impact on the environment. An Environmental Impact Statement (EIS) is not required under RCW 43.21C.030(2)(c). This
Determination of Non-Significance is issued under WAC 197-11-340. Because other agencies of jurisdiction may be
involved, the lead agency will not act on this proposal for fourteen (14) days.
Appeals of the environmental determination must be filed in writing on or before 5:00 p.m. on September 9, 2016.

In order to consolidate legalized medical and recreational marijuana, the State Legislature adopted several changes
to the RCW's regarding legalized marijuana. The City now has three recreational marijuana stores open and has the
benefit of improved understanding of them as a land use. As a result of these two things, the City is amending its
marijuana regulations.
Summary of proposed and considered recreational marijuana changes:
• Allow no more than five retail marijuana stores in the City.
o The City adopted a cap of five stores in October 2015. In January 2016, the State allocated six stores
to Renton. The rationale in setting the cap at five was based in the intent of the new regulations
consolidating recreational and medical marijuana into one system. The initial allocation from the
State for recreational marijuana was three stores. The City had two medical marijuana stores in the
City at that time. Consolidation of the two systems is five stores.
• Set the parking requirements at a minimum of 4 and a maximum of 5 parking stalls for retail marijuana.
o There are more customers at retail marijuana than typical retail establishments. They function more
similarly to convenience stores. The new standard should help ensure adequate parking.
• Not allow marijuana cooperatives
o Marijuana cooperatives are up to four medical marijuana patients who share resources in growing
marijuana in the residence of one of the members. They must be registered with the State and have
many regulations regarding tracking and reporting. Members can grow up to 60 plants.
Cooperatives replace collective gardens and are rooted in the same implementing laws. The city will
ban these cooperatives because of concerns about safety of residents, both cooperative members
and surrounding property owners, and concerns about impacts on neighborhoods.
• Reduction of buffers from allowed sensitive uses (Under consideration by Planning Commission)
o The initial legislation legalizing recreational marijuana required retail stores to be at least 1,000 feet
from elementary and secondary schools, playgrounds, parks, day cares, transit centers, arcades, and
libraries. Jurisdictions are now allowed to reduce buffers from everything except schools and
playgrounds to as little as 100 feet. The Planning Commission is considering recommending reducing
these buffers.
PART TWO: ENVIRONMENTAL REVIEW
In compliance with RCW 43.21C.240, the following environmental (SEPA) review addresses only those
project impacts that are not adequately addressed under existing development standards and
environmental regulations.

substantive comments will be provided to the Responsible Officials for their consideration and possible

determination must be filed in writing on or before 5:00 PM, September 16, 2016.
Renton Municipal Code Section 4-8-110.B governs appeals to the Hearing Examiner. Appeals must be filed

The State Environmental Policy Act (SEPA), Chapter 43.21C RCW, requires all governmental
agencies to consider the environmental impacts of a proposal before making decisions. An
Environmental Impact Statement (EIS) must be prepared for all proposals with probable
significant adverse impacts on the quality of the environment. The purpose of this checklist is
to provide information to help you and the agency identify impacts from your proposal (and to
reduce or avoid impacts from the proposal, if it can be done) and to help the agency decide
whether an EIS is required.
INSTRUCTIONS FOR APPLICANTS:
This environmental checklist asks you to describe some basic information about your proposal.
Governmental agencies use this checklist to determine whether the environmental impacts of
your proposal are significant, requiring preparation of an EIS. Answer the questions briefly,
with the most precise information known, or give the best description you can.
You must answer each question accurately and carefully, to the best of your knowledge. In
most cases, you should be able to answer the questions from your own observations or project
plans without the need to hire experts. If you really do not know the answer, or if a question
does not apply to your proposal, write "do not know" or "does not apply". Complete answers
