EE01703 CASE# 23-10320 OF COLLISION 09/06/23 17:14 OF CbLLI510N NARRATIVE 23-10320 On 09/06/2023 at approximately 1716 hours, I was dispatched to an injury collision in the 1500 block of Benson Road South (JNO Eagle Ridge Drive South), within the City Limits of Renton, County of King, State of Washington. While en route, Dispatch advised of a collision involving a vehicle versus bicyclist with the cyclist down and unable to move his leg. Dispatch advised that the Renton Regional Fire Authority (RRFA) and Medics would be responding. Upon arrival, I observed the cyclist laying in some landscaping just east of the roadway/sidewalk along Benson Road South and being attended to by medical personnel. The cyclist, a juvenile male later identified as MAYER, was communicating but was unable to move his leg. RRFA treated MAYER at the scene and later transported him to Harborview Medical Center (HMC) for further evaluation. The driver of Unit#1 was identified via pictured WADL as GARCIA. The driver of Unit#1 said that prior to the collision, she was traveling northbound in the 1500 block of Benson Road South and was just north of Eagle Ridge Drive South. The driver of Unit#1 admitted to adjusting her radio and may have been distracted, not seeing a bicyclist who was crossing the roadway. The driver of Unit#1 stated she continued northbound and struck the bicyclist in the roadway. The bicyclist (MAYER) stated he was riding his bicycle from Raisbeck Aviation, a route he takes regularly, and was traveling southbound on the sidewalk parallel to Benson Road South and on the west side of roadway. MAYER stated he needed to cross the roadway with the intent to reach the east side of the roadway to get to his residence. MAYER stated that he proceeded to ride his bicycle perpendicular to the roadway and across two lanes of traffic but not at a marked crosswalk. It should be noted that MAYER crossed the roadway in the approximate area of the Altitude Apartments driveway entrance/intersection. MAYER stated that while in the roadway, he was subsequently struck by Unit#1 causing MAYER to be ejected from his bicycle and come to a rest in the landscaping on the east side of the roadway/sidewalk. A witness, identified as Andy Wong, has been added to the police report as a witness who remained at the scene and had spoken with Officer R. Slinkman regarding his account of what occurred. I determined the driver of Unit#1 (GARCIA) to be the predominant factor in the cause of collision. Although MAYER should have crossed at a marked crosswalk, GARCIA did violate RMC 10-12- 25 INATTENTIVE DRIVING: It shall be a traffic infraction, subject to RCW 7.80.120(1)(a), for any person to drive a motor vehicle on any public highway, street, alley, or road in an inattentive manner in the City of Renton. "Inattentive manner" in this section means a lack of: 1) attentiveness required to safely operate the vehicle under the prevailing conditions, including, but not limited to, the nature and condition of the roadway, the weather conditions, the presence of pedestrians, the presence of other traffic, or by the driver focusing or directing the driver's attention to something other than driving the motor vehicle; or 2) attentiveness that would permit the driver of a motor vehicle to observe anything resting on, or traveling on, or entering the roadway in time to take appropriate action as circumstances require. (Ord. 4462, 7-25-94, eff. retroactive to 7-1-94; Ord. 5635, 11-14-11) I believe that had the driver of Unit#1 not been adjusting her vehicle radio controls, and paying full attention to the roadway, this collision may have been avoided. I provided both parties a copy of the Exchange of Information. Unit#1 was able to be driven away from the scene without further incident.
