The applicant has requested a shoreline exemption for the maintenance and
repair of approximately 4,600 square feet of sidewalk along Mill Avenue South
adjacent to the King County library parking lot. The sidewalk replacement
would run approximately 340 liner feed from the Bronson Way S. bridge south
along Mill Ave. S. The site is located in the Shoreline of the Cedar River,
Reach B, designated Shoreline High Intensity. All trees located along the
street would be preserved. The sidewalk is proposed to be reduced in width
around the trees to provide a larger space, which would reduce the amount of
impervious surface within the shoreline by approximately 72 square feet. A
metro bus shelter is proposed to be removed and replaced in the same
location. The site is also located in a seismic hazard area and a Wellhead
Protection Zone 1.

An exemption from a Shoreline Management Substantial Development Permit is hereby Approved on the
proposed project in accordance with RMC 4.9.190C 'Exemption from Permit System' and for the following
reasons:
Subsection 3: Maintenance and Repair: Normal maintenance or repair of existing structures or
developments, including damage by accident, fire or elements:
a. "Normal maintenance" includes those usual acts to prevent a decline, lapse, or cessation from a lawfully
established condition.

b. "Normal repair" means to restore a development to a state comparable to its original condition, including
but not limited to its size, shape, configuration, location and external appearance, within a reasonable
period after decay or partial destruction, except where repair causes substantial adverse effects to the
shoreline resource or environment.
c. Replacement of a structure or development may be authorized as repair where such replacement is the
common method of repair for the type of structure or development and the replacement structure or
development is comparable to the original structure or development including, but not limited to, its size,
shape, configuration, location and external appearance and the replacement does not cause substantial
adverse effects to shoreline resources or environment
The proposed development is:
Consistent with the policies of the Shoreline Management Act.
Not Applicable to the guidelines of the Department of Ecology where no Master Program has been finally
approved or adopted by the Department.
Consistent with the City of Renton Shoreline Master Program.

MILL AVENUE SOUTH SIDEWALK IMPROVEMENTS
SHORELINE EXEMPTION APPLICATION
PROJECT NARRATIVE
This project consists of the replacement of approximately 4600 ft.2 of sidewalk and 340 lineal feet of
curb and gutter along Mill Avenue South adjacent to the library parking lot. Approximately 80% of the
work will take place within the 200 foot shoreline setback. The existing sidewalk has been damaged by
root heave by three existing mature trees. As part of the sidewalk improvement, the size of the cutouts
for the three trees will be increased significantly thereby improving the health of the trees. At the same
time, the slope and flow of the street gutter will be improved and the existing catch basin upgraded.
Elements of the sidewalk improvement include:
• All trees are being preserved.
• All parking places are being preserved (six spaces will be converted to compact parking from
regular stalls). Previously, of the 72 total parking spaces, only one was a compact space. Now
there will be seven compact spaces.
• The two existing sidewalk wheelchair ramps will be re-created in the same locations.
• Due to the increased size of the tree cutouts, the total impervious surface area will actually
decrease by 72 ft. 2
• Water drainage will be improved due to the new street gutter and curbs and the replacement of
an existing catch basin with a new larger one.
• The bus shelter will be removed, carefully preserved, and then reinstalled after pouring the
concrete. It will be supplied with Metro's next-generation of schedule signage.
The basis for the exemption request is that virtually all the work will be a replacement of existing
features. The use of the site will remain the same. The proposed work will actually improve safety,
drainage, and landscaping.
