the majority of land and Commercial
Neighborhood on the .98 acres
fronting Duvall Avenue NE.

you that they have completed their review of the environmental impacts of the above-referenced
project. The Committee, on May 21, 2007, decided that your project will be issued a
Determination of Non-Significance.
The City of Renton ERC has determined that it does not have a probable significant adverse
impact on the environment. An Environmental Impact Statement (EIS) is not required under
RCW 43.21C.030(2)(c). This decision was made by the ERC under the authority of Section 4-6-
6, Renton Municipal Code, after review of a completed environmental checklist and other
information, on file with the lead agency. This information is available to the public on request.
Appeals of the environmental determination must be filed in writing on or before 5:00 PM

the subject site in advance of annexation, pursuant to RCW 35A.14.330, so zoning will be in place at the time the
subject site comes into the City. The City is proposing to prezone the 7.6 acre proposed annexation area R-8. This
corresponds with the Residential Single Family designation in Renton's Comprehensive Plan. Whereas the proposed
annexation is considered to be a non-project action under SEPA, the proposed zoning is not. The City is also proposing

MARSHALL ANNEXATION PREZONE
PROJECT DESCRIPTION: The applicants for the proposed Marshall Annexation have requested that the City
prezone the subject site in advance of annexation, pursuant to RCW 35A.14.330, so zoning will be in place at the time the
subject site comes into the City. The City is proposing to prezone the 7.6 acre proposed annexation area R-8. This
corresponds with the Residential Single Family designation !n Renton's Comprehensive Plan. Whereas the proposed
annexation is considered to be a non-project action under SEPA, the proposed zoning is not. The City Is also proposing a
Comprehensive Plan Amendment (CPA 2007-M-07) which would re-designate and rezone approximately .98 acres of the
site as Commercial Neighborhood (CN).
PROJECT LOCATION: This site is completely surrounded by the City of Renton just north of NE Sunset
Blvd. It is west of the intersection of NE Duvall Ave and SE 107th Place.
OPTIONAL DETERMINATION OF NON-SIGNIFICANCE (DNS): As the Lead Agency, the City of Renton has determined
that significant environmental impacts are unlikely to result from the proposed zoning. Therefore, as permitted under the
RCW 43.21C.110, the City of Renton is using the Optional DNS process to give notice that a DNS is likely to be issued.
Comment periods for the project and the proposed DNS are integrated into a single comment period. There will be no
comment period following the issuance of the Threshold Determination of Non-Significance (DNS). A 14-day appeal
period will follow the issuance of the DNS.

The subject site is located within the Residential Single Family (RS)
Comprehensive Plan Land Use Map designation. The proposed R-8 prezone is
consistent with this land use designation, as well as relevant land use policies
adopted in November 2004. A proposed Comprehensive Plan Amendment (CPA
2007-M-07) would change the land use designation on approximately .98 acres
along Duvall Ave. NE from RS designation to Commercial Neighborhood (CN)
designation. If this amendment is approved, the zoning on the four parcels
fronting Duvall Avenue NE would be CN.

This non-project action will be subject to the City's SEPA Ordinance and
Development Regulations and other applicable codes and regulations as
appropriate.
Proposed Mitigation Measures: The analysis of the proposal does not reveal any adverse environmental impacts
requiring mitigation above and beyond existing code provisions. However, mitigation may be necessary and may be
imposed at the time of a site specific development proposal on the subject annexation site.

MARSHALL ANNEXATION PREZONE PROJECT NARRATIVE AND PROPOSAL
SUMMARY
The applicants for the proposed Marshall Annexation have requested that the City prezone the
subject site in advance of annexation, pursuant to RCW 35A.14.330, so zoning will be in place at
the time the subject site comes into the City. The site is completely surrounded by the City of
Renton just north of NE Sunset Blvd. It is west of the Intersection of SE I 07th Place and Duvall
Ave NE. Annexation is considered exempt from SEP A. However, the prezoning of the subject
7.6-acre area does require SEPA review.
The City is proposing to prezone the proposed annexation area R-8. This corresponds with the
Residential Single Family designation in Renton's Comprehensive Plan. The proposed prezone is
considered a non-project action under SEPA. Surrounding zoning to the north and south is
Renton R-8, 8 units per net acre. The property is currently zoned King County 4 units per gross
acre.
The City is also proposing an amendment to its Comprehensive Plan, which would redesignate
three parcels along Duvall Ave NE for Commercial Neighborhood (CN) land use with
Commercial Neighborhood (CN) zoning. This proposal is being processed as CPA 2007-M-07.
Currently, 26 detached single-family units exist in this area. At full build out under Renton R-8 it
is estimated there is capacity for 43 homes. There are no plans for redevelopment of the area at
this time. Since this prezone is a non-project proposal, development of any new housing units
will be subject to additional project specific review at the time of development. If the four
parcels fronting Duvall Ave NE were to be designated CN and zoned CN there would be capacity
for approximately 37 single family units, approximately 11,500 square feet of commercial (and
employment of about 28 people).
Marshall Annexation Prezone Justification
The area proposed for prezoning has already been designated for Residential Single Family in the
Renton Comprehensive Plan. King County's Comprehensive Plan has designated the area for
urban development at a density of 4-12 dwelling units per gross. R-4 zoning of this property
would be consistent with both King County's and Renton's Comprehensive Plans. Renton's
zoning uses net developable area to determine project density, not gross developable area. It also
allows a density bonus up to six units per acre. As a result, full buildout of this area at King
County's R-4 zoning could result in 45 units. Under Renton's proposed R-8 regulations, full
development would result in 43 units. Thus, King County's R-4 is comparable to Renton's R-8
zoning standard.
The proposal to redesignate a portion of this site for Commercial Neighborhood was originally
initiated by one of the property owners. The property immediately across Duvall Ave NE is
commercially zoned (Commercial Arterial zoning in the Commercial Corridor Land Use
Designation) and the area is adjacent to the Sunset Blvd. Business District. Thus, rezoning the
parcels fronting on Duvall Ave NE would be a natural extension of the commercial area.

The State Environmental Policy Act (SEPA), Chapter 43.21C RCW, requires all governmental agencies to
consider the environmental impacts of a proposal before making decisions. An Environmental Impact
Statement {EIS) must be prepared for all proposals with probable significant adverse impacts on the
quality of the environment. The purpose of this checklist is to provide information to help you and the
agency identify impacts from your proposal (and to reduce or avoid impacts from the proposal, if it can be
done) and to help the agency decide whether an EIS is required.
INSTRUCTIONS FOR APPLICANTS:
This environmental checklist asks you to describe some basic information about your proposal.
Governmental agencies use this checklist to determine whether the environmental impacts of your
proposal are significant, requiring preparation of an EIS. Answer the questions briefly, with the most
precise information known, or give the best description you can.
You must answer each question accurately and carefully, to the best of your knowledge. In most cases,
you should be able to answer the questions from your own observations or project plans without the need
to hire experts. If you really do not know the answer, or if a question does not apply to your proposal, write
"do not know" or "does not apply". Complete answers to the questions now may avoid unnecessary
delays later.
Some questions ask about governmental regulations, such as zoning, shoreline, and landmark
designations. Answer these questions if you can. If you have problems, the governmental agencies can
assist you.
The checklist questions apply to all parts of your proposal, even if you plan to do them over a period of
time or on different parcels of land. Attach any additional information that will help describe your proposal
or its environmental effects. The agency to which you submit this checklist may ask you to explain your
answers or provide additional information reasonably related to determining if there may be significant
adverse impact.

City Council must give approval of the annexation and zoning. There is a proposed
Comprehensive Plan Amendment to allow commercial zoning on the properties fronting on Duvall
Ave NE. This would require Council approval of a Comprehensive Plan Amendment.

This non-project action includes pre-zoning approximately 7.6 acres to R-8 in Renton's Potential
Annexation Area currently being considered for annexation using the 60% Direct Petition method.
Under RCW, 43.21.C.222 annexations are specifically exempted from SEPA. RCW 35.A.14.330-
340 provides for rezoning potential annexation areas. Alternately, ii has been proposed to rezone
approximately 6.62 acres to R-8 and .98 acres to Commercial Neighborhood (CN). This would be
possible if a proposed Comprehensive Plan Amendment is adopted which would change the land
use designation of the four parcels fronting Duvall Ave NE from RS (Residential Single Family) to
Commercial Neighborhood (CN).

D. SUPPLEMENTAL SHEETS FOR NONPROJECT ACTIONS
(These sheets should only be used for actions involving decisions on policies, plans and
ro rams. You do not need to fill out these sheets for ro·ect actions.
Because these questions are very general, it may be helpful to read them in conjunction with the
list of the elements of the environment.
When answering these questions, be aware of the extent the proposal, or the types of activities
likely to result from the proposal, would affect the item at a greater intensity or at a faster rate than
if the proposal were not implemented. Respond briefly and in general terms.
1. How would the proposal be likely to increase discharge to water; emissions to air; production,
storage, or release of toxic or hazardous substances; or production of noise?
It is unlikely that the proposal would have any affect on the above environmental issues.
Additional residential development is likely to occur on this site with or without the proposal.
Proposed measures to avoid or reduce such increases are:
New development resulting as a consequence of these proposed amendments would be required
to comply with the City's development regulations, including the City's Critical Areas Ordinance.
2. How would the proposal be likely to affect plants, animals, fish, or marine life?
There would be no affect on plants, animals, fish, or marine life as a direct consequence of this
non-project, prezoning proposal.
Proposed measures to protect or conserve plants, animals, fish, or marine life are:
None at this non-project level. Development of new dwelling units under this proposal must
comply with City of Renton regulations and with Renton's Critical Areas Ordinance. Any
measures needed in this regard will be implemented at the project level review.
3. How would the proposal be likely to deplete energy or natural resources?
The proposed non-project action will not deplete energy or natural resources. Future project level
development may impact energy or natural resources slightly but will not deplete them.
Proposed measures to protect or conserve energy and natural resources are:
None are proposed at this non-project action stage.
4. How would the proposal be likely to use or affect environmentally sensitive areas or areas
designated (or eligible or under study) for governmental protection; such as parks, wilderness,
wild and scenic rivers, threatened or endangered species habitat, historic or cultural sites,
wetlands, flood plains, or prime farmlands?
This proposal would likely not use or affect environmentally sensitive areas. At such time that
additional dwelling units are developed on this site, they will be subject to City of Renton critical

area regulations and development standards that are designed to protect environmentally
sensitive areas.
Proposed measures to protect such resources or to avoid or reduce impacts are:

5. How would the proposal be likely to affect land and shoreline use, including whether it would allow
or encourage land or shoreline uses incompatible with existing plans?
The proposed prezoning of this area will increase compatibility with the ~urrounding uses since ft
will limit future residential development to single-family detached housing currently prevalent in the
area. With the proposed Comprehensive Plan Amendment it would also allow commercial
development on parcels that are already adjacent to an existing commercial district.
Proposed measures to avoid or reduce shoreline and land use impacts are:
None.
6. How would the proposal be likely to increase demands on transportation or public services and
utilities?
Assuming full development at R-8 capacity there would be 43 single family units and
approximately 430 AWDTE. There are no plans at current time, however, to develop the area
beyond the existing 26 single family homes (and 260 AWDTE). If the proposed Comprehensive
Amendment is adopted that allows commercial zoning, there would be approximately 37 single
family units and approximately 370 AWDTE, plus 11,500 square feet of commercial space, adding
another 506 AWDTE for a total of 876 AWDTE
Proposed measures to reduce or respond to such demand{s) are:
None.
7. Identify, if possible, whether the proposal may confiict with local, state, or federal laws or
requirements for the protection of the environment.
The proposal will not conflict with local, state, or federal laws or requirements for protection of the
environment.
