It is intended to meet the conditions imposed by the City of Renton in the decision approving the Munson Short Plat, to wit: Lot 1 is permitted to connect to the existing side sewer serving Lot 2 (otherwise known as 210 NW 2nd street). That portion of the easement crossing Lot 2 of the Munson short plat shall therefore be for the benefit of the owner of Lot 1 and shall allow the owner of Lot 1 to install, utilize, and maintain that portion of the side sewer between Lot 1 and the shared portion of the side sewer on Lot 2. The portion of the easement crossing Lot 3 of the Munson Short Plat (otherwise known as 207 Taylor Avenue NW) shall be for the benefit of the owners of Lot 2 and Lot 1 of the Munson Short plat and shalralrow the ownersof'Lot I and Lot 2 to install, utilize, and maintain that portion of the side sewer which runs across lot 3. UTILITIES EASEMENT - 1 of 5 DMD MUNSON:EASEMENT:01-06-97]dm This easement is granted subject to the following terms and conditions: 1. The Grantee shall, upon completion of any work within the property covered by the easement, restore the surface of the easement, and any private improvements disturbed or destroyed during execution of the work, as nearly as practicable to the condition they were in immediately before commencement of the work or entry by the Grantee. 2. Grantor shall retain the right to use the surface of the easement as long as such use does not interfere with the easement rights granted to the Grantee. Grantor shall not, however, have the right to: a. Erect or maintain any buildings or structures within the easement; or b. Plant trees, shrubs or vegetation having deep root patterns which may cause damage to or interfere with the utilities to be placed within the easement by the Grantee; or c. Develop, landscape, or beautify the easement area in any way which would unreasonably increase the costs to the Grantee of restoring the easement area and any private improvements therein. d. Dig, tunnel or perform other forms of construction activities on the property which would disturb the compaction or unearth Grantee's facilities on the right-of- way, or endanger the lateral support facilities. e. Blast within fifteen (15) feet of the right-of-way. This easement shall run with the land described herein, and shall be binding upon the parties, their heirs, successors in interest and assigns. The short plat in question is located over the driveway that leads to our house. This driveway has been in existence for a minimum of 50 years and constitutes a prescriptive easement. This can easily be verified by an inspection of the property by the City Of Renton. At this time this case is being referred to our attorney and will settled within the legal system. A copy of your instruction letter is attached. According to our records, all three were submitted to King Co. that same day along with recording instructions. In checking, however, I find that only two of the three documents have been recorded. • We have received back the Declaration of Public Sewer Covenant and the mylar itself, both with their recording numbers of 9705190907 and 9705199029 respectively. We did not get back the Hold Harmless Agreement, and I find no record of it ever being recorded. I did call Mary Trujillo.at KC plat division, and also talked to Stacy at KC Customer Service. Both say there is no record or trace of that document. I was told that even if it got separated in the Assessor's office, it should have been processed by now. So, I want to make you aware of this. Also I need to know how you wish to proceed with this. We have a copy of the Hold Harmless which could be recorded, but that's not like having an original. Also there is the matter of recording sequence. I see that even the Declaration of Sewer Covenant recording number is not noted on the mylar copy, and of course neither is the non-existent Hold Harmless number. Anyway, I'm trying to clear up some of these problems, so if you can get back to me as to your wishes, I'd appreciate it. (Sorry this had to happen, but it is beyond our control.) Thank you. Project Description/Background The applicant, Ronald Munson, owns a 22,982 sf lot with two existing homes located on it. The applicant is requesting approval of an Administrative Short Plat in order to subdivide the lot into three lots. The proposed lots would be 5,000 sf(Lot 1), 7,955 sf(Lot 2), and 10,027 sf(Lot 3) in area. One of the existing homes would be located on Lot 2 and the other home would be located on Lot 3. Lot 1 would be vacant and available for a future single-family dwelling. The two existing homes are on separate side sewers that connect into the sanitary sewer main in Taylor Ave. NW. The new home, when constructed on Lot 1, would be able to connect into the existing side sewer serving Lot 2 as a temporary arrangement. The owner of Lot 1 would need to join in a future LID to construct a sewer main in NW 2nd Street and would be strongly encouraged to connect into the main when it is constructed. 2. Environmental Review In accordance with Section 4-6, Environmental Ordinance, of the Renton Municipal Code and SEPA (WAC 197-11-800), the proposed three lot short plat is exempt from environmental review. 3. Compliance with ERC Conditions Not Applicable. 4. Staff Review Comments Representatives from various city departments have reviewed the application materials to identify and address issues raised by the proposed development. These comments are contained in the official file, and the essence of the comments has been incorporated into the appropriate sections of this report and the Departmental Recommendation at the end of the report. 5. Consistency Short Plat Criteria Approval of a plat is based upon several factors. The following short plat criteria have been established to assist decision makers in the review of the plat: a) Compliance with the Comprehensive Plan Designation Obiective LU-J: Protect and enhance the character of Residential Single Family neighborhoods, improve opportunities for better public transportation, and make more efficient use of urban services and infrastructure. Single family residential lots in this area range in size from 4,500 sf to over 18,000 sf in area. The proposed lot configuration is consistent with the adjacent residential area and will allow for a more efficient use of City utilities. shpltrpt.doc City of Renton P/B/PW Department Administrative Land Use Action REPORT AND DECISION DATED August 9,1996;PROJECT LUA-96-085,SHPL Page 4 Policy LU-35 requires lots to be a minimum of 4,500 square feet in area. The proposed lots range in size from 5,000 sf to 10,027 sf. The lot size is consistent with the requirements of the Comprehensive Plan. b) Compliance with the Underlying Zoning Designation The subject property is zoned Residential 8 du/acre. This zone requires lots to be a minimum of fifty feet in width. The smallest proposed lot is minimum of fifty feet in width and the other two lots are approximately 79 and 100 feet in width. All of the proposed lots are consistent with the lot width requirements. The R-8 zone requires lots to have a minimum depth of 65 feet. The applicant is proposing to provide lots with a depth of 100 feet. All of the lots are consistent with the lot depth requirements. Lot 3 has an existing house and an existing detached carport within its boundaries. Although the existing house meets the setback requirements for the R-8 zone, the existing carport does not meet the setbacks as it is located 5.7 feet from a property line. The R-8 zone requires a twenty foot setback from the property line along a public street for the side yard setback. Since it is an existing structure the applicant is not required to relocate the structure at this time. However, in the future, if the applicant needs to rebuild the structure he will need to meet Code-requirements. c) Compliance with Subdivision Regulations Streets: The applicant is not proposing to develop any new streets as part of this short plat. Street improvements are required by Code along the west side of Taylor Ave. NW and the north side of NW 2nd Street adjacent to the project site. These improvements include new concrete curb, gutter, and sidewalks; with paving extended from the edge of the existing pavement to the new gutter. The pavement section for this portion of NW 2nd Street is required to be a minimum of 28 feet in width. City Code does allow for modification and/or waiver of the street requirements. If the applicant wishes to request a modification or a waiver to these requirements, a written request with justifications should be submitted to the Plan Review Section for consideration. Blocks: The applicant is not creating a new block through this short plat. The dimension of the existing block will remain the same. Lots: As noted above, the applicant is proposing lots that range from 50'x 100'to approximately 100'x 100' and from 5,000 to 10,027 sf in area. These lot dimensions and areas are consistent with the Code requirements. d) Reasonableness of Proposed Boundaries Access: Access to all three lots is from NW 2nd Street. Lot 3 could also take access from Taylor Ave. However, as the existing carport is adjacent to NW 2nd Street it is assumed that this will be the vehicle access to the lot. The proposed short plat will generate an additional 10 vehicle trips per day above that trips that are generated by the two existing homes. The City has adopted an ordinance that establishes an impact mitigation fee of $75.00 per trip. Therefore, the applicant will need to provide a transportation mitigation fee of $750.00 to pay for the City-wide transportation improvements required due to the increase in traffic flows generated by this project. shpltrpt.doc • • City of Renton P/B/PW Department Administrative Land Use Action • REPORT AND DECISION DATED August 9,1996;PROJECT LUA-06-085,SHPL Page 5 Topography. The project site slopes from a high point on the northwest corner to the low point at the southeast corner at about a 12% to 15% slope. The creation of driveways at slopes at 8% or less should not be a problem. NW 2nd Street has been established at approximately the same grade as the surrounding area and the driveways will be cutting across the slope. Any future applicant will need to ensure that the cross slope on any new driveway, this applies mainly to Lot 1, does not exceed an 8% slope. Relationship to Existing Uses: The subject property is located in one of Renton's older neighborhoods that has developed under a number of King County and City of Renton development standards. Lots in this area have mainly been developed for single family homes. The proposed short plat will allow for the construction of one additional single family home on a lot that is similar in size and area to the existing lots in this neighborhood. e) Availability and Impact on Public Services(Timeliness) Police an d d Fire: Police Department staff note that the addition of a single family home in this area will potentially generate 1.48 calls for assistance per year. The Police Department staff also recommend that any future home be provided with exterior security lighting, solid core doors, and address numbers a minimum of 6" in height, of a color contrasting with the color of the house. Fire Prevention Bureau staff note that the fire flow requirement is 1,000 gpm. At least one fire hydrant is required within 100 feet of the proposed building pad for the new house. A fire mitigation fee of $488.00 will be assessed at.the time building permits are issued for the new house. The fee will only be assessed on the new house. Recreation: The City has adopted an ordinance that establishes a mitigation fee of$530.76 per new single family home. This impact fee has been established to off-set the impacts of new development on the City's recreation system. The applicant will need to provide this fee prior to the issuance of construction permits. Schools: The proposed short plat potential will generate 0.7 new students within the Renton School District. It is not anticipated that this will have a significant impact on the schools in the area. Storm Water: There is an existing 12" storm water line in Taylor Ave. NW. The construction of one additional single family home in this area will not cause a significant impact on the City's storm water system. The drainage from the subject property will continue to flow into this system. As part of the construction associated with the short plat, the applicant will need to submit a detailed storm water report in accordance with existing City Code-requirements. Water and Sanitary Sewer Utilities: Water and sanitary sewer lines already exist in this area. Wastewater Utility staff noted in a letter to the applicant, dated March 27, 1996, that the proposed new lot could connect with the existing side sewer for Lot 2. Wastewater Utility staff also noted that a covenant must be executed and recorded against"Lot 1" with the property owner agreeing to participate in the future extension of the public sewer main across the frontage of the parcel, to the extent that said main fulfills the responsibility assigned to said parcel as its fair share proportion. Said participation of"Lot 1" may be by direct participation, Local Improvement District, Special Assessment District, or Latecomers. The owners of Lot 1 and Lot 2 will be required to execute "hold harmless agreement" that relieve the City of any responsibility of problems caused by the use of a dual side sewer. The owner of Lot 2 would have to provide an easement allowing the owner of Lot 1 to install, utilize, and maintain that portion of the side sewer between Lot 1 and the shared portion of the side sewer. The owner of Lot 3 would have to provide an easement allowing the owners of Lot 1 and Lot 2 to install, utilize, and maintain the side sewer across Lot 3. Neither Lot 2 nor Lot 3 will be required to participate in the costs of future extension(s) of the sewer main in NW 2nd Street unless the owners reconnect their side sewers to the new line. Sewer connection for Lot 1 shall be subject to the fee, permit, and construction requirements at the time of application. H. DECISION: The Short Plat, File No. LUA-96-085,SHPL, is approved subject to the following conditions: 1. Prior to the recording of the short plat the applicant shall submit a transportation mitigation fee of$750.00 to off- set the adverse impact of this development on the City-wide transportation system. 2. Prior to the recording of the short plat, the applicant shall submit a mitigation fee of$488.00 to mitigate the impact of the new development on the Renton Fire Department. 3. Prior to the recording of the short plat the applicant shall submit a parks and recreation mitigation fee of$530.76 to mitigate the impact of the proposed new construction on the City's parks and recreation system. /4. The applicant shall record a covenant on Lot 1 agreeing to participate in the future extension of the public sewer main across the frontage of the parcel, to the extent that said main fulfills the responsibility assigned to said parcel as its fair share proportion. A 10" water main is available in Taylor Ave NW. A 8" water main is available in NW 2nd St adjacent to this site. SEWER - Supplied by City of Renton. A 8" sewer main is available in Taylor Ave NW adjacent to this site, with a side sewer extended to the existing house on proposed Lot 2. STORM DRAINAGE -There is an existing 12" storm line on the west side of Taylor Ave NW. STREETS - Both Taylor Ave NW and NW 2nd St are improved with paving only. There are no curbs, gutters, sidewalks or street lights on these adjacent street sections. CODE REQUIREMENTS 'WATER 1. No water main extensions required for this project. 2. Runoff from the new building site could be directed to the existing system along Taylor Ave NW. TRANSPORTATION MUNSON1DOC 1. A Traffic Mitigation i-ee of $750 will be due prior to recording of the short plat (see separate fee calculation sheet). 2. Street improvements are required along the west side of Taylor Ave NW and the north side of NW 2nd St adjacent to the project site. These improvements include new concrete curb, gutter and sidewalks; with paving extended from the edge of the existing pavement to the new gutter. The pavement section for this portion of NW 2nd St is required to be a minimum of 28 feet in width. • 3. City Code does allow for modification and/or waiver of the above listed street improvement requirements. If the applicant wishes to request a modification or waiver to these requirements, a written request with justifications should be submitted to the Plan Review Section for consideration. SUBJECT: SEWER AVAILABILITY FOR PROPOSED 3 LOT MUNSON SHORT PLAT Mr. Munson, The Wastewater Utility has reviewed sewer availability for a proposed 3 lot short plat of King County Parcel Number 420440-0335. Standard policy requires that, as a condition of connection to the sewer system, each owner/developer is responsible for the physical or financial participation in the extension of the sewer main across the frontage of the parcel unless it can be shown, by engineering means,that there will be no need for future extensions of the system beyond the subject parcel. That is, in order to obtain sewer service for a proposed western lot (hereinafter described in this letter as "lot 1"), the owner/developer is required to extend the sewer from the existing sewer in Taylor Avenue NW along NW 2nd Street to the western boundary of the parcel being short platted. The Wastewater Utility proposes the following option which,we believe,meets the intent of the policy.
