All 4 dogs are Shih Tzus, and all are approximately under 10 pounds each. The property is a total of 9,900 square feet. A 5 foot tall wood fence exists around the entire rear yard area. A small enclosed dog run (approximately 7 feet x 10 feet) is currently installed on the south portion of the property, between the side of the house and the south property line. This dog run is connected to an indoor dog house by a pet gate that the dogs can use to freely access both the indoors and enclosed outdoor dog run. The applicant has indicated that all 4 dogs wear bark collars to prevent barking. DECISION CRITERIA: The Planning Division Director shall review requests for Additional Animals Permits for compatiblity of the proposal with the surounding neighborhood. In order to determine that the site and facility will be adequate and to ensure the humane and appropriate care of the animals, the Planning Division Director may require that the property be inspected by an Animal Control Officer. Factors to be considered in determining compatiblity and adequacy are: 1. Will the keeping of additional animals have an adverse effect on abutting or adjacent properties or cause a detriment to the community? Comments: The applicant is requesting an additional animals permit in order to keep 1 additional dog than the maximum of 3 allowed per code (Renton Municipal Code, Section 4-4-0lOG.1.). The dogs in question are 4 sibling Shih Tzus that are approximately seven years old, which the applicant has had since birth. City staff agrees that one additional dog will not adversely effect the abutting or adjacent properties, or cause a detriment to the community, any more than the three permitted dogs. Is there a past history of animal control complaints regarding animals kept by the applicant? Comments: One complaint per Animal Control research regarding excessive barking. The applicant has indicated that all 4 dogs wear bark collars to prevent barking. 3. Do adequate and appropriate facility and rear yard specifications/dimensions exist that ensure the health and safety of the animals? Comments: Confirmed per Animal Control Inspection. 4. Are the animals' sizes, types, and characteristics of breed compatible with the adequacy of the site and facilities? Comments: Confirmed per Animal Control Inspection. 5. Is the animal waste product managed in a safe, clean and odor-free manner? Comments: Confirmed per Animal Control Inspection. 6. Is the request for additional animals compatible with the zoning classification of the premises on which the keeping of additional animals is to occur? Comments: Yes, provided this Additional Animals Permit is approved. 7. Keeping of Additional Large Lot Animals Requirements: If the application is for keeping of additional large lot animals does the applicant provide a copy of the adopted farm management plan based on the King County Conservation District 1s Farm Conservation and Practice Standards? Comments: N/A 8. Keeping of Additional Large Lot Animals Requirements: Is there adequate pasturage to support a greater number of animals? Comments: N/ A 9. If the application is for animal foster care provider, has the applicant kept paperwork for all foster animals which states that the animals are foster animals from a sponsoring organization? (Such paperwork shall be provided upon request to City officials) Comments: N/A 10. Is the shelter location located a minimum of ten (10) feet from any property line and in the rear yard? (Note: Unless Planning Division determines that a side yard would be a better location.) Comments: The dogs are sheltered indoors. 11. Is the subject lot smaller than one (1) gross acre in size? If so, are dog-runs, open-run areas and permanent/temporary kennel structures surrounded by a fence of adequate height, located a minimum of ten (10) feet from any property line and in the rear yard? {Note: Unless Planning Division determines that a side yard would be a better location.) The site is fenced and gated. The fence is 5 feet high and is of adequate height to keep the dogs inside the property. The dog-run is installed between the house and the south property line, within the side yard setback. The dog-run is not a minimum of 10 feet from the property line; however, the dog-run is approximately 25 feet from the nearest neighboring home. The dogs are sheltered indoors. The indoor dog shelter directly accesses to the dog-run within the side yard setback, therefore, staff determines that the side yard would be the most suitable location for the dog-run. 12. Is the subject lot larger than one (1) gross acre in size? If so, are dog-runs, open run areas and permanent/temporary kennel structures surrounded by a fence of adequate height, may be located closer than ten (10) feet from any property line and if the dog-run, open run areas and kennel structure is no closer than one hundred (100) feet to any dwelling unit and the location is approved by the Planning Division. Comments: N/ A 13. Are all animals kept in such a manner so as not to create any objectionable noise, odor, annoyance, or become a public nuisance? Comments: Renton Munipical Code, Section 8-7-3; Public Disturbance, Noises, states that "It is unlawful for any person knowingly to cause or make, or for any person in possession of property knowingly to allow to originate from the property, unreasonable noise that disturbs another. Noises constituting a public nuisance shall include, but shall not be limited to, the following sounds or combinations of sounds: Frequent, repetitive or continuous noises made by any animal which unreasonably disturbs or interferes with the peace, comfort or repose of property owners or possessors, except that such sounds made in animal shelters, commercial kennels, veterinary hospitals, pet shops, or pet kennels licensed as such, shall be exempt from this subsection." Per Animal Control Officer comments, "When the dogs are unrestricted they can and do become an issue with barking at any noise from the southern exposure. It was explained to the applicant in order for this to work he is going to have to restrict the times when the dogs have access to the outside, and it should only be when the residents are capable of monitoring the dog's activity. When the dogs become vocal, restrict them to the inside of the residence, and at no time are they to be left out at night or early morning hours." Planning staff agrees with this assessment and recommends a condition of approval that the dogs remain indoors between the hours of 10pm and 8am daily (except for necessary bathroom breaks), and that the dogs will be taken indoors when they become vocal. The applicant shall comply with Renton Municipal Code, Section 8-7-31 and prevent any frequent, repetitive or continuous noises made by their animals which unreasonably disturbs or interferes with the peace, comfort or repose of abutting property owners or possessors. 14. Are animal and food wastes properly removed to keep the kennel free from the infestation of insects, rodents or diseases and from obnoxious or foul odors? Comments: Confirmed per Animal Control Officer Inspection. "CONDITIONS OF APPROVAL: 1. The dogs shall remain indoors between the hours of 10pm and 8am, daily. The doors and windows shall remain closed between those hours to prevent noise from escaping the residence. 2. When the dogs become vocal they shall be immediately restricted to the inside of the residence. 3. The applicant shall comply with Renton Municipal Code, Section 8-7-3, and prevent any frequent, repetitive or continuous noises made by their animals which unreasonably disturbs or interferes with the peace, comfort or repose of abutting property owners or possessors. Appeals to the Examiner are governed by RMC 4-8-110 and more information regarding the appeal process may be obtained from the Renton City Clerk's Office, Reconsideration: Within 14 days of the decision date, any party may request that the decision be reopened by the approval body. The approval body may modify his decision if material evidence not readily discoverable prior to the original decision is found or if he finds there was misrepresentation of fact. After review of the reconsideration request, if the approval body finds sufficient evidence to amend the original decision, there will be no further extension of the appeal period. Any person wishing to take further action must file a formal appeal within the 14-day appeal time frame. Expiration: An Additional Animals Permit shall be valid as long as the keeping of animals has not Date been discontinued for more than one year, the operator is in compliance with the City requirements and has not had the Additional Animals Permit and/or any related home occupation license revoked or renewal refused. In addition, all animals that are required to be licensed shall be individually licensed according to the regulations found in RMC 5-41 Animal Licenses. Failure to renew animal licenses as · required in RMC 5-4 shall trigger review and/or revocation of the Additional Animals Permit.
