THE CONTRACT IS MODIFIED AS FOLLOWS:
Description of Change:
Contract Provisions:
1.Add the following additional working days to the contract:
Current contract working days including previous change orders (42)
Additional working days (20)
Reason for Change:
1.During the preconstruction meeting the City requested that Active Construction
completed the street one side at a time to limit impacts to businesses and residents for
the 2023 holiday season and allow to keep one side of parking and sidewalks open at all
times during construction.
2.In order to allow the contractor to complete the work in an orderly fashion and due to a
change in circumstances to the original contract, it is mutually agreed that additional
working days are necessary to complete work.

Equitable Adjustment:
This Change Order does/does not include an equitable adjustment per Section 1-09.4 of
the 2023 WSDOT/APWA Standard Specifications. There are no reductions in cost to the
project.
Extension of Time:
The Time for Completion is extended 20 Working Days.

Sections 1-04.4 and 1-04.5 of the 2023 WSDOT/APWA Standard Specifications shall govern
this Change Order. The Work of the referenced Contract is modified to include the changes
detailed herein. The payment provided for herein shall constitute the complete and final
settlement for all costs of labor, equipment, materials, overhead, profit, permit fees, and all
other claims that may be made by the Contractor as a result of this change.
This Power of Attorney limits the acts of those named herein, and they have no authority to
bind the Company except in the manner and to the extent herein stated.

ARTICLE IV – OFFICERS: Section 12. Power of Attorney.
Any officer or other official of the Corporation authorized for that purpose in writing by the Chairman or the President, and subject to such limitation as the Chairman or the
President may prescribe, shall appoint such attorneys-in-fact, as may be necessary to act in behalf of the Corporation to make, execute, seal, acknowledge and deliver as surety
any and all undertakings, bonds, recognizances and other surety obligations. Such attorneys-in-fact, subject to the limitations set forth in their respective powers of attorney, shall
