This permit is within the area of Springbrook Creek boundaries as shown in the maps and the documents that are included. Yearly, Springbrook Creek becomes overgrown with vegetation that requires removal prior to winter months and high water flows. Without maintenance, the vegetation causes Springbrook Creek and other drainage ditches to fill and overflow since the forward flow has been interrupted by overgrown vegetation. Presently, there are no roads, buildings or any man-made structures to be removed and/or modified as part of this project. The planned use of these properties to be maintained and cleared is to allow drainage within the Kent/Renton valley. The brush cutting will not adversely affect the view of any adjacent structures. The total estimated construction cost for this project is in excess of $120,000.00 and will be funded by Drainage District Number One of King County annual fund. The proposed annual dates for this project are between 15 September and 31 December. It is our request that the Shoreline Permit and the JARPAIHPA permits run concurrently with the same date of expiration. We are presently reapplying for a new 5 year JARPA/HPA with the Washington Department of Fish & Wildlife. The basis for the exemption request is that the Drainage District Number One of King County is a County District Organization and the scope of this project is to maintain and remove vegetation in the existing drainage of the Springbrook Creek area. Clearing will be conducted in accordance with attached plans. We request that the application and attached documents be reviewed by your office with information, remark and/or approval be sent to me at your earliest convenience. The project involves the removal of overgrown vegetation including grass and brush along the banks of Springbrook Creek to reduce blockage of the forward flow of the channel. Vegetation will be removed from the edge of Springbrook Creek and within a 10-foot wide area from the edge of the waterway. Brush would be cut at a height no greater than 6-inches above the existing ground. A measuring device that is 10 feet in length will be used to verify adequate brush removal from within the clearing zone. Cut brush and grass from the site will be removed and disposed of outside of the floodplain. In addition, garbage and debris within the channel will be removed as authorized by the Drainage District. Remove invasive plants (primarily reed canary grass and blackberries) within 10 lateral feet of the low flow channels and debris within 25 feet of culvert inlets and restore native woody vegetation landward of the 10 foot "clearing zone" in the drainages. PROVISIONS 1. The project may begin immediately and shall be completed by December 20, 2016, provided that vegetation removal shall occur only between September 15 and December 31. 2. Work shall be accomplished per plans and specifications approved by the Washington Department of Fish and Wildlife (WDFW) entitled, "2012 -2019 BRUSH CUTIING AREA"; "5 YEAR PLANTING PLAN 2012 -2017"; and "STANDARD DRAINAGE DITCH ENHANCEMENT PLAN", except as modified by this Hydraulic Project Approval. A copy of these plans shall be available on site during construction. 3. Cutting of vegetation shall be restricted to invasive species, such as reed canary grass and blackberries. Cutting of woody species shall not occur. 4. Vegetation shall be cut using hand held tools, which will allow the operators to avoid cutting native vegetation. Any activity requiring use of heavy equipment requires additional approval from WDFW. 5. All cut vegetation shall be removed from the stream areas and properly disposed of outside the floodplain of the streams. 6. Small debris (not including large woody material--trees or tree parts larger than four inches in diameter and longer than six feet, and rootwads, wholly or partially within the ordinary high water line--see Provision 7) within stream channels within 25 feet of culvert inlets may also be removed, provided the debris is not embedded in the streambed or banks. Failure to comply with the provisions of this Hydraulic Project Approval could result in a civil penalty of up to one hundred dollars per day and/or a gross misdemeanor charge, possibly punishable by fine and/or imprisonment. All Hydraulic Project Approvals issued under RCW 77.55.021 are subject to additional restrictions, conditions, or revocation if the Department of Fish and Wildlife determines that changed conditions require such action. The person(s) to whom this Hydraulic Project Approval is issued has the right to appeal those decisions. Procedures for filing appeals are listed below. Requests for any change to an unexpired HPA must be made in writing. Requests for new HPAs must be made by submitting a new complete application. Send your requests to the department by: mail to the Washington Department of Fish and Wildlife, Habitat Program, 600 Capitol Way North, Olympia, Washington 98501-1091; e-mail to HPAapplications@dfw.wa.gov; fax to (360) 902-2946; or hand-delivery to the Natural Resources Building, 1111 Washington St SE, Habitat Program, Fifth floor. APPEALS INFORMATION If you wish to appeal the issuance, denial, conditioning, or modification of a Hydraulic Project Approval (HPA), Washington Department of Fish and Wildlife (WDFW) recommends that you first contact the department employee who issued or denied the HPA to discuss your concerns. Such a discussion may resolve your concerns without the need for further appeal action. If you proceed with an appeal, you may request an informal or formal appeal. WDFW encourages you to take advantage of the informal appeal process before initiating a formal appeal. The informal appeal process includes a review by department management of the HPA or denial and often resolves issues faster and with less legal complexity than the formal appeal process. If the informal appeal process does not resolve your concerns, you may advance your appeal to the formal process. You may contact the HPA Appeals Coordinator at (360) 902-2534 for more information. A. INFORMAL APPEALS: WAC 220-110-340 is the rule describing how to request an informal appeal of WDFW actions taken under Chapter 77.55 RCW. Please refer to that rule for complete informal appeal procedures. The following information summarizes that rule. Page3of4 i Washington Department of FISH and WlLDLIFE . WDFW must receive your request within 30 days from the date you receive notice of the decision. If you agree, and you applied for the HPA, resolution of the appeal may be facilitated through an informal conference with the WDFW employee responsible for the decision and a supervisor. If a resolution is not reached through the informal conference, or you are not the person who applied for the HPA, the HPA Appeals Coordinator or designee will conduct an informal hearing and recommend a decision to the Director or designee. If you are not satisfied with the results of the informal appeal, you may file a request for a formal appeal. B. FORMAL APPEALS: WAC 220-110-350 is the rule describing how to request a formal appeal of WDFW actions taken under Chapter 77.55 RCW Please refer to that rule for complete formal appeal procedures. The following information summarizes that rule. A person who is aggrieved by the issuance, denial, conditioning, or modification of an HPA may request a formal appeal of that action. You must send your request for a formal appeal to the clerk of the Pollution Control Hearings Boards and serve a copy on WDFW within 30 days from the date you receive notice of the decision. You may serve WDFW by mail to the Washington Department of Fish and Wildlife HPA Appeals Coordinator, 600 Capitol Way North, Olympia, Washington 98501-1091; e-mail to HPAapplications@dfw.wa.gov; fax to (360) 902-2946; or hand-delivery to the Natural Resources Building, 1111 Washington St SE, Habitat Program, Fifth floor.
