Box 2431 Renton, WA 98059 Jennifer Henning (425-430-7286) SE Bremerton Avenue & 7th Place NE PROPOSAL: The applicant is requesting an exemption from the Critical Areas Regulations in order to remove approximately 19 dangerous trees from within a wetland area. The trees are located within a retention pond/wetland and are abutting and adjacent to homes. The trees are shown on a submitted map as numbered 1, 2, 3, 4, 5, 6-18, and 19. Some of the trees would be in danger of damaging residential structures if the trees fell. City of Renton Code Compliance staff verified that the trees are considered to be dead, dangerous, or diseased per RMC 4-4-1 C2. Furthermore, Planning Division staff visited the site and determined that trees numbers 6 -18. and 19 are within striking distance of residences, and meet the criteria for removal, provided a Critical Areas Exemption is granted. CRITICAL AREA: The subject site contains a Category 3 wetland. EXEMPTION JUSTIFICATION: Pursuant to RMC section 4-3-050.C.5.c.iii, of the Critical Areas Regulations is hereby granted for the following reason(s): X iii. Dead or Diseased Trees: Removal of dead, terminally diseased, damaged, or dangerous ground cover or hazard trees which have been certified as such by a forester, registered landscape architect, or certified arborist, selection of which to be approved by the City based on.the tvoe of information reauired, or the Citv orior to their removal. FINDINGS & CONCLUSIONS: The proposed development is consistent with the following findings pursuant to RMC section 4-3-050.C.5.e: 1. The activity will be conducted using best management practices as specified by industry standards or applicable Federal agencies or scientific principles; and, 3. Impacts are minimized and, where applicable, disturbed areas are immediately restored pursuant to RMC 4-3-050.C.5.e.iii. DECISION & CONDITIONS OF APPROVAL: The proposal to cut down a maximum of 14 dead, diseased, and dangerous trees within a wetland area is APPROVED, subject to the following conditions, 1. Only trees located within striking distance of residential buildings may be cut. These trees are specified as follows and shown on the attached plan: Nos. 6-18, and 19. 2. A minimum of five (5) of the trees shall be cut at a height so that they effectively function as habitat snag trees. These trees shall be cut at a point of approximately 25 feet above the ground to provide perch habitat. The selection of the 5 trees shall be up to the discretion of the Homeowner's Association. 3. The remaining trees (maximum of 9) to be cut within the wetland and buffer area shall be left "dead and down" to enhance habitat. SIGNATURE: C. E. The bulk of these trees, identified on the Site Plan found within the Application are adjacent to adjoining homes, and present a danger of falling on them. As also noted in our Application, the City's Code Compliance Dept. has already had personnel out to inspect these failing trees, and has approved of them being dropped into the pond once our Request for Critical Areas Exemption has been approved, and the Permit issued. If there are any questions, or comments, regarding our Application, please contact the undersigned. We appreciate the City's efforts to get this Permit issued as soon as possible, so that we can hopefully get these trees down before the fall rain/wind storms arrive. He suggested I contact Terry Flatley, Renton's certified tree arborist in the Parks Dept., to see if he would be willing to help identify which dead/diseased trees can be snagged within our designated wetlands area. I'm attaching photos of these rather large, dead/diseased trees, which we need to address soon, and especially before the fall windstorms arrive, as any one of them could potentially blow over and present an extensive liability for us if they are not dealt with soon. The bulk of these trees seem to be located directly behind Peachtree Townhomes at the northwest corner of their site. It's been my experience working with dead/diseased trees in a designated wetlands area previously in another city, that so long as we get the diseased/dead trees identified by a certified arborist, we should ultimately be able to proceed per their recommendation and everyone, including the City should be happy?? If the City of Renton's arborist is available to help us with this identification in the near future, we would be so very grateful. If he's not available, our HOA will need to hire Alan from the City of Issaquah, a cost our HOA money really can't afford right now -especially after all the vandalism/graffiti removal we have been dealing with this year. Also, if we end up having to hire Alan from the City of Issaquah, I will need to know from you, or someone with the City of Renton, that the City is willing to accept in total his arborist report and recommendations relative to the disposition of these diseased/dead trees. Also, we never did receive a response from Qwest regarding the certified letter our HOA sent them after all the work they did back in February on the other side of Duvall that impacted our retention pond .. Is it also normal that these utility companies, when they do work outside the right of way areas, don't have to contact the adjacent private property owners to request permission and also provide insurance certificates in case of any damage, such as this issue here, caused to the adjacent private property as they perform their work in these areas.??
