The applicant is proposing to enclose an existing
120 square foot deck, and add a staircase on the
outside of the enclosed space. The structure would
be constructed 50 feet landward of the ordinary
high water mark (OHWM) of the Cedar River. The
area of work is located in the urban shoreline
environment, but outside of the required 25-foot
shoreline buffer area.

An exemption from a Shoreline Management Substantial Development Permit is hereby granted
on the proposed project in accordance with RMC 4-3-090L 14 and RMC 4-9-190C7:

.lQL_ Construction on shorelands by an owner, lessee or contract purchaser of a single-
family residence for his/her own use or for the use of his/her family, which residence
does not exceed a height of thirty-five (35) feet above average grade level and which
meets all requirements of the State agency or local government having jurisdiction
thereof, other than requirements imposed pursuant to this chapter.
1. "Single family" residence means a detached dwelling designed for and
occupied by one family including those structures and developments within a
contiguous ownership which are a normal appurtenance. An "appurtenance" is
necessarily connected to the use and enjoyment of a single-family residence
and is located landward of the ordinary high water mark and the perimeter of a
wetland. On a statewide basis, normal appurtenances include a garage; deck;
driveway; utilities; fences: installation of a septic tank and drainfield and grading
which does not exceed two hundred fifty cubic yards and which does not involve
placement of fill in any wetland or waterward of the ordinary highwater mark.
2. Construction authorized under this exemption shall be located landward of
the ordinary high water mark.

Lot is approximately 11,000 sq.ft.

An existing wood deck (12 ft by 10 ft) will be enclosed with a roof and windows. The deck is on
the second story of the house. A stairway will be added from the enclosed deck down to ground
level. Wood fencing, approximately 6 feet high, will be added to extend an existing wood fence
along the east and west property lines.
Basis of Exemption:
The construction is on an existing single family residence for use by the owners.
Anticipated dates of work:
Work on the deck enclosure is estimated to begin in late spring or early summer of 2006, and be
completed by fall of 2006. The other work may be done in summer 2006, or spring/summer of
2007.
Other permits required:
A building permit will be required for the deck and stairs, and if electrical outlets or lighting is
added to the deck enclosure, an electrical permit will be required.
Current and proposed use of site:
Single frunily residence.
Special site features:
The Cedar River is adjacent to the property.
Soil type and drainage:
The soil is generally sandy and rocky, and drains well.

Between $25,000 and $30,000

There may be a small runount of excavation to dig for footings if the existing deck requires
