Dear Ms. Owens:
The City of Renton has finished reviewing your proposed lot line adjustment and is now ready to
send the final version for recording. Please submit five sets of original signed lot line
adjustment plan sets and a check for $36.04 made out to Postal Express to my attention at the
sixth floor counter of City Hall.
Please verify that the plan sets have been signed by all owners of record and have been
notarized with an ink stamp (not embossed). The ink stamp must be legible so that King County
will promptly record the lot line adjustment.
This decision to approve the proposed lot line adjustment is subject to a fourteen (14) day
appeal period from the date of this letter. Any appeals of the administrative decision must be
filed with the City of Renton Hearing Examiner by 5:00 pm, October 24, 2016. Appeals must be
filed in writing together with the required fee with: Hearing Examiner, City of Renton, 1055
South Grady Way, Renton, WA 98057. Appeals to the Examiner are governed by RMC 4-8-110
and information on the appeal process may be obtained from the City Clerk's Office, (425) 430-
6510.

Owens Lot Line Adjustment

SUBJECT: Principles of Acceptability of a Lot Line Adjustment
Section 4-7-0608, lists 4 principles of acceptability that the Administrator or designee
considers, along with all other relevant information, when making a decision on a Lot
Line Adjustment application. A lot line adjustment shall be consistent with the following
principles of acceptability:
Check the appropriate box and give analysis, if necessary:
IZJ Correcting: Adjust lot lines including the elimination of a common lot line in
order to correct property line or setback encroachments;
Staff Analysis: The parcels were created by short plat in 1965 under the
jurisdiction of King County. When the lots were segregated a boundary
encroachment was inadvertently created. In order to have marketable title to
both properties the lot line must be adjusted. Both lots currently have single
family homes that were built and permitted to then current code in the 1960's.
IZJ Improving: Create better lot design, or improve access;
Staff Analysis: The proposed lot line adjustment improves access to 11411 SE
160th St and improves lot design by creating setbacks that more closely comply
with the setbacks of the Residential-6 (R-6) zone.
IZJ Approval Criteria:
a. An additional lot, parcel or tract shall not be created; and
b. The subject lots, parcels or tracts are within the same zoning district; and
c. The proposed adjustments shall not cause the lots, parcels or tracts to
increase the nonconformity with respect to applicable zoning (see RMC 4-2),
subdivision and other code requirements pertaining to lot design, building
location, and development standards; and
d. The adjusted lot line(s) is shared by the subject lots.

Staff Analysis: No additional lots or tracts were created as part of this lot line
adjustment. The adjusted lot lines are shared by the subject lots. Both lots
are located within same zoning designation and the lot line adjustment
increases conformity with the current R-6 zoning district by increasing the
west side yard setback at 11411 SE 160th St from -1.9 ft to 11.85 ft and
increasing the rear yard of 16004 114th Ave SE from an average of 23 ft to an
average of 26 ft. The new property lines would more closely comply with
minimum side yard and rear yard setbacks of the zone.
[8J Non-Evasive: Lot line adjustments shall not serve to eliminate or circumvent any
state or local requirements, including but not limited to frontage improvements,
payment of fee-in-lieu, payment of latecomer fees or the installation of required
infrastructure.
a. Assessment of fees, right-of-way dedication and frontage improvements for
the entire length of the property line(s) bordering rights-of-way may be
required as a condition of approval for a lot line adjustment.
b. Lots, parcels or tracts that are increased in area by lot line adjustments shall
not be permitted to be subdivided for five (5) years following the date upon
which the Jot line adjustment is recorded or three (3) years following the
approval of a lot line adjustment, whichever is longer, unless the following is
met:
i. The subdivision application includes all Jots, parcels and tracts involved in
the lot line adjustment in the overall subdivision; or
ii. All required infrastructure, including but not limited to frontage
improvements, required infrastructure and utility lines are constructed
along the frontage of all lots included in the lot line adjustment.
Staff Analysis: The applicant is requesting a Lot Line Adjustment to adjust the
Jots lines between 11411 SE 160th St (parcel no. 0088000064) a 12,756 sf lot and
16004 114th Ave SE (parcel no. 0088000067) a 7,650 sf Jot. The proposed lot line
adjustment would result in a reconfiguration of the existing Jots for marketable
title. The revised lot sizes would be 13,347 sf for 11411 SE 160th St and 7,060 sf
for 16004 114th Ave SE. Both lots would retain their respective single family
home and still comply with the minimum lot size of the R-6 zone. Access to
16004 114th Ave SE would be retained from 114th Ave SE at the southwest
corner of the lot and 11411 SE 160th St would gain access from the 20-foot-wide
private ingress, egress, and utility easement that runs parallel with the north
property line of 16004 114th Ave SE. In addition, a revocable crossing permit and
agreement for vehicular access to use a 12-foot-wide access along SE 160th St
(Not Open), property owned by City of Seattle, Seattle Public Utilities, was also
recorded for access to 11411 SE 160th St (Recording No. 20161006001018). This
decision to approve the proposed lot line adjustment did not include frontage
improvements or right-of-way dedication. Complete street standards under RMC
4-6-060 would be reviewed if a building permit application is submitted.

Recitals
Whereas, the City owns the 30 foot wide Bow Lake Pipeline Right of Way, (herein "BLPL RW"), situated
in the County of King, State of Washington, in the Northeast Quarter of Section 29, Township 23,
· North, Range 6 East, W .M.; and
Whereas, the City operates municipal water transmission pipelines and appurtenances within said BLPL
RW; and
Whereas, the City requires that the BLPL RW and the water transmission pipelines be protected; and
Whereas, Permittees own property adjacent to the BLPL RW, situated in the County of King, State of
Washington, in the Northwest Quarter of Section 29, Township 23 North, Range 6 East, W.M.; and

Whereas, Pennittees have requested from the City pennission for vehicular ingress and egress across the
BLPL RW serve the Permittees' property commonly known as 11411 SE 160th St, Renton WA 98055;
King County Parcel Number 0088000064; and
Whereas, City is willing to pennit said pennission under certain terms and conditions.
Now therefore, for and in consideration of compensation set forth herein, including mutual and off-setting
benefits, if applicable, and subject to the tenns and conditions hereinafter set forth, the parties agree as
follows:
GRANTofPERMITandAGREEMENT
I. Subject to the purposes, terms, conditions, and restrictions herein described, City hereby grants to
Pennittees, a non'"CXclusive and revocable pennit for vehicular ingress and egress across a portion of the
BLPL R W to serve the Pennittees' property situated in the Northwest Quarter of Section 29, Township
23 North, Range 6 East, W.M., County of King, State of Washington; commonly known as 11411 SE
160"' St, Renton WA 98055; King County Parcel Number 0088000064.
2. All references to the City's activities or use of its City Property, including the Pennit Area, shall also
apply to its officers, employees, agents, consultants, contractors, representatives, invitees, or licensees.
LOCATION
South 10 feet of the City of Seattle-owned BLPL R W, which is abutting the North property line of both parcels
0088000064, 0088000067. Beginning 15' West of the Easterly right of way line of 1141h Ave. S. and
extending 105' East, as depicted in EXHIBIT A, attached hereto and made part of this agreement.

Permit Administration Fee: $1,835
Use Fee: At the time of this Permit Agreement, the City considers this use a right of way for vehicular
crossing and there wit.I be no l\llilU&l Use Fee. However, the City reserves the right in accordance with any
future policy to institute an Annual Use Fee.
TERMS and CONDfflONS
A. PURPOSE and USE of the PERMIT AREA by the PERMITTEES
l. Use of a 12 foot wide access is only for the purpose of ingress and egress to one single family house,
11411 SE 160th St, Renton WA 98055, by the Pennittees and their invitees, and not to members
of the general public and not for any commercial purpose.
2. Vehicles entering the Permit Area will be limited to cars, vans, standard pickup trucks including
standard delivery vehicles with a maximum gross vehicle weight (GVW) of 10,000 pounds. No
trailers, equipment or construction/commercial material deliveries are pennitted.
3. Use of the Permit Area by the Permittees is subject to all rules, regulations, and laws governing the
construction, operation and maintenance of such use.
4. City shall not be responsible for the operation, maintenance and safety of the Penni! Area.
5. Pennittees are responsible for limiting the use of the Permit Area to those approved herein.
6. All references to the City shall also apply to City officers, employees, agents, consultants,
contractors, representatives, invitees, or licensees.

7. All references to the Permittees shall also apply to Permittees' employees, agents, consultants,
contractors, representatives, invitees, or licensees, and all actions of Permittees' invitees are
considered to be the same as if performed or caused by the Permittees.
8. The Permit Area may be subject to existing rights and other authorized uses, and the Permittees
shall not interfere with access or use by other such existing rights and other authorized uses.
9. Permittees agree to comply with all applicable laws and regulations, and to procure any other
permits that may be required for this project.
10. This Permit Agreement is not valid until executed by the Perrnittees and the authorized
representative of City.
11. Permittees have not relied on City for assessing site conditions or determining the suitability of the
site conditions to accommodate Permittees' use within the permit area.

C. NO FUTURE WORK WITHOUT PRIOR APPROVAL
I. For any future work within the permit area, including but not limited to: grading or filling, installing
or diverting drainage, and placement of surface material of any kind, Permittees must submit plans
and specifications for review and approval by SPU, and obtain a separate permit before
commencing any work of any kind.
D. CONSTRUCTION, MAINTENANCE AND REPAIR BY THE PERMITTEE
I. Permittees assume sole responsibility and expense for the construction and maintenance of the
access driveway and any other improvements made by the Permittees within the Permit Area.
2. Permittees are not responsible for the repair of any damage to the Permit Area caused by City or
any other party.
3. Any and all damage or injury done to the Permit Area, City Property, City facilities, or facilities of
others, resulting from the use of the Permit Area by Permittees, must be repaired to the City's and/or
other facility owner's satisfaction within thirty (30) days of the occurrence of such damage or of
notification to Permittees by the City or other facility owner of the existence of such damage, at the
sole cost and expense of Permittees or its successors or assigns.
4. If Permittees have not corrected, or made an acceptable agreement with City to correct any
condition caused by Permittees that City determines as unacceptable within thirty (30) days of
notification by City, City may perform such work, and all reasonable costs incurred shall be paid

by Pennittees within 30 days of receipt of an invoice for the work. City may act immediately for
conditions which pose a threat to public health, safety or the environment. Any late payments will
be charged I% per month interest.
5. Permittees are responsible for all surface drainage due to the construction and use of the access
driveway.
E. SAFETY
I. The safety of the Use of the Permit Area and any other improvements made by the Pennittees
within the Permit Area are the sole responsibility and expense of the Pennittees.
F. OWNERSIDP AND RIGHTS OF THE CITY
1. City has fee ownership of the property (right of way) within which the Permit Area is located.
2. Permittees shall acquire no right or interest in the Permit Area, or to the occupancy of the same, or
any part thereof, other than for the period of time herein specified and only for the purpose herein
described and pursuant to conditions and restrictions herein stated.
3. City retains the right to grant or deny permission to use or occupy the Permit Area for any other
purpose; provided that such use or occupancy shall not unreasonably conflict with the Permittees'
rights granted herein.
4. The City shall have the right to enter upon said Permit Area at any and all times for the purpose of
the security, operation, maintenance, or reconstruction of the existing and future City facilities,
including the right to temporarily close the ingress and egress area in the Pennit Area to travel
when necessary for City's operational needs.
5. City shall have the right to install, repair, replace, maintain, operate and make lateral connections
to any ofits City facilities within the Permit Area. This may result in the Permit Area being blocked
temporarily or Permittees' improvements to the access driveway being disturbed. Perrnittees will
restore their own improvements at no expense to the City.
6. The Permittees shall not use the Permit Area in any way that interferes with the security, operation,
maintenance, or reconstruction of City's right of way or infrastructure.
7. If at any time the Pennittees' improvements interfere with City's installation, repair or replaeement
of its existing or future municipal water system facilities, property or other improvements at this
location, Pennittees upon written notice from City shall promptly remove or relocate its
improvements at their own expense prior to City's work according to plans approved by City.
8. City does not waive or subordinate any other rights and privileges granted to City.
G. RELEASE AND INDEMNIFICATION
I. Permittees shall release, defend, indemnify and hold harmless the City and its officials, employees,
agents, licensees, contractors, consultants and representatives (collectively, the "lndemnitees")
from and against any and all claims, liens, demands, actions,. costs, losses, expenses, harm,
damages, and liability of any kind or character (collectively, "Claims"), including any damage or
injury to any person or property, asserted or arising from, on account of, or caused by (i) Pennittees
exercise of its rights or obligations under this Agreement, (ii) the acts or omissions of Permittees
or Permittee's employees, agents, consultants, contractors, representatives, licensees or invitees in
or upon the Permit Area, or (iii) the existence of, damage to, or failure of any of Permittee's
improvements both on and off the Permit Area; provided, however, nothing herein shall require
Permittees to indemnify and hold harmless the Indemnitccs from Claims arising out of any damage

or injury to any person or property to the extent caused by or resulting from the lndemnitees' sole
negligence.
2. Pennittees shall indemnify, defend and hold hannless Indemnitees from any and all liabilities,
losses, damages, costs, expenses or claims of any kind or nature (including, without limitation,
reasonable attorneys' fees and any liability for costs of investigation, abatement, remediation,
cleanup, fines, penalties, or other damages arising under any environmental laws} arising out of or
in connection with the disposal, release or discharge, migration, handling, or transportation of
hazardous materials or substances, as that term may be defined by applicable local, state or federal
law on or from any portion of Permittee's Property, Permittees improvements or activities, uses or
operations within the Easement Area, except to the extent caused by the City's municipal
operations.
3. As between the parties and solely for the purpose of effectuating the indemnities contained in
subsections 1 and 2 of this section G, Permittees specifically and expressly waives, with respect to
the Indemnitees, its immunity and limitation, defense or protection on liability that may be granted
to it under any industrial insurance legislation, including but not limited to, the Washington State
Industrial Insurance Act, Revised Code of Washington Title 51 or any other industrial insurance,
workers' compensation or similar laws of the State of Washington. This section shall not be
interpreted or construed as a waiver of Permittee's right to assert any such immunity, defense or
protection directly against any of its own employees or such employee's estate or other
representatives. Pennittees acknowledge that this subsection 3 was specifically entered into after
mutual negotiation.
The Indemnifications set forth in this agreement shall survive the expiration or tennination of this
Agreement.
H. TERMINATION
I. This Pennit Agreement is revocable upon thirty days' notice by the Director of Seattle Public
Utilities.
2. This Permit Agreement shall tenninate if the Permit Area is no longer used for ingress and egress
to the Property.
3. This permit is not assignable, and shall tenninate if the property commonly known as 11411 SE
160,. St, Renton WA 98055 changes ownership.
4. This Permit Agreement and all of Permittee"s rights hereunder shall terminate in the event that the
Permittees is in default of its obligations herein, does not commence a cure within thirty (30) days
of City's notice of such default, and does not proceed with diligence to cure such default. No
termination of this Permit Agreement shall release Permittees or City from any liability or
obligation with respect to any matter occurring prior to such termination.
5. Within 60 days of the termination of this Permit Agreement, the Pennittees shall decommission all
installed improvements pursuant to applicable laws as regulated by the Local, State, and Federal
agencies. The Permittees shall leave the Permit Area in a safe, orderly, fit and sanitary condition
after termination of this Permit Agreement.
6. Termination of this Agreement shall not release Permittees or City from any liability or obligation.
This Agreement and each of the terms, provisions, conditions and covenants herein shall be binding upon
and inure to the benefit of the parties hereto. Perm ittees hereby agree to all terms, provisions and conditions
herein.

The Indemnifications set forth in this agreement shall survive the expiration or tennination of this
Agreement.
H. TERMINATION
l. This Permit Agreement is revocahle upon thirty days' notice by the Director of Seattle Public
Utilities.
2. This Permit Agreement shall terminate if the Penni! Area is no longer used for ingress and egress
to the Property.
3. This permit is not assignable, and shall terminate if the property commonly known as 11411 SE
160" St, Renton WA 98055 changes ownership.
4. This Permit Agreement and all of Permittee's rights hereunder shall terminate in the event that the
Pcnnittees is in default of its obligations herein, does not commence a cure within thirty (30) days
of City's notice of such default, and docs not proceed with diligence to cure such default. No
termination of this Permit Agreement shall release Permittees or City from any liability or
obligation with respect to any matter occurring prior to such termination.
5. Within 60 days of the termination of this Permit Agreement, the Permittees shall decommission all
installed improvements pursuant to applicable laws as regulated by the Local, State, and Federal
agencies. The Permittees shall leave the Permit Arca in a safe, orderly, fit and sanitary condition
after termination of this Permit Agreement.
6. Tennination of this Agreement shall not release Pennittees or City from any liability orobligation.
This Agreement and each of the tenns, provisions, conditions and covenants herein shall be binding upon
and inure to the benefit of the parties hereto. Permittees hereby agree to all terms, provisions and conditions
herein.

The Planning Division of the City of Renton accepted the above master application for
review on June 16, 2016. During our review, staff has determined that additional
information is necessary in order to proceed further.
The following information will need to be submitted before November 4, 2016 so that we
may continue the review of the above subject application:
• As noted in the Revision Request Letter dated July 19, 2016 (comment #16), the
existing home located at 11411 SE 1601h St. (Parcel A) currently gains access from
SE 160'h St., which is a private roadway owned by the City of Seattle. No access
right have been provided to the City in order for this lot to use this private roadway.
Therefore, a hard surface access road shall be constructed witin the propsoed
access easement on 16004 114th Ave SE (Parcel B) that meets the City of Renton
Standards. Once the driveway construction has been complted, documation of
competion shall be provided to the City.
At this time, your project has been placed "on hold" pending receipt of the requested

Owens Lot Line Adjustment, LUA16-000451, LLA
Dear Ms. Owens:
The City of Renton has completed the initial review of your proposed lot line adjustment.
The subject properties, 11411 SE 160th St (parcel no. 0088000064) and 16004 114th Ave
SE (0088000067), are part of an Engineer's Subdivision from 1965 and met the
requirements of legal lot status for the City of Renton. The following changes will be
necessary in order for the City to approve your proposal:
1. Note the City of Renton land use action number and land record number, LUA16-
000451 and LND 30-0396, respectively, on the final submittal. The type size used
for the land record number should be smaller than that used for the land use
action number.
2. Show two ties to the City of Renton Survey Control Network; the geometry will be
checked by the city when the ties have been provided. Make a specific statement
to that effect if the intent is to make a tie by reference.
3. Note the date the existing city monuments were visited, per WAC 332-130-150,
and what was found.
4. On the final submittal, remove all references pertaining to utilities facilities, trees,
concrete, gravel, decks and other items not directly impacting the lot line
adjustment. These items are provided only for preliminary approval.
5. If the abutting properties are platted, note the lot numbers and plat name on the
drawing, otherwise note them as 'Unplatted.'
6. The City of Renton "APPROVALS" block is signed by the City of Renton
Administrator, Department of Community and Economic Development.
7. The new easements for ingress, egress, utilities, etc. shown for the benefit of
future owners ofthe proposed lots each need a note defining the rights
associated with the easement at issue. Since these new "proposed" easements
shown aren't "granted and conveyed" until the benefited and/or burdened lots

are conveyed to others add the following language on the face of the short plat
drawing:
8. DECLARATION OF COVENANT: The owners of the land embraced within this short
plat, in return for the benefit to accrue from this subdivision, by signing hereon
covenant and agree to convey the beneficial interest in the new easement shown
on this short plat to any and all future purchasers of the lots, or of any
subdivisions thereof. This covenant shall run with the land as shown on this short
plat.
9. The private ingress, egress and utility easements require a "New Private Easement
for Ingress, Egress and Utilities Maintenance Agreement" statement.
10. Dimensions across the north and south lines are unclear as to what the
dimensions are calling to. Please use additional crows feet to help clarify and also
dimension to the old and new property lines.
11. The old and new lines could be emphasized more as they get lost in the other
linework on the drawing.
12. Lines through text on Sheet 2 in a couple of locations. Please revise to ensure
legibility.
13. SE 160th Street is a privately owned parcel in some areas and is not considered
public right-of-way. Please revise on map to reflect ownership.
14. Hatching in house does not meet recording standards. Please remove.
15. The minimum rear yard setback in the Residential-6 (R-6) zoning district is 25 feet
and the minimum lot size is 7,000 square feet. Reduce the length of the new lot
line from 28.75 to approximately 17 feet. This would reduce the rear yard of
Parcel B by approximately 11.75 feet and Parcel A would more closely comply with
the rear yard setbacks of the zone. See enclosure for more information.
16. Access:
a. The existing single family home located at 11411 SE 160th St (Parcel A)
currently gains access from SE 160th St, which is a private roadway owned
by the City of Seattle. No access rights have been shown in order for this
lot to use this private roadway. Documentation shall be provided that
shows the right to access the private roadway to the north (SE 160th St); or
b. A hard surface access road shall be constructed within the proposed access
easement on 16004 114th Ave SE (Parcel B) that meets the City of Renton
Standards. Please note that if a hard surface access road is constructed,
the addition of this impervious area would be under the 2,000 square foot
threshold, thus a drainage report complying with the City adopted 2009
King County Surface Water Manual and City Amendments would not be
required.
17. No additional right-of-way dedication is required along 114th Ave SE. Street
standards (RMC 4-6-060) would be required if a building permit application is
submitted.

copies of the revised lot line adjustment to me at the sixth floor counter of City Hall. The
revised plans will be routed for final review and you will be notified when it is appropriate

OWENS LOT LINE ADJUSTMENT
The parcels are located at the corner of 11411 SE 160th
ST and 16004 1141h Ave SE, Renton, WA 98055.
Assessor account numbers: 00800-0067 and 00800-0064
The parcels were created by short plat in 1965 under the
jurisdiction of King County. When the lots were
segregated a boundary encroachment was inadvertently
created. In order to have marketable title to both
properties the lot line must be adjusted. Both lots
currently have single family homes that were built and
permitted to then current code in the 1960's.
The owners Ronald and Dorothea Owens wish to sell
and have no idea what a buyer or buyers of the
properties would plan for their use.
The density will be unchanged.
There is no site work proposed and the landscaping will
remain unchanged.
The utilities are existing and water and sewer are
provided by Soos Creek Water and Sewer and will not be
changed.
