Since a portion of the mitigation along Springbrook Creek at Oakesdale
was released from regulatory review this fall, who does the property
owner need to contact to obtain a reduction in their bonds? To whom
would we provide a new bond quantity worksheet to for the area that is
still under regulatory review?

Subject: Zelman Easement - Request to Release Wetland Mitigation Performance Bond
The following is my response to your voice mail regarding the our efforts to get the 80 -ft access easement
that is held by the Zelman Development Company that is located on Unit D of the Springbrook Creek
Wetland and Habitat Mitigation Bank. Based upon your message you indicated that the access easement
holder (Zelman) would be willing to release the easement, if the City released a bond that we are holding
for wetland mitigation that Zelman had to perform on their site when it was developed (Oakesdale
Business Park Development).
As part of the Oakesdale Business Park Development, the City Hearing Examiner required the developer,
Zelman Development Co., to post a bond in the amount of $87,738 (Bond 6054474). The bond was
required to ensure on-site wetland mitigation satisfied the performance standards established in the
approved mitigation plan during a 5 year monitoring and maintenance period. The cost of the bond was
based upon 125% of the estimated cost for replacement, maintenance and monitoring.
The 5 -yr maintenance and monitoring period expired in 2005 with only one of two wetland mitigation areas
meeting performance standards. The City extended the monitoring period for an additional 4 -yrs to 2009
years to give the developer time to demonstrate appropriate establishment for the remaining wetland. City
code requires a minimum of 5 -years of monitoring to ensure performance standards are met. In addition
City code does not allow the use of bonds anymore. A letter of credit, cash deposit or other acceptable
surety device is allowed.
Since one of two wetlands mitigation areas is in compliance with the City's performance standards for
wetland establishment, we could reduce the amount of the surety device that we are holding, in exchange
for them releasing the easement, but we should not offer to release the whole Bond. A new surety device,
with a reduced amount (say half - $43,869), would be acceptable. After a new surety device with the
reduced amount is received, the City it we would release the original ($87,738) bond. The use of a letter
of credit or cash deposit or other security device would need to used, instead of using a bond, however.
We could also allow Zelman to provide a new cost estimate for replacement, maintenance and monitoring
of the remaining wetland (Wetland A) that did not meet performance standards, which would be used to
establish the amount of the security device including the 125% factor. The cost estimate will need to be
review and accepted by the City and include a contract document for the cost to perform replacement,
maintenance and monitoring. This may further reduce the amount of the surety device.
In conclusion, offer to reduce the bond amount to half of a revised replacement, maintenance and
monitoring cost estimate for remaining wetland mitigation (Wetland A) that must monitored and
maintained until year 2009 to ensure performance standards are met in exchange for Zelman releasing
the 80 -ft access easement (Zelman) over Unit D in the Springbrook Wetland and Habitat Mitigation Bank.
We would accept a letter of credit or cash deposit as the new surety device, since we do not accept bonds
anymore. Upon receipt of the new financial surety device, we would release the original bond.

The City of Renton has received and evaluated the sixth year wetland monitoring report dated December 5, 2005
for the Oakesdale Business Campus. The purpose of this letter is to inform you of the City's findings regarding
the wetland mitigation project for the Oakesdale Buiness Campus and SAFECO bond #6054474.
The report has indicated one year of successful growth for "Wetland A" located in the northwest portion of the
site. Renton Municipal Code 4.-8-120D23 mandates a minimum of five years of successful wetland mitigation
and monitoring. The wetland does not yet meet City requirements for release,of your bond. When your wetland
mitigation project has been successfully installed and established according to your approved mitigation plan for
a period of five consecutive years you will be eligible for a release of your bond. The earliest eligible release
date would be December of 2009.
Due to the success of the wetland mitigation area along the Spnngbrook Creek, the City of Renton will no
longer require submission of monitoring reports for this area. However, for "Wetland A", the City of Renton
requires annual wetland monitoring reports to be submitted until the wetland has been successful for a minimum
of 5 years. Please send future reports to the attention of Laureen Nicolay

Thanks Mike. December 19 will serve as the date the project is back in compliance, and monitoring reports will be due in March,
June, September and December of 2008. Assuming everything meets performance standards reports will thereafter be annual.

On November 5, 2007, I visited the buffer enhancement area at the Oakesdale Business Campus
to inspect replanting that occurred in late October and early November of 2007. This letter shall
serve as documentation of the successful installation of new plants in the buffer area.
The following plants were installed in the buffer enhancement area this fall. The replacement
figure was arrived at by multiplying the area previously void of woody vegetation by the original
plant densities specified in the 1998 NRC Wetland Mitigation Plan.

Planting was successfully completed prior to my November 5, 2007 walkthrough. Plants had an
adequate mulch ring and were arranged to provide a diverse strata throughout the buffer
enhancement area. Furthermore, plant densities and composition are now generally consistent
with original specifications outlined in the original mitigation plan. The buffer enhancement
area has 100 percent plant survival, and is currently in compliance with annual performance
standards.
Quarterly monitoring site visits are scheduled for next year, with annual monitoring visit to
follow in subsequent years. A baseline plant count will be conducted during our early 2008 site
visit from which future survival calculations will be measured.

The following performance standards shall be achieved. The final success criteria of the buffer
enhancement area is to have "...an 80 percent aerial cover of self-sustaining, non-invasive,
native wetland vegetation at the end of the five-year monitoring program..."
