SUBJECT: Chen Dentistry Building Required Street Improvements
Dear Mr. Adams:
This letter is in reference to the required street improvements needed for the Chen Dentistry
site located at 10912 SE Petrovitsky Road. The subject site is a corner lot located on SE
Petrovitsky and 110'" Ave SE. The improvements to the structure (LUA14-000242 and
813006340) trigger conformance with street standards unless a different standard is approved
via a modification. You have applied for a waiver of the street improvements, and state that
there are "no similar improvements in the vicinity and there is little likelihood that the
improvements will be needed or required in the next ten (10 years)."
Ultimately, dedication of right-of-way is needed and street improvements to be installed.
Dedication along Petrovitsky will not be required although in the future there may be
improvements to the street corridor to widen the right-of-way. Along 110'", dedication along the
subject site is 1.5 feet. The improvements are for a sidewalk to be installed along 110'" to the
southerly lot line. The sidewalk from Petrovitsky is to be matched, with curb and tie in with the
driveway into the lot with appropriate ADA approaches. No planting strip is required at this
point as the mature vegetation on-site provides for tree and vegetated canopy near the right-of-
way. The sidewalk would need to provide for transition to the unimproved southerly lot. Below
are the criteria reviewed as part of the modification submittal.
RMC4-9-250C requires that decisions regarding the waiver of street improvements be based on
the following:
a. Required street improvements will alter an existing wetlands or stream, or have a
negative impact on a shoreline's area.
Staff Comment: Nat applicable for either SE Petravitsky Rood or 110"' Ave SE.
b. Existing steep topography would make required street improvements infeasible.
Staff Comment: Not Applicable for either SE Petrovitsky Road or 11o'• Ave SE.
c. Required street improvements would have a negative impact on other properties, such
as restricting available access.
Staff Comment: Improvements existing on SE Petrovitsky Road. Access is currently

available /ram 110th Ave SE. Requiring the full frontage improvements on 110,. Ave SE
would require the removal of mature trees and landscaping and would result in a
negative aesthetic impact to the area. Therefore, the requirement for street improve

Staff Comment: There are currently no similar improvements on SE Petrovitsky Road
and it is unlikely that the improvements will be needed within the next 10 years. For
110th Avenue SE, only 30 feet of sidewalk and curb presently exist. The applicant will be
required to construct the additional sidewalk and curb along 110th Ave SE to match the
existing sidewalk. And, the applicant will be required to dedicate an additional 1.5 feet
of right-of-way along 11~ Ave SE as the right-of-way is presently 50 feet wide, and
should be 53 feet wide for the future (with one-half of the required dedication being the
responsibility of this property).
e. In no case shall a waiver be granted unless it is shown that there will be no detrimental
effect on the public health, safety or welfare if the improvements are not installed, and
that the improvements are not needed for current or future development. (Ord. 5137, 4-
25-2005)
Staff Comment: The waiver of improvements is for SE Petrovitsky only. A modification is
being granted for 11~ Ave SE to provide for dedication of 1.5 feet of frontage, and for
the construction of sidewalk and curb to match the existing configuration.

and application submittal items for construction of the street improvements at 425-430-7216.

I H. FINDINGS OF FACT:
1. The applicant, Hua Allen Chen & Lan Alice Chen of Chen Dentistry, are requesting Administrative Site
Plan Review and a Lot Combination for the combination of two parcels and expansion of an existing
two-story 4,012 sf building by 223 sf for a dental office.
2. The Administrative Site Plan Review is optional to allow a setback reduction for a small building
addition.
3. The Planning Division of the City of Renton accepted the above master application for review on
February 27, 2014 and determined complete on March 5, 2014. The project complies with the 120-day
review period.
4. The two parcels to be combined into one are under same ownership, where the west lot is 6,827 sf and
the east lot is 6,300 square feet.
5. The proposal consists of many minor improvements to the already existing two story office structure
and associated parking area, entry, and driveway; the minor improvements include extending the front
fa~ade upper story cantilever to the ground level, refacing the structure with new materials, adding
more glazing to the structure, restriping the existing parking stalls, reducing the slope of the entry to
the site, and expanding the front entry area.
6. The proposed structure has a height of approximately 29 feet and 6-inches at the tallest point of the
extended shed roof line (Exhibit 3).

8. The subject site is located on the southeast corner of the intersection of SE Petrovitsky Rd and 110th
Ave SE (Exhibit 1).
9. The property is located within the Commercial Corridor (CC) Comprehensive Plan land use designation
and the Commercial Arterial (CA) zoning classification.
10. The site currently has a building on the westerly parcel and associated parking and landscaping on the
easterly parcel where both parcels will be consolidated as a condition of approval through a Lot
Combination.
11. Access to the site is provided through a curb cut off 110th Ave SE (Exhibit 2).
12. The site is generally flat in the western portion of the site with a 5 foot drop and slope from the 110th
Ave SE street into the parking area in the eastern portion of the site (Exhibit 2).
13. Pursuant to the City of Renton's Environmental Ordinance and SEPA (RCW 43.21C, 1971 as amended),
the proposal is exempt from SEPA Environmental Review.
14. Representatives from various city departments have reviewed the application materials to identify and
address issues raised by the proposed development. These comments are contained in the official file,
and the essence of the comments have been incorporated into the appropriate sections of this report
and the Departmental Recommendation at the end of this report.
15. Public comments were not received.
16. The proposal requires a Lot Combination as part of the proposed building entry improvements would
be onto the abutting easterly property. The Lot Combination has been reviewed by city staff and
advisory notes on the requirements for approval are provided in Exhibit 6.
17. The proposal requires Site Plan Review in order to reduce the front yard setback for the expansion of
the structure. The following table contains project elements intended to comply with Site Plan Review
decision criteria, as outlined in RMC 4-9-200.E:

yard along-a-street setback of 10 feet which may be reduced to zero feet during the site pion

is o maximum front yard setback of 15 feet. The CA zone hos no rear or side yard setback except 15
feet if lot abuts or is adjacent to o residential zone.

The applicant is proposing a reduced front yard along-a-street setback down to a minimum setback
of 4'5" along SE Petrovitsky Rd. The building elevations indicate various new building materials
would be used to replace the existing facades in order to add texture to the all building elevations
including the street frontage facade which has a length of 65 feet. These materials include porclain
tile, metal panels, and new glazing. The new square footage added to the first floor along the front
yard setback along a street will have significant glazing to keep from creating a "blank wall." If the
conditions of approval are complied with the applicant will achieve visual interest along the fa,ade
facing the SE Petrovitsky Rd. Therefore staff supports the proposed reduction in the side yard along-
a-street setback from 10 feet to 4'5" at the northwest corner of the front fa,ade and 4'7" feet along
the northeastern corner of the front fa,ade if all conditions of approval are met. The proposal
complies with all other setback requirements of the zone.
Building Height: Per RMC 4-2-120A building height is restricted to 50 feet, except 60 feet with
residential use, and above these allowances o conditional use permit would be require.
The height of the proposed structure would be 29 feet at the tallest point of the projecting shed roof
of the clerestory wall (Exhibit 3) which is the same height as the existing structure. The proposal
complies with the height requirements of the zone.

Building Standards: Per RMC 4-2-120A the allowed lot coverage is 65 percent for proposals within the
CA classification.
The proposed building would have an approxmiate footprint of 2,300 square feet on the 13,128
square foot lot resulting in a building lot coverage of approximately 18 percent.
landscaping: Per RMC 4-4-070, on-site landscaping is broken into these separate areas:
Along Streets: Ten feet of on-site landscaping is required along all public street frontages, with the
exception of areas for required walkways and driveways and those zones with building setbacks
Jess than ten feet {10'}. In those cases, ten feet (10') of landscaping shall be required where
buildings are not located per RMC 4-4-070.
Visual Buffer between residential and non-residential development: A fifteen-foot (15') wide
partially sight-obscuring landscaped visual barrier, or ten-foot (10'} wide fully sight-obscuring
landscaped visual barrier, is required along common property lines when a commercial Jot or use is
abutting a residential zone.
Perimeter Parking lot: Parking areas shall have a minimum of 10 feet in width of landscaping as
measured from the street right-of-way.
Interior Parking lot: Surface parking lots with more than 14 stalls shall be landscaped where this
proposal with 17 total spaces would need 15 square feet of landscaping per space, or 255 square
feet.
Staff Comment: Much of the site has mature or existing, maintained, landscaping including a mix of
mature trees, shrubs and groundcover around the site and parking areas. No new landscaping or
landscaped areas are proposed. Pursuant to RMC 4-4-070.CZ, alterations or small additions, as
determined by the Administrator of the Department, that do not warrant improvements to the entire
site may be exempt from the landscape regulations of RMC 4-4-070. Existing mature landscaping at
the subject site consists of:
Along Streets: Along SE Petrovitsky Rd, there is landscaping along the whole street frontage. The
building projects into the 10 foot setback so there is less landscaping depth than 10 feet. East of
the building there is between 7 and 16 feet of landscaping depth to the parking area. Along 110'"
Ave SE there is a landscape strip width between 7 and 20 feet.
Visual Buffer between residential and non-residential development: There is an existing fully
sight-obscuring landscaped visual buffer between the southern single family home and the subject
site, where there is a fully sight-obscuring fence along the shared property line in addition to a
range of landscaped area between 4 and 10 feet where mature trees are located. The properties
abutting the subject site to the west is a commercial use, so no sight-obscuring landscaping is
required.
Perimeter Parking Lot: There is a minimum of 10 feet of existing landscaping between the street
and parking areas. Along SE Petrovitsky Rd, there is between 7 and 16 feet of landscaping
between parking areas and the street. Along 110'" Ave SE there is a landscape strip width that
varies between 7 and 20 feet.
Interior Parking Lot: 255 square feet of parking lot interior landscaping would be required. There
are existing interior parking landscaping areas existing that provide breaks between rows of stalls.
The square footage of this existing landscaped area is unknown.
Staff concludes that there is existing mature landscaping in each of the areas where landscaping is
required by current code, along streets, between residential and the commercial site, and within and
around the parking areas. Staff concludes that the improvements to the overall site are not
significant enough to cause the landscaping to be improved or revised to meet existing code through

the exemption allowance within the Landscaping code 4-4-070C.2.e, where it is recommended that
the Administrator not require improvements to the entire site.
Refuse and Recyclables: Per RMC 4-4-090 for medico/ and dental offices a minimum of 2 square feet
per every 1,000 square feet of building gross floor area shall be provided far recyclable deposit areas
and a minimum of 4 square feet per 1,000 square feet of building gross floor area shall be provided
for refuse deposit areas with a total minimum area of 100 square feet.
The applicant has an existing refuse and recyclable deposit area that is roughly 80 square feet,
located in the western area of the site at the west edge of the building away from vehicle and
pedestrian areas. The refuse area is screened by both vegetation and fencing. The proposal is not a
new development, where there have been commercial uses and the existing building at the site
historically, so the refuse and recyclables requirements do not apply to this project and the existing
deposit area does provide adequate refuse and recyclables function.
Vehicles: Per RMC 4-2-120 a connection shall be provided for site-ta-site vehicle access ways, where
topographically feasible, to allow a smooth flaw of traffic across abutting CA parcels without the need
ta use a street. Access may comprise the aisle between raws of parking stalls but is not a/lawed
between a building and a public street.
This section of code is intended to provide vehicular connections to abutting commercial uses. The
existing site development does not provide a connection to the CA property to the east. The
applicant is not proposing to change the parking area square footage or width of the drive aisles or
access point to the property from the public street as part of the subject remodeling and minor site
improvements. This is not a demolition of an existing building to create a new layout, new parking
area or new building on the property. As such, compliance with this standard is outside the scope of
the project.
Critical Areas: There are no critical areas located on site.
Parking: The parking regulations, RMC 4-4-080, require a specific number of off-street parking stalls
for bicycles and vehicles unless exempt from the requirement.
Staff Comment: The project is exempt from the vehicle and bicycle parking regulations per RMC 4-4-
080.B.1.iv where, a change of use that requires more parking than the previous use would require
parking standards to be met. The change of use does not require more parking than the previous
office use. The existing site provides 17 vehicle stalls on-site, and no more than 12 would be required
for the proposed use as a dental office. Additionally, the bicycle parking regulations do not apply
through the same exemption.
Sidewalks, Pathways, and Pedestrian Easements:
Staff Comment: The applicant is proposing a new corner patio as part of the primary entry into the
building between the building and parking area. There is no existing pedestrian connection to the
building from the sidewalk on SE Petrovitsky or from llO'h Ave SE. Further analysis of this element is
found below in the Design Regulation Compliance and Consistency -"iii. Pedestrian Environment"
subsection where staff comments and recommendation are made.

i. SITE DESIGN AND BUILDING LOCATION:
Intent: To ensure that buildings are located in relatian to streets and other buildings so that the Vision of
the City of Renton can be realized for a high-density urban environment; so that businesses enjoy visibility
from public rights-of-way; and to encourage pedestrian activity.
1. Building Location and Orientation:
Intent: To ensure visibility of businesses and to establish active, lively uses along sidewalks and
pedestrian pathways. To organize buildings for pedestrian use and so that natural light is available to
other structures and open space. To ensure an appropriate transition between buildings, parking areas,
and other land uses; and increase privacy for residential uses.
Guidelines: Developments shall enhance the mutual relationship of buildings with each other, as well as
with the roads, open space, and pedestrian amenities while working to create a pedestrian oriented
environment. Lots shall be configured to encourage variety and so that natural light is available ta
buildings and open space. The privacy of individuals in residential uses shall be provided for.
Standard: The availability of natural light (both direct and reflected) and direct sun exposure

Staff Comment: The existing building on a corner lot provides a street presence along the
arterial Petrovistsky but the entry is oriented to the other street 110'h Ave SE. The building is
without a clear connection to the sidewalk along the arterial Petrovistsky where the
sidewalk connects to a larger network of pedestrian connections within the area. Staff
recommends as a condition of approval that a pedestrian path be installed, which would
connect the sidewalk with the building entry that meets ADA compliance regulations.

sidewalk a minimum of ten feet (10') and feature substantial landscaping between the
sidewalk and the building or have the ground floor residential uses raised above street level
for residents privacy.
2. Building Entries:
Intent: To make building entrances convenient to locate and easy to access, and ensure that building
entries further the pedestrian nature of the fronting sidewalk and the urban character of the district.
Guidelines: Primary entries shall face the street, serve as a focal point, and allow space for social
interaction. All entries shall include features that make them easily identifiable while reflecting the
architectural character of the building. The primary entry shall be the most visually prominent entry.
Pedestrian access to the building from the sidewalk, parking lots, and/ar other areas shall be provided
and shall enhance the overall quality of the pedestrian experience on the site.

Staff Comment: The building and entry are already existing. Staff recommends as a

Standard: A primary entrance of each building shall be made visibly prominent by
incorporating architectural features such as a facade overhang, trellis, large entry doors,
and/or ornamental lighting.
Staff Comment: The proposal includes new railing for the primary entry and an ADA ramp in
addition to a new larger entry patio, and entry fa~ade materials to provide greater presence

new buildings differ from surrounding development in terms af building height, bulk and scale.
Standard: At least one af the fa/lawing design elements shall be considered ta promote a
transition to surrounding uses:
(a) Building proportions, including step-backs on upper levels;
(b) Building articulation ta divide a larger architectural element into smaller
increments; or
(c) Roof lines, roof pitches, and roof shapes designed to reduce apparent bulk and
transition with existing development.

Staff Comment: A variety of building articulations and roof lines already exist as part of the
structure and proposed to be very similar. An upper story projection on the front fa,ade will
be dropped vertically to the ground level where the lower story is proposed to project out
as a new enclosure to create new building square footage.
4. Service Element Location and Design:
Intent: To reduce the potential negative impacts af service elements (i.e., waste receptacles, loading
docks) by locating service and loading areas away from high-volume pedestrian areas, and screening
them from view in high visibility areas.
Guidelines: Service elements shall be concentrated and located so that impacts to pedestrians and other
abutting uses are minimized. The impacts of service elements shall be mitigated with landscaping and an
enclosure with fencing that is made of quality materials. Staff Comment: The site has an existing service

Intent: To provide safe, convenient access to the Urban Center and the Center Village; incorporate various
modes of transportation, including public mass transit, in order to reduce traffic volumes and other
impacts from vehicles; ensure sufficient parking is provided, while encouraging creativity in reducing the
impacts of parking areas; allow an active pedestrian environment by maintaining contiguous street
frontages, without parking lot siting along sidewalks and building facades; minimize the visual impact of
parking Jots; and use access streets and parking to maintain an urban edge to the district.
1. Surface Parking:
Intent: To maintain active pedestrian environments along streets by placing parking lots primarily in back
of buildings.
Guidelines: Surface parking shall be located and designed so as to reduce the visual impact of the parking
area and associated vehicles. Large areas of surface parking shall also be designed to accommodate
future infill development.
Standard: Parking shall be located so that no surface parking is located between a building
and the front property line, or the building and side property line, on the street side of a
earner lot.

between businesses, on sidewalks, to and from access points, and through parking lots; and promote the
use of multi-modal and public transportation systems in order to reduce other vehicular traffic.

locations. To create usable and inviting open space that is accessible to the public; and to promote
pedestrian activity an streets particularly at street corners.
Guidelines: Developments located at street intersections should provide pedestrian-oriented space at the
street corner to emphasize pedestrian activity (illustration below). Recreation and common open space
areas are integral aspects of quality development that encourage pedestrians and users. These areas
shall be provided in an amount that is adequate to be functional and usable; they shall also be
landscaped and located so that they are appealing to users and pedestrians

1. Building Character and Massing:
Intent: To ensure that buildings are not bland and visually appear ta be at a human scale; and ensure
that all sides of a building, that can be seen by the public, are visually interesting.
Guidelines: Building facades shall be modulated and/or articulated to reduce the apparent size of
buildings, break up long blank walls, add visual interest, and enhance the character af the neighborhood.
Articulation, modulation, and their intervals should create a sense of scale important to residential
buildings.
Standard: All building facades shall include modulation or articulation at intervals of no

architectural features such as a facade overhang, trellis, large entry doors, and/ar ornamental lighting
(illustration below). Detail features should also be used, to include things such as decorative entry paving,
street furniture (benches, etc.), and/or public art.

Loading and Storage Areas: Locating, designing and screening storage areas, utilities, rooftop
equipment, loading areas, and refuse and recyclables to minimize views from surrounding properties.
Staff Comment: Existing mature landscaping will be kept as it is incorporated into the site already in
order to screen refuse and recyclable areas.
Views: Recognizing the public benefit ond desirability of maintaining visual accessibility to attractive
natural features.
Staff Comment: There are no large attractive natural features on or near the site for which to
maintain visual accessibility.
Landscaping: Using landscaping to provide transitions between development and surrounding
properties to reduce noise and glare, maintain privacy, and generally enhance the appearance of the
project.
Staff Comment: See Landscaping subsection under Zoning Compliance and Consistency. The existing
mature landscaping does enhance the appearance of the proposal.
Lighting: Designing and/or placing exterior lighting and glazing in order to avoid excessive brightness
or glare to adjacent properties and streets.
Staff Comment: The lighting on site should adequately provide for public safety without casting
excessive glare on adjacent properties. Staff recommends, as a condition of approval, the applicant

Structure Placement: Provisions for privacy and noise reduction by building placement, spacing and
orientation.
Staff Comment: The exisitng structure is placed in to the north of the site, near the arterial, and
furthest away from the southerly single family zoned lot (Exhibit 2). The proposed structure is
located as far from abutting single family zoned property and structure as possible. Service elements
have been located away from the pedestrian oriented spaces in order to minimize their impact on
the pedestrian environment.
Structure Scale: Consideration of the scale of proposed structures in relation to natural
characteristics, views and vistas, site amenities, sunlight, prevailing winds, and pedestrian and vehicle
needs.
Staff Comment: The scale and bulk of the building is reduced through the use of differing materials
on the building facades and a variable roofline. Architectural features and building treatments have
been incorporated into the street facing facade (Exhibit 3). The building is existing and the two
additions will continue to allow adequate light and air circulation to the buildings and the site. The
design of the structure would not result in excessive shading of the property. In addition, there is
ample area surrounding the building to provide normal airflow.
Natural Features: Protection of the natural landscape by retaining existing vegetation and soils, using
topography ta reduce undue cutting and filling, and limiting impervious surfaces.
Staff Comment: Existing mature vegetation will be kept as part of the proposal. No trees are

proposed to be removed. A small amount of excavation is proposed to decrease the slope of the
existing driveway, to below 15% as required by code. The proposed grading would not impact
existing vegetation.
Landscaping: Use of landscaping to soften the appearance of parking areas, to provide shade and
privacy where needed, to define and enhance open spaces, and generally to enhance the appearance
of the project. Landscaping also includes the design and protection of planting areas so that they ore
less susceptible ta damage from vehicles or pedestrian movements.
Staff Comment: The existing landscaping is used to provide a transition between the development
and streets on this corner lot. The mature landscaping softens the appearance of the parking areas
and generally enhances the appearance of the project.
g. ACCESS:
Location and Consolidation: Providing access points on side streets or frontage streets rather than
directly onto arterial streets and cansolidotion of ingress and egress points on the site and, when
feasible, with adjacent properties.
Staff Comment: The site has two public street frontages, SE Petrovitsky Rd (Arterial) and 110th Ave SE.
There is an existing curb cut along 1101h Ave SE. The proposed development is expected to maintain
the safety and efficiency of pedestrian and vehicle circulation on the site if all conditions of approval
are complied with including the addition of a pathway between the sidewalk along Petrovitsky and
the building front entry.
Internal Circulation: Promoting safety and efficiency of the internal circulation system, including the
location, design and dimensions of vehicular and pedestrian access points, drives, parking,
turnarounds, walkways, bikewoys, and emergency access ways.
Staff Comment: See Location and Consolidation discussion above. Additionally, the driveway slope
cannot be greater than 8% without Administrator approval. The slope into the parking area is 17%.
The applicant is proposing to re-grade to a slope of 11% as shown in the Site Plan project summary
(Exhibit 2). The Administrator approves the slope up to the 11% but cannot approve a slope greater
than 15%. The proposal is to re-stripe parking stalls to meet the minimum stall size standard width of
9 feet. The project proposal complies with required drive aisle widths and parking stall dimensions.
Loading and Delivery: Separating loading and delivery areas from parking and pedestrian areas.
There are no dedicated loading or delivery areas proposed on site.
Transit and Bicycles: Providing transit, carpools and bicycle facilities and access.
Staff Comment: A major neighborhood bus connection area is within two blocks of the site, just east
at the intersection of 1081h Ave SE/Benson Rd/State Highway 515 and SE Carr Rd/SE Petrovitsky Rd.
Additionally, transit is available going east and west along both sides of SE Petrovitsky Rd and the
where the proposal site is located to connect to other areas of Renton and other neighborhoods.
Pedestrians: Providing safe and attractive pedestrian connections between parking areas, buildings,
public sidewalks and adjacent properties.
Staff Comment: There are no pedestrian connections to the arterial SE Petrovitsky. A pedestrian
connection should be made from the front entry to the sidewalk along SE Petrovitsky. Staff has
recommended, as a condition of approval, the applicant be required to revise the site plan in order to
incorporate the additional pedestrian connection on site in from the arterial to the building entry.

SE. There is an existing curb cut along llO'h Ave SE for entry and exiting. Dedication of right-of-way is
required along 110th Ave SE along with street improvements. There is no right-of-way dedication
required along Petrovitsky although the city acknowledges that in the future, this arterial may be
expanded and require dedication.
It is anticipated that the proposed project would result in impacts to the City's street system. In
order to mitigate transportation impacts the applicant would be required to pay an appropriate
Transportation Impact Fee. A fee, as determined by the Renton Municipal Code at the time of
payment, shall be payable to the City as specified by the Renton Municipal Code at the time of
building permit issuance.

Water and Sewer: Water service is provided by Soos Creek Water and Sewer District and a water

the City or within the immediate area of the proposed use. The proposed location is suited for the
proposed use.
9. The existing use would not result in a substantial or undue adverse effect on adjacent properties. The
construction of a new structure would result in an overall improvement of the visual environment.
10. Adequate parking for the proposed use has been provided.
11. The proposed site plan ensures safe movement for vehicles and pedestrians and has mitigated
potential effects on the surrounding area if all conditions of approval are complied with.
12. The proposed development would not generate any long term harmful or unhealthy conditions.
Potential noise, light and glare impacts from the proposed use have been evaluated and mitigated if all
conditions of approval are complied with.
13. Existing landscaping is provided in all areas not occupied by the building or paving.
II J. DECISION
The proposed site plan for CHEN DENTISTRY, File No. LUA14-000242, SA-A, LC is approved and is subject to the
following conditions:
1. The applicant shall be required to provide a pedestrian connection from the sidewalk along SE
Petrovitsky Rd and the front entry of the building. The revised Site Plan shall be submitted to and
approved by the Current Planning Project Manager prior to building permit approval.
2. The applicant shall be required to provide a separate sign permit application to be reviewed and
approved. No signage shown in the Site Plan application is approved through this land use action.
3. The applicant shall be required to provide a lighting plan that adequately provides for public safety
without casting excessive glare on adjacent properties at the time of building permit review.
Downlighting shall be used in all cases to assure safe vehicular movement in an area where pedestrians
could be walking. The lighting shall be submitted to, and approved by, the Current Planning Project
Manager prior to building permit approval.
4. The applicant shall meet the requirements of the Advisory Notes (Exhibit 6) for dedication of right-of-
way along 110th Ave SE and street frontage improvements unless a modification is applied for and
approved as described in the notes. No dedication of right-of-way or street frontage improvements are
required along SE Petrovitsky Rd.

following comments·
EXISTING CONDITIONS
WATER Water service will be provided by Soos Creek Water and Sewer District. A water availability certificate will be required
to be submitted to the City prior to building permit application.
SEWER Sewer seivice will be provided by Soos Creek water and Sewer District. A sewer availability certificate will be
required to be submitted to the City prior to building permit application.
STORM There are storm improvements in SE Petrovitsky Road and in 110th Ave SE.
STREETS There are frontage improvements in SE Petrovitsky.
CODE REQUIREMENTS
TRANSPORTATION/STREET
1. Transportation impact fees wlll be owed for this new use Credit will be given for the existing use. The transportation impact
fee that is current at the time of building permit application will be levied.
2. SE Petrovitsky Road is classified as a principal arterial. The city has plans to widen SE Petrovitsky Road in the future. Street
improvements along the south side of the road will include an 8-foot planting strip, an 8-foot sidewalk, 1-foot back of sidewalk
and a pavement width of approximately 22 feet from the fronl of curb. To accommodate this widening in the future, up to twelve
feet at the west end and five feet at the east end of the site will be required to be dedicated to the city.
Existing right-of-way width in 110th Ave SE fronting the site is 50 feet. 110th Ave SE is classified as a residential access street.
To meet the City's complete street standards, street improvements including a pavement width of 13 feet from the center line,
ci..rb, gutter, an a-foot planter strip, 5-foot sidewalk, and storm drainage improvements are required lo Le cunstructed in the right
of way fronting the site per Crty code 4-&-060. To build this street section, one and half feet of right-of-way dedication is
required fronting the site in 110th Ave SE. There is no sidewalk fronting the site in 110th Ave SE
3. A final survey will be required to determine the exact dedication requirement along SE Petrovitsky Road.
4. Applicant may submit an application to the City requesting a modification to the street frontage improvements as outlined in City
c.ode 4-9-250C5d. Request shall be in writing addressed to Jennifer Henning, Planning Director. The request will be submitted
through the plan reviewer
5 Comer lots reqwre a minimum radius of 15-feet of dedication. A curb ramp meeting current ADA standards may be required.
6. Paving and trench restoration will comply with the City's Trench Restoration and Overlay Requirements.
GENERAL COMMENTS
1. Separate permits and fees for street improvements will be required.
2. All construction utility permits for drainage and street improvements will require separate plan submittals. All utility plans
shall confonn to the Renton Drafting Standards. A licensed Civil Engineer shall prepare the civil plans.
3. Rockeries or retaining walls greater than 4 feet in height will be require a separate building permit. Structural calculations
and plans shall be submitted for review by a licensed engineer. Special Inspection is required.

5. The applicant shall erect and maintain six foot (6') high chain link temporary construction fencing around the drip lines of all
retained trees, or along the perimeter of a stand of retained trees. Placards shall be placed on fencing every fifty feet (50')
indicating the words, "NO TRESPASSING -Protected Trees" or on each side of the fencing if less than fifty feet (50'). Site access
to individually protected trees or groups of trees shall be fenced and signed. Individual trees shall be fenced on four (4) sides In
addition, the applicant shall provide supervision whenever equipment or trucks are movmg near trees.

The revised code of Washington (RCW) Section 58.17.040 (6) allows for adjusting the boundary
(combining) line between contiguous properties provided that:
• No additional parcels, sites, tracts, or lots are created; and
• No parcels are established which have insufficient area or setbacks as
required by zoning or other regulations.
In order to insure that a Lot Combination meets these requirements, it must be reviewed by the Department of
Communrty and Economic Development. Once approved, it must be recorded with the King County Recorder's
Office.
REQUIRED ELEMENTS OF A DECLARATION OF LOT COMBINATION (SEE SAMPLE COPY ATTACHED) ARE AS
FOLLOWS:
1. The Declaration of Lot Combination document must contain the complete and accurate legal descriptions,
including any recorded easements along with the parcel number(s) of the existing/original. When completed,
the document must contain the notarized acknowledgements and signatures of ALL involved parties;
2. An accurate drawing of the existing/original and the revised/combined parcels, depicting the parcel
number, the location of all roads, easements, structures, and other features. The drawing does not need to
meet a particular scale, but it must be legible and clearly show property dimensions, distances from all
structures to property lines, and an arrow pointing north. A clear one (1) inch margin shall be left on all
four (4) sides of the drawing. Drawings should not exceed 8 Y." x 14" in size. The existing/original lots
must be labeled Parcel A, Parcel B, and so on;
3. Deeds, deeds of trust, or mortgage releases if ownership is being transferred;
4. "Declaration of Lot Combination" must be clearly filled in with dark ink printing or typing. The document must
have exact State required margins as follows: 3" Top Margin, 1" on each Side and Bottom of the page (your
return address can be within the 3" top margin). All other sheets must have 1" margins on both sides.
Once drafted, the original proposed Lot Combination documents (including items 1 through 4 above) plus one
(1) copy of each submittal item shall be submitted to Department of Community and Economic Development
along with any applicable processing fee. In the application, be sure to attach the name, address, and phone
number of the person who should be contacted when the Declaration of Lot Combination is ready to record or if
a problem arises.
When approved, the applicants are notified that their Declaration of Lot Combination Documents are ready for
recording with King County, along with necessary supportive documents such as an excise tax affidavit deed(s),
deed(s) of trust, or mortgage releases. One (1) copy of the recorded document shall be returned to
Development Services, and one (1) copy to the King County Assessor's Office, to assure proper processing of
the revised parcels.
CAUTION: Applicants may wish to obtain a title report and have the Declaration reviewed by a licensed land
surveyor and/or title officer to ensure that all deeds, legal descriptions, and maps are correct and accurate. The

1. The term "mortgage" when used herein shall include deed of trust, trust deed, or other security
instrument.
2. If the proposed Insured has or acquires actual knowledge of a defect, lien, encumbrance,
adverse claim or other matter affecting the estate or interest or mortgage thereon covered by
this Commitment, other than those shown in Schedule B hereof, and shall fail to disclose such
knowledge to the Company in writing, the Company shall be relieved from liability for any loss or
damage resulting from any act or reliance hereon to the extent the Company is prejudiced by
failure to so disclose such knowledge. If the proposed Insured shall disclosure such knowledge
to the Company, or if the Company otherwise acquires actual knowledge of any such defect, lien,
encumbrance, adverse claim or other matter, the Company at its option, may amend Schedule B
of this Commitment accordingly, but such amendment shall not relieve the Company from liability
previously incurred pursuant to paragraph 3 of these Conditions and Stipulations.
3. Liability of the Company under this Commitment shall be only to the named proposed Insured
and such parties included under the definition of Insured in the form of Policy or Policies
committed for, and only for actual loss incurred in reliance hereon in undertaking in good faith
(a) to comply with the requirements hereof, or (b) to eliminate exceptions shown in Schedule B,
or (c) to acquire or create the estate or interest or mortgage thereon covered by this
Commitment. In no event shall such liability exceed the amount stated in Schedule A for the
Policy or Policies committed for and such liability is subject to the Insuring provisions, exclusion
from coverage, and the Conditions and Stipulations of the form of Policy or Policies committed for
in favor of the proposed Insured which are hereby incorporated by references, and are made a
part of this Commitment except as expressly modified herein.
4. Any claim of loss or damage, whether or not based on negligence, and which arises out of the
status of the title to the estate or interest or the lien of the Insured mortgage covered hereby or
any action asserting such claim, shall be restricted to the provisions and Conditions and
Stipulations of this Commitment.
