C. Project Description / Background:
Younker Nissan is an established automobile dealership in the City of Renton. Its location at the intersection
of East Valley Road South and SW 34'" Street is a new one. The site is located in the Heavy industrial (IH)
zone. Access to the development is provided lro111 two driveway access points along East Valley Road South
and one driveway access point on SW 34'h Street.
Renton Municipal Code Section 4-4-IOOE.5 limits the number of freestanding, ground, roof, and projecting
signs pennitted on a parcel within a commercial or industrial zoning designation to one for each street frontage
from which the business gains access. Younker Nissan gains access to the site along two street frontages (East
Valley Road South and SW 34'h Street) and is permitted to have two freestanding, ground, roof, or projecting
signs per RMC 4-4-100E.5.g.ii. To exceed the number, height, area or pcnnitted location of pennitted
freestanding, ground, roof, or projecting signs, administrative variances must be granted.
The applicant, Sign Solutions, Inc., is requesting approval of variances for one proposed freestanding pole sign
located at the southeast comer of the project site. One freestanding ground sign is currently in place at the
northeast comer of the project site. The applicant states that the proposed sign would provide visibility to
drivers on the Valley (SR 167) Freeway and would direct people towards Younker Nissan.
The proposed pole sign (Exhibit 4) would be double-faced, internally illuminated, and a total of 63 feet, 3
inches in height. This proposed sign would be double-faced wifh each face having an area of 200 square feet.
It would be set back 21 feet from the property line along East Valley Highway Road. The proposed sign
would be display the Nissan logo.
The proposed sign would be taller than the existing pennitted freestanding sign and is compatible with the
existing automobile dealership. The applicant states that the new sign would be easily read from greater
distances allowing drivers to make directional decisions earlier and safer.

D. Findings
Having reviewed the written record in the matter, the City now makes and enters the following:
1) Request: The applicant has requested approval of administrative variances from the required height
and size for one new freestanding sign from the Sign Regulations (RMC 4-4-100E.3.b and RMC 4-4-
100E.5.g.ii) on the property located at 3401 East Valley Road South.
2) Administrative Variance: The materials submitted by the applicant for administrative variances
comply with the requirements necessary to process variances. The applicant's site plan and other
project drawings are provided as Exhibits 2 through 5.
3) Existing Land Use: Land USes surrounding the subject site include:
North -warehouse uses; zoned III
South -motorcycle dealership and theatre; zoned IM
East -mini-warehouse and the Valley (SR 167) Freeway; zoned CA
West -Far West Steel; zoned It!
4) Zoning: The site is located in the Hea"y Industrial (IH) zone.
5) Topography: The topography of the site is primarily flat.
E. Consistency with Variance Criteria
RMC 4-9-250B.5 lists four criteria that the Reviewing Official is asked to consider, along with all other
relevant information, in making a decision on an Administrative Variance application. The four criteria are:
a. That the applicant suffers undue hardship and the variance is necessary because of special
circumstances applicable to subject property, including size, shape, topography, location or
surroundings of the subject property, and the strict application of the Zoning Code is found to
deprive subject property owner of rights and privileges enjoyed by other property owners in the
vicinity and under identical zone classification:
The subject property is currently developed with an automobile dealership, Younker Nissan. The
property has direct access to East Valley Road and to SW 34'h Street. The applicant contends that the
location of the property inhibits visibility from the Valley (SR 167) Freeway which the applicant
contends is crucial to the viability of the automobile dealership. The applicant believes that current
signage is ineffective and that the proposed new sign would more effectively direct drivers to the
facility_ The applicant further contends that the topography of the site makes the placement of the
proposed new sign necessary. Staff concurs that the location of the property results in a hardship; and,
without the requested sign height and size it would be difficult to see. Therefore, the requested
variance is reasonable.
b. That the granting of the variance will not be materially detrimental to the public welfare or
injurious to the property or improvements in the vicinity and zone in which subject property is
situated:
The proposed sign would enhance the Jaeility in terms of making it more identifiable and facilitate its
continued viability as an asset to the City of Renton and the region. Staff supports the new sign and
has determined that it would not be materially detrimental to the public welfare or injurious to the
property or improvements in the vicinity and zone.
The requested variances would exceed the height and size of allowable signs. The ability to clearly
identify this automobile dealership through the placement of the proposed sign may, in fact, enhance
the public welfare by avoiding confusion, since the dealership is outside the auto mall area, in more
efficiently directing drivers to this destination.

c. That approval shall not constitute a grant of special privilege inconsistent with the limitation
upon uses of other properties in the vicinity and zone in which the subject property is situated:
The applicant contends that some signs for businesses in the vicinity of the proposed sign are larger
than the proposal. Staff believes that the approval of the requested variances would not provide the
applicant with special privilege inconsistent with the limitation upon uses of other properties in the
vicinity or zone.
d. That the approval as determined by the Administrator is a minimum variance that will
accomplish the desired purpose:
The applicant contends that the request is a minimum variance needed in order to more clearly define
the Younker Nissan facility and direct drivers to their destination more efficiently. Younker Nissan
has operated in good standing in the City of Renton for many years. The proposed signage would play
an important role in identifYing the automobile dealership and its services.
Staff supports the request for one new freestanding pole sign as minimum variances. These variances
allow Younker Nissan to maximize its visibility, define its business, and more efficiently direct
customers.
F. Conclusions
I. The subject site is located at 3401 East Valley Road South, within the Heavy Industrial (1M) zoning
designation.
2. The sign regulations for the proposed site are covered under the Sign Regulations of the Renton
Municipal Code (RMC 4-4-100).
3. The analysis of the proposal according to variance criteria is found in the body of the Staff Report.
4. The requested variances meet the [our criteria necessary to justify granting of the variances.
G. Decision
The Administrative Sign Variances for the Younker Nissan Sign Variance, File No. LUA08-079, V-A, V-A
is approved subject to the following conditions:
1. The variances granted encompass one freestanding sign identified on Exhibit 3, Younker Nissan Site
Plan.
2. The new freestanding sign shall be designed in conformance with the dimensions and specifications
depicted in Exhibit 4.

Land Use Action Request for Reconsideration, Appeals & Expiration
The administrative land use decision will become final if the decision is not appealed within fourteen (14) days
of the effective date of decision.
RECONSIDERATION: Within fourteen (14) days of the effective date of decision, any party may request
that a decision may be reopened by the Administrator (Decision-maker). The Administrator (Decision-maker)
may modify his decision if material evidence not readily discoverable prior to the original decision is fonnd or
if he finds there was misrepresentation of lact. Alicr review of the reconsideration request, if the Administrator
(Decision-maker) finds sufficient evidence to amend the original decision, there will be no further extension of
the appeal period. Any person wishing to take ILlliher action must file a formal appeal within the 14-day appeal
timeframe.
APPEAL: This administrative land use decision will become final if not appealed in writing to the
Hearing Examiner on or before 5:00 PM on August 29, 2008. An appeal of the decision must be filed
within the 14-day appeal period (RCW 43.21.C.075(3); WAC 197-11-680). Appeals to the Examiner are
governed by City of Renton Municipal Coele Section 4-8-110. Additional information regarding the appeal
process may be obtained from the Renton City Clerk's office, Renton City Hall-7th Floor, (425) 430-6510.
Appeals must be filed in writing, together with the required $75.00 application fee to: Hearing Examiner, City
of Renton, 1055 South Grady Way, Renton. \VA 98057.
THE APPEARANCE OF FAIRNESS [)OCTlUNE: provides that no ex parte (private one-on-one)
communications may occur concerning the land use decision. The Doctrine applies not only to the initial
decision, but to Appeals to the Hearing Examiner as welL All communications after the decision/approval
date must be made in writing through the Hearing Examiner. All communications are public record and this
permits all interested parties to know the conlents of the communication and would allow them to openly rebut
the evidence in writing. Any violation of this doctrine could result in the invalidation of the appeal by the
Court.
EXPIRATION: The variance approval will expire two (2) years from the date of decision. A variance two-
year extension may be requested pursuant to RMC 4-9-250B.16.

Request for Variance for Yonkers Nissan

We are requesting two variances for Yonkers Nissan Dewership located
at 3820 E. Valley Hwy.
The first variance is for additional signage (pole sign). Currently this
location falls under 4-4-100.g. (motor vehicle dealerships located
outside the Automall). The section that applies to this location allows for
one freestanding sign per street frontage, with a maximum of (1 00) sq.
ft. per sign face, and (2) accessory ground signs. We are requesting
Yonkers Nissan be considered in the same category as motor vehicle
dealerships located in the Automall area. The granting of this variance
will not provide the Yonkers Nissan dealership with any special
privilege. In fact it will be consistent with all the other Automall
dealerships by giving them the same advertising benefit currently afford
them. They should not be penalized just because they fall out side the
Automall zone.
The second variance is for increa<;ing the over all height of the requested
additional pole sign (first variance) from 50' overall height to 63' tall
and increasing the square footage allow from 150 sq. ft. per sign face to
200 sq. ft per face. The height and size of sign is needed to get the same
visibility from hwy 167 as the dealership had from their previous
location that was located next to 167. There is also precedence for pole
signs that are over 50' tall and larger then 150 sq. ft. in size in this area.
There is a motor cycle business and movie theater next to the dealership
that both have much larger sign then we are requesting. Granting the
variance would not be detrimental to the businesses in the vicinity. It
would be in line with what is already there.
