned P-1 and, in fact,nearly half of the public schools in the area have zoning designations different that P-1 and many municipal buildings including City Hall do not have P-1 zoning at the current time; and, 5. these zones are not consistent with the City's Comprehensive Plan Land Use Map. The intent of these rezones is too make the remaining P-1 zoned sites consistent with the City's Comprehensive Plan Land Use Map. To date approximately 41 formerly zoned P-1 sites have been rezoned to one of the City's new zoning classifications adopted in 1995. These rezones have been conducted over the last couple years and should be completed in late 1997 or early 1998. All former P- 1 zoned sites that were publicly owned will carry a so-called"P"suffix designating that they are publicly owned. Project Summary The subject rezone proposal is one of approximately 50 City sponsored rezones of publicly held properties in the City of Renton that are currently zoned Public Use(P-1)a zoning classification that the City has decided to get rid of. Reasons for not keeping this zoning classification include: 1. it allows too large an array of uses (every thing from public hospitals and schools to museums, offices,and libraries to fire stations,municipal airports and park and ride lots for transit patrons). In addition,uses such as heliports,major medical office buildings,and buildings over 50 feet in height are allowed as conditional uses; 2. such zones are often"spot"zones where there is only one lot or one owner for the area designated;and, 3. such zones are often subject to legal challenge because they are"spot"zones and do not represent a class or group of lots or multiple owners within a given area. 4. not all publicly held sites are zoned P-1 and,in fact,nearly half of the public schools in the area have zoning designations different that P-1 and many municipal buildings including City Hall do not have P-1 zoning at the current time; and, 5. these zones are not consistent with the City's Comprehensive Plan Land Use Map. The intent of these rezones is too make the remaining P-1 zoned sites consistent with the City's Comprehensive Plan Land Use Map. To date approximately 41 formerly zoned P-1 sites have been rezoned to one of the City's new zoning classifications adopted in 1995. These rezones have been conducted over the last couple years and should be completed in late 1997 or early 1998. All former P- 1 zoned sites that were publicly owned will carry a so-called"P"suffix designating that they are publicly owned. It is unlikely that sites GR-42 or GR-43 were ever used for agricultural purposes. GR-39, Liberty Park may have been used for this purpose in the past but this is not known for certain. c. The airport houses a number of airplane hangars for smaller aircraft. d. Will any structures be demolished? If so, what? Not as a result of these rezones. The subject rezones are part of a series of approximately fifty (50) similar rezones that are necessary in order to phase out the Pubic Zone, a zone which is considered to be a "spot" zone that allows a wide array of different uses, many of which would have questionable land use compatibility with surrounding uses. New zoning is consistent with the City's. Comprehensive Plan and will afford a greater level of compatibility. In addition, the two sites 1 at the P-1 Forebay will receive Resource Conservation zoning which would allow considerable less development on these two sites than is allowed under the current P-1 zoning designation. Gene Coulon Park is proposed toJJ receive R-8 zoning which allows for less intense uses than commonly allowed under the current P-1 zoning on this site. Whereas Liberty Park and the Cedar River Park would be rezoned to more intense zones, there is no intention of changing these uses, and were they to change there would be ample opportunity for public input because of the 60 day notification provisions under the "P" suffix provisions that would be attached at the time the six sites are rezoned under this proposal.
