HomeMy WebLinkAboutAddendum - 4AMENDMENT NO. 4 TO CAG 22-058 AGREEMENT FOR RAINIER/GRADY JUNCTION PLANNED ACTION THIS AMENDMENT, dated for reference purposes only as October 31, 2023, is by and between the City of Renton (the “City”), a Washington municipal corporation, and BERK Consulting, Inc. (“Consultant”), a Washington Corporation. The City and the Consultant are referred to collectively in this Amendment as the “Parties.” Once fully executed by the Parties, this Amendment is effective as of the last date signed by both parties. Whereas, the City engaged the services of the Consultant under Agreement CAG-22-058, dated March 3, 2022 which has been amended on May 24, 2022, August 31, 2022, and August 16, 2023, to provide necessary services for the Rainier/Grady Junction Planned Action (referred to herein as the “Agreement as amended”); Whereas, the Parties wish to further amend the Agreement as amended to extend completion of the contract for the Rainier/Grady Junction Planned Action draft Environmental Impact Statement (EIS). NOW THEREFORE, it is mutually agreed upon that CAG-22-058, as amended, is further amended as follows: 1.Time of Performance: Section 3, Time of Performance, is amended to extend completion of the Agreement set forth in Exhibit A-4, which supplements but does not replace Exhibit A-3. All work shall be performed by no later than May 1, 2024. 2.All terms of the Agreement not explicitly modified herein shall remain in full force and effect and such terms shall apply to Work performed according to this Amendment as if fully set forth herein. JULY 2023 1 File location: C:\Users\abravo\OneDrive - City of Renton\Margarette\Long Range Planning\Contracts\TODI\Amendment 4\Exhibit A-4 INTRODUCTION The following supplemental scope of services is for Perteet, Inc (Consultant) to provide additional support to BERK related to Renton’s TODI Grant 2021. The services in this scope supplement the existing contracted scope of services to perform alternative analysis and Draft EIS preparation for the Rainier/Grady Junction Subarea Planned Action for Transportation, Stormwater, Utilities, and Natural Environment. Adding this supplemental scope of services allows the Consultant team to preserve budget allocated to complete remaining scope on the preferred alternative and final EIS steps, as well as respond to the City’s requests and project needs beyond the original scope and budget. Some additional project needs that have already been addressed within the contracted budget include: • Coordination with Transpo Group on travel demand model volumes in the Rainier/Grady area • AM volume development. The contracted scope assumed volumes would be provided by the City. However, neither counts nor volumes were available, so Perteet processed volumes from a previous study in the area to estimate AM volumes for current conditions. Current outstanding requests and needs that will be addressed in this supplemental scope of services are: • to provide additional detail for mitigation measures for transportation at the request of the City • to incorporate results of wastewater modeling and water technical analysis input revisions from the City • Incorporate findings of both the elements above into the written alternatives analysis and Draft EIS. Consultant’s services for this amendment will be limited to those expressly set forth herein. If the service is not specifically identified herein, it is expressly excluded. Consultant will have no other obligations, duties, or responsibilities associated with the project except as expressly provided in this Agreement. Transferring Budget within Contract Maximum: The level of effort is specified in the scope of services. The budget may be transferred between discipline tasks at the discretion of the Consultant, provided that the total contracted amount is not exceeded. The Consultant will have the flexibility to manage budget within a given discipline on a subtask level. SUPPLEMENT 02 OF EVALUATION OF PAVEMENT MANAGEMENT PLAN STRATEGIES Agreement with Perteet Inc. JULY 2023 2 File location: C:\Users\abravo\OneDrive - City of Renton\Margarette\Long Range Planning\Contracts\TODI\Amendment 4\Exhibit A-4 Services provided by the Consultant will consist of: GENERAL SCOPE OF SERVICES This supplemental Scope of Services describes the work elements to be accomplished by the Consultant as summarized under each Step. This supplemental scope consists of the following elements: Step 3.6 – Additional Preparation of Transportation Analysis and Draft EIS Step 3.7 – Additional Preparation of Utilities Analysis and Draft EIS Optional Services With prior written approval by the City and written notice-to-proceed, work elements described in this scope of services as optional services (as directed) may be produced by the Consultant. This Scope of Services is defined in the tasks below. SCOPE OF SERVICES DEFINED Action 3 – Perform alternative analysis and Draft EIS (task is amended with the following) Step 3.6 Additional Preparation of Transportation Analysis and Draft EIS (new step) – Based on prior and continuing consultation with the City, the Consultant will revise the alternatives analysis and transportation mitigation measures prepared for the Draft EIS to contain more detailed information on specific recommendations, and to consider additional future potential conditions. Step 3.6.1 Necessary for Draft EIS Revisions in this Step 3.6.1 are necessary to capture in the Draft EIS analysis, as they are critical to incorporate in order to evaluate the impacts development will have on the area and to propose appropriate mitigation measures to the public. These revisions will include the following items previously discussed with the City: • Updates to EIS narratives on alternatives impacts (including assumptions) and mitigation measures to consider future right-of-way needs to accommodate subarea plan sections and the planned I-line design provided by the City on Grady Way. Additionally, this Step includes a minimal effort to consider updated Alternative 2 growth predictions by refining the Impacts narrative section that describes Alternative 2 through the SUPPLEMENT 02 OF EVALUATION OF PAVEMENT MANAGEMENT PLAN STRATEGIES Agreement with Perteet Inc. It is assumed that Alternative 2 will continue to be excluded from the technical analysis as it is not one of the book-end alternatives. Step 3.6.2 Refinement of Mitigation Measures Revisions in this Step 3.6.2 are not necessary to capture in the Draft EIS analysis, as they center around developing feasible concepts or preliminary design guidance for proposed mitigation measures. These revisions will include the following items previously discussed with the City: • Feasibility of extending the existing two-way cycle track on Shattuck Ave S to cross S Grady Way and connect to the subarea core. Feasibility analysis will identify impacts to WSDOT property, and necessary reconfigurations to implement. • Revise recommendation for the shared-use path along the north side of S Grady Way to route bicycle traffic via Shattuck to 7th Street to reach Burnett Linear Park. Step 3.6.3 Additional Scenarios for Draft EIS Revisions in this Step 3.6.3 involve an alternate assumptions or consideration of additional mitigation measures. These changes are based on the City’s requests to investigate these additional scenarios, which would impact the Draft EIS analysis. These revisions will include the following items previously discussed with the City: • Expanding on the mitigation measure “Building on MT-2 from the Subarea Plan (see Incorporated Plan Features), the new grid of complete streets should prioritize the high- growth Renton Village area, serving to connect with Talbot Rd S and S Grady Way, with an east-west street that can be used to access into the core of Renton Village area” by: o Conducting intersection level-of-service analysis for AM and PM peak-hours at existing Renton Village access entrances/egresses for Alternatives 1 and 3. These will be the intersections of S Grady Way and Lake Avenue S and Talbot Road S and S Renton Village Place. o Documenting the impacts of both alternatives and develop proposed mitigation measures in the EIS. o Coordinate with the City and consider location of WSDOT right-of-way limits in mitigation measure development. For all of Step 3.6, revisions to the transportation section of the EIS will be sent to the City for comment. The City will provide comments that Perteet will use to refine the transportation section. Assumptions: • Up to two (2) one-hour virtual meetings will be sufficient for coordination with the City on this Step. SUPPLEMENT 02 OF EVALUATION OF PAVEMENT MANAGEMENT PLAN STRATEGIES Agreement with Perteet Inc. JULY 2023 4 File location: C:\Users\abravo\OneDrive - City of Renton\Margarette\Long Range Planning\Contracts\TODI\Amendment 4\Exhibit A-4 • Alternative 2 will continue to be excluded from the technical analysis as it is not one of the book-end alternatives. • No additional coordination with Transpo Group on the Travel Demand Model will be done. • The effort for any revisions from City or public review comments after the initial revision for the items in this step through the publishing of the Final EIS will not exceed 9 hours. Deliverables: • Revised transportation section of EIS for City comment • Revised transportation section of EIS for publishing Step 3.7 Additional Preparation of Utilities Analysis and Draft EIS (new step) – Based on prior and continuing consultation with the City, the Consultant will revise the alternatives analysis and utilities mitigation measures prepared for the Draft EIS to consider key pieces of new information. Revisions in this Step 3.7 are necessary to capture in the Draft EIS analysis, as they are critical to incorporate in order to evaluate the impacts development will have on the area and public. These revisions will consider the following items previously discussed with the City: • Results of wastewater modeling (to be provided by the City) • Water system inputs for demand calculations (such as peak hour factor and other numerical value inputs to be provided by Public Works) Additionally, this Step includes a minimal effort to consider updated Alternative 2 growth predictions. It is assumed that Alternative 2 will continue to be excluded from the technical analysis as it is not one of the book-end alternatives. A revised utilities section of the Draft EIS will be sent to the City for comment. The City will provide comments that Perteet will use to develop transportation section of the Draft EIS for public comment. Assumptions: • Up to two (2) one-hour virtual meetings will be sufficient for coordination with the City on this Step • Alternative 2 will continue to be excluded from the technical analysis as it is not one of the book-end alternatives • The effort for any revisions from City or public review comments after the initial revision for the items in this step through the publishing of the Final EIS will not exceed 7 hours.
