Is there an opportunity for a variance on this? The lots are around 7000 square feet, and we’re not talking about any massive reductions in size, it’s a matter of inches. In a state where we need more housing, I’m surprised to hear that one of your solutions is to reduce the project? I guess I don’t understand, and it seems like the code could be interpreted di$erently to allow. The issue is that the lot cannot encompass the same area as a setback from the stormwater tract, correct? Why is this? Zach J. In order for a short plat applica8on to be accepted by the City for review, the proposed layout would need to demonstrate compliance with the City’s adopted codes and regula8ons. This includes the minimum lot depth requirement of 80 feet (RMC 4-2-110A), the placement of the stormwater facility within a tract (RMC 4-7-200B), as well as any setback requirements between the stormwater facility and property line. Based on our review, you have two op8ons available to you at this point: 1) redesign the stormwater facility such that the short plat layout would comply with these minimum dimensional requirements; or 2) revise the short plat layout to a two lot short plat. I’ve been digging into this further to see what else possibility I could do. I can go slightly higher with the vault, maybe 6 inches, but I’m s8ll going to come up slightly short here. In an effort to at least keep the storm analysis on the up and up (accoun8ng for frontage bypass, doing a bit of target surface trading, ect.) something will likely need to give here to meet the lot depth minimum and put the vault plus setbacks within a tract. If there any way, maybe through a devia8on of sorts, that could allow for the last 3 feet or so of the required setback be made up of a func8onally equivalent easement? Or would the city rather this be two lots because a setback cannot be within the tract as a result of being a few feet short. Just to revisit the compe8ng codes here and going back to the ‘meet in the middle’ idea. First, if looking at the stormwater requirements, there is an allowance for a vault to be within an easement, and the setback being from an easement line as you noted below. Thus I would consider the stormwater code met. Next, looking at the residen8al subdivision requirement. The requirement is that the vault be located in a dedicated tract. I feel like this has also been met as the vault is indeed located en8rely within a tract. The setback requirement comes from the drainage requirements, which allows for easement. So don’t know if that would have any weight for considera8on. Given the situa8on here though, let me know if it looks like we need to end the project or if there is any hope at a solu8on. I’m following your logic for how you got to the “tract or easement” language that you are referring to in the storm manual however, as this is a residen8al subdivision, this project must also meet all residen8al subdivision code requirements in addi8on to the storm requirements. I agree with Jill that for this project, the proposed vault would need to be fully within a tract so that the residen8al subdivision requirements can be met. Based on your most recent submiJal, I do understand what you are proposing. Unfortunately, the code is explicit in the setback requirements for deten8on vaults sta8ng, “Setbacks to tract/easement lines for vaults shall be 5 feet”. Given the most recent proposal, this is not being met. Moving forward, in looking to meet this criteria, is there a possibility to alter the vault dimensions/depth to meet the setbacks? I haven’t explored if this would work with the grading and conveyance systems but I’m just brainstorming. Let me know if you have any ques8ons about my responses.
