The evaluation criteria for a Special Fence Permit are as follows: (a) The proposed fence improycs the pnvacy and security of the adjoining space (met); (b) The proposed fence does not deh·act fromthe quality of the residential environment by being out of scale or creating vast blank walls along public roadways (not met); ( c) The proposed fence compliments tlie environment it serves in an aesthetically pleasing manner (not met); and ( d) The proposed fence does not present a hazard to vehicular or pedestrian traffic (met). In order to meet the criteria band c listed above, the City typically requires applicants to increase the distance of the fence from the property line in order to allow for landscaping. In other situations, fences are modulated ( off-set) or have latticework on top in order to provide some measure for limiting blank walls along the sidewalk. Since your application did not include any provisions for landscaping, modulation, or latticework, it does not meet the criteria for approYal of a Special Fence Permit. In order to be approved you must undertake one of the following measures: I. Relocate the fence a minimum of three feet (3 ') from the property line to allow for landscaping and provide a landscape plan, or; 2. Reduce the fence height to four feet (4'J to comply with coqe requirements for .fence height along a street, This administrati.ve decision will become final if not appealed to the Hearing Examiner by 5:00 p.m. on August 7, 2007. In response to your letter, in some cases the City does issue a Special Fence Permit for fences that exceed the standard height in a particular zone. No pcnrnl is necessary for a fence 1n a residential zone that is 6 feet high, or less. However, in this case the applicant's fence exceeds the 4-foot height limit for fences along a side yard adjacent to a street. Because the fence is already in place, his only recourse to keep the fence at its current height is to apply for a Special Fence Permit As for the violation of the Honey Creek Ridge Homeowners' Association CC&R's, that is an issue between the HOA and the applicant. The City does not get involved with private property disputes. You will receive a copy of the decision which will be made sometime in the next week or so. As a reminder, you have two weeks from the decision date to file an appeal. Appeals are made to the Hearing Examiner and must be submitted to the City Clerk's office on the 7th floor of Renton City Hall with a $75.00 application fee. This letter is in response to the above mentioned permit. We live a few doors down from 2407 Olympia Avenue NE. The fence went up within days of the homeowners moving in. The homeowners did not attempt to contact the Homeowner's Association concerning approval of the planned fence. The fence is not in compliance with the overall planning of the development. We feel that permitting this fence to stay as it is will set precedence for other homeowners to build as they please and then apply for permission/permits later. The reason homeowner's associations are established is to preserve the integrity and value of all of the properties in an area. Allowing homeowner's to build as they please causes neighborhood property values to fall and the aesthetics of a neighborhood are compromised. We feel very strongly that the Meade's need to comply with regulation and lower the fence height as well as move it away from the sidewalk area. The Honey Creek Ridge Board has spent quite a bit of time and money on this issue. This is time and money that would have been better spent for the good of the whole neighborhood instead. Please consider denying this special permit and requiring this homeowner to comply not only with Renton regulation, but the Honey Creek Ridge CC&R's and wishes of 100 other homeowner's in the area. As a homeowner in the Honey Creek Ridge HOA, I note that the fence in question is both against the CC&Rs of our HOA and is also is an eyesore that significantly detracts from the aesthetics of our neighborhood. Accordingly, the permit should be denied. It is my understanding that the applicant installed the fence, which is clearly not allowed by the CC&Rs, with no advance discussion with the HOA Board. Further, the applicant has not entered into substantive discussions with the HOA Board even after receiving a notice from the Board that the fence violates the CC&Rs to which he is bound. The application for a special permit is nothing more than an attempt to legitimize this flagrant violation of our CC&Rs. No other houses have fences on the side of their houses that border on a street, and I do not think this homeowner should be allowed to disturb the harmony of our neighborhood. Not only should the permit be denied, but I believe the fence should be removed. The fence was constructed without prior approval from the Honey Creek Ridge Homeowners Association as required by the CC&R's. It was also constructed without prior request from the City. There have been numerous communications with this owner by the HCRHOA and the City requesting that the owner comply with City regulations as it related to height and location. They refuse to take corrective action. It would set a bad precedence for the City and CC&R's if this breach of compliance is allowed to continue. I believe the process for a Special Fence Permit requires the request prior to construction and not after the fact, as in this case. Please keep me advised as the process continues. We would like our children to be able to play in the back yard without concerns of them being hit by an automobile. The existing landscaping hides the fence from the street so the fence is barely noticeable.
