The applicant has requested approval of a Special Fence Permit for the installation of
. a 6 foot cedar fence along the side yard along a street (south) property line of 438
Williams Ave S. The property is located within the R-14 zone. The proposed fence
would have a maximum height of 6 feet and would be setback from the sidewalk and
property line a minimum of 24 inches (See Exhibit 1). The proposed fence would be
constructed utilizing treated grade 2 cedar boards, with the graded side facing the
street. The posts would be spaced approximately 8-foot on center, except where
restricted by available length. Landscaping including Emerald Green Arborvitae and
Mondo Grass is proposed within the 2-foot setback along the full length of the fence
to prevent a blank wall appearance (Exhibit 3). The existing fence in this location
(See exhibit 4) is a 4 foot tall metal chain link fence. While the existing fence does
comply with Renton Municipal Code fence regulations, the applicant's proposed
cedar fence does meet the intent of RMC4-4-040, which serves to maintain and/or
create aesthetically pleasing neighborhoods, which can be obtained by encouraging
high quality materials.

The applicant has requested approval of a Special Fence Permit for the installation of
a maximum 6 foot cedar fence within the side yard along a street setback (south
property line) of 438 Williams Ave S. The property is located within the R-14 zone.
The applicant proposes a 24 inch landscape strip between the property line and
fence, rather than the required eight feet per RMC4-4-040D.3.e.ii (See Exhibit 1). The
proposed fence would be constructed utilizing treated grade 2 cedar boards, with the
graded side facing the street. The posts would be spaced approximately 8-foot on
center, except where restricted by available length. The applicant is proposing
landscaping which includes Emerald Green Arborvitae and Mondo Grass within the 2
foot setback along the full length of the fence (Exhibit 3). The applicant argues that,
due to the small size of the backyard, a two foot setback, rather than an eight foot
setback, would be more appropriate in order to preserve more private yard area. City
staff agrees with the applicant's justification for reduced setback, however staff has
determined that two feet is insufficient for an adequate landscape buffer. Therefore
staff recommends approval of this Special Fence Permit request with conditions that,
the landscaped setback is increased from 2 feet to 5 feet, the landscape strip is
installed according to the landscape requirements established in
RMC4-4-040D.3.e.iii, the finished face of the fence shall be oriented to the street,
and the Dogwood tree within the side yard along a street setback is retained and
protective measures put in place.

*CONDITIONS OF APPROVAL:
1 The Dogwood tree within the side yard along a street setback shall be retained and protective measures
put in place during fence installation.
2 The finished face of the fence shall be oriented to the street.
3 There shall be a minimum distance of 5 feet between the property line and proposed fence.
4 The 5 foot landscape strip shall be planted with 11 ground cover plants (minimum 4 inch pots} per 5
linear feet and 5 low shrubs (minimum mature height of 3 feet} per 5 linear feet, and shall comply with
the planting standards of RMC4-4-040D.3.e.iv-vi. An updated landscape plan shall be submitted to the
Current Planning Project Manager for review and approval prior to fence installation.

Appeals of permit issuance must be filed in writing on or before 5:00 p.m. on June 15, 2016, together with the
required fee with: Hearing Examiner, City of Renton, 1055 South Grady Way, Renton, WA 98057. Appeals to the
Examiner are governed by RMC 4-8-110 and more information regarding the appeal process may be obtained from
the Renton City Clerk's Office, 425-430-6510.
Reconsideration: Within 14 days of the decision date, any party may request that the decision be reopened by the
approval body. The approval body may modify his decision if material evidence not readily discoverable prior to the
original decision is found or if he finds there was misrepresentation of fact. After review of the reconsideration
request, if the approval body finds sufficient evidence to amend the original decision, there will be no further
extension of the appeal period. Any person wishing to take further action must file a formal appeal within the
14-day appeal time frame.
