Motor, City Clerk June 9. 1986 Renton City Council Minutes Page 4 Union Avenue NE/Sunset Boulevard Project Councilman Stredicke asked the Administration to investigate road improvement project on Union Avenue NE north of Sunset Boulevard NE due to complaints regarding matching grade of road and sidewalk and problems incurred by property owner at 104th and Union in replacing fence which was removed to allow the project. Mayor Shinpoch agreed to check on the matter. PUBLIC SAFETY COMMITTEE Fire Hydrant Ordinance Public Safety Committee Chairman Reed presented a report recommending the following changes to the Fire Hydrant Ordinance No. 3541: Section II: FIRE HYDRANTS REQUIRED - Paragraph two, has been moved from Section V - Special Requirements. The purpose for this change is due to improper location in the existing ordinance. This paragraph directly relates to this section. Section IV: BUILDINGS OPEN TO.THE PUBLIC - This section has been deleted; classifications for buildings have been updated. Section VI: SPECIAL REQUIREMENTS: Section D has been moved to Section IX - last paragraph, due to improper location in existing ordinance. The Committee further recommended that this matter be referred to Ways and Means Committee. MOVED BY REED, SECONDED BY TRIMM, COUNCIL CONCUR IN THE COMMITTEE REPORT. CARRIED. Emergency Services Ordinance Public Safety Committee Chairman Reed presented a report recommending concurrence in the proposed changes to the existing ordinance. CARRIED: Automatic Aid Contract - District #40 - Boundary Definition 'Public Safety Committee Chairman Reed presented a report recommending concurrence.in the request of the Fire Chief for redefinition of the boundaries for automatic fire/aid response with King County Fire District #40. Fourth of July Fire-Safety Activities Public Safety Committee Chairman Reed presented a report concurring in the direction of the Renton Fire Department/Fire Prevention to step up their role in promoting safe fireworks activities. They are members of the Puget Sound Council on Fireworks Safety. The goal is to provide, through public education, an awareness of fire safety. This is to be accomplished through frequent monitoring of fireworks stands to assure only legal fireworks are being distributed; law enforcement of illegal fireworks; media releases to promote fire safety; and Mayor's proclamation for "Fourth of July Safety Week." No action required. ORDINANCES AND RESOLUTIONS - Ways and Means Committee Ways and Means Committee Chairman Hughes presented the following ordinances for second and final reading: Ordinance #3999 - Uniform Building Code. etc. An ordinance was read amending portions of Chapters 1, 2, 4, 9 and 17 of Title IV (Building Regulations) of City Code by adopting the 1985 editions of the Uniform Building Code, Uniform Plumbing Code, Uniform Swimming Pool and Hot Tub Code, Uniform Housing Code, and Uniform Mechanical Code by reference. BUILDING & ZONING The Building & Zoning Department Report was DEPARTMENT REPORT: received by the Examiner on March 25, 1986. PUBLIC HEARING: After reviewing the Building and Zoning Department Report, examining available information on file with the application and field checking the property and surrounding area, the Examiner conducted a public hearing on the subject as follows: The hearing was opened on April 1, 1986, at 9:05 A.M. in the Council Chambers of the Renton Municipal Building. Parties wishing to testify were affirmed by the Examiner. The following exhibits were entered into the record: Exhibit #1 - Yellow file containing application, proof of posting and publication and other documents pertinent to this request. Exhibit #2 - Assessors Map. Exhibit #3 - Illustrative Site Plan. Opening testimony was presented by the Zoning Administrator, Roger Blaylock with the entry of the above exhibits into the record. He presented a review of the proposal citing the rezone request is for 1.5 acres belonging to Puget Power Company, with said property to be utilized by the applicant to provide a gateway image for the Valley 405 Business Park Which is owned by the applicant. The property involved will be landscaped, and additional parking as well as monument signs for the Business Park will be installed. The property is located under power lines thereby limiting its use. Existing zoning is G-1, access is off Powell Avenue S.W., services are available to the area, and this site was previously part of the Washington Technical Center. There are no structures on the site, and Mr. Blaylock continued with a review of the criteria used to consider a rezone request stating the site meets the intent of the Comprehensive Plan, the rezone is believed to be appropriate as the area is in a transitional phase at this time, making this request timely. Mr. Blaylock reviewed staff comments and advised the only concern expressed was the dedication of Oakesdale S.W.. The LID for Oakesdale is under formation. It was noted that the Comprehensive Plan clearly shows a connection in the arterial street program for • Oakesdale Avenue with the connection going from SR-900 to S.W. 43rd Street. making it a major collector street. With increased demands upon Lind Avenue S.W., Powell Avenue S.W., and S.W. 7th staff feels the extension of Oakesdale Avenue is of major importance with the development of the valley area. At this point Mr. Blaylock requested approval of the rezone request subject to the dedication of the right-of-way for the extension of Oakesdale Avenue S.W. First City Equities R-011-86 April 9, 1986 Page 2 The Examiner called for testimony in support of this proposal from the applicant or their representative. Responding was: Barbara Moss First City Equities 800 Fifth Avenue. Suite 4170 Seattle, Wa. 98104 Ms. Moss advised the applicant will soon be submitting a request for site plan approval on this property. They have approval from Puget Power and Puget Western to landscape the frontage of their property which will be utilized to place the signs for the Business Park, and to place a small parking lot on the property for the extension of the Phase II development. The existing code does not permit these changes to be made under the G-1 zone. She said it is their intent to clean up the property and present as great a visual, professional appearance as possible in a gateway setting for the development. Ms. Moss advised that for now. the site set aside for the proposed substation will be planted in grass and will be graded, landscaped and irrigated as Puget Power will be coming back in five to ten years to build. Regarding the dedication of Oakesdale. she said she personally would like to see a dedication, or property reserved for the Oaksdale right-of-way. Calling for further testimony in support. testifying was: Andy Padvorac Puget Power Company Puget Power Building Bellevue, Washington. 98009 Mr. Padvorac stated Puget Power supports the requested rezone as they feel the gateway design will be an asset to the area. Regarding the reservation and/or dedication for a right-of-way for Oakesdale across the property he asked for a clarification of the difference between the two. The Hearing Examiner clarified the terms. and continuing Mr. Padvorac said it would be Puget Power's preference that Oakesdale right-of-way not be dedicated at this time as an LID may purchase the property. and property to the south owned by Pacific Western. a subsidiary of Puget Power. and if Oakesdale goes through it will separate two tax lots damaging the value of the remaining property on the west. With this information. he recommended that property for the Oakesdale right-of-way be reserved instead of dedicated at this time. He had no further comments. Bob Bergstrom of the Public Works Department. City of Renton, testified briefly outlining the progress of that department with regard to the LID for the Oakesdale extension. He said the project is past the formation stages and is expected to go to bid sometime in the 'latter part of the year. He said some of the property belonging to Puget Power that fronts on S.W. Grady Way, that has been suggested for dedication of the Oakesdale right-of-way. is in fact part of the property involved in the S.W. Grady Way LID, which is currently under construction. Mr. Bergstrom said the City has had negotiations with Puget Power recently and have placed them in the S.W. Grady LID. excluded them from the Oaksdale LID as the City felt they would not benefit enough to be assessed for both LID's, and indicated to Puget Power they would purchase property from them at a fair market value for the Oakesdale extension going north and south through their property. With this in mind. Mr. Bergstrom stated the City would prefer a reservation of property I for the Oakesdale LID instead of a dedication of property. Speaking again briefly. Ms. Moss commented on the agreement with Puget Power and Pacific Western for the use of their property stating no compensation is being paid directly. but First Cities is installing landscaping, providing for the drainage ditch, and 'will be irrigating the property. 'The Examiner called for further testimony and/or comments from those in attendance, ;there was no one wishing to speak. The hearing was closed at 9:35 A.M. FINDINGS, CONCLUSIONS & RECOMMENDATION: 'Having reviewed the record in this matter. the Examiner now makes and enters the following: First City Equities R-011-86 April 9, 1986 Page 3 FINDINGS: 1. The applicant, First City Equities, has requested approval of a rezone of approximately 1.5 acres of property from G-1 (General: Single Family Residential: Minimum lot size - 35,000 sq ft) to M-P (Manufacturing Park). 2. The application file containing the application, the State Environmental Policy Act (SEPA) documentation, the Building and Zoning Department Report, and other pertinent documents was entered in the record as Exhibit #1. 3. Pursuant to the City of Renton's Environmental Ordinance and SEPA (RCW 43.21 C, 1971, as amended), a Declaration of Non-Significance has been issued for the subject proposal by the Environmental Review Committee (ERC), the responsible official. 4. Plans for the proposal have been reviewed by all City departments affected by the impact of this proposal. 5. There was no opposition to the subject proposal from any member of the public. 6. The subject site is located at the northwest corner of S.W. Grady Way and Powell Avenue S.W. and consists of the power line right-of-way which parallels Grady Way in this area. 7. The subject site was annexed into the City by the adoption of Ordinance 1745 in April, 1959, as amended by Ordinances 1764 and 1928 adopted in May, 1959 and December, 1961 respectively. The site was automatically zoned G-1 (General; Single Family Residential: Minimum lot size - 35,000 sq ft) upon annexation. 8. The map element of the Comprehensive Plan designates the area in which the subject site is located as suitable for the development of manufacturing park/multiple option uses, but does not mandate such development without consideration of other policies of the plan. 9. A variety of uses have been or are being developed in the general vicinity. The applicant is constructing, and has approval for an office building just north of the site, and other projects proposed north and west of the site. Further north, combined office park, commercial and light industrial uses have been developed. 10. Grady Way is being upgraded by an LID, and a new bridge is under construction. An LID for Oakesdale has been approved by the City Council. 11. The applicant proposes utilizing the subject site primarily as a focal point for its adjacent northerly development projects - to serve as the primary draw along Grady Way. The site will be landscaped and 'gateway' type monument signing is proposed to identify the site. The eastern end of the site would also serve for parking for the applicant's approved Phase II office building. 12. The site is owned by Puget Power. Potential development of a substation on the site, or portions of the site, is envisioned in the future. Puget Power has agreed to reserve the westerly portion of the site, generally in an alignment coinciding with the proposed Oakesdale right-of-way, for that roadway's planned expansion and intersection with Grady Way. CONCLUSIONS 1. The proponent of a rezone must demonstrate that the request is in the public interest, it will not impair the public health, safety and welfare and in addition, complies with at least one of the three,criteria found in Section 4-3010, which provides in part that: a. The subject site has not been considered in a previous area-wide rezone or land use analysis: or b. The subject site is potentially designated for the new classification per the Comprehensive Plan; or First City Equities R-011-86 April 9, 1986 Page 4 c. There has been a material and substantial change in the circumstances in the area in which the subject site is located since the last rezoning of the property or area. The requested reclassification is justified and should be approved. 2. The site abuts property zoned M-P, the category requested, and a rezone would therefore provide continuity in zoning. The request would extend the zoning to Grady Way, providing similar zoning from Grady Way north to the railroad right-of-way. 3. Significant changes have occurred not only along Grady where new development and LID's have changed the character of the area, but also north where the entire area is being redeveloped with light industrial uses, modern warehouses and office parks. The rezone will permit compatible development on the subject site, although such development will be limited by the restrictions of the power line corridor. The proposed development is in fact a landscaped extension of the northerly office park development in the main, and appears to be compatible with the area. 4. The rezone is also consistent with the proposed valley zoning now before the City Council. 5. The applicant should reserve along the site's western end, sufficient land to permit the extension of Oakesdale Avenue to permit the construction of a street envisioned in the Comprehensive Plan, and necessary for the overall growth and vitality of the area. The already existing constraints of the power line corridor indicate that the reservation will not unduly hamper development potential of the site. 6. The rezone request therefore, should be approved by the City Council. The applicant, First City Equities, is requesting the rezoning of approximately 1.5 acres from G-1, General Use, to M-P, Manufacturing Park. The rezone would allow First City Equities the opportunity to utilize the property that is owned by Puget Sound Power and Light for additional landscaping, parking and monument signs for the Valley 405 Business Park. 2. The . Environmental Review Committee has issued a declaration of non-significance on March 5, 1986. The appeal period expired on Monday, March 24, 1986 at 5 p.m. The Environmental Review Committee submitted an additional memorandum to the Hearing Examiner requesting that the Hearing Examiner evaluate the reservation and/or dedication of the extension of Oakesdale Avenue S.W. across the subject site as part of the rezoning process. 3. The Hearing Examiner must review four specific criteria under Section 4-3014(C) to determine that the circumstances surrounding the rezone request are adequate to recommend approval of the reclassification to the City Council. The following evidence demonstrates that the rezone request is appropriate: a. That substantial evidence was presented demonstrating the subject reclassification appears not to have been specifically considered at the time of the last area land use analysis and area zoning. The subject site was annexed into the City in April of 1959 by Ordinance No. 1745. Since that time, the subject site has not been considered for rezoning from its present G-1, General Use, classification. b. That the property is potentially classified for the proposed zone being requested pursuant to the policies set forth in the Comprehensive Plan and conditions have been met which would indicate the change is appropriate. The proposed rezone request to M-P, Manufacturing Park, is in conformance with the Comprehensive Plan land use map designation of Manufacturing Park-Multiple Option. The• development of the subject site is limited by the location of the overhead power lines. R-011-86 APRIL 1, 1986 PAGE 3 use of the site is to provide a positive aesthetic amenity for the Valley 405 Business Park which borders immediately to the north. In addition, the applicant's proposed utilizing some of the area for parking. Cleaning up the area that would not normally be developed because of the limitation of power lines will greatly enhance the intent of the Comprehensive Plan to provide a manufacturing park atmosphere for this general area. c. That since the last previous land use analysis of the area zoning of the subject property, authorized public improvements, permitted private development or other circumstances affecting the subject property have undergone significant and material change. The City is presently constructing $6 million plus worth of major public improvements adjacent to the site. The Grady Way bridge and subsequent improvements from the bridge eastward to Lind Avenue S.W. will greatly enhance the traffic circulation in this area. The development of major office structures in Valley 405 Business Park has prompted formation of an LID to construct Oakesdale Avenue S.W. from S.W. Grady Way to Monster Road. In total, both public and private development in the area has exceeded $100 million during the last five years. The image of the area has significantly improved from the previous industrial warehousing atmosphere developed in the 1970s. d. Timeliness: The final test to determine whether the rezone is appropriate is to address the question of timeliness. Public services and major developments in the private sector suggest that the area is undergoing a dramatic change from an undeveloped state to Manufacturing Park. 4. Department comments are attached for the p public's and the Examiner's review. Those comments all suggest approval with only minor suggestions about latecomers or other development charges. The only comment that was raised was also raised by the Environmental Review Committee as it relates to the extension of Oakesdale Avenue S.W. The Comprehensive Plan clearly calls for the extension of a major arterial through the subject site to link SR-900 (Empire Way) and S.W. 43rd Street. The Environmental Review Committee did not see that the proposed rezoning and ultimate development of the site (limited by the power lines) created an impact sufficient to be mitigated by the dedication of a public street. However, the goals and policies of the Comprehensive Plan clearly show access and traffic circulation intent. It should be reviewed as part of the land use decision. This is the first land use action to occur on the subject site since 1959 when the site was annexed and: therefore, the first opportunity to obtain the necessary right-of-way for a planned street. Without the ability to extend Oakesdale Avenue, access to the area would be limited and congestion and traffic hazards would increase as a result of increased demands upon Lind Avenue S.W., Powell Avenue S.W. and S.W. 7th Street. H. R-011-86 The Environmental Review Committee analyzed the environmental information presented by First City Equities for the rezoning of 1.5 acres of property from G-1, General Use, to M-P, Manufacturing Park, to allow the eventual placement of signs, parking, landscaping, and a future substation at the northwest corner of Powell Avenue and S.W. Grady Way. The Environmental Review Committee issued a declaration of non-significance without Conditions, but it was concerned that the right-of-way for Oakesdale Avenue S.W. be obtained as part of the rezone procedure. Grady Way Powell Avenue and 0akesdale The rezone is being requested to provide similar zoning in an area that is locked in by major streets and developments of current MP zoning. This property was not rezoned when the majority of the property in the area was rezoned. The existing G-1 zone is not compatible with adjacent streets and zoning. The City of Renton is currently revising the entire valley zoning to simplify it and to align it with the comprehensive plan. This area is proposed to be rezoned to MP when the City's rezoning is final. In the interim period, or if the new zoning for the entire area is not rezoned, we request a compatible zone to relate to established improvement of industrial and office uses in the area.
