EE05507 CASE# 23-11007 OF COLLISION 09/25/23 15:42 OF CbLLI510N NARRATIVE 23-11007 On 09/25/2023 at approximately 1549 hours, I was dispatched to a 3-vehicle hit-and-run collision in the 1600 block of Duvall Ave NE, within the City Limits of Renton, County of King, State of Washington. While en route, Dispatch advised that one of the involved vehicles had fled the scene and was described by involved parties and several witnesses as a blue Kia Optima bearing WA Plate #BJY9991. According to witnesses, Unit#1 was occupied by one occupant and the driver was described as a white female, in her 30's, medium build, with light-colored hair at the time of collision. was informed by a third witness that recognized the driver as one of the May Valley Dentistry patients. 1 was provided the name of Lindbeck, Kimberlee W (DOB 02/14/1969). Witnesses also informed me that the driver of Unit#1 did not appear to be "all there" during their short encounter with her and that her driving before the collision consisted of the vehicle not stopping at a stop sign at the intersection of NE 19th Street and weaving between lanes of travel, prior to the collision. The witnesses mentioned that they believed the driver of Unit#1 to be impaired based on observed driving behavior prior followed by their personal encounter. Based on witnesses and involved party statements, Unit#1 was traveling southbound in about the 1600 block of Duvall Ave NE prior to the collision. Unit#1 got into the center-turn-lane just south of NE 17th PI and appeared to make a left turn (eastbound) across the northbound lanes of Duvall Ave NE. During the turn, Unit#1 made contact with the driver's side of Unit#2 causing damage to the front drivers side quarter panel and bumper of Unit#1. The driver of Unit#1 initially pulled her vehicle into the Subway (1702 Duvall Ave NE) parking but later relocated to the southeast corner of the Bank of America drive-thru lanes where Unit#1 made contact with a third vehicle that was parked and unoccupied (Unit#3). The driver of Unit#1 initially interacted with the involved party (Unit#2) but when a witness, who went by the name of Eugene White, suggested that the police respond and who encouraged the driver of Unit#1 to provide her drivers license and other documents, the driver of Unit#1 got back into her vehicle and proceeded back out onto Duvall Ave NE, fleeing the scene without providing any of her driving or contact information. The driver of Unit#2 stated that prior to the collision he was traveling northbound in about the 1600 block of Duvall Ave NE in lane 2 of 2 and was intending to continue north when Unit#1 turned into the side of Unit#2. Unit#2 was unable to avoid the collision and had nearly passed Unit#1's location when Unit#1 made the turn. As a result, Unit#2 suffered moderate damage to the front and rear drivers side doors as well as the rear drivers side fender/wheel well. The driver of Unit#2 pulled into the same parking lot and followed Unit#1 as it proceeded to strike a parked vehicle in the parking lot of Bank of America. The owner of Unit#3 stated that her vehicle was parked and unoccupied at the southeast corner of the Bank of America ATM drive-thru lanes. The owner of Unit#3 works at the May Valley Dentistry where one of the witnesses also works. Unit#3 suffered minor damage to the rear driver side bumper of her vehicle as a result of the collision. Both the owner of Unit#3 and her coworker identified the driver of Unit#1 as Lindbeck with 100% certainty. The coworker, a witness identified as Rachelle Jaussaud stated that they were so certain it was Lindbeck, because not only did they visually observe Lindbeck drive into Unit#3, but they had just called her to come in for an appointment and were expecting Lindbeck at the dentistry. Two independent witnesses, identified as Chris McLaughlin and Eugene White, stated that they independently saw Unit#1 traveling southbound on Duvall Ave NE and collide with Unit#2. White stated that he was the one who saw Unit#1 fail to stop at NE 19th Street/Duvall Ave NE and turn out onto Duvall Ave NE, nearly colliding with another vehicle. White stated that upon Unit#1 turning onto Duvall Ave NE, it proceeded to weave in and out of lanes of travel and that White felt the driver of Unit #1 may have been impaired. White then observed the collision occur between Unit#1 and Unit#2 and proceeded to follow both vehicles into the lot so he could be a witness for the other party. McLaughlin stated that he works for 405 driving school and was in his office at the time of collision. Through the window, McLaughlin stated he saw Unit#1 turn into Unit#2 and collide. McLaughlin stated he went out into the parking lot to be a witness when he noticed Unit#1 had collided into Unit #3. 1 believe Unit#1 was the predominant factor for the cause of collision. Based on the above statements, I determined that the driver of Unit#1 (Lindbeck) did not grant the right of way to Unit#2 traveling in the roadway which had the right of way and was already underway. The driver of Unit#1 was turning left and traversing across traffic and must not do so until it is clear of hazard/traffic. The driver of Unit#1 (Lindbeck) violated RCW 46.61.185.1 by being the driver of a vehicle intending to turn to the left within an intersection and shall yield the right-of-way to any vehicle approaching from the opposite direction which is within the intersection or so close thereto as to constitute an immediate hazard. Unit#1 (Lindbeck) also committed two (2) counts of Hit-and-Run -one Attended and one Unattended count by being involved in an accident with another vehicle, which is attended and unattended, and failing to stop and remain at the scene until fulfilling all statutory duties (provide name, address, insurance company, policy, vehicle license, exhibit driver's license and render reasonable assistance to any person injured). I cited Lindbeck via complaint for the two (2) counts of hit-and-run and by mail for the failure to yield to a motor vehicle during a left turn. On 09/28/2023 at 1627 hours, I attempted contact with Lindbeck at the registered address of Unit#1; 1822 Queen PI NE, Renton. A male answered the door claiming to be the husband of Lindbeck. The male stated that Lindbeck had gone to a dentist appointment and should be back later. I informed the male of the incident which he seemed genuinely surprised by the information. The male and a teen- aged female who was also at the residence, had begun several attempts to reach Lindbeck by phone but had negative results. I provided the male with my business card and case number and asked that Lindbeck reach out to me regarding her statement and insurance information. On 09/27/2023 at 0752 hours, I received an email from Attorney Greg Schwesinger. Schwesinger stated in the email that Lindbeck wished to exercise her fifth amendment and that any further communication from the Police Department should be routed through him as Lindbeck's legal representation. Schwesinger did provide me with Lindbeck's insurance information which I forwarded to the other involved parties. On 09/27/2023 at 1600 hours, I returned to the registered address of Unit#1 at the request of City of Renton prosecutor's office to obtain photos of Unit#1 at the residence. Upon arrival, I observed Unit #1 parked in the driveway. From plain-view and while standing on public property, I captured photos of Unit#1 parked at the Lindbeck residence with what appeared to be recent damage to the front driver's side bumper and quarter panel. This was consistent with where the damage was reported by other involved parties and witnesses. The photos have since been uploaded to evidence.com under PAGE 4 OF 7 REPORT NO.
