SUMMARY OF ACTION: Building and Zoning Department Recommendation: Deny as presented, recommend City Council rezone to O-P. Hearing Examiner Recommendation: Recommends City Council rezone from R-3 to O-P, with restrictive covenants. BUILDING & ZONING The Building & Zoning Department Report was DEPARTMENT REPORT: received by the Examiner on December 10, 1985. PUBLIC HEARING: After reviewing the Building and Zoning Department Report, examining available, information on file with the application and field checking the property and surrounding area, the Examiner conducted a public hearing on the subject as follows: The hearing was opened on December 17, 1985, at 9:00 A.M. in the Council Chambers of the Renton Municipal Building. Parties wishing to testify were affirmed by the Examiner. The following exhibits were entered into the record: Exhibit #1 - Yellow file containing application, proof of posting and publication and other documents pertinent to this request. Exhibit #2 - Assessors Map. Exhibit #3 - Sketch showing houses currently on the site. Exhibit $4 - Site Plan showing the potential building envelope under the O-P zone. The hearing opened with the Zoning Administrator, Roger Blaylock, presenting the staff report for review. After entering the above exhibits, Mr. Blaylock advised this request is for a rezone from residential to commercial on 0.81 acre of property on N.E. Sunset Blvd. At the present time there are two homes on the site. The Comprehensive Plan designates this property for office park uses. There are two main intersections in the area in established commercial nodes; services are currently located in the area; and a review was presented of the four rezone criteria to be considered. The property was rezoned to R=3 in 1979 but in 1981 the Comprehensive Plan was changed to Office Park. Mr. Blaylock stated staff does not believe the requested zone change is appropriate as it is not in compliance with the goals and policies of the Comprehensive Plan, and the business designation would intrude into the Office Park development. It was also pointed out that the Planning Commission and City Council had previously looked at the intersections of N.E. Sunset Blvd. and Union Ave. N.E. and N.E. Sunset Blvd. and Duvall Ave. N.E. and declared those specific areas should not become one at this point in time. They also increased the usability of the property by permitting development of offices instead of strictly residential uses when they modified the Comprehensive Plan in 1981. Mr. Blaylock stated when there are properties located near major arterials or between other areas of commercial uses, a designation of multiple-family or office park has been applied. He feels the request is not in conformance and requested the Hearing Examiner to consider a lesser zoning classification. ;Anton Althoff R-092-85 December 30, 1985 Page 2 Continuing, Mr. Blaylock stating the applicant wanted to pursue the B-1 application, but would be satisfied with the O-P classification. He stated if the O-P classification is approved, the front yard setback requirement of 20 ft. is necessary, but the building has ;only 10 ft. at present. It was suggested that if the Examiner recommended a.rezone of O-P to the City Council that he also provide for Restrictive Covenants stating the 'current residences on the property could not be used if converted to Office Park uses. 'Mr. Blaylock closed by recommending the Hearing Examiner recommend to the City Council that they rezone this property to an Office Park designation. Calling for comments in support of this application, responding for the applicant was: Larry Brown 13975 Interurban Avenue South Seattle, Washington, 98168 :Mr. Brown stated his agreement, with the majority of the staff report, but took exception to the staff recommendation of Office Park uses. He stated he originally applied on 'behalf of the applicant for a B-1 classification based upon his real estate experience and knowledge of the area for over 10 years. He reviewed previous rezonings in the area over the last few years and stated there is not a market for office park property in the Renton Highlands area, and feels rezoning this site to that designation would take away the major opportunities that could be utilized by the property owner. Mr. Brown reviewed some of the uses he felt would be marketable in the area, but under the Office Park designation those uses would not be permitted. The property is approximately 35,000 sq. ft. (less than an acre), and the existing O-P zoning he is aware of in the surrounding areas are all on larger acreage, which again, he feels would inhibit the applicant in the usage of this smaller parcel if required to carry O-P zoning. On the current property, if zoned O-P, j 49% of the area would have to be utilized for setbacks. Of that area, a portion would be 'landscaped, with an additional 20% of the overall site area outside of the setbacks landscaped as well, making 35% of the site utilized for landscaping. Mr. Brown stated between Union and Duvall there are over 30 commercial businesses at the present time and feels the imposition of O-P zoning on a small island seems to be out of place. Mr. Brown continued stating he foresees no additional traffic impacts from this proposal 'and stated he has the support of several of the businesses for commercial uses on this property. He referred to a 'mixed use' of property wherein one might use a commercial use on the ground floor of the building and a residential use above. The Hearing Examiner stated when using the O-P zoning it is possible to have retail sales as well as office facilities located above. Mr. Brown advised he was not aware of any of this type of 'facility in Renton, and did not personally feel this would be a successful way to go. When asked by the Examiner if the applicant would accept O-P zoning as a fall-back position, Mr. Brown said the applicant would indeed accept O-P as it would take another year to rezone the property. This would also give him time to look for a buyer who would be able to use O-P zoning or come in for a Conditional Use Permit for the property. There was no further testimony offered in support of this proposal. The Examiner called for testimony in opposition to this proposal. There being no one else wishing to speak, and no further comments from staff, the hearing closed at 9:45 A.M. FINDINGS, CONCLUSIONS & RECOMMENDATION: Having reviewed the record in this matter, the Examiner now makes and enters the following: FINDINGS: 1. The applicant, Anton Althoff, has requested approval of a rezone of approximately .81 acres of property from R-3 (Medium Density Multi-family Residential) to B-1 (Business/Commercial). 2. The application file containing the application, the State Environmental Policy Act (SEPA) documentation, the Building and Zoning Department Report, and other pertinent documents was entered in the record as Exhibit #1. • Anton Althoff R-092-85 December 30, 1985 Page 3 3. Pursuant to the City of Renton's Environmental Ordinance and SEPA (RCW 43.21C, 1971, as amended), a Declaration of Non-Significance has been issued for the subject proposal by the Environmental Review Committee (ERC), the responsible official. 4. Plans for the proposal have been reviewed by all City departments affected by the impact of this proposal. 5. The subject site is located at 4409 Sunset Blvd N.E. on the south side of the street. The site is just west of the McDonalds restaurant. 6. The Albertsons/Ernst Shopping Center is located further east at the Corner of Duvall Avenue N.E. and N.E. Sunset Boulevard. 7. The subject site was annexed into the City by the adoption of Ordinance 2408 which was enacted in May, 1968. 8. The site was reclassified to its current R-3 classification in April of 1979 by the adoption of Ordinance 3311. 9. The property was also the subject of a short plat in June, 1974. (File No. Short Plat 345-79). 10. The map element of the Comprehensive Plan designates the area in which the subject site is located as suitable for the development of office park type uses, but does not mandate such development without consideration of other policies of the plan. This area was subject to specific analysis since the City intends to prevent strip commercial development between Union Avenue N.E., west of the site and Duvall Avenue N.E., east of the site. The Office Park designation on the south side of Sunset was coupled with a multiple family designation just across Sunset to separate the nodes of commercial proposed and developing at the Union and Duvall intersections. (See Page 57 of the Comprehensive Plan). 11. Staff recommends the site be reclassified to O-P (Office Park) rather than the B-1 classification requested by the applicant. Staff analysis indicates that O-P is the classification which best represents the office park designation in the Comprehensive Plan. 12. The applicant's representative opposes the staff's recommendation. Based upon location, neighboring uses and market factors, the representative indicates that B-1 is more appropriate for the subject site. The applicant indicates that O-P is more acceptable than the site's current R-3 which permits only residential use of the site. 13. Approximately 5 acres of vacant property zoned B-1 are located in the vicinity of the subject site. Another 5 acres zoned B-1 in the immediate vicinity contains marginal uses which could be redeveloped. 14. Uses permitted in the O-P zone include, but are not limited to some of the following: administrative and professional offices; medical and dental clinics; banks; and a variety of schools. Other uses are permitted by conditional use permit. Retail uses are generally prohibited in the zone but can be combined with other uses in the buildings. 15. Existing single family homes are located on the site. One home is located within 10 feet of the street. Staff recommended that the homes not be utilized for commercial uses. CONCLUSIONS 1. The proponent of a rezone must demonstrate that the request is in the public interest, it will not impair the public health, safety and welfare, and in addition, complies with at least one of the three criteria found in Section 4-3010, which provides in part that: a. The subject site has not been considered in a previous area-wide rezone or land use analysis; or b. The subject site is potentially designated for the new classification per the Comprehensive Plan; or Anton Althoff R-092-85 December 30, 1985 Page 4 c. There has been a material and substantial change in the circumstances in the area in which the subject site is located since the last rezoning of the • property or area. The requested reclassification is unjustified in light of the designation in the Comprehensive Plan as well as the availability of other land appropriately zoned. 2. The Comprehensive Plan emphasizes the review and resultant determination of the City Council to avoid strip commercial development along Sunset Boulevard in the area between Union and Duvall. While two separate commercial nodes are shown on the map, the map most definitely divides those two nodes by designating the south side of Sunset for office park uses and the north side of Sunset for multi-family development. 3. The office park designation particularly breaks into the commercial strip since it requires greater setbacks, and emphasizes stylish design in a campus type setting. The zone permits flexibility by allowing landscaping and certain setbacks to be shifted due to site variations. In addition, no minimum site area is required. 4. Retail uses, if not the sole use, may also be permitted when combined with appropriate office functions. The latitude of professional offices and medical and dental facilities permits an expanded range of reasonable uses in the O-P zone. 5. The applicant's request, when further viewed against the approximately 10 acres of land already zoned for B-1 uses, is unpersuasive. The applicant's acquiescence in O-P zoning as a step to eventual B-1 zoning hopefully is not an indicator of the applicant's intention to sit on the property. If that were to be the case, than it would be untimely to reclassify the property to even O-P. As indicated, there are a wide range of attractive commercial uses which could be accommodated on the subject site. 6. Given the strong indications of the City to avoid strip development along Sunset in this area, it might be more appropriate to retain the R-3 zoning as a complement to the zoning across the street (R-2 and R-3) and to the Comprehensive Plan's designation of residential for the area north of Sunset. Therefore, this office reluctantly recommends that the City rezone the subject site from R-3 to O-P with the expectation that the applicant will make use of the O-P zoning. 7. The City Council should condition the rezone to include a reversion clause which automatically rezones the property back to R-3, its current zoning, if the development plans are not submitted within 2 years of final approval of the rezone. In addition, the existing structures should not be used for commercial purposes as they would be non-conforming. RECOMMENDATION The City Council should approve the reclassification of the subject site from R-3 to O-P subject to the filing of restrictive covenants specifying that the zoning of the site will revert from O-P back to R-3 if specific development plans in the form of a building permit application, or other land use permit representing an intension to utilize the O-P zoning, such as an application for site plan review or conditional use permit, is not submitted within two years of final approval of this zoning action. The applicant, Anton Althoff, is requesting a rezone of .81 acre from R-3, Multiple Family Residential, to B-1, Business Use. The property is located at 4409 N.E. Sunset Boulevard. McDonalds is immediately adjacent to the east. 2. The Environmental Review Committee has issued a declaration of non-significance. The appeal period will expire at 5 p.m. on Monday, December 16, 1985. 3. The Hearing Examiner must review four specific criteria under Section 4-3014(C) to determine that the circumstances surrounding the rezone request are adequate to recommend approval of the reclassification to the City Council. The following evidence clearly demonstrates the rezone request is not appropriate. a. That substantial evidence was presented demonstrating the subject reclassification appears not to have been specifically considered at the • time of the last area land use analysis and area zoning. The subject site was annexed into the.City in May of 1968 by Ordinance 2408. Ordinance 3311 in April of 1979 rezoned the property to R-3, Multiple Family Residential. Subsequently, in December of 1981 the Northeast Renton Plan was revised changing the land use classification designation to Office Park. There has not been a rezone request since 1981; thus the criteria appears to have been complied with. b. That the property is potentially classified for the proposed zone being requested pursuant to the policies set forth in the Comprehensive Plan and conditions have been met which would indicate the change is appropriate. The proposed rezone request to B-1, Business Use, is not in conformance with the Comprehensive Plan Land Use Map designation of Office Park for the subject site. The proposal is on the western edge of a commercial node designated around the intersection of N.E. Sunset Boulevard and Duvall Avenue N.E. This commercial area is dominated by the shopping center located, on the southwest corner of that intersection. f PRELIMINARY REPORT THE HEARING EXAMINER ANTON ALTHOFF, FILE NO. R-092-85 DECEMBER 17, 1985 PAGE 3 The Policy Development Department has presented an opinion opposing the rezone classification to B-1 because the request is not in compliance with either the Comprehensive Plan Land Use Map or the intent of the goals and policies. It would create a specific intrusion into the area designated for Office Park development. ISSUE: HAS THERE BEEN SUFFICIENT JUSTIFICATION PRESENTED ,DEMONSTRATING THAT A VARIATION OF THE COMPREHENSIVE PLAN DESIGNATION BASED UPON COMPREHENSIVE PLAN POLICIES IS WARRANTED? The applicant has presented data stating that changes in the area suggest that the predominant development of land uses along N.E. Sunset Boulevard are commercial. The applicant also points to the fact that only the B-1 use allows enough flexibility for development of the lot since it is less than one acre in size. The Building and Zoning Department believes that the written presentation by the applicant is not sufficient to warrant the rezone request to B-1 primarily based upon the fact that the Planning Commission and City Council specifically looked at the two commercial areas designated at the intersections of N.E. Sunset Boulevard and Union Avenue N.E. and N.E. Sunset Boulevard and Duvall Avenue N.E. and made a clear statement that those two areas should not grow to become one at this time. The Planning Commission and City Council increased the usability of the property by allowing the development of offices instead of strictly residential uses on the subject site in the Comprehensive Plan modifications in 1981. Another fact that is not supportive of the proposed rezone is the fact that there is an oversupply of commercial area at this time. Normally, rezones in the area would support an applicant's request; however, there is more than five acres of vacant commercial property immediately available for development with potentially another five acres of redevelopment in the area. It should also be pointed out that if the subject site was developed as an office building based upon the required parking and setbacks that there is still the potential for the building to be converted if the City Council changes its position to allow one commercial area instead of two. Since the property is not appropriately classified in the Comprehensive Land Use Plan nor is the request supported by the policies of the • Comprehensive Plan, a secondary issue arises. ISSUE: CAN THE LAND USE HEARING EXAMINER APPROVE A MORE RESTRICTIVE ZONING CLASSIFICATION THAN INITIALLY REQUESTED? The Hearing Examiner has the ability to place conditions upon or make recommendations of conditions to the City Council upon any land use request. The City Council at the recommendation of the Hearing Examiner on many cases has placed covenants which limit the use or dimensional development requirements of a project. Specific examples are best seen where the use of a site has been limited to office functions without the ability to allow retail uses. In this case the Comprehensive Plan supports the rezoning classification of O-P, Office Park, which is then supported by all of the City departments. An Office Park designation would also comply with the intent of the goals and policies of the Comprehensive Plan. In addition the Office Park classification would allow site plan review. PRELIMINARY REPORT _ THE HEARING EXAMINER ANTON ALTHOFF, FILE NO. R-092-85 DECEMBER 17, 1985 PAGE 4 The reclassification to Office Park would also comply with the three rezoning criteria as outlined under Section 4-3014(C)(1). The most interesting point is that all of the applicant's justifications stating that new development has occurred in the area would then support the issue of timeliness which is a statement that (1) there are adequate services and (2) there is a need. 4. In conclusion the rezone request as submitted should be DENIED, but a recommendation to the City Council of rezoning the subject property to O-P, Office Park, should be made. The applicant in their own statement agrees that an O-P classification would be appropriate if the B-1 classification was denied. The Building and Zoning Department would like to point to the fact that the issue in this case is one of timing of the Comprehensive Plan. If extreme demand for commercial activity is placed on the general neighborhood in the future, there may be a change in the land use classification of the subject site. The applicant has the opportunity in the construction design of the building to place the structure so that a conversion to a commercial use could be done fairly simply and cost effectively in the future if the Comprehensive Plan and ultimate zoning was changed at that time. ' H. Williams, Associate Planner SUBJECT: ALTHOFF REZONE ,We have reviewed the proposed rezone from R-3 to B-1 of the Althoff property on Sunset Boulevard and offer the following comments. While we recognize the limitations of a parcel of property of less than one acre, we cannot support a rezone to B-1. In our view, B-1 zoning would be clearly in conflict with adopted City land use policies. The Comprehensive Plan Land Use Map designates the area for Office/Office Park type uses. More importantly, the Comprehensive Plan shows Commercial uses only in clearly defined areas. along Sunset Boulevard. There are large Commercial nodes around the Highlands shopping district, at the intersection of Union Avenue and Sunset Boulevard and at Duvall Avenue and Sunset. The City very carefully placed other uses as the appropriate uses between these nodes. The intent was to avoid a strip commercial arterial and to concentrate commercial activities in well defined centers. Written policies of the Comprehensive Plan reinforce this intent: Commercial Development Policy (Page 57) 01 -- Commercial uses developed along ... Sunset Boulevard N.E. should be oriented within shopping centers or other sizeable complexes. #2 -- Strip commercial development should only be allowed when no other design alternative is available. In accord with these policies, the land use designations between the Commercial nodes at Duvall and at Union are Multiple Family north of Sunset Boulevard and Office Park south of Sunset Boulevard. The most appropriate zoning classification to implement this designation is Office Park. In some cases, we would support B-1 zoning to implement such a designation, because many of the uses are similar. However, the conditions or restrictive covenants which would be required for the B-1 zone to avoid the impacts of strip commercial would be tantamount to O-P zoning. Therefore, we believe that O-P zoning is justified for the subject site. Because of the development standards of the O-P zone, the property will be able to accommodate a different style of development. The setbacks and open space standards are greater in O-P. However, through site plan approval, the O-P zone permits reduced setbacks and landscaping by shifting these areas to other portions of the site. Moreover, O-P is not limited to large acreages; there is no minimum lot size in the O-P zone. Therefore, O-P standards are stricter, but adequate development is still permitted. With regard to the permitted uses in O-P versus B-1, many of the same uses are allowed. Retail is permitted in O-P by conditional use when combined with other activities. Business services and all manner of offices and financial activities and even limited indoor manufacturing are permitted in the O-P zone. The key point about the standards and uses of the O-P zone is that most of the impacts of strip commercial activity, which City policy seeks to avoid, are mitigated by employing the O-P zone instead of B-1. In addition, the O-P zone requires site plan approval to examine the specific impacts of future development. Because of the reasons stated above and because the applicant by letter has expressed a willingness to accept O-P zoning as a viable alternative to B-1 zoning, we recommend that a rezone from R-3 to O-P be approved for the property instead of a rezone to B-1. Williams, Associate Planner SUBJECT: ALTHOFF REZONE We have reviewed the proposed rezone from R-3 to B-1 of the Althoff property on Sunset Boulevard and offer the following comments. While we recognize the limitations of a. parcel of_property of less than one acre, we cannot support a rezone to B-1. In our view, B-1 zoning would be clearly in conflict with adopted City land use policies. The Comprehensive Plan Land Use Map designates the area for Office/Office Park type uses. More importantly,.the Comprehensive Plan shows Commercial uses only in clearly defined areas. along Sunset Boulevard. There are large Commercial nodes around the Highlands shopping district, at the intersection of Union Avenue and Sunset Boulevard and at Duvall Avenue and Sunset. The City very carefully placed other uses as the appropriate uses between these nodes. The intent was to avoid a strip commercial arterial and to concentrate commercial activities in well defined centers. Written policies of the Comprehensive Plan reinforce this intent: Commercial Development Policy (Page 57) #1 --' Commercial uses developed along ... Sunset Boulevard N.E. should be oriented within shopping centers or other sizeable complexes. #2 -- Strip commercial development should only be allowed when no other design alternative is available. In accord with these policies, the land use designations between the Commercial nodes at Duvall and at Union are Multiple Family north of Sunset Boulevard and Office Park south of Sunset Boulevard. The most appropriate zoning classification to implement this designation is Office Park. In some cases, we would support B-1 zoning to implement such a designation, because many of the uses are similar. However, the conditions or restrictive covenants which would be required for the B-1 zone to avoid the impacts of strip commercial would be tantamount to O-P zoning. •Therefore, we believe that O-P zoning is justified for the subject site. P - 2 - Because of the development standards of the O-P zone, the property will be able to accommodate.a different style of development. The setbacks and open space standards are greater in O-P. However, through site plan approval, the O-P zone permits reduced setbacks and landscaping by shifting these areas to other portions of the site. Moreover, O-P is not limited to large acreages; there is no minimum lot size in the O-P zone. Therefore, O-P standards are stricter, but adequate development is still permitted. With regard to the permitted uses in_O-P versus B-1, many of the same uses are allowed. Retail is permitted in O-P by conditional use when combined with other activities. Business services and all manner of offices and financial activities and even limited indoor manufacturing are permitted in the O-P zone. The key point about the standards and uses of the O-P zone is that most of the impacts of strip commercial activity, which City policy seeks to avoid, are mitigated by employing the O-P zone instead of B-1. In addition, the O-P zone requires site plan approval to examine the specific impacts of future development. Because of the reasons stated above and because the applicant by letter has expressed a willingness to accept O-P zoning as a viable alternative to B-1 zoning, we recommend that a rezone from R-3 to O-P be approved for the property instead of a rezone to B-1.
