Pursuant to RMC 4-9-2S0D the applicant is requesting an Administrative Modification from
RMC 4-6-060 Street Standards to modify NE 10th Place to maintain the existing street section
keeping the sidewalk adjacent to the curb and gutter and locating the planter strip behind the
sidewalk.
BACKGROUND:
NE 10th Place is a Residential Street with an existing ROW width of 60 feet (as per assessor
map). This street classification requires a minimum right-of-way width of 53 feet. The existing
pavement width is 32-feet, 0.5-foot curb and gutter, approximately 4.5-foot sidewalk, and an
approximately 9-foot planter strip. To meet the City's complete street standards 8-foot planter
strip and 5-foot sidewalk behind the existing curb and gutter is required to be constructed in
the right of way fronting the single family home per City Code 4-6-060.

ANALYSIS OF REQUEST:
The Section 4-6-0GOQ.1 allows the Administrator to grant modifications provided the
modifications meet the following criteria (pursuant to RMC 4-9-250D.2):

a. Substantially implements the policy direction of the policies and objectives of the
Comprehensive Plan Land Use Element and the Community Design Element and the
proposed modification is the minimum adjustment necessary ta implement these
policies and objectives.
Staff Comment:
The Comprehensive Plan Land Use Element has applicable policies listed under a
separate section labeled Promoting a Safe, Healthy, and Attractive Community. These
policies address walkable neighborhoods, safety and shared uses. These policies address
walkable neighborhoods, safety and shared uses. The intent of the policies is to
pramate new development with walkable places that support grid and flexible grid
street and pathway patterns, and are visually attractive, safe, and healthy
environments. The requested street modification is generally consistent with these
policy guidelines. However, one specific policy does not support the modification
request. This policy is Policy L-58 which states that the goal is to provide "complete
street" that "locate planter strips between the curb and the sidewalk in order to provide
separation between cars and pedestrians."

environmental protection and maintainability intended by the Code
requirements, based upon sound engineering judgment.
Staff Comment:
The modified street improvements will meet the objectives of a safe walkable
environment consistent with the surrounding neighborhood provided that the following
conditions are met:
• The existing sidewalk and driveway shall be brought up to current ADA
compliance and shall meet the minimum 5-foot width required by Section 4-6-
060 and shall be constructed per City Standard Plans 102 and 104.1.
• A minimum 8-foot planting strip shall be constructed behind the 5-foot
sidewalk.
b. Will not be injurious to other property(ies) in the vicinity.
Staff Comment:
Provided that the conditions of approval are met, the modified street section is
consistent with the surrounding neighborhood and will increase pedestrian safety.

c. Conforms to the intent and purpose of the Code.

This modification provides a safe pedestrian and vehicle route in and around the
existing neighborhood.
d. Can be shown to be justified and required for the use and situation intended; and

DECISION
The proposal satisfies 5 of the 6 criteria listed in RMC 4-9-250D.2 for the requested
modification. Therefore, the street modifications for Suciu SFR located at 4232 NE lO'h Place
Project Number LUA16-000740, B16-002862 is approved under the following conditions:
1. The existing sidewalk and driveway shall be brought up to current ADA compliance and
shall meet the minimum 5-foot width required by Section 4-6-060 and shall be
constructed per City Standard Plans 102 and 104.1.
2. A minimum 8-foot planting strip shall be constructed behind the 5-foot sidewalk.

Modification justification
Please disregard our prior waiver request for sidewalk and annul the sidewalk impact fee
/ Fee in lieu as we are going to change the sidewalks following the Renton Municipal
Code
Our current architectural remodel is estimated to be over $50,000 and therefore poses a
sidewalk improvement requirement.
According to the Renton Municipal Code 4-9-250 section D the new sidewalks will
provide safety and function, will improve the appearance of the neighborhood while
maintaining environmental protection.
Changing the sidewalks will not only improve the appearance of the neighborhood but
also eliminate the risk of injury to the pedestrians that the current cracked sidewalks can
pose.
We will not disturb the sidewalks adjacent to the neighboring properties
We are planning of not doing a planter strip of 8' -0" rather just a 4' -4" sidewalk plus a
O' -6" curb for a total of 4' -1 O" sidewalk to match the rest of the neighborhood in its
existing location. There is no room in front of the house for the planter strip.
