Pursuant to RMC 4-9-2500 the applicant is requesting an Administrative Modification from
RMC 4-6-060 Street Standards to leave the existing Index Avenue NE street section as is and
replace the existing sidewalk in-kind.
BACKGROUND:
Index Ave NE is classified as a residential access street with an existing right-of-way width of 50
feet (as per King County Assessor's Map). The existing traveled way width is 24 feet with an
approximate 4-foot wide sidewalk.
The minimum street width for a residential access street is 53 feet. To meet the City's complete
street standards, street improvements including a pavement width of 26 feet, curb, gutter, an 8
foot planter strip, 5-foot sidewalk, and storm drainage improvements are required to be
constructed in the right of way fronting the site per City code 4-6-060. To build this street
section one and half feet of right of way will be required to be dedicated to the City fronting the
site in Index Ave NL

ANALYSIS OF REQUEST:
The Section 4-6-060Q.1 allows the Administrator to grant modifications provided the
modification meets the following criteria (pursuant to RMC 4-9-250D.2):

a. Substantially implements the policy direction of the policies and objectives of the
Comprehensive Plan land Use Element and the Community Design Element and the
proposed modification is the minimum adjustment necessary to implement these
policies and objectives.
Staff Comment:
The Community Design Element has applicable policies listed under a separate section
labeled Streets, Sidewalks and Streetscapes. These policies address walkable
neighborhoods, safety and shared uses. Considering that the project frontage
represents less than half a residential block and a 10-foot landscape strip is required
along the project frontage, two specific policies support the decision to leave the
existing street section. These policies are Policy CD-102 and Policy CD-103 which state
that the goal is ta promote new development with "walkable places," "support grid and
flexible grid street and pathway patterns," and "are visually attractive, safe, and
healthy environments." The requested street modification is consistent with these pa/icy
guidelines provided that the existing sidewalk is replaced with a 5-foat wide sidewalk
meeting current ADA standards and is tinted ta match the ca/or of the existing sidewalk.
b. Will meet the objectives and safety, function, appearance, environmental
protection and maintainability intended by the Code requirements, based upon
sound engineering judgment.
Staff Comment:
Provided that the existing sidewalk is replaced with a 5-foot wide sidewalk meeting
current ADA standards and is tinted to match the color of the existing sidewalk, the
requested street modification with meet current ADA standards and is consistent with
the surrounding street section.

Staff Comment:
The modification request, if all conditions are met, meets the standards for safe
vehicular and pedestrian use.
d. Conforms to the intent and purpose of the Code.
Staff Comment:
This modification provides a safe pedestrian route in and around the existing
neighborhood.

DECISION
The proposal satisfies 6 of the 6 criteria listed in RMC 4-9-250D.2 for the requested
modification if all conditions of approval are met. Therefore, the street modification for the
Syrbu Short Plat, Project Number LUA16-000386, MOD is approved subject to the following
condition of approval:
1. Replace the existing sidewalk with a 5-foot wide sidewalk meeting current ADA
standards. The new concrete shall have a pigment introduced into it to more closely
match the connecting sidewalk.

We are applying for a Modification (fee in lieu 01) for curbs, gutters, sidewalks and street
drainage along Index Ave NE. Syrbu III Short Plat. No such improvements are now
existing along Index Ave NE in the area of the short plat.
RMC Section 4-9-060 allows for a modification (fee in lieu ot) for street improvements
under special conditions.
Justification for the Modification (fee in lieu 01) is as follows:
a. Implements the policy and direction of the Comprehensive Plan in that a safe
walkway will be provided allowing walkway for children to school and others for
alternate transportation.
b. The new sidewalk proposed fronting the short plat will meet the safety
requirements. The present sidewalk is cracked and could be considered not safe.
The new sidewalk will approve the appearance and maintainability.
c. The construction of a new sidewalk matching the sidewalks on both sides will not
be injurious to other properties but will improve the present situation.
d. Conforms to the intent of the code by providing a safe walkway that is compatible
with the neighborhood.
e. The short plat is an infill situation. Index Ave NE in this area has older residential
uses all with the old street improvements abutting each property. The replacement
of the sidewalk will provide an adequate safe walkway superior to the others in
the area
f. The new sidewalk without the full street improvements will improve the present
situation without the disturbance of the entire street. Other properties will not be
adversely impacted.
