MUNICIPAL
CODE SECTIONS:
RMC 4-9-140, Temporary Use Permits
REFERENCE: N/A
SUBJECT:
Restricted Hours of Operation for Mobile Food Vendors
BACKGROUND: RMC 4-9-240.K.2, Mobile Food Vendors, requires licensed vending
units in the IL, IM, IH, CA, CV and CD zones to vacate their
permitted locations between 12:00 a.m. (midnight) and 5:00 a.m.
on a daily basis, except for a special event where a unit is allowed
at the same location for up to seventy two (72) hours.
Tier I Temporary Use Permits (TUPs) may permit mobile food
vendors in the IL, IM, IH, CA, CV and CD zones, while Tier II TUPs
may allow mobile food vendors to be located outside of the IL, IM,
IH, CA, CV and CD zones.
DECISION:
Regardless of zoning, mobile food vendors are required to vacate
their permitted locations between 12:00 a.m. (midnight) and 5:00
a.m. on a daily basis, except for a special event where a unit is
allowed at the same location for up to seventy two (72) hours.
JUSTIFICATION:
The purpose of requiring mobile food vendors to vacate their
permitted locations is not zone-specific, and was intended to be a
citywide policy.
