HomeMy WebLinkAboutAddendum - 2AMENDMENT NO. 2 TO AGREEMENT FOR FINAL DESIGN OF THE  SE 172ND ST & 125TH AVE SE GREEN STORMWATER  INFRASTRUCTURE PROJECT  THIS AMENDMENT, dated for reference purposes only as January 16, 2024, is by and between  the City of Renton (the “City”), a Washington municipal corporation, and Osborn Consulting, Inc.  (“Consultant”), a Washington corporation. The City and the Consultant are referred to collectively  in this Amendment as the “Parties.” Once fully executed by the Parties, this Amendment is  effective as of the last date signed by both parties.  Whereas, the City engaged the services of the Consultant under Agreement CAG‐23‐082, dated  February 1, 2023, to provide necessary services for the Final Design of the SE 172nd St & 125th Ave  SE Green Stormwater Infrastructure Project (referred to herein as the “Agreement”);  Whereas, the Parties wish to amend the Agreement to change the scope of work, change the  time for performance, and change the compensation in order to provide for 100% Design and  final plans, specifications, and cost estimate.  NOW THEREFORE, It is mutually agreed upon that CAG‐23‐082 is amended as follows:  1.Scope of Work: Section 1, Scope of Work, is amended to add work as specified in Exhibit A‐2, which is attached and incorporated herein. 2.Time of Performance: Section 3, Time of Performance, is amended pursuant to the schedule(s) set forth in Exhibit D‐2. All Work shall be performed by no later than December 31, 2024. 3.Compensation: Section 4, Compensation, is amended so that the maximum amount of compensation payable to Consultant is increased by $98,969 from $132,614 to $231,583, plus any applicable state and local sales taxes. The additional compensation shall be paid based upon Work actually performed according to the rate(s) or amounts specified in Exhibit C‐2,which is attached and incorporated herein]. 4.All terms of the Agreement not explicitly modified herein shall remain in full force and effect and such terms shall apply to Work performed according to this Amendment as if fully set forth herein. Contract Number: BACKGROUND The Project will plan and design stormwater system modifications and green stormwater infrastructure (GSI) to improve water quality and drainage capacity for approximately half a block (600 ft) north of SE 172nd Street for 122nd Ave SE, 123rd Ave SE, 124th Ave SE and 125th Ave SE, and approximately two blocks (1,400 ft) of SE 172nd Street. This project for the City of Renton (City) will consist of installing a new stormwater conveyance system and green infrastructure with pervious concrete sidewalks supplemented with GULD facilities to collect and treat stormwater runoff from approximately 2 acres of pollution generating impervious surfaces. The project design and deliverable will meet the requirements of the Washington State Department of Ecology (Ecology) Water Quality Stormwater Pre-Construction Grant agreement and follow the 2019 Stormwater Management Manual for Western Washington (2019 SWMMWW), and the 2022 City of Renton Surface Water Design Manual (SWDM) as an amendment to the 2021 King County Surface Water Design Manual. This amendment will provide the final design of the project to bid ready plans, specifications and engineers estimate. This will include the final bid package deliverables for Ecology’s approval. The final bid package will include the water and sewer final design elements as a separate bid schedule that will be compiled through a separate task amendment. Additional site survey will be completed to document driveway and private fence revisions completed since the previous site survey. Support services during bidding and construction will be added through a future project amendment. The scope of work below is assumed to be completed between approximately January 2024 to June 2024. Construction is planned to begin in the autumn of 2024. SCOPE OF WORK Task 1 Project Management Monitoring and communicating the status of the scope, schedule, and budget of this work assignment and providing monthly reporting to the City over a 6-month period. Consultant Services Prepare status reports describing the following: Services completed during the month. Outstanding issues (if any). Client Responsibility  Attend project meetings (via teleconference).  Review and approve invoices.  Review and comment on submittals within the project schedule. Assumptions  One meeting will be held with the City to review the Revised 90% review comments.  One meeting will be held with the City to review the Revised 95% review comments.  Meetings will be held virtually with bi-weekly meetings lasting up to 30-minutes. Deliverables  Project schedule, update to be provided with monthly status reports.  Issue Log and Risk Register to be provided at each deliverable.  Bi-weekly check-in action items summary.  Monthly status reports. Task 7 Storm and Roadway Design – 95% Submittal The Consultant shall revise the design layout per City review comments with the 95% design submittal to provide dispersed water quality treatment units with reduced piped conveyance connections to these proposed facilities to limit system complexity, maintenance concerns and reduce the number of utility relocations required. The locations of existing driveways and fences that have been modified since the previous site survey will be located in the field with electronic updates to the project basemap. The 95% design plans, estimate and specifications will include the stormwater and roadway improvements with the proposed improvements to the water and sewer system reflected in the revised design. The water and sewer improvements will be included as a separate submittal with separate bid schedules within the combined SE 172nd GSI Project Final Ad-Ready Submittal in Task 8. Consultant Services  Site survey of up to 3 driveways and two fences will be completed with electronic updates to the project basemap and construction sheets. DocuSign Envelope ID: 858A6534-723C-4A41-BF7A-BE1121795BE4 3 | Page SE 172nd St Green Stormwater Infrastructure Project- Final Design Amendment 2 – Final Design and Construction Support  The 90% Design Report will be updated to reflect to design changes to the water quality system for review and approval by the City and Ecology.  The project existing conditions sheets, proposed improvement sheets and cost estimates will be updated to reflect the revised field survey.  The 95% plans, special provisions and cost estimates will be updated per the revised stormwater system design and to address 90% review comments. Client Responsibility  City to provide one (1) consolidated review comments of the Revised 90% submittal by the City and Soos Creek. Assumptions  Sewer design will be completed through Amendment No. 3 of this contract. The Soos Creek standard plans to be included in an appendix of the project specifications.  Additional site survey along 125th Ave SE for the sewer force main design will be completed and incorporated into the project basemap through Amendment No.3 of this contract.  No roadway or pedestrian improvements will be required south of SE 172nd St along 125th Ave SE.  The City will update and compile the project specifications, with exception to the bid schedule summary in Section 10 and the Special Provisions in Section 24. Deliverables  95% Design Package Submittal (PDF)  Revised 90% Review Comment Responses (PDF)  95% Design Construction Plans with Soos Creek water and sewer 50% plans as a separate submittal (PDF)  95% Design Special Provisions with Soos Creek specifications (PDF and MS Word document)  95% Design Construction Estimate of Probable Cost (PDF and Excel Spreadsheet)  95% Design Report (PDF) Task 8 Storm and Roadway Design – Final Submittal The Consultant shall provide comment response and make minor updates to the reports and plans based on City’s and Ecology’s comments. The final design plans, estimate and specifications will include the stormwater and roadway improvements along with the water and sewer improvements as separate bid schedules in the combined SE 172nd GSI Project Final Ad-Ready Submittal. Consultant Services  Updates to the Final Design Report will be completed to address City and Ecology comments and meet the grant submittal requirements. Client Responsibility  City to provide one (1) consolidated review comments of the 95% Design submittal by the City and Soos Creek.  Provide updates to the project specifications and compile into a single Ad-Ready PDF. Assumptions  The Cover Sheet, Notes and Abbreviations sheets will be incorporated in the final combined submittal.  Sewer design will be completed through Amendment No. 3 of this contract. The Soos Creek standard plans to be included in an appendix of the project specifications.  The City will update and compile the project specifications, with exception to the bid schedule summary in Section 10 and the Special Provisions in Section 24.  There will only be minor changes to the project design to address review comments of the 95% Design submittal.  A design report of sewer improvements will not be required.  Neither pump station nor SCADA modification will not be required. Printing of hard copy sets will be provided by the City.  Project specifications and bid items will be based on WSDOT standard specifications.  Planting plans will consist of a hatch pattern which defines plant species and planting requirements.  Traffic Control plans are not included in this scope of work. SCHEDULE The overall project design, through construction support, is estimated to cover a 6-month period from January 2024 to June 2024.
