RESOLUTION NO. 2608
A RESOLUTION OF THE CITY OF RENTON, WASHINGTON,
• APPROVING FINAL PLAT (SCHNEIDER HOMES FP-021-85)
WHEREAS a petition for the approval of a preliminary plat
for the subdivision of a certain tract of land as hereinafter more
particularly described, located within the City of Renton, has
• heretofore been duly approved by the Hearing Examiner; and
WHEREAS after due investigation the Building and Zoning
Department has considered and recommended the approval of said final .
plat and the Hearing Examiner having reviewed the requirements of
the preliminary plat and finding that those requirements have been
met, and such approval being deemed proper and advisable and in the
public interest, NOW THEREFORE
THE CITY COUNCIL OF THE CITY OF RENTON, WASHINGTON, DO
RESOLVE AS FOLLOWS:
SECTION I: The final plat heretofore submitted and approved
by the Hearing Examiner, pertaining to the following described real
estate, to-wit:

Stromberg Rezone An ordinance was read changing the zoning classification of
R-016-85 property located at 901 Sunset Boulevard from Single Family
Resident District (R-1) to Medium Density Multifamily District
(R-3) for Roger Stromberg, File No. R-016-85. MOVED BY
CLYMER, SECONDED BY HUGHES, COUNCIL REFER THIS ORDINANCE
BACK TO COMMITTEE FOR ONE WEEK. CARRIED.
Weapons in Taverns An ordinance was read amending Section 6-189 of Title VI
and Establishments (Police Regulations) of City Code by repealing Subsection
Dispensing Alcoholic (A) 1 . and amending Subsection (C) to require posting of
Beverages a warning notice prohibiting weapons at the entrance to
all liquor dispensing establishments. MOVED BY CLYMER,
SECONDED BY HUGHES, COUNCIL REFER THIS ORDINANCE BACK TO
COMMITTEE FOR ONE WEEK. CARRIED.
Speed Limit An ordinance was read amending Section 10-1201 of Title X
Ordinance (Traffic) of City Code relating to speed limits on City
Streets. MOVED BY CLYMER, SECONDED BY HUGHES, COUNCIL
REFER THIS ORDINANCE BACK TO COMMITTEE FOR ONE WEEK.

Ways and Means Committee Chairman Clymer presented a report
recommending adoption of the following resolution:

Schneider Homes final plat located at 5th and Monroe Avenue NE. (FP-021-85)
Final Plat MOVED BY CLYMER, SECONDED BY HUGHES, COUNCIL ADOPT THE
FP-021-85 RESOLUTION AS READ. CARRIED.
Marine Patrol Ways and Means Committee Chairman Clymer presented a report
Interlocal Agreement recommending concurrence in the staff recommendation to enter
with Mercer Island into this agreement, and authorizing the Mayor and City Clerk
1985 to execute the agreement. MOVED BY CLYMER, SECONDED BY
HUGHES, COUNCIL CONCUR IN THE COMMITTEE REPORT. CARRIED.
Vouchers Ways and Means Committee Chairman Clymer presented a report
recommending approval of Vouchers 7214 through 7494 in the
amount of $1 ,062,062. 14, having received departmental
certification that merchandise/services have been received
or rendered; Vouchers 7229-7237 machine voided. MOVED BY

ADMINISTRATIVE Mayor Shinpoch distributed copies of Resolutions 4656 and
REPORT 4658 adopting 1986 Metro Transit and Water Quality Budgets
Metro Transit (6/6/85) . She noted that the budgets were approved
and Water Quality by a unanimous vote of the Metro Council with one abstention.
Budgets Adopted No transit fare increase was imposed for 1986; an 80C
per month per residence sewer rate increase was approved;
and the reserve account has been reduced to less than $5
million.
Thomas Barr Mayor Shinpoch acknowledged receipt of letter from Gloria
Rezone, R-009-85 Longville Mehrens regarding Thomas Barr Rezone, R-009-85,
denied by the Hearing Examiner on 6/7/85. The appeal
period will extend to 6/21/85, and Councilmembers must
restrict communication with the parties of record in the
event an appeal is filed. (Property on, S. Tobin Street.)

Audience Comment continued
Honey Creek Mayor Shinpoch assured that the Hearing Examiner would
Associates determine whether:changes are of sufficient substance to
R-014-84 and warrant submission of a new application. City Attorney
PPUD-015-84 Warren confirmed that submission of a new application
would be required to the Building & Zoning Department for
review of plans which contain substantial revision. Mr.
Murray referenced a memorandum from Zoning Administrator
Roger Blaylock to Hearing Examiner Fred Kaufman recommending
delay 'of the remand hearing until developers are able to
complete a lot line adjustment. He requested the opportunity
to communicate his objections to that request to the Hearing
Examiner. City Attorney Warren felt that Mr. Murray should
be allowed to correspond with the Hearing Examiner on the
matter. Following further discussion regarding lengthy time
periods which occur between approval of preliminary PUDs
and final approval and construction, it was MOVED BY

Honey Creek Mayor Shinpoch assured that the Hearing Examiner would

PPUD-015-84 Warren confirmed that submission of a new application

review of plans which contain substantial revision. Mr.

delay of the remand hearing until developers are able to

FINDINGS, CONCLUSIONS & DECISION:
Having reviewed the record in this matter, the Examiner now makes and enters the
following:
FINDINGS:
1. The applicant, Schneider Homes, Inc., has requested approval of a final plat on 14.5
acres for 21 lots.
2. The application file containing the application, the State Environmental Policy Act
(SEPA) documentation, the Building and Zoning Department Report, and other
pertinent documents was entered in the record as Exhibit #1.
3. Pursuant to the City of Renton's Environmental Ordinance and SEPA (RCW 43.21C,
1971, as amended), a Declaration of Non-Significance has been issued for the
subject proposal by the Environmental Review Committee (ERC), the responsible
official.
4. Plans for the proposal have been reviewed by all City departments affected by the
impact of this proposal.
5. The subject site is located on the east side of Monroe Avenue N.E. in the vicinity
of N.E. 6th Street.
6. The site is zoned R-1 (Single Family Residential), R-2 (Duplex Residential), and
R-3 (Medium Density Multiple Family Residential). The various zoning categories
were applied with the adoption of Ordinance 3293 in March, 1979.
7. A number of different applications, including prior plats, a special permit, and a
conditional use permit, were approved but permitted to expire by the applicant.
The pending Preliminary Plat was approved in August of 1984 and the Final Planned
Unit Development (FPUD) was approved in February, 1985.
8. The Preliminary Plat required landscaped buffers along all property lines where
dissimilar zoning districts met. The applicant has provided the 25 foot buffers
required in plans submitted for a building permit. Landscaping plans have been
provided together with fencing where such zoning conditions exist. 100 foot
buffers have been provided along the eastern property line, while 25 foot buffers
are provided along the north and south property lines.

9. The plat map indicates that access from the proposed multi-family areas to N.E.
6th Street will be restricted as required in the approval of the Preliminary Plat.
10. The applicant has installed, and the city has approved, most of the required
improvements. As built plans must be submitted. Bonding for first year
maintenance is still necessary.
11. Since the plat includes not only a multiple family complex but a series of single
family lots, the plat map should include a statement that Tract A, the multi-family
parcel, is reserved for multiple family apartment type units. Such notification will
clearly indicate the types of development envisioned for the subject site.
CONCLUSIONS
1. The applicant has apparently satisfied the conditions placed upon the approved
Preliminary Plat, and the current Final Plat would appear to satisfy the goals and
policies of the Comprehensive Plan.
2. A variety of housing types will be provided by the proposed development. The
location encourages infilling in an. area in which utilities are available and
therefore will not burden the city's utility infrastructure.
3. To afford notice of the type of construction proposed for the subject site to
potential residents of the site and the area, the Plat map should indicate that Tract
A is reserved for multiple family apartment type units.
RECOMMENDATION
The City Council should approve the Final Plat subject to the posting of the applicable
bonds and subject to the Plat map indicating that Tract A is reserved for multiple family
apartment type units.

Pursuant to Title IV, Section 3015 of the City's Code, request for reconsideration must be
filed in writing on or before May 23, 1985. Any aggrieved person feeling that the decision
of the Examiner is based on erroneous procedure, errors of law or fact, error in judgment,
or the discovery of new evidence which could not be reasonably available at the prior
hearing may make a written request for review by the Examiner within fourteen (14) days
from the date of the Examiner's decision. This request shall set forth the specific errors
relied upon by such appellant, and the Examiner may after review of the record, take
further action as he deems proper.
An appeal to the City Council is governed by Title IV, Section 3016, which requires that
such appeal be filed with the City Clerk, accompanying a filing fee of $75.00 and meeting
other specified requirements. Copies of this ordinance are available for inspection or
purchase in the Finance Department, first floor of City Hall.
The Appearance of Fairness Doctrine provides that no ex parte (private one-on-one)
li communications may occur concerning land use decisions. This means that parties to a
land use decision may not communicate in private with am/decision-maker concerning the
proposal. Decision-makers in the land use process include both the Hearing Examiner and
members of the City Council.
All communications concerning the proposal must be made in public. This permits all
,interested parties to know the contents of the communication and would allow them to
openly'rebut the evidence. Any violation of this doctrine would result in the invalidation
of the request by the Court.
The Doctrine applies not only to the initial public hearing but to all Requests for
Reconsideration as well as Appeals to the City Council.

2. The Environmental Review Committee has issued a Memorandum of
Concurrence concurring in their original decision of non-significance for the

plat. The Environmental Review Committee made their decision on April 17,
1985, and all appeal periods are now over.

3. The preliminary plat that was approved by the Hearing Examiner on July 14,
1983, contains two basic conditions. The first condition required a
twenty-five (25) foot buffer area against more intense or less intense uses.
The applicant has provided the twenty-five (25) foot buffer along the
northern and southern property lines and approximately a 100 foot buffer,
which also contains recreational uses, along the eastern property line. In
addition, the applicant has provided a six (6) foot high cedar fence along the
northern and southern property lines with a six (6) foot cyclone fence along
the eastern property line. The twenty-five (25) foot buffer is not specifically
shown on the final plat, however, the building plan and landscaping plans
which were approved on April 25, 1985, address that specific buffer as part of
the multiple family residential development. The second condition was that
no access except for emergency vehicles was to be allowed on Olympic
Avenue N.E. A specific provision has bee placed on the face of the plat to
comply.
4. Various city departments have commented: Parks, Policy Development,
Police, Building and Zoning, and the Fire Department have all recommended
approval. The Public Works Department notes minor items which must be
taken care of prior to the actual filing of the plat.
The applicant has gone ahead and constructed the necessary improvements
instead of bonding. In that case, the City is waiting for final acceptance of
the street lighting system which has been installed and the actual streets
upon dedication through the plat. The Utilities Engineering Division notes
that as-built plans for all utilities are still pending, however, easements have
been taken care of at this point.
In a letter dated April 2, 1985, the Engineering Division has requested a
$51,000 maintenance bond as required for any potential problems with the
utilities within the first year. At this point, that bond has not been posted.
However, a bond in the amount of $4,429 has been filed with the Board of
Public Works for deferral of paving on Monroe Avenue N.E. and N.E. 6th
Street.
5. In conclusion, the proposal is consistent with the Comprehensive Plan, the
underlying zoning, and the preliminary plat approval, PP-023-81) which
included two basic conditions.
H. DEPARTMENTAL RECOMMENDATION:
Based upon the above analysis, it is recommended that the final plat, FP-021-85,
be recommended for approval to the City Council.

• Dear Carl:
A final inspection of the above-referenced subdivision was
held on March 19, 1985 and except for a few minor items
which were discussed at the time, all of the physical
improvements were found to be in an acceptable condition.
However, as the multi-family portion of the project is
not yet complete, you will be held responsible for any
damage to the system until it is completed. Also, you
will need to secure separate approval of the lighting sys-
tem from the Traffic Engineering Division. You will need I
to-provide the City with as-built drawings, easements and
any other paper work related to the project which has been
supplied. A one-year maintenance bond in the amount of 1.:i
$51,000, plus a deferral and bond for the paving at Monroe c"
Ave. N.B. and N.E. 6th St. will also be required.
Once all these items have been completed, the City will '
. accept for continual maintenance all the improvements in
j the single-family portion of the subdivision, plus the
improvements installed in Monroe Ave. N.E. A conditional
acceptance will be given for the utilities installed in
the interior of the multi-family portion of the project
until such time as it is completed and a reinspection of
the utilities completed.

Dear Richard:
In response to your letter of March 13, 1985, the City of Renton will continue in the
processing of the final plat request for Schneider Homes as requested. After review of
the RCW, it appears that it is not necessary to notify adjacent property owners in a final
plat situation.
In the matter of the Environmental Checklist. you are correct that a new checklist should
not be required to make a new threshold determination on a continuing project. However,
an Environmental Checklist may be used by the Administrator if it would assist him in his
planning or decision-making. In this specific case I am referring to the issue of."new
information." The law appears very clear in that it includes all new information whether
it is solicited or not. Therefore, it would be our position that the new information could
be generated out of comparing two Environmental Checklist that were requested as
supplemental information in part of the land use planning action.

I am writing on behalf of Schneider Homes, Inc. , which
we represent in connection with the Plat of Hilltop in the
City of Renton. In your letter of March 8 , 1985, to
Group Four, Inc. (a copy of which is enclosed) , you indicate
that the environmental checklist submitted is no longer
valid and that a new one should be submitted. I believe
that your interpretation of the new SEPA rules (WAC
ch. 197-11) is erroneous and that no further environmental
processing is required at this time.
The final Plat of Hilltop has been submitted pursuant
to the preliminary plat approval which was granted by the
City of Renton several years ago. The SEPA threshold deter-
mination process was carried out at the preliminary plat
stage, as it properly should be. The DNS issued at that
time is final and binding and all agencies, unless a reeval-
uation is required under WAC 197-11-600 . SEPA Rules, WAC
197-11-390. Here, no environmental checklist for a new
threshold determination is required at the final plat stage
for the Plat of Hilltop because (1) no substantial change
has been made to the proposal such that it is likely to have
significant adverse impacts, and (2) no new information has
become known indicating the proposal' s probable significant
adverse environmental impacts. See WAC 197-11-600 (2) ;
(3) (b) .

There simply is no need to require an environmeintalt 4 1985
checklist at the final plat stage because a final plat is
not a "proposal" that for the first time suggests some
change in the environment; on the contrary, it is a
preliminary plat that is a "proposal" that must properly be
analyzed for SEPA purposes. See WAC 197-11-760; 197-11-784 .
Consequently, your department should not be requiring any
environmental checklist at the final plat stage.
Furthermore, it is of no importance that the environ-
mental checklist form has changed from that used under the
former SEPA Guidelines (the "red book") . The new SEPA Rules
(the "green book") shall not be applied to invalidate or
require modification of any threshold determination under-
taken or completed before the effective date of the new
procedures. WAC 197-11-916 (2) .
Consequently, I hope you will reconsider your position
on this matter. Both the letter and the spirit of the
"green book" are plain. The required SEPA processing,
including submission of an environmental checklist and a
threshold determination for the Plat of Hilltop, were
properly done at the preliminary plat stage. The proposal
has not changed significantly since that time. I would
therefore appreciate your confirming with me in writing that
no further SEPA review will be required for the plat at this
time.

Introduction The State Environmental Policy Act of 1971, Chapter 43.21C, RCW, requires
all state and local governmental agencies to consider environmental' values both for their

3 . WATER
No streams enter or exit the property, nor does the site lie within any
floodplain.
Absorption would decrease and runoff would increase due to impervious
surfaces created by development . The potential for surface runoff
pollution would be greatest during construction activities . Temporary
siltation control devices should be implemented in drainage channels to
settle particulate matter before stormwater runoff leaves the site.
After construction, pollutants would be mostly debris and oil washed
from the roads . Roadway paving would create about 1.4 acres of
impervious surfaces . Stormwater runoff would be collected by the storm
drainage system and directed to the on-site retention/detention systems
which will limit flow to that discharged prior to development . Catch
basins with petroleum separators would be installed in the storm
drainage system.
4. FLORA
Vegetation on the site is sparce with little overstory or ground cover.
The major coverage is scotch broom, scrub alder, and grasses . Other
trees include douglas firs , magnolia, and some fruit trees . Some of
the second growth coniferous forest still exist along the east property
line. This area is dominated by large mature douglas firs with a salal
undergrowth.
Development will result in a decrease in the numbers of plants ;
although graded areas would be landscaped with species common to
suburban areas . The keeping of lawns and gardens would prevent the
normal re-population of natural species .
No unique, rare or endangered species of flora would be jeopardized nor
would any agricultural lands be reduced by development.
5. FAUNA
The size and present condition of the site would normally preclude
large populations of natural species . Small rodents , reptiles , and
birds likely to inhabit the site would be further reduced by
residential development . Species that can withstand the change of
habitat or are suited to the new habitat would survive in reduced
numbers . Animals displaced from the site would eventually be
eliminated through competitive exclusion. The introduction of house
pets (dogs and cats) would further limited the re-population of natural
species .
To our knowledge, no unique, rare, or endangered species would be
jeopardized by development .

Noise levels would be intermittently high throughout construction, but
should be limited to normal waking hours . After construction,
residential activity and traffic noise would increase ambient noise
levels .

8 . LAND USE
The existing site is undeveloped and uninhabited. To the north and
east of the site are single-family lots . The Renton Voc-Tech Center is
to the west across Monroe Ave. To the south is a mixture of commercial
land and multi-family development . The commercial uses include a gas
station, miscellaneous commercial buildings , General Telephone and a
trailer park.
The site was rezoned with the northerly plus or minus 260 feet from
N.E. 6th St . and designated as R-1. The southerly 150 feet is R-3,
whereas the remainder is R--1. The R-2/R-3 multi-family complex
proposed is considered a conditional use per the City of Renton
Building regulations and as such requires approval.
9 . NATURAL RESOURCES
Development would create short-term increase of the use of resources
such as lumber and gravel. There would be permanent increase in the
use of power and water. The land itself is a rapidly diminishing
resource and development must be considered a long term commitment .
There should be no major depletion of any natural resources .
13 . TRANSPORTATION/CIRCULATION
A. Single Family Lots
Assuming 10 ADT (average daily trips ends) per residence, the proposed
plat would generate approximately 210 average daily vehicular trips (21
x 10 ADT) . Access will be from Monroe Ave. , 6th St . N.E. and two
proposed cul-de-sacs which will both access from 6th. Resident off
street parking would be constructed with each dwelling, but street
shoulders could provide additional space for occasional peak parking
needs . Construction of raised sidewalks along all abutting streets
should minimize hazard to bicyclists and pedestrians .
B. Multiple Family Tracts
Assuming 5 .5 ADT per unit the 156 dwelling units would generate
approximately 8858average daily vehicular trips 156 x 5 .5 ADT) . Access
will be from Monroe Avenue . There should be little cause for increased
hazard to motor vehicles , bicyclists , or pedestrians , considering the
playground, open area, pedestrian walkways and jogging path proposed,
along with a well defined parking and vehicle circulation plan.
14 . PUBLIC SERVICES
Fire protection is provided by the Renton Fire Department . The nearest
stations are located at N.E. Ninth Street and Harrington Avenue N.E.
and 138th Avenue S.E. and S .E. 128th Street.
Police protection is provided by the Renton Police Department , located
at the Renton City Hall .
The site lies within the Renton School District No. 403 and would be
served by the following facilities :
Highlands Elementary School Hazen High School
2727 N.E. Ninth Street 1101 Hoquiam N.E.
McNight Middle School
2600 N.E. 12th Street
Parks within the area include Kiwanis Park and Winsor Hills Park.
Additional demands would be made on libraries , mail-delivery, public
health and other miscellaneous services by new residents .
