WHEREAS, the Council has heretofore adopted and filed a "Comprehensive Plan" and has implemented and amended the "Comprehensive Plan" from time to time, together with the adoption of various codes, reports and records; and WHEREAS, the Planning Commission has fully recommended to the Council, from time to time, certain amendments to the City's "Comprehensive Plan"; and WHEREAS, the City, pursuant to the Washington State Growth Management Act, has been required to review its "Comprehensive Plan"; and WHEREAS, the City has held a public hearing on this matter on December 1, 2010; and WHEREAS, the Planning Commission has made certain findings and recommendations to the Council; and WHEREAS, the Council has duly determined after due consideration of the evidence before it that it is advisable and appropriate to amend and modify the City's "Comprehensive Plan"; and WHEREAS, such modification to the "Comprehensive Plan" is in the best interest of the public; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF RENTON, WASHINGTON, DOES ORDAIN AS FOLLOWS: 1 ORDINANCE NO. 5585 SECTION I. The above findings and recitals are found to be true and correct in all respects. SECTION II. The "Comprehensive Plan" map is hereby modified, amended and adopted in its entirety as shown on Attachment A. SECTION Ill. The Administrator of the Department of Community and Economic Development or the Administrator's designee is hereby authorized and directed to make the necessary changes to the City's "Comprehensive Plan" and the related maps to evidence the aforementioned amendment. SECTION IV. However, on November 2, 2009, a letter was received from David Halinen (applicant's contact) requesting the City defer the decision on the Comprehensive Plan Amendment until the next year's cycle. This request was made to allow time for an associated docket amendment request, D-41 Office in the IL, and resolution to the buffer proposed by Staff on the Virtu property. A second letter was received on November 12, 2010, amending the original request for CO zoning on the MLDC property to IL zoning. A third letter was received on November 17, 2010 requesting amendments to the original 2009 request for the Virtu property, these changes are described below in "Part B (Virtu)". On September 28, 2009 SEPA review was completed for the subject amendment. However, this review evaluated a CO zoning request on the MLDC property and IL zoning request on the Virtu Property. During this September 2009 Environmental Review a DNS was made for this map amendment. However, as small portions of the original request has been modified since 2009, staff is conducting SEPA Environmental Review on these parcels again. A proposal for a Comprehensive Plan Amendment was submitted for three separate parcels located within the vicinity of the Sunset View Apartments at 2101 SW Sunset Boulevard. ("MLDC"), (2) Quarry Industrial Park, LLC ("QIP"), and (3) AGNirtu Sunset View, L.L.C. ("Virtu") Proposal Location: The proposal primarily involves three privately owned properties: (1) the "MLDC Property" (which is owned by MLDC), (2) the "QIP Property" (which is owned by QIP), and (3) the "Virtu Property" (which is owned by Virtu). The proposal also involves a 20-foot-wide strip of unimproved City of Renton street right-of-way (named South 13?1h Street under King County's street naming system and unnamed under Renton's street naming system) lying along the entire north edge of the QIP Property. All of the property is located in Section 13, Township 23 North, Range 4 East, Willamette Meridian. (See the accompanying map exhibit for the layout of the properties.) DLH 2-6-09 The curving north and northeast edges of the 27.08-acre MLDC Property abut SW Sunset Boulevard. The easterly two-fifths of the property's south boundary abut the forested westerly end of the site of the existing Sunpointe Townhomes. The westerly three-fifths of the property's south boundary abut the north edge of the 100-foot-wide Burlington Northern and Santa Fe Railway (BNSF) railroad right-of-way (which contains an active railroad line). The property's west boundary abuts the QIP Property, the Virtu Property, and the Sunset View Apartments parcel. The 9.0-acre QIP Property is bounded by (a) the 20-foot-wide South 137th Street unimproved street right-of-way to the north, (b) the MLDC Property to the east, (c) the 30-foot-wide South 140th Street (King County street name) unimproved right-of-way to the south, and (d) a portion of the Black River Quarry to the west. (The site of the Sunset View Apartments-which includes the Virtu Property at its southeast corner-lies immediately to the north of the above- referenced, unimproved South 137th Street unimproved street Page 1 of 10 Current Uses: Current Comp. The approximately 27.1-acre MLDC Property, the site of the previously planned and approved Sunset Bluff Residential Subdivision, has largely been cleared and graded in preparation for residential development. About 4.7 acres of the east end of the MLDC Property remain forested, as well as a tree line along the property's north edge. A stormwater detention pond has been constructed along a portion of the MLDC Property's south edge. The QIP Property is graded and is used for storage of construction materials and equipment, as well as for construction-materials recycling activities. (The QIP Property is the east part of the site of the Black River Quarry.) The Virtu Property is a vacant, triangle-shaped portion of the Sunset View Apartments site at that site's southeast corner. Map Designations: Approximately 26.03 acres of the MLDC Property are designated Residential Medium Density (RMD) on the City of Renton Comprehensive Plan Land Use Map, while the remaining approximately 1.05 acres of the MLDC Property (a strip along the westerly portion of the MLDC Property's south boundary) are designated Residential Low Density (RLD). The QIP Property is irregular in shape, is graded and slopes generally to the south. (The QIP Property is the east part of the site of the Black River Quarry.) The Virtu Property is triangular in shape and also slopes generally to the south-southeast. It is forested. An active Burlington Northern and Santa Fe Railway (BNSF) railroad line and associated 100-foot-wide right-of-way, which Page 4 of 10 lie at the base of a steep slope, abut the south edge of the 30-foot wide unimproved South 140th Street right-of-way lying along the QIP Property's south edge. The BNSF railroad line and associated 100-foot-wide right-of-way also lie along approximately the westerly 60 percent of the MLDC Property's south boundary. An intermittent, non-fish-bearing stream (not meeting the criteria for any of the types of waters defined under WAC 222-16-030) with a channel approximately 2 to 2.5 feet wide runs generally from north to south across the site (a) from an existing culvert that conveys stormwater flows into the north side of the MLDC Property approximately 1,100 feet west- northwest of the property's extreme southeast corner into the approximately 3-acre City of Renton Category 1 Wetland described in the next paragraph. An approximately 3-acre City of Renton Category 1 Wetland that has no surface discharge straddles a part of the easterly portion of the MLDC Property's south boundary. (Only about 6,078 square feet of that wetland lie on the MLDC Property.) Also, an approximately 400-square-foot City of Renton Category 3 Wetland straddles a small part of the westerly portion of the MLDC Property's south boundary. (Only about 258 square feet of that wetland lie on the MLDC Property. The remainder lies within the abutting BNSF railroad right-of- way.) No wetlands exist on either the QIP Property or the Virtu Property. The Black River riparian forest exists within an approximately 100-acre City of Renton park to the south of the site (south of the BNSF railroad line and right-of-way). A great blue heron nesting colony lies within roughly the center of the City park property. The closest distance between the site and the heron colony is approximately 950 feet. Specific Responses to the Following Decision Criteria: A. The CPA and associated Rezone bear a substantial relation to the public health, safety or welfare. Page 5 of 10 DLH 2-6-09 The requested Comprehensive Plan Amendments and rezone bear a substantial relation to the public health, safety or welfare because they would: (1) Provide opportunity for development of Commercial Office and Light Industrial Uses in the north, upper edge of the area defined in Comprehensive Plan Land Use Policy LU-303 as the "Black River Valley" (an area defined therein as being "located between Sunset Blvd and SW Grady Way") and commensurate in-City employment opportunities; (2) Provide opportunity for the development of the Virtu Property, which currently cannot be readily developed because of topographic constraints on its north edge but which could be developed in conjunction with the development of the QIP Property to the south; (3) Provide for logical zoning and land use transitions from west to east-i.e., from (a) the existing Heavy Industrial zoning of the balance of the Black River Quarry property to the west of the QIP Property to (b) the proposed Light Industrial zoning of the QIP and Virtu Properties to (c) the proposed Commercial Office Zoning of the MLDC Property (property that includes about 4.7 acres of forest buffer area at its east end); (4) Provide for logical zoning and land use transitions from south to north-i.e., from (a) the City park south of the BNSF railroad line to (b) the BNSF railroad line to (c) the following: (i) On the west, the proposed Light Industrial zoning of the QIP and Virtu properties and the Sunset Bluff Apartments and its RM-F zoning to the north of those properties; (ii) On the east, the proposed Commercial Office Zoning of the MLDC Property with SW Sunset Boulevard (SR 900) along its north edge and with single-family homes and zoning up on the hill to the north of SW Sunset Boulevard. B. The CPA and associated Rezone address changing circumstances or the needs of the City as a Whole. Page 6 of 10 DLH 2-6-09 The subject CPA and associated rezone proposal address the changing circumstances brought about by the worldwide economic crisis and the corresponding abrupt decline of the market for new single-family homes in our area. As a result, residential development of the subject site is no longer needed. What is needed at the site is Light Industrial and Commercial Office development that could accommodate major employers and provide substantial, close-in employment opportunities. The proposed CPA and associated rezone would make such development possible. C. The CPA and associated Rezone are compatible with the provisions of the Comprehensive Plan or other policies or goals of the City The following discussion of applicable Comprehensive Plan Land Use Policies demonstrates that the requested Comprehensive Plan Land Use Map Amendment and associated rezone are compatible with applicable provisions of the Renton Comprehensive Plan. Employment Areas Policies from the Land Use Section of the Existing Renton Comprehensive Plan Note that the stated Goal of Renton's Employment Areas Policies is to "[a]chieve a mix of land uses including industrial, high technology, office, and commercial activities in Employment Areas that lead to economic growth and a strengthening of Renton's employment base." The first paragraph of the "Discussion" section immediately following that goal stresses the following: "These policies are designed to ensure that Renton will have adequate reserves of land and appropriate use designations to further its economic development efforts. Adequate land is necessary to attract new businesses in an effort to expand and diversify, and stabilize the employment base." (Emphasis added.) The following policies further those ideas and support the Applicants' CPC and Rezone proposal: DLH 2-6-09 Objective LU-EEE: Encourage economic growth resulting in greater diversity and stability in the employment and tax bases by providing adequate land capacity through zoning amounts of land to meet the needs of future employers. Policy LU-290. The City should endeavor to expand its present economic base, emphasizing new technologies, research and Page 7 of 10 development facilities, science parks, and high-technology centers, and supporting commercial and office land uses. Policy LU-291. In each employment designation, an appropriate mix of commercial, office. light industrial, and industrial uses should be supported. The mix will vary depending on the employment area emphasis. Objective LU-FFF: Promote the development of low impact, light industrial uses, particularly those within the high-technology category, in Employment Area-Valley and Employment Area- Industrial designations where potentially adverse impacts can be mitigated. (Emphasis added.) Employment Areas-Valley Land Use Designation Policies from the Land Use Section of the Existing Renton Comprehensive Plan The following policies Employment Areas-Valley Land Use Designation objectives and policies also support the Applicants' CPC and Rezone proposal: DLH 2-6-09 Objective LU-HHH: Provide for a mix of employment-based uses, including commercial, office, and industrial development to support the economic development of the City of Renton. Policy LU-303. Develop the Green River Valley ("The Valley") and the Black River Valley (located between Sunset Blvd and SW Grady Way) areas as places for a range and variety of commercial, office, and industrial. Policy LU-306. Uses such as research, design, and development facilities should be allowed in office designations and industrial designations when potential adverse impacts to surrounding uses can be mitigated. Policy LU-307. Recognize viable existing and allow new industrial uses in the Valley. while promoting the gradual transition of uses on sites with good access and visibility to more intensive commercial and office use. Policy LU-308. Changes from one zone to another should be considered to achieve a balance of uses that substantially Page 8 of 10 improves the City's economic/ employment base. Factors such as increasing the City's tax base, improving efficiency in the use of the land, and the ability of a proposed land use to mitigate potential adverse land use impacts should be considered. Policy LU-314. Zone property Industrial-Light [when] it is appropriate for very low intensity manufacturing and industrial services such as storage. Uses, and potential impacts of those uses (noise, glare, vibration, etc.), within this zone are typically fully contained within buildings. Policy LU-315. Commercial Office zoning should be supported where a site has high visibility, particularly in those portions of the Valley that are gateways and/or along the 1-405 and SR 167 corridors, where larger sites can accommodate more intensive uses, and where sites can take advantage of existing and/or future multi-modal transportation opportunities. (Emphasis added.) Note that the MLDC Property portion of the subject site is on SW Sunset Boulevard (SR 900), the City's westerly gateway. Metro transit route 101 serves the MLDC Property from SW Sunset Boulevard. Transit stops are available at the intersection of SW Sunset Boulevard and Oakesdale Avenue SW, which is about half a block west of the expected site entrance intersection with SW Sunset Boulevard. Metro route 101 connects with the Renton Transit Center, which is located at South 2nd Street and Burnett Avenue South about 1 mile to the east of the above-mentioned transit stops. D. The CPA and associated Rezone are compatible with and not materially detrimental to adjacent Land Uses and surrounding neighborhoods. As explained in items (3) and (4) on page 6, above, the CPA and Rezone would create logical zoning and land use transitions from west to east and from south to north and thus would be compatible with and not materially detrimental to adjacent land uses and surrounding neighborhoods. E. The CPA and associated Rezone will not result in development that will adversely impact community facilities, including but not limited to utilities, transportation, parks or schools Sanitary sewer and water mains are available to serve the subject properties. Sewer has already been installed into the QIP Property from the west and water main connections are available from SW Sunset Page 9 of 10 DLH 2-6-09 Boulevard and Monster Road SW. Electricity and natural gas is also available to the site. As to vehicular transportation, primary access to a future, possible Commercial Office development on the MLDC Property would be from abutting SW Sunset Boulevard, with secondary access (or at least emergency vehicle access) through the Black River Quarry Property and the QIP and/or Virtu properties to Monster Road SW. Depending upon the nature of the particular development on the QIP and Virtu properties (and possibly depending upon the nature of the particular development on the MLDC Property), Light Industrial development on the QIP and Virtu properties would likely have primary access to Monster Road SW (with at least emergency vehicle access to SW Sunset Boulevard) or, alternately, primary access to both Monster Road SW and SW Sunset Boulevard. Both Monster Road SW and SW Sunset Boulevard can accommodate traffic to and from the site. Unlike residential development, proposed Commercial Office and Light Industrial development would add very little demand to use of City parks and no demand upon schools. F. The subject property is suitable for development in general conformance with zoning standards under the proposed zoning classification. The subject properties have generally moderate topography that is suitable for Commercial Office and Light Industrial development in general conformance with zoning standards under the proposed CO and IL zoning classifications of the properties. As part of a development of the MLDC Property, the east 4.7 acres would be placed in a native growth protection easement.
