DESCRIPTION: The applicant is requesting a Tier II Temporary Use Permit to permit 3
dedicated lea sa ble commercial units within the Altitude Apartments
development (Units 2, 3, and 4) to be utilized as live/work units. The applicant
is requesting an extended approval for a period of 5 years, after which the
applicant ha s indicated that the units would be converted back to a
commercial only use. The project site is located within the Commercial Arterial
(CA) zoning designation. Unit 2 totals 866 square feet in area, Unit 3 totals
1,261 square feet and Unit 4 totals 1,242 square feet.
Live/work units are defined under RMC 4-11-120L as "a structure or portion of
a structure that combines a commercial activity with a residential living space
where there is an internal connection between the living and working spaces
within the unit. The nonresidential portion of the unit must meet commercial
building standards."
The Temporary Use Permit is hereby Approved with Conditions* and subject to the following
condition s.

1 . The applicant shall construct a wall segregating the work space from the living space and shall
obtain any necessa ry building permits and complete all required inspections for the construction of the
wall from th e City of Renton Building Department. The wall shall be constructed and all required
inspection s completed prior to the occupancy of the space.
2. The lea se agreement shall specify th at Units 2, 3, and 4 as identified on the submitted floor plans,
are to be lea sed as live/work spaces and shall not be occupied solely as residential dwelling units. A
copy of the lease agreement shall be submitted to the Current Planning Project Manager for review anc
approval prior to the occupancy of the units.
3 . Reclamation plan: During the first quarter of the fourth year (Fall 2021) of the temporary use permit,
the applicant shall submit a preliminary reclamation plan that would convert the live /work spaces to
commercial only uses. The final reclamation plan shall be submitted to and approved by the Current
Planning Project Manager. Prior to expiration of the temporary use permit, the site should be reclaimec
per the approved plan and all additional land use and/or building permits (if necessary) shall be
received for such reclamation.
4. The applicant's compliance with the conditions mentioned above will be subject to annual review by
the Planning Division for the duration of the temporary use. If conditions of approval are not met, the
Admini strator may suspend or revoke the temporary use permit upon twenty (20) days written notice t
the applicant, unless an emergency exis t s, in which case the Administrator may declare such an
emergency and immediately suspend the temporary use permit until the emergency is abated.
5. Unit 1 is not approved as a live/work space.

RECONSIDERATION: Within 14 days of the decision date, any party may request that the decision be
reopened by the approval body. The approval body may modify hi s decision if material evidence not
readily discoverable prior to the original decision is found or if he find s there was misrepresentation or
fact . After re v iew of the Reconsideration request, if the approval body find s sufficient evidence to
amend the original deci sion, there will be no further extension of the appeal period. Any person
wishing to take further action must file a formal appeal within the 14 -day appeal time frame.
APPEALS : Appeal s of the permit issuance must be filed in writing on or before 5:00 p.m. on October
03 , 2016 . Appeals must be filed in writing together with the required fee with Hearing Examiner c/o
City Clerk, City of Renton, 1055 S Grady Way, Renton , WA, 98057. Appeal s to the Exa miner are
governed by City of Renton Municipal Code Section 4-8-110. Additional information regarding the
appeal process may be obtained from the Renton City Clerk's Office, 425-430-6510.

EXPIRATION : A Temporary Use Permit is valid for up to one year from the effective date of the permit,
unless the Community & Economic Development Admini strator or designee establishes a shorter time
frame or an applicant can request that a permit be valid beyond the one year expiration, for up to five
years at the time of application or prior to permit expiration .
EXTENSIONS : Extension requests do not require additional fees and shall be reque sted in writing prior
to permit expiration to th e Department of Community & Economic Development Admini strator.

Temporary Use Permit Request: Altitude Apartments, Renotn, WA
Project Narrative:
The Altitude Apartments, located at 1600 and 1620 Benson Rd.Sin Renton WA is a
120 unit apartment and offic e development. 116 of the 120 units are dedicated as
residential units, 4 of the units are commercial in nature. Since our initial TCO for
the project in March of 2015 we have attempted to rent the commercial spaces with
limi ted success.
The isolated location of the building, lack of street visibil ity, parking and other
factors have contributed to the resistance of the market for these kinds of
commercial spaces. One of the four commercial spaces ( Unit One) has been rented
to a barber shop, the remaining three commercial units have been vacant since we
opened our doors.
Our TUP request i s to allow three of the office spaces ( Units 2,3 and 4) to be
utilized as part commercial use and part residential use. In short ,as live/work
spaces. All of these units have been designed and approved by the City of Renton
with kitchens and bathrooms .. See photos attached. These units would allow a
small business person to both operate a store front office as well as having a living
area.
Our ultimate objective is to lease the office spaces for strictly commercial purposes.
A temporary live/work use will allow us to keep our assets productive a nd
profitable until the Renton market is able to absorb it vacant Class 8 office space.

2. Description of PUD Uses, Densities and Phases.
The PUD consists ofa south building with 60 residential units and 4,476 square feet of
commercial offices, and a north building with 56 residential units. The project was
constructed in two phases, Phase One being construction of the south building and its parking
area and common open space area, and Phase Two being the north building along with its
parking and landscaping.
3. Specifications of the PUD and Variances from Specific Zoning
Requirements.
See attached Table A.
4. Covenant Regarding PUD or Current Zone Compliance.
The lots or structures affected by the variances described on attached Table A shall
meet the standard created with the approval of the PUD or, if applicable, the current zone in
effect at the time of subsequent land use, building or construction permits.
5. Formation of Property Owners' Association Prior to Sale.
There is currently only one owner of the Property. Prior to the first subsequent sale of
any legally segmented portion of the Property, a legally incorporated property owners'
association must be formed for the owners of the Property or covenants shall be recorded to
ensure the maintenance of infrastructure and open space or other common improvements on
the Property.
6. Covenant to Maintain Amenity Areas. The Property includes: ( a) an
approximately ten (I 0) foot by fifty-eight (58) foot pea patch area located in the northwest
corner of the Property; (b) an amphitheater area located generally in the center of the
Property; (c) an approximately thirty (30) foot by forty (40) foot pet area located on the
southern portion of the Property (collectively "Amenity Areas"). Grantor shall maintain or
cause to be maintained the Amenity Areas in order to keep the Amenity Areas in good
condition and to a standard associated with good property management.
7. Covenant to Maintain Landscaping. The Property includes trees, shrubberies,
and other vegetation. which may change in type and location over time ("Landscaping").
Grantor shall maintain or cause to be maintained the Landscaping within the Property in order
to keep the Landscaping in a condition of good health and appearance, and to a standard
associated with good properly management.

8. Covenants Run With Land.
The covenants contained in this Planned Urban Development Covenants run with the
Property described in Section I above and are binding on the grantees, successors and assigns
of the Grantor.
9. Permitted Activities Deemed to Comply. This Covenant shall not operate to
limit Grantee's permitting authority with respect to the Property. Any actions taken by
Grantor that comply with permits or other written approvals by Grantee to Grantor shall be

limited liability company ("Grantor") and the City of Renton, a municipal corporation of the State of
Washington (the "City").
RECITALS
A. Grantor is the owner of that certain real property commonly known as Altitude
Apartments and Offices, located at 1600 and 1620 Benson Road South, Renton, Washington 98055,
and legally described in the attached Ex_hibit A ("Grantor's Property").
B. Gran tor has installed an original piece of artwork in accordance with the requirements
of the City and with approval of the Renton Arts Commission, such approval being dated August 7,
2015.

C. The artwork (the "Public Art") consists of a mural painted by Fernando Aceves
Sanchez titled "Vuelos de Verano." The Public Art is approximately two-hundred (200) /eel long and
eleven ( 11) feet high and is located on the lower west wall of the building located on 1620 Benson
Road South.
D. The Public /\rt is for the enjoyment and benefit of the citizens and visitors of the City,
to enhance the character of the City as a whole, and to benefit and enhance the apartment and offices
constructed on Grantor's Property.
AGREEMENT
In consideration of the above recitals, the mutual promises and covenants contained herein and
other good and valuable consideration, the receipt and sufficiency of which are hereby acknowledged,
the undersigned covenant, stipulate and agree as follows:
I. Recitals incorporated. The Recitals set forth above are incorporated herein by this
reference.
2. Covenant to Maintain Put,_lic Art.
(a) Grantor shall perform such necessary repairs and maintenance to the Public Art in
order to maintain the Public Art in good condition and to the reasonable satisfaction of the City's
Public Works Administrator, or his/her successor ("Administrator"). The Public Art shall be held to
no greater standard of maintenance and upkeep than that of similar public artwork within the City.
(b) Grantor shall not remove, eliminate or replace the Public /\rt without the prior consent
of the Administrator, whose consent shall not be unreasonably withheld, conditioned or delayed. In
the event of removal, Grantor shall replace the Public Art with the same or substantially similar mural
or other artwork within six (6) months of removal of the Public /\rt or, alternatively, shall pay to the
City an amount equal to the cost to install the Public Art ($5,500.00) as adjusted for inflation.
3. Term. This Covenant and the terms, conditions. and restrictions contained herein
shall commence on the Effective Date and shall terminate automatically on the earlier of: (a) the
demolition of the building on which the Public Art is located. or (b) the twentieth (20th) anniversary of
the Effective Date.
4. Se_yc_r~bi~Hy. The invalidation by any court of any reservation, covenant, restriction,
limitation or agreement herein contained shall in no way affect any of the other provisions hereof and
the same shall remain in full force and effect.
5. Conflict. To the extent this Covenant modifies any prior documents of record
affecting Grantor's Property, this Covenant shall control.
6. !_{uns with tile L_a_ncl. The benefits and burdens of the agreements contained in this
Covenant shall run with Grantor's Property and shall inure to the benefit and be binding upon the
successors of Grantor and Grantee.
7. Govern_ing_J,a"'. This Covenant shall be governed by the laws of the State of
Washington.

The lots or structures affected by the variances described on Exhibit A shall meet the

5. Formation of Property Owners' Association Prior to Sale.
There is currently only one owner of the Property. Prior to the first subsequent sale of
