Subject: Modification request to reduce the planting strip along NE 8th
Street Section & to reduce width of right of Way on NE 8th Street”
Dear Mr. Close,
Following our virtual/tele-conference meeting on September 14, 2023, with “City of Renton
Development Engineering Manager”, Mr. Nathan Janders, we are formally submitting this
Modification request to reduce the planting strip width that reduces the overall right of way
width from 43.5-feet down to 38.5-feet and to eliminate the curb and gutter under this permit
based on conclusion of several studies and group meetings. As we all discussed during the
meeting(s) with Mr. Janders, a modification request would be warranted based on the
parameters (Outlined below):
1-The overall ROW will be reduced to 38.5 feet in lieu of 43.5 feet shown in exhibit “A”
attached (in red-clouded).
2- The amount of dedication will be reduced from 13.5 feet to 8.5 feet
3- Project will provide a 5-feet sidewalk along this property on NE 8th, the remaining 3.5 feet
will be planted with shrubs as landscape buffer for a total of 8.5 feet.
4- construction of curb, gutter, related drainage, and planter strip is waived under this
development and will be done once NE 8th is fully developed by others at a later time, and
under a separate project.
5- City has no objection to leave NE 8th as gravel in front of this property. The owner(s) of this
project will coordinate with the Sierra Homes for further improvements (If any) on the existing
NE 8th easement/access road in accordance with the easement underlying language.
Page2 This modification request is to reduce the width of the right way, consequently the
width of the planting strip along NE 8th Street based on the following justifications and
compliance with the applicable codes:
a. This modification will conform with the purpose of the code, and the necessary
standards for a safe access path for pedestrians.
b. The reduction of the planting strip along NE 8th will NOT cause any situation that will
alter the intend of the street section nor will it cause any detriment to the foot or
vehicular traffic safety or cause any hazardous conditions.
c. This modification request is the minimum adjustment necessary to implement the
required land Use and Community Design Elements. Furthermore, the proposed
modification meets and conforms to the policy directions of the policies and objectives
of the comprehensive plan Land Use Elements and Community Design Element
outlined by the City of Renton
d. The reduction of the planting strip will not have an adverse impact to the neighboring
properties as many of the existing planting strips are about the same width.
e. The proposed modification to reduce the planting strip width, meets the objective and
safety goals of the city standards, supports functionality requirements, maintains
standards of appearance, also meets and exceeds the code-intended environmental
protection and maintainability requirements, that ultimately leads to the highest level of
sound engineering practice and judgments.
f. The proposed modification will satisfy all fire access, all utility access as well as road
drainage to discharge as intended.

Again, we appreciate you looking into the alignment of NE 8th Street, the solutions you had presented is
very workable and we will follow through the design process accordingly.
To summarize our understating, I have outlined the following adjustments related to the width of ROW,
and consequently the reduction on dedications this project will be providing:

Hi Hamid,
I concur with the outlined items 1-5 with the following clarifications:
• The curb and gutter are not waived, instead staff supports a modified street section that does
not include them. Effectively it results in the same thing that they would not need to be
Page6 installed, however, a modification must be applied for in conjunction with the land use
application.
• Engineering has no objection to the offsite private property remaining gravel; however, Renton
Regional Fire Authority may have requirements that must be met and/or the easement may
have specific requirements if it is disturbed. I recommend referring to the pre-construction
notes that fire provided and the easement.
