PURPOSE: To ensure the proposed land division is in accordance with City of Renton's adopted
standards and consistent with the approved Short Plat. In addition, final review is used to verify
compliance with any required conditions.
COMPLETE APPLICATION REQUIRED: In order to accept your application, each of the numbered
items must be submitted at the same time. If you have received a prior written waiver of a submittal
item(s), please provide the waiver form in lieu of any submittal item not provided. All plans and
attachments must be folded to a size not exceeding 8% by 11 inches.
APPLICATION SCREENING: Applicants are encouraged to bring in one copy of the application
package for informal review by staff, prior to making the requested number of copies, colored drawings,
or photo reductions. Please allow approximately 45 minutes for application screening.
APPLICATION SUBMITTAL HOURS: Applications should be submitted to Development Services staff
at the 6th floor counter of Renton City Hall, 1055 South Grady Way, between 8:00 A.M. and 4:00 P.M.
Monday through Friday. An appointment to submit your application is not necessary. Due to the
screening time required, applications delivered by messenger cannot be accepted.

Confirmation of Compliance with all Conditions of Plat Approval: Please provide 5 copies
of a statement detailing how all conditions of plat approval have been addressed.
Plat Certificate or Title Report: Please provide 3 copies of a current Plat Certificate or Title
Report obtained from a title company documenting ownership and listing all encumbrances of the
involved parcel(s). The Title Report should include all parcels being developed, but no parcels
that are not part of the development. If the Plat Certificate or Title Report references any
recorded documents (i.e. easements, dedications, covenants) 5 copies of the referenced
recorded document(s) must also be provided. All easements referenced in the Plat Certificate
must be located, identified by type and recording number, and dimensioned on the Site Plan.

Draft Legal Documents: Please provide 4 copies of any proposed street dedications, restrictive
covenants, draft Homeowners Association, or any other legal documents pertaining to the
development and use of the property.
Additional Requirements for Plats with Private Utility and Access Easements: Short Plats
with parcels requiring access via a private easement shall show the locations and widths of these
proposed utility and access easements. The following two notes shall be included upon the face
of the short plat:
• Declaration of Covenant: The owner of land embraced within this short plat, in return
for the benefits to accrue from this subdivision, by signing hereon covenants and agrees to
convey the beneficial interest in the new easements shown on this short plat to any and all ·
future purchasers of the lots, or of any subdivision thereof. The covenant shall run with the
land as shown on this short plat.
• Private Access and Utilities Maintenance Agreement: New private exclusive
easement for ingress and egress is to be created upon the sate of lots shown on this short
plat. The owners of lots shall have an equal and undivided interest in the ownership
and responsibility for maintenance of the private access easement appurtenances. These
appurtenances and maintenance responsibilities include the repair and maintenance of the
private access road, drainage pipes, and storm water quality and/or detention facilities within
this easement, private signage, and other infrastructure not owned by the City of Renton or
other utility providers. Maintenance costs shall be shared equally. Parking on the paving in
the access easement is prohibited, unless pavement width is greater than 20 feet. (NOTE:
If only one lot is subject to the agreement, contact the Public Works Department at
425-430-7235 for special language.)
Aquifer Protection Notice: For Short Plats within either of the Aquifer Protection Zones, the
following notice must be included upon the face of the short plat:
The lots created herein faff within Zone (1 or 2) of Renton's Aquifer Protection Area and
are subject to the requirements of the City of Renton Ordinance #4367. This City's sole
source of drinking water is supplied from a shallow aquifer under the City surface. There
is no natural barrier between the water table and ground surface. Extreme care should
be exercised when handling of any liquid substance, other than water, to protect from
contact with the ground surface. It is the homeowners' responsibility to protect the City's
drinking water.
Density Worksheet: Please submit 5 copies of a completed density worksheet for all residential
projects.
Short Plat Plan for Recording: Please provide 3 copies of a fully-dimensioned plan prepared
by a State of Washington registered professional land surveyor, drawn at a scale of 1" = 40' on
an 18" x 24" plan sheet (or other size or scale approved by the Development Services Division)
and including the following information:
• Name of the proposed plat
• In the upper right hand corner include the City land use file number (e.g. LUA02-037)
and below in smaller font, the city LND number provided by the property services
section (e.g. LND _____ ~
• Name and address of the licensed land surveyor/engineer
• Legal description of the property to be subdivided
• Date, graphic scale, and north arrow oriented to the top of the paper/plan sheet
• Location and dimensions of all property lines including the square footages
of each lot
• Location of the subject site with respect to the nearest street intersections
(including driveways and/or intersections opposite the subject property),
alleys and other rights of way
• Names, locations, types, widths and other dimensions of existing and
proposed streets alleys, easements, parks, open spaces and reservations

• Data sufficient to readily determine and reproduce on the ground the location,
bearing and length of every street, easement line, lot line and boundary line on site.
Dimensions shall be to the nearest one-hundredth (1/100) of a foot, angles,
bearing, degrees, minutes and seconds. All measurements and bearings shall
be mathematically correct
• Coordinates shall be included per City of Renton surveying standards for
permanent control monuments
• Location and dimensions of all easements referenced in the plat certificate with
the recording number and type of easement (e.g .. access, sewer, etc.) indicated
• Location and dimensions of any existing structures to remain within or
abutting the. plat
• Location of existing conditions on or adjacent to the site, which could hinder
development.
Certifications:
• Certification by a licensed land surveyor that a survey has been made
and that monuments and stakes will be set

requirements of 4-8-120D.
Wetland Mitigation Plan: (Only for projects with wetlands). Please provide 3 copies of a Final
Mitigation Plan meeting the requirements of RMC 4-8-120D.

Monument Cards: When a monument(s) is installed as part of the project, please provide
2 copies of a form obtained from the City Technical Services Division and filled out by a surveyor
providing information regarding a single monument, including the Section, Township and Range,
method of location, type of mark found or set, manner of re-establishment of the single
monument (if applicable}, description, and a drawing showing the location of a single monument
and indicating a reference point to that monument.
Proof of Improvement Deferral or Installation: Please provide 4 copies of the Improvement
Deferral Form located in the Customer Service Center on the 61
" Floor of Renton City Hall. Any
deferrals of improvements must be approved by the Development Services Director prior to the
recording of the short plat.
Deed of Right-of-Way Dedication: If any public right-of-way is required for your project, please
provide 4 copies of a draft deed of right-of-way dedication

REVIEW PROCESS: Once the final short plat information is submitted to the Development Services
Division, the materials will be routed to those City departments having an interest in the application.
Reviewers have approximately two weeks to return their comments to the Development Services
Division. All comments and any requests for revisions will be sent to the applicant. Once all comments
have been addressed, the applicant re-submits the revised plans and/or documents for review.
As part of the review process, the Development Services Division will ensure improvements have been
installed and approved and that all conditions of the short plat approval have been met. Once the
applicant has demonstrated these items have been addressed through either a confirmation of
improvement installation approval or letter of deferral, the City will send a written request for the final
mylar, courier fees and any associated legal documents. Once all of the City's required approval
signatures have been obtained, the City will transmit the mylar via courier to King County for recording.
The entire recording process typically takes four weeks to complete. However, the time frame for getting
a short plat recording is largely dependent upon application completeness and prompt turnaround time
for revisions. Lots cannot legally be sold until the Short Plat has received its recording number.
DEFERRAL OF IMPROVEMENTS: If a developer wishes to defer certain on-site or off-site
improvements (i.e. landscaping, curbs and sidewalks), written application with full and complete
engineering drawings must be submitted to the Development Services Division. The application should
explain the reasons why such delay is necessary. If approval is granted, security in the form of an
irrevocable letter of credit, set-aside fund, assignment of funds, certified check or other type of security
acceptable to the City shall be furnished to the City in an amount equal to a minimum of 150% of the
estimated cost of the required improvements. The security must be submitted prior to the recording of
the short plat.
DEDICATION OF RIGHT OF WAY: If right-of-way dedication is required for the short plat, separate
application for City approval is required. The associated deed of right-of-way dedication must be
approved by City Council prior to recording of the short plat. This process may take six weeks, so early
application is encouraged.

Confirmations of Compliance with all conditions of the Plat Approval as requested are listed below:
Note the City of Renton land use action number and land record number, LUA-06-069-SHP and
LND-20-0456, respectively, on the drawing. The type size used for the land record number should
be smaller than that used for the land use action number. This has been changed and is on the
plan sheets.
Show two ties to the City of Renton Survey Control Network, or tie by reference. Add the
following (if tying by reference) to the "NOTES" block on Sheet 1 of 2: "FOR TIES TO THE
CITY OF RENTON SURVEY CONTROL NETWORK PER CITY OF RENTON LOT LINE
ADJUSTMENT, KING COUNTY, RECORDING NO. 20041223000856" or other recorded
document. This has been done and is on the plan sheets.
Note all easements, covenants and agreements of record on the drawings. Done

SCHEDULE OF EXCLUSIONS FROM COVERAGE OF THIS GUARANTEE
1. Except to the extent that specific assurance are provided in Schedule A of this Guarantee, the Company assumes no liability for loss or damage by reason of the following:
(a) Defects, liens, encumbrances, adverse claims or other matters against the title, whether or not shown by the public records.
(b) (1) Taxes or assessments of any taxing authority that levies taxes or assessments on rear property; or, (2) Proceedings by a public agency which may result in taxes
or assessmen1:5, or notices of such proceedings, whether or not the matters excluded under (1) or (2) are shown by the records of the taxing authority or by the publlc
records.
(c) (1) Unpatented mining claims; (2) reservations or exceptions In patents or in Acts authorizing the Issuance thereof; (3) water rights, claims or title to water, whether
or not the matters excluded under (1), (2) or {3) are shown by the public records.
2. Notwithstanding any specific assurances which are provided in Schedule A of this Guarantee, the Company assumes no liability for loss or damage by reason of the
following:
(a) Defects, liens, encumbrances, adverse claims or other matters affecting the title to any property beyond the lines of the land expressly described in the description set
forth in Schedule (A), (C) or in Part 2 of this Guarantee, or tltle to streets, roads, avenues, lanes, ways or waterways to which such land abuts, or the right to maintain therein
vaults, tunnels, ramps, or any structure or improvements; or any rights or easements therein, unless such property, rights or easements are expressly and specifically set forth
in said description.
(b) Defects, liens, encumbrances, adverse claims or other matters, whether or not shown by the public records; (1) which are created, suffered, assumed or agreed to by
one or more of the Assureds; (2) which result in no loss to the Assured; or (3) which do not result in the invalidity or potential invalidity of any judicial or non-judicial
proceeding which is within the scope and purpose of the assurances provided.
(c) The identity of any party shown or referred to in Schedule A.
(d) The validity, legal effect or priority of any matter shown or referred to in this Guarantee.
GUARANTEE CONDITTONS AND STIPULATIONS
1. Definition of Terms,
The following terms when used in the Guarantee mean:
(a) the "Assured": the party or parties named as the Assured in this Guarantee, or
on a supplemental writing executed by the Company.
(b) "land": the land described or referred to in Schedule (A} (C) or in Part 2, and
improvements affixed thereto which by law constitute real property. The term "land"
does not include any property beyond the lines of the area described or referred to in
Schedule (A) (C) or in Part 2, nor any right, title, interest, estate or easement in
abutting streets, roads, avenues, alleys, lanes, ways or waterways.
(c) "mortgage": mortgage, deed of trust, trust deed, or other security instrument.
(d) "public records" : records established under state statutes at Date of
Guarantee for the purpose of Imparting constructive nobce of matters relating to real
property to purchasers for value and without knowledge.
(e) "date": the effective date.
2, Notice of Claim to be Given by Assured Claimant.
AA Assured shall notlfy the Company promptly In writing in case knowledge shall
come to an Assured hereunder of any claim of title or interest which is adverse to the
title to the estate or Interest, as stated herein, and which might cause loss or damage
for which the Company may be liable by virtue of this Guarantee. If prompt notice
shall not be given to the Company, then all liability of the Company shall terminate
with regard to the matter or matters for which prompt notice is required; provided,
however, that failure to notify the Company shall in no case prejudice the rights of
any Assured under this Guarantee unless the Company shall be prejudiced by the
failure and then only to the extent of the prejudice.
3. No Duty to Defend or Prosecute.
The Company shall have no duty to defend or prosecute any action or proceeding to
which the Assured Is a pat't).', notwithstanding the nature of any allegation in such
action or proceeding.
4. Company's Option to Defend or Prosecute Actions; Duty of Assured
Claimant to Cooperate.
Even though the Company has no duty to defend or prosecute as set forth in
Paragraph 3 above:
(a) The Company shall have the right, at its sole option and cost, to institute and
prosecute any action or proceeding, Interpose a defense, as limtted in {b), or to do
any other act which in its opinion may be necessary or desirable to establish the title
to the estate or interest as stated herein, or to establish the lien rights of the
Assured, or to prevent or reduce loss or damage to the Assured. The Company may
take any appropriate action under the terms of this Guarantee, whether or not it shall
be liable hereunder, and shall not thereby concede liability or waive any provision of
this Guarantee. If the Company shall exercise its rights under this paragraph, it shall
do so dlligently.
(b) If the Company elects to exercise its options as stated in Paragraph 4(a} the
Company shall have the right to select counsel of its choice (subject to the right of
such Assured to object for reasonable cause) to represent the Assured and shall not
be liable for and will not pay the fees of any other counsel, nor will the Company pay
any fees, costs or expenses incurred by an Assured in the defense of those causes of
action which allege matters not covered by this Guarantee.
(c) Whenever the Company shall have brought an action or interposed a defense
as permitted by the provisions of this Guarantee, the Company may pursue any
litigation to final determination by a court of competent jurisdlction and expressly
reserves the right, in its sole discretion, to appeal from an adverse judgment or order.
(d) In all cases where this Guarantee permits the Company to prosecute or
provide for the defense of any action or proceeding, an Assured shall secure to the
Company the right to so prosecute or provide for the defense of any action or
proceeding, and all appeals therein, and permit the Company to use, at its option, the
name of such Assured for this purpose. v..thenever requested by the Company, an
Assured, at the Company's expense, shall give the Company all reasonable aid in any
action or proceeding, securing evidence, obtaining witnesses, prosecuting or
defending the action or lawful act which in the opinion of the Company may be
necessary or desirable to establish the title to the estate or interest as stated herein,
or to establish the lien rights of the Assured. If the Company is prejudiced by the
failure of the Assured to furnish the required cooperation, the Company's obligations
to the Assured under the Guarantee shall terminate.
5. Proof of Loss or Damage.
In addition to and after the notices required under Section 2 of these Conditions and
Stipulations have been provided to the Company, a proof of loss or damage signed
and sworn to by the Assured sha/1 be furnished to the Company within ninety (90)
days after the Assured shall ascertain the facts giving rise to the loss or damage. The
proof of loss or damage shall describe the matters covered by this Guarantee which
constitute the basis of loss or damage and shall state, to the extent possible, the
basis of calculating the amount of the loss or damage. If the Company is prejudiced
by the failure of the Assured to provide the required proof of loss or damage, the
Company's obligation to such Assured under the Guarantee shall terminate. In
addition, the Assured may reasonabty be required to submit to examination under
oath by any authorized representative of the Company and shall produce for
examination, inspection and copying, at such reasonable times and places as may be
designated by any authorized representative of the Company, all records, books,
ledgers, checks, correspondence and memoranda, whether bearing a date before or
after Date of Guarantee, which reasonab~ pertain to the loss or damage. Further, if
requested by any authorized representative of the Company, the Assured shall grant
its permission, in writing, for any authorized representative of the Company to
examine, inspect and copy all records, books, ledgers, checks, correspondence and
memoranda in the custody or control of a third party, which reasonably pertain to the
Loss or Damage. All information designated as confidential by the Assured provided
to the Company, pursuant to this Section shall not be disclosed to others unless, in
the reasonable judgment of the Company, it is necessary in the administration of the
claim. Failure of the Assured to submit for examlnabon under oath, produce other
reasonably requested information or grant permission to secure reasonably necessary
information from third parties as required in the above paragraph, unless prohibited
by Jaw or governmental regulation, shall terminate any liability of the Company under
this Guarantee to the Assured for that claim.

6, Options to Pay or Otherwise Settle Claims: Termination of Liability.
In case of a claim under this Guarantee, the Company shall have the following
additional options:
(a) To Pay or Tender Payment of the Amount of liability or to Purchase the
Indebtedness.
The Company shall have the option to pay or settle or compromise for or in the name
of the Assured any claim which could result in loss to the Assured within the coverage
of this Guarantee, or to pay the full amount of this Guarantee or, if this Guarantee is
issued for the benefit of a holder of a mortgage or a lienholder, the Company shall
have the option to purchase the indebtedness secured by said mortgage or said lien
for the amount owing thereon, together with any costs, reasonable attorneys' fees and
expenses incurred by the Assured claimant which were authorized by the Company up
to the time of purchase.
Such purchase, payment or tender of payment of the full amount of the Guarantee
shall terminate all liability of the Company hereunder. In the event after notice of
claim has been given to the Company by the Assured the Company offers to purchase
said indebtedness, the owner of such indebtedness shall transfer and assign said
indebtedness, together with any collateral security, to the Company upon payment of
the purchase price.
Upon the exercise by the Company of the option provided for in Paragraph (a) the
Company's obligation to the Assured under this Guarantee for the claimed loss or
damage, other than to make the payment required in that paragraph, shall terminate,
including any obligation to continue the defense or prosecution of any litigation for
which the Company has exercised its options under Paragraph 4, and the Guarantee
shall be surrendered to the Company for cancellation.
(b) To Pay or otherwise Settle With Parties other Than the Assured or With the
Assured Claimant.
To pay or otherwise settle with other parties for or in the name of an Assured claimant
any claim Assured against under this Guarantee, together with any costs, attorneys'
fees and expenses incurred by the Assured claimant which were authorized by the
Company up to the time of payment and which the Company is obligated to pay.
Upon the exercise by the Company of the option provided for in Paragraph (b) the
Company's obligation to the Assured under this Guarantee for the claimed loss or
damage, other than to make the payment required in that paragraph, shall terminate,
including any obligation to continue the defense or prosecution of any litigation for
which the Company has exercised its options under Paragraph 4.
7. Determination and Extent of Liability.
This Guarantee is a contract of Indemnity against actual monetary loss or damage
sustained or Incurred by the Assured claimant who has suffered loss or damage by
reason of reliance upon the assurances set forth in this Guarantee and only to the
extent herein described, and subject to the Exclusions From Coverage of This
Guarantee.
The Liability of the Company under this Guarantee to the Assured shall not exceed the
least of:
(a) the amount of liability stated in Schedule A or in Part 2;
(b) the amount of the unpaid principal indebtedness secured by the mortgage of an
Assured mortgagee, as limited or provided under Section 6 of these Conditions and
Stipulations or as reduced under Section 9 of these Conditions and Stipulations, at the
time the loss or damage Assured against by this Guarantee occurs, together with
interest thereon; or
(c) the difference between the value of the estate or interest covered hereby as
stated herein and the value of the estate or interest subject to any defect, !ien or
encumbrance Assured against by this Guarantee.
8. Limitation of Liability.
(a) If the Company establishes the titie, or removes the alleged defect, lien or
encumbrance, or cures any other matter Assured against by this Guarantee in a
reasonably diligent manner by any method, including litigation and the completion of
any appeals therefrom, it shall have fully performed its obligations with respect to that
matter and shall not be liable for any loss or damage caused thereby.
(b) In the event of any litigation by the Company or with the Company's consent,
the Company shall have no liability for loss or damage until there has been a final
determination by a court of competent jurisdiction, and disposition of all appeals
therefrom, adverse to the title, as stated herein.
(c) The Company shall not be liable for loss or damage to any Assured for liabll\ty
voluntarily assumed by the Assured in settling any claim or suit without the
prior written consent of the Company.
9. Reduction of Liability or Termination of Liability.
All payments under this Guarantee, except payments made for costs, attorneys' fees
and expenses pursuant to Paragraph 4 shall reduce the amount of liability pro tanto.
10. Payment of Loss.
(a) No payment shall be made without producing this Guarantee for endorsement
of the payment unless the Guarantee has been lost or destroyed, in which case proof
of loss or destruction shall be furnished to the satisfaction of the Company.
(b) When liability and the extent of loss or damage has been definitely fixed in
accordance with these Conditions and Stipulations, the loss or damage shall be
payable within thirty (30) days thereafter.
11. Subrogation Upon Payment or Settlement.
Whenever the Company shall have settled and paid a claim under this Guarantee, all
right of subrogation shall vest in the Company unaffected by any act of the Assured
claimant.
The Company sha!I be subrogated to and be entitled to all rights and remedies which
the Assured would have had against any person or property in respect to the claim had
this Guarantee not been issued. If requested by the Company, the Assured shal!
transfer to the Company all rights and remedies against any person or property
necessary in order to perfect thls right of subrogation. The Assured shall permit the
Company to sue, compromise or settle in the name of the Assured and to use the
name of the Assured in any transaction or litigation involving these rights or remedies.
If a payment on account of a claim does not fully cover the loss of the Assured the
Company shall be subrogated to all rights and remedies of the Assured after the
Assured shall have recovered its principal, interest, and costs of collection.
12. Arbitration.
Unless prohibited by applicable law, either the Company or the Assured may demand
arbitration pursuant to the TrtJe Insurance Arbitration Rules of the American Arbitration
Association. Arbitrable matters may include, but are not limited to, any controversy or
claim between the Company and the Assured arising out of or relating to this
Guarantee, any service of the Company in connection with its issuance or the breach
of a Guarantee provision or other obligation. All arbitrable matters when the Amount
of Liability is $1,000,000 or less shall be arbitrated at the option of either the Company
or the Assured. All arbitrab!e matters when the amount of liability is in excess of
$1,000,000 shall be arbitrated only when agreed to by both the Company and the
Assured. The Rules in effect at Date of Guarantee shall be binding upon the parties.
The award may include attorneys' fees only if the laws of the state in which the land is
located permits a court to award attorneys' fees to a prevailing party. Judgment upon
the award rendered by the Arbitrator(s) may be entered in any court having
jurisdiction thereof.
The law of the situs of the land shall apply to an arbitration under the Title Insurance
Arbitration Rules.
A copy of the Rules may be obtained From the Company upon request.
13. Liability Limited to This Guarantee; Guarantee Entire Contract.
(a) This Guarantee together with all endorsements, if any, attached hereto by the
Company is the entire Guarantee and contract between the Assured and the
Company. In interpretlng any provision of this Guarantee, this Guarantee shall be
construed as a whole.
{b) Any claim of loss or damage, whether or not based on negligence, or any action
asserting such claim, shall be restricted to this Guarantee.
(c) No amendment of or endorsement to this Guarantee can be made except by a
writlng endorsed hereon or attached hereto signed by either the President, a Vice
President, the Secretary, an Assistant Secretary, or validating officer or authorized
signatory of the Company.
14. Notices, Where Sent.
All notices required to be given the Company and any statement in writing required to
be furnished the Company shall include the number of this Guarantee and shall be
addressed to the Company at 2 First American Way. Bldg. 2, Santa Ana, CA. 92707.

1. Project Description/Background
The applicant, Nicole Hernandez of W&H Pacific, is proposing to subdivide a 13.2-acre (575,055 square foot)
parcel zoned Urban Center -North 1 (UC-N1) into two lots. The property is located south of N 1 o'" Street,
west of Garden Avenue N, North of N a'" Street, and east of Park Avenue N. Proposed lot sizes are: Lot 1 at
228,261 sq. ft. and Lot 2 at 346,794 sq. ft. Access to the proposed lots would be provided via N 101
h Street,
Garden Avenue N, N 8th Street, or Park Avenue N.
2. Environmental Review
Except when located on lands covered by water or sensitive areas, short plats are exempt from SEPA
Environmental Review pursuant to WAC 197-11-800(6)(a).
3. Compliance with ERC Conditions

4. Staff Review Comments
Representatives from various city departments have reviewed the application materials to identify and address
issues raised by the proposed development. These comments are contained in the official file, and the essence
of the comments has been incorporated into the appropriate sections of this report and the Departmental
Recommendation at the end of the report.
5. Consistency Short Plat Criteria
Approval of a plat is based upon several factors. The following short plat criteria have been established to
assist decision-makers in the review of the plat:
a) Compliance with the Comprehensive Plan Designation
The site is designated Urban Center North (UCN) on the Comprehensive Plan Land Use Map. The
purpose of the UC-N is to redevelop industrial land for new office, residential, and commercial
uses at a sufficient scale to implement the Urban Centers criteria adopted in the Countywide
Planning Policies. This portion of the Urban Center is anticipated to attract large-scale
redevelopment greater than that in the Urban Center-Downtown, due to the large available land
holdings under single ownership. In addition, this new development is expected to include a wider
group of uses including remaining industrial activities, new research and development facilities,
laboratories, retail integrated into pedestrian-oriented shopping districts, and a range of urban-
scale mixed-use residential, office and commercial uses. The combined uses will generate
significant tax income for the City and provide jobs to balance the capacity for the more than 5,000
additional households in the Uroan Center. The proposal is consistent with the following
Comprehensive Plan Land Use Element policies:
Policy LU-272. Support uses that serve the region, a sub-regional, or citywide market as well as
the surrounding neighborhoods.
The proposed short plat would create two parcels, which are proposed to Ile developed with
commercial/retail structures as specified under the Landing Master Plan (File No. LUA05-136).
The implementation of the Landing Master Plan would create a development, which would serve at
a minimum the surrounding neighoorhoods and possillly an even larger market.

Policy LU-280. Use a hierarchy of conceptual plan, master plan and site plan review and approval
to encourage the cohesive development of large land areas within the Urban Center-Norlh.
Incorporate integrated design regulations into this review process.
The subject property was previously reviewed under the Landing Master Plan and is proposed to
be developed with commercial/retail structures. Prior to the issuance of building permits
Administrative Site Plan approval will be required.
Policy LU-281. Address the mix and compatibility of uses, residential density, conceptual building,
site and landscape design, identification of gateway features, signs, circulation, transit
opporlunities, and phasing through master plan and site plan review process.
These issues will all be addressed through the site plan review process. The subject property was
a part of the Landing Master Plan that has been completed. An Administrative Site Plan Review of
the proposed structures will be required prior to the issuance of any building permits.
b) Compliance with the Underlying Zoning Designation
The subject site is designated Urban Center -North 1 (UC-N1) on the City of Renton Zoning Map.
The proposed development would allow for the future construction of a commercial development
on the subject property.
The allowed density range in the UC-N 1 zone is a minimum of 20 (unless a mixed use
development is proposed) to a maximum of 85 dwelling units per acre. Density for flats may be
increased up to 150 dwelling units per net acre provided that ground-floor commercial uses are
incorporated into the structure. Net density is calculated after the deduction of sensitive areas,
areas intended for public right-of-way, and private access easements. No residential units are
proposed on the subject property; therefore this section does not apply.
The allowed building lot coverage in the UC-N1 zone is 90 percent of the total lot area or 100
percent if parking is provided within the building or within a parking garage. The lot coverage for
the new lots would be verified at the time of Site Plan review.
The required setbacks in the UC-N1 zone are as follows: the minimum front yard and side yard
along a street setbacks are O feet and the maximum front yard and side yard along a street
setbacks are 5 feet, no interior side or rear yard setbacks are required. The setbacks for the
proposed lots would be verified at the time of Site Plan review.
The parking regulations require a minimum number of spaces depending on the use proposed.
Along a pedestrian-oriented street parking may not be located between the proposed building
associated with the parking and pedestrian-oriented public streets unless located within a
structured parking garage. On other arterials, local streets, and internal streets parking shall be
located consistent with RMC 4-3-100E1 Urban Center Design Overlay Regulations. Compliance
with the parking requirements will be verified at the time of Site Plan review.
c) Community Assets
The subject property was previously used as a parking lot; there is no vegetation on the property.
The City's landscaping regulations require the installation of landscaping within all required setback
areas along a street frontage. Additional landscaping is required within surface parking lots based
on the number of parking spaces provided. The landscaping proposed shall either consist of
drought resistant vegetation or shall be irrigated appropriately. Compliance with the landscaping
requirements will be reviewed at the time of Site Plan review.
d) Compliance with Subdivision Regulations
Streets: No new public streets would be created as part of the proposed short plat.
The subject property has frontage along N 101

improvements will be installed at a later date under other permits.
Blocks: No new blocks will be created as part of the proposed short plat.

Lots: The size, shape, orientation, and arrangement of the proposed lots comply with the
requirements of the Subdivision Regulations and the development standards of the UC-N1 zone.
Each lot is roughl~ rectangular in shape. Both of the proposed lots provide direct access to a
public street (N 1 O Street, Park Avenue N, N a'h Street, or Garden Avenue N).
The minimum lot size in the UC-N1 zone is 25 acres, however the minimum lot size can be
amended through Site Development Plan Review under RMC 4-9-200. The subject property was
included in the Landing Master Plan (LUA05-136) that was approved May 19, 2006. Under the
approved Master Plan, it was indicated that a commercial/retail development would occupy the
subject property. The proposed subdivision would further the implementation of the approved
Master Plan, therefore per the approved Master Plan lot sizes less than 25 acres in area may be
permitted on the property. Proposed Lot 1 would be 228,261 square feet (5.24 acres) in area and
proposed Lot 2 would be 246,794 square feet (7.96 acres) in area.
There is no minimum lot width or depth required in the UC-N 1 zone. Proposed Lot 1 has a lot
width of 325 feet and lot depth of 745 feet. Lot 2 has a lot width of 390 feet and a lot depth of 840
feet. The dimensions of the proposed lots meet the minimum width and depth requirements and
are compatible with other existing lots in this area under the same UC-N1 zoning classification. In
addition, both lots appear to contain adequate building areas for the construction of the proposed
commercial/retail development when taking setbacks and lot coverage requirements into
consideration. These requirements will be reviewed at the time of Site Plan review.
e) Reasonableness of Proposed Boundaries
Access: Each lot would have direct access to a public right-of-way (N 10'" Street, Park Avenue N,
N a'" Street, and Garden Avenue N) via driveway entrances.
Topography: The topography of the subject site is flat.
Relationship to Existing Uses: The properties surrounding the subject site are commercial and
industrial uses designated Urban Center -North 1 (UC-N 1) on the City's zoning map. The
proposal is similar to existing development patterns in the area and is consistent with the
Comprehensive Plan, Zoning Code, and The Landing Master Plan {LUA05-136).
f} Availability and Impact on Public Services (Timeliness)
Police and Fire: Police and Fire Prevention staff indicate that sufficient resources exist to furnish
services to the proposed development, subject to the installation of Code required improvements
and the payment of fees.
H. Findings:
Storm Water: No stormwater improvements will be installed with this short plat. All stormwater
improvements will be installed at a later date under separate permits. The Surface Water System
Development Charges will be assessed prior to the issuance of building permits.
Utilities: No utility related improvements will be required to be installed under this short plat. All
utility related improvements will be installed at a later date under separate permits. The Water and
Sewer System Development Charges will be assessed and paid prior to the issuance of building
permits.
Having reviewed the written record in the matter, the City now enters the following:
1. Request: The applicant has requested Administrative Short Plat Approval for the Landing Lot 3 Short
Plat, File No. LUA-06-069, SHPL-A.
2. Application: The applicant's short plat application complies with the requirements for information for
short plat review. The applicant's short plat plan and other project drawings are contained within the
official land use file.
3. Comprehensive Plan: The subject proposal is consistent with the Comprehensive Plan designation
of the Urban Center North (UCN) land use designation.

4. Zoning: The proposal as presented complies with the zoning requirements and development
standards of the Urban Center -North 1 (UC-N1) zoning designation, provided all advisory notes and
conditions of approval are complied with.
5. A lot size of less than 25 acres is permitted as the subject property was reviewed under The Landing
Master Plan (LUA05-136).
6. Subdivision Regulations: The proposal complies with the requirements established by the City's
Subdivision Regulations provided all advisory notes and conditions are complied with.
7. Existing Land Uses: Land uses surrounding the subject site include: North: N 1 o'h Street (zoned UC-
N1 ); East: Garden Avenue N (zoned UC-N1 ); South: N 81h Street (zoned UC-N1 and IH); and West:
Park Avenue N (zoned UC-N1).
8. Setbacks: The setbacks for future development would be reviewed during the Site Plan review
process.
9. System Development Charges: A Water System Development Charge, a Surface Water System
Development Charge and a Sewer System Development Charge, at the current applicable rates, will
be required for the proposed development.
10. Public Utilities: Utility improvements will be installed at a later date under separate permits.
I. Conclusions:
1. The subject site is located in the Urban Center North (UCN) comprehensive plan designation and
complies with the goals and policies established with this designation.
2. The subject site is located in the Urban Center -North 1 zoning designation and complies with the
zoning and development standards established with this designation provided all advisory notes and
conditions are complied with.
3. The proposed short plat would create two lots less than 25 acres in area, which may be permitted as
the site was reviewed under the approval Landing Master Plan (LUA05-136).
4. The proposed two lot short plat complies with the subdivision regulations as established by city code
and state law provided all advisory notes and conditions are complied with.
5. The proposed two lot short plat complies with the street standards as established by City Code,
provided the project complies with all advisory notes and conditions of approval contained herein.
J. DECISION:
The Landing Lot 3 Short Plat, File No. LUA-06-066, SHPL-A, is approved.

The administrative land use decision will become final if the decision is not appealed within 14 days of the effective date of
decision. An appeal of the decision must be filed within the 14-day appeal period (RCW 43.21.C.075(3); WAC 197-11-680).
RECONSIDERATION. Within 14 days of the effective date of the decision, any party may request that a decision on a short plat
be reopened by the Administrator. The Administrator may modify his decision if material evidence not readily discoverable prior to
the original decision is found or if he finds there was misrepresentation of fact. After review of the reconsideration request, if the
Administrator finds insufficient evidence to amend the original decision, there will be no further extension of the appeal period. Any
person wishing to take further action must file a formal appeal within the following appeal timeframe.
APPEAL This administrative land use decision will become final if not appealed in writing to the
Hearing Examiner on or before 5:00 PM on July 13, 2006. Appeals to the Examiner are governed by City of
Renton Municipal Code Section 4-8-110. Additional information regarding the appeal process may be obtained from the Renton
City Clerk's Office, (425) 430-6510. Appeals must be filed in writing, together with the required $75.00 application fee, to: Hearing
Examiner, City of Renton, 1055 South Grady Way, Renton, WA 98055.

Format and Legal Description Review
Bob Mac Onie and I have reviewed the above referenced short plat submittal and have the
following conunents:
Comments for the Applicant:
Boeing Binding Site Plan Tract "N" was part of Lot 3A when said Lot was established per City of
Renton Lot Line Adjustment No. LUA-06-068-LLA, under Rec. No. 20041223000856. Said
tracts can be shown as part of this short plat request if the following occurs:
1) If said tract is to remain on the short plat submittal, it needs to be referenced as in
the legal description (Sheet 1 of 2), and the City of Renton needs to be a party to and
a signatory of the short plat (Sheet I of 2).
2) If said tract "N" is vacated the legal description would need to be modified to
include the Tract i.e. "TOGETHER WITH VACATED TRACT ... "including the
recording of the vacation Ordinance.
The tract may be shown on the short plat but cannot be included within the boundary of Lot
1 unless either of the two options above has been met.
The indexing information noted on both short plat drawing sheets is incorrect -the "RGE" should
be 2., not "3". "DELAWARE" is misspelled on sheet 1.
NOTE: The legal description included in the First American Title Insurance Company
Subdivision Guarantee document, Order No. NCS-229509-WAI, dated April 14, 2006, is out-of-
date. The subject property is described therein as "Lots 2 and 3 Boeing Lakeshore Landing,
Binding Site Plan," etcetera rather than the legal description shown on the short plat.

Item No. 8 under "RECORD MA TIERS" of said subdivision guarantee document, references
Rec. No. 9607220167 for a control panel, architectural control wall and railing, etc., which does
not appear to be noted on the short plat drawing.
Information needed for final short plat approval includes the following:
Note the City of Renton land use action number and land record number, LUA-06-069-SHPL and
LND-20-0456, respectively, on the drawing. The type size used for the land record number
should be smaller than that used for the land use action number.
Show two ties to the City of Renton Survey Control Network, or tie by reference. Add the
following (if tying by reference) to the "NOTES" block on Sheet 1 of 2: "FOR TIES TO THE
CITY OF RENTON SURVEY CONTROL NETWORK PER CITY OF RENTON LOT LINE
ADJUSTMENT, KING COUNTY, RECORDING NO. 20041223000856" or other recorded
document.
Note al] easements, covenants and agreements of record on the drawing.
Change the text, noted with three of the easements (two water easements and one sanitary sewer
easement) on the short plat drawing, from" TO BE RELEASED BY SEPARATE
DOCUMENT"' to "TO BE REQUESTED FOR RELEASE BY SEPARATE DOCUMENT".
All vested owner(s) of the subject short plat need to sign the final short plat drawing. Include
notary blocks as needed.
It is suggested that DECLARATION be used instead of "DEDICATIONS" for the title of the
dedications block noted in the upper left-hand comer of Sheet 1 of 2. DECLARATION is a
better fit for the language noted within said block.
Note that if there are easements, restrictive covenants or agreements to others (City of Renton,
etc.) as part of this subdivision, they can be recorded concurrently with the short plat. The short
plat drawing and the associated document(s) are to be given to the Project Manager as a package.
The short plat will be recorded first (by King County). The recording number(s) for the
associated document(s) are to be referenced on the short plat drawing. Provide spaces for the
recording numbers thereof.

We represent a non profit corporation, Alliance for South End, with members in
Renton who are negatively effected by the Landing. Please accept these written comments on both
of the above referenced applications. We request to be timely informed of any action on these
applications.
We request that decisions on these two short plat applications be postponed until the
appeals of The Landing's Master Plan are resolved. As you know, multiple appeals of the Master
Plan approval have been filed due to violations of SEPA and the City's Master Plan procedures and
review criteria. The chances of remand for corrective work on the Master Plan are exceedingly high
in the current appeals. The Landing will need to be substantially redesigned to comply with the
required review criteria. Interim plats are almost certain to be inconsistent with a revised Master
Plan.
Further, Renton Municipal Code 4-9-2008.1 requires all development in the UC-N1 zone
undergo Master Plan review. Renton Municipal Code 4-9-200C.1.a.ii clarifies that any subdivision
that results in lots less than 25 acres must undergo Master Plan review. The proposed subdivisions
are located within the UC-N1 zone and will create lots less than 25 acres. If the City continues to
process the proposed short plat applications in the face of multiple challenges to the validity of the
Master Plan approval, the City will be knowingly violating its own procedures by approving a
development action without a valid Master Plan.
Finally we would note that the plat applications and their current processing suffer from all
of the same SEPA, concurrency, etc flaws noted in the ending ASE appeals. We hereby
incorporate those appeals by reference.

We represent a non profit corporation, Alliance for South End, with members in
Renton who are negatively effected by the Landing. Please accept these written comments on both
of the above referenced applications. We request to be timely informed of any action on these
applications.
We request that decisions on these two short plat applications be postponed until the
appeals of The Landing's Master Plan are resolved. As you know, multiple appeals of the Master
Plan approval have been filed due to violations of SEPA and the City's Master Plan procedures and
review criteria. The chances of remand for corrective work on the Master Plan are exceedingly high
in the current appeals. The Landing will need to be substantially redesigned to comply with the
required review criteria. Interim plats are almost certain to be inconsistent with a revised Master
Plan.
Further, Renton Municipal Code 4-9-200B.1 requires all development in the UC-N1 zone
undergo Master Plan review. Renton Municipal Code 4-9-200C.1.a.ii clarifies that any subdivision
that results in lots less than 25 acres must undergo Master Plan review. The proposed subdivisions
are located within the UC-N 1 zone and will create lots less than 25 acres. If the City continues to
process the proposed short plat applications in the face of multiple challenges to the validity of the
Master Plan approval, the City will be knowingly violating its own procedures by approving a
development action without a valid Master Plan.
Finally we would note that the plat applications and their current processing suffer from all
of the same SEPA, concurrency, etc flaws noted in the ending ASE appeals. We hereby
incorporate those appeals by reference.

Format and Legal Description Review
Bob Mac Onie and I have reviewed the above referenced short plat submittal and have the
following comments:
Comments for the Applicant:
Boeing Binding Site Plan Tract "N" was part of Lot 3A when said Lot was established per City of
Renton Lot Line Adjustment No. LUA-06-068-LLA, under Rec. No. 20041223000856. Said
tracts can be shown as part of this short plat request if the following occurs:
1) If said tract is to remain on the short plat submittal, it needs lo be referenced as in
the legal description (Sheet I of 2), and the City of Renton needs to be a party to and
a signatory of the sh011 plat (Sheet I of 2).
2) If said tract "N" is vacated the legal description would need to be modified to
include the Tract i.e. "TOGETHER WITH VACATED TRACT ... " including the
recording of the vacation Ordinance.
The tract may be shown on the short plat but cannot be included within the boundary of Lot
I unless either of the two options above has been met.
The indexing information noted on both short plat drawing sheets is incorrect -the "RGE" should
be}, not "3". ·'DELA WARE" is misspelled on sheet 1.
NOTE: The legal description included in the First American Title Insurance Company
Subdivision Guarantee document, Order No. NCS-229509-WAl, dated April 14, 2006, is out-of-
date. The subject property is described therein as "Lots 2 and 3 Boeing Lakcshore Landing,
Binding Site Plan," etcetera rather than the legal description shown on the short plat.

Item No. 8 under "RECORD MATTERS" of said subdivision guarantee document, references
Rec. No. 9607220167 for a control panel, architectural control wall and railing, etc., which docs
not appear to be noted on the short plat drawing.
Information needed for final short plat approval includes the following:
Note the City of Renton land use action number and land record number, LUA-06-069-SHPL and
LND-20-0456, respectively, on the drawing. The type size used for the land record number
should be smaller than that used for the land use action number.
Show two ties to the City of Renton Survey Control Network, or tie by reference. Add the
following (if tying by reference) to the "NOTES" block on Sheet I of 2: "FOR TIES TO THE
CITY OF RENTON SURVEY CONTROL NETWORK PER CITY OF RENTON LOT LINE
ADJUSTMENT, KING COUNTY, RECORDING NO. 20041223000856" or other recorded
document.
Note all easements, covenants and agreements of record on the drawing.
Change the text, noted with three of the casements (two water easements and one sanitary sewer
easement) on the short plat drawing, from" TO BE RELEASED BY SEPARATE
DOCUMENT"" to "TO BE REQUESTED FOR RELEASE BY SEPARATE DOCUMENT".
All vested owner(s) of the subject short plat need to sign the final short plat drawing. Include
notary blocks as needed.
It is suggested that DECLARATION be used instead of "DEDICATIONS" for the title of the
dedications block noted in the upper left-hand corner of Sheet I of 2. DECLARATION is a
better fit for the language noted within said block.
Note that if there are easements, restrictive covenants or agreements to others (City of Renton,
etc.) as part of this subdivision, they can be recorded concurrently with the short plat. The short
plat drawing and the associated document(s) are to be given to the Project Manager as a package.
The short plat will be recorded first (by King County). The recording number(s) for the
associated document(s) are to be referenced on the short plat drawing. Provide spaces for the
recording numbers thereof.

Enclosed with this letter is the submittal package for the Short Plat Subdivision for Lot 3 of the
Boeing Lakeshore Landing Binding Site Plan. This area was previously used for parking by the
Boeing Company. The future use of Lot 3 is for retail and parking that was described in more
detail in the Master and Site Plan review documents for The Landing project that were
submitted to the City on October 31, 2005.
The majority of the attachments required for the Short Plat package were submitted as part of
the Master and Site Plan review for The Landing project. We have attached 12 copies of the
Short Plat Plan along with the Land Use Permit Application.

The Landing Short Plats
In response to your voicemail, here is the information that I got from
our surveyor.
Lot 3: (9607220167 -Sewer) lies to the south of Lot 3, in Tract L of
the Binding Site Plan. This tract is being dedicated as part of NE 8th
St.
Lot 2: (8805190541 -Water) actually lies in Lot 3, and is shown on the
Lot 3 Short Plat.
Lot 2: (20041228001870 -Storm) lies in Lots 1 and 4 to the west.
In summary it appears that none of the easements, although listed in the
back up documents, are actually located on the Lots in which they're
referenced. Please let me know if you need us to provide additional
information in order for the packages to be accepted as complete. Thank
