C. Project Description I Background:
The applicants, John and Petra Hansen, are requesting approval of an administrative
variance from the required side yard along a street setback in the R-8 zone. The subject site
is located at 4005 Park Avenue N (Parcel No. 322405-9045).
The development standards of the R-8 zone require a side yard along a street setback of 15
feet. The setback is measured from the property line to the building footprint. The applicant
is proposing a 2-foot protrusion into the required side yard along a street setback for the
south corner of the proposed addition.
The applicant submitted a site plan showing the existing residence and the proposed
addition in relation to the proposed side yard along a street property line. The existing
residence would comply with the remaining side and rear yard setback areas.
FINDINGS, CONCLUSIONS & DECISION
Having reviewed the written record in the matter, the City now makes and enters the
following:

Findings
Request: The applicant has requested approval for an administrative variance from
the required 15-foot side yard along a street setback for an addition to an attached
garage in the R-8 zone for the property located at 4005 Park Avenue N. A 13-foot
sideyard along a street setback is proposed for the south corner of the proposed
addition area. All other portions of the addition would comply with the 15-foot
required setback.

2) Administrative Variance: The applicant's administrative variance submittal materials
comply with the requirements necessary to process a variance. The applicant's site
plan and other project drawings are entered as Exhibits 1 through 5.
3) Existing Land Use: Land uses surrounding the subject site include: North: single-
family residential (R-8 zone); South: single-family residential (R-8 zone); East
single-family residential (R-8 zone); and West: single-family residential (R-8 zone).
4) Zoning: The site is located in the Residential -8 (R-8) dwelling units per acre zone.
The development standards for the R-8 zone require a 15 foot front yard setback for
the primary structure and a 20-foot setback for an attached garage, 20-foot rear yard
setback, 5-foot interior side yard setback, and a 15-foot side yard along a street
setback for a primary structure and a 20-foot setback for an attached garage
accessing off of the side yard street. Maximum lot coverage is 35 percent or 2,500
sq. ft. for lots 5,000 sq. ft. or greater.
4) Topography: The site slopes in a northwesterly direction.
5) Lot and Building Size: The site area is 11,700 square feet. The existing single-
family residence totals approximately 1,975 square feet and the addition area totals
404 square feet. The existing footprint of the residence is approximately 1,975 square
feet and the footprint of the addition area is approximately 404 square feet on an
11,700 square foot lot, which results in a building lot coverage of 20.3 percent
(20.3%).
CONSISTENCY WITH VARIANCE CRITERIA
Section 4-9-2508.5.a. Lists 4 criteria that the Zoning Administrator is asked to consider,
along with all other relevant information, in making a decision on an Administrative Variance
application. These include the following:
The Zoning Administrator shall have authority to grant an administrative variance
upon making a determination, in writing, that the conditions specified below have
been found to exist:
a. That the applicant suffers undue hardship and the variance is necessary
because of special circumstances applicable to subject property, including
size, shape, topography, location or surroundings of the subject property,
and the strict application of the Zoning Code is found to deprive subject
property owner of rights and privileges enjoyed by other property owners in
the vicinity and under identical zone classification:
The applicant contends that special circumstances apply to the subject site, which
imposes limitations on the lot. Specifically, the applicant indicates that the location
of the existing residence on the subject property such that the closest part of the
existing garage is 5 feet from the property line, and despite the fact that the garage
angles back away from this property line, the south corner of the propsed addition
area would still protrude 2 feet into the 15-foot setback.
In addition, the right-of-way width of Park Avenue N is 60 feet; however the
pavement width is only 26 feet. The distance between the property line and the

edge of pavement is approximately 25 feet, therefore it appears that the garage is
setback much farther from the side yard along a street property line than it actually
is.
Staff has reviewed the proposed variance request and concurs that a hardship
exists on the subject property due to the location of the existing residence on the
subject site. The location of the residence coupled with the appearance of a much
larger side yard along a street due to the 60-foot right-of-way width with 26 feet of
paving which adds the appearance of approximately 26 feet to the side yard along
the street warrants the approval of the proposed 2-foot projection into the 15-foot
side yard along a street setback.
b. That the granting of the variance will not be materially detrimental to the
public welfare or injurious to the property or improvements in the vicinity and
zone in which subject property is situated:
The applicant contends that the requested reduction in the required side yard along
a street setback area would not be detrimental to the pulbic welfare or injurious to
the property or improvements in the project vicinity as the variance would allow for
the addition onto and existing garage that is currently located within the required
setback area and the addition area would be located further from the required
setback. Staff concurs that the granting of the variance would not be materially
detrimental to the public welfare or injurious to surrounding properties or
improvements.
c. That approval shall not constitute a grant of special privilege inconsistent
with the limitation upon uses of other properties in the vicinity and zone in
which the subject property is situated:

The approval of the variance request would not be a grant of special privilege as
the variance would allow for an addition onto and existing garage already located
within the required setback and the proposed addition would be located further from
the required setback area with only a 2-foor protrusion of the south corner of the
addition into the setback.
d. That the approval as determined by the Zoning Administrator is a minimum
variance that will accomplish the desired purpose:
The applicant contends that the request is a minimum variance needed in order to
extend the end of the existing garage. The proposed addition would not widen the
existing garage, would only extend it. Staff has reviewed the request and concurs
that the proposed variance is the minimum necessary to accomplish the desired
purpose of extending the existing garage.
Conclusions
The subject site is located at 4005 Park Avenue N, within the Residential -8 Dwelling
Units per Acre (R-8) zoning designation.

2. The R-8 zone requires a minimum 15-foot side yard along a street setback for the
attached garage from the property boundary. The applicant is proposing to add onto
the existing garage and to cover an existing patio/storage area.
3. The analysis of the proposal according to variance criteria is found in the body of the
Staff Report.
4. Staff's analysis concludes that the applicant's proposal is justified based on the four
applicable criteria needed to grant a variance.
F. Decision
The Administrative Setback Variance for the Hansen Setback Variance, File No. LUA-
07-013, V-A, is approved.

The administrative land use decision will become final if the decision is not appealed within 14 days of the date of
approval. An appeal of the decision must be filed within the 14 day appeal period (RCW 43.21.C.075(3); WAC
197-11-680). An appeal to the Hearing Examiner is governed by Title IV, Section 4-8-11.B, which requires that
such appeals be filed directly with the Hearing Examiner via the City of Renton City Clerks Office. Appeals must
be made in writing on or before 5:00 PM on May 1, 2007. Any appeal must be accompanied by a $75.00 fee
and other specific requirements.
THE APPEARANCE OF FAIRNESS DOCTRINE provides that no ex parte (private one-on-one) communications
may occur concerning the land use decision. The Doctrine applies not only to the initial decision, but to Appeals
to the Hearing Examiner as well. All communications after the decision/approval date must be made in writing
through the Hearing Examiner. All communications are public record and this permits all interested parties to
know the contents of the communication and would allow them to openly rebut the evidence in writing. Any
violation of this doctrine could result in the invalidation of the appeal by the Court.

Request for Variance for proposed addition to existing Hansen residence garage,
located at: 4005 Park Ave. North in Renton
PROJECT NARRATIVE
This variance request is to allow construction ofan (8 ft. by 21 ft.) addition to the west
end of the existing garage, and to construct a roof over an adjacent (11 ft. by 21 ft.)
fenced and paved storage area, at my house located at the NW comer of the intersection
of Park Ave. North and N. 40th Street, in the north Kennydale area.
• Land use permits required: Only this requested variance and a building permit
• Zoning: Subject property and all adjacent properties zoned R-8
• Current site use: Paved and fenced storage area between house & garage
• Special Site Features: None -site slopes gently to the west
• Soil type & drainage: Sandy loam -drains well
• Proposed use: Continue as single family residential
• Access: Access is available from both Park Ave. No. and N. 40'h St.
• Proposed off-site improvements: None
• Estimated construction cost: $20,000.
• Excavation/fill quantities: insignificant

Request for Variance for proposed addition to existing Hansen residence garage,
located at: 4005 Park Ave. North in Renton
JUSTIFICATION FOR VARIAN CE REQUEST
I am requesting this variance to allow construction of an 8 foot extension of the back
(NW) end of my garage, and roofing over of an adjacent ( currently) paved and fenced
area. This will provide a more appropriately sized garage (for today's vehicles and some
storage/work space) and provide a roofed enclosure for garden tools and firewood, which
I currently keep in the space, but under tarps. This addition will improve the general
appearance of my house from the street, and thus, be an improvement to the
neighborhood. The following are additional justification for allowing the variance:
• The need for this variance is due to a hardship created by the comer of the pre-
existing garage having been located within 5 feet of what is now the street right-of-
way. Even though the garage sits at an approx. 25-degree angle to the street (N. 40 1h
St.), the proposed addition to the west end of the garage would still overlap into the
allowable 15 foot setback requirement, even though it is receding increasingly farther
away from the street/right-of-way as it continues to the west.
• The granting of this variance will neither be materially detrimental to the public
welfare, nor injurious to property or improvements in the vicinity. North 40th St. has
a 60 foot right-of-way, but the street itself (2-lanes) is located almost entirely on the
south half of the right-of-way. The corner ofmy existing garage, which is within 5
ft. of the right-of-way line, is approximately 30 ft. from the north edge of the street.
The proposed addition will be at least 10 feet farther away, at its nearest point to the
right-of-way line and the street, than the SE comer of the existing garage currently is.
The southwest comer of the proposed storage shed enclosure, would be
approximately 25 ft. from the right-of-way line.
• The approval of this variance request would not constitute a grant of special privilege
inconsistent with the limitation upon uses of other properties in this vicinity and zone,
as the proposed addition would be considerably farther away from the street and
right-of-way line than the currently-existing garage, thus not providing any new
encroachment into the right-of-way.
• The proposed project is the minimum addition that meets the needs of an adequately
sized garage, and merely provides a more permanent enclosure and a roof over an
existing storage area that is currently a fenced and paved ( concrete slab) yard.
