CORPORATE LIMITS BY ANNEXATION
Dear Board Members:
As required by Chapter 36.93 of the Revised Code of Washington (RCW), the City of Renton
hereby gives notice of intention to annex territory hereafter referred to as the "Leitch
Annexation." This annexation is proposed under the 60% Direct Petition method in accordance
with the applicable provisions of Chapter 35A.14 of the RCW. This annexation would
incorporate into the City of Renton approximately 15.47 acres of territory for the provision of
urban services.
To assist in your consideration of the proposed action, the required articles and exhibits are
enclosed and numbered in accordance with the Board's suggested format. The $50.00 filing fee
is also enclosed.

NOTICE OF INTENTION
PROPOSED LEITCH ANNEXATION TO THE CITY OF RENTON
I. BACKGROUND/MAPS
1. The description of and reason for seeking the proposed action:
The proposed action is to annex approximately 14.59 acres to the City of Renton.
Ann�xation is sought by the proponents to develop under City of Renton regulations and
processes and to receive Renton public services.
The annexation was initiated through the 60% Direct Petition method under RCW
35A.14.120—35A.14.140.
T'he proposed annexation area is located in the south half of NW`/s of the NW'/of the SW
1/4 of Section 32, Township 23 North,Range S East.
2. Copies of the Renton City Council minutes for actions taken relative to the proposed
annexation:
A. Ea�hibit A: Certified minutes of the October 10, 2005 public meeting of the
Renton City Council accepting the Leitch Annexation 10% Notice
of Intent to Commence Annexation Proceedings petition and
authorizing the circulation of a Direct Petition to Annex.
B. Exhibit B: Certified minutes of the August 21, 2006 public hearing of the
Renton City Council accepting the 60% Direct Petition to Annex
and declaring the City's intent to annex the area, subject to the
actions of the Boundary Review Board.
3. Exhibit C: Certification of Sufficiency for the 60% Direct Petition to annex made by the
King County Department of Assessments dated May 25, 2006.
4. Exhibit D: Legal description of the proposed annexation boundaries.

II. FACTORS THE BOARI)MUST CONSIDER
1. Overview
A. Population: The population of the proposed annexation area is estimated to be
about 103 persons at full build out based upon 2.3 persons per household and a total
of 45 households. The City of Renton population as of Apri12006 was 58,360.
B. Territorv: The proposed annexation area includes approximately 14.59 acres.

�� '�� D. Assessed Valuation: The current assessed value of the properties proposed for
annexation is approximately$2,633,100.
2. Land Use
A. Existin�: Existing uses include 8 single-family homes with an estimated population
of 18 persons.
B. Proposed: Although no specific proposal has been submitted it is anticipated that
portions of the site will develop as new subdivisions or short plats under Renton's
proposed R-4 zoning. This zoning allows single-family residential development at
up to four(4)units per net acre.
3. Comprehensive Plans/Franchise(s)
A. Conformance with Coun Countvwide Planning Policies adopted by King Countv:
The proposed action is consistent with the Countywide Planning Policies in general,
and the following policies in particular:
LU-31 In collaboration with adjacent counties and cities and King County, and in
consultation with residential groups in affected areas, each ciry shall
designate a potential annexation area. Each potential annexation area
shall be specific to each ciry....
LU-32 A city may annex territory only within its designated potential annexation
area. All cities shall phase annexations to coincide with the ability for the
city to coordinate the provision of a full range of urban services to areas to
be annexed.

T`he City of Renton has designated a Potential Annexation Area in the City's
Comprehensive Plan. (Exhibit H) Renton has the ability to provide a full range of
urban services to the area proposed for annexation and is the designated sewer
service provider for the East Renton Plateau PAA in which this proposed
annexation is located.
LU-33 Undeveloped lands adjacent to that city should be annexed at the time
development is proposed to receive a full range of urban services.
New development is likely to proceed upon annexation into the City of Renton and
the availability of sewers. Sewer certificates have already been issued for new
housing developments to the west and north of the site and can easily be extended to
serve the subject annexation site when it develops.
FW-13.Cities are the appropriate providers of local urban services to urban areas
either directly or by contract.
Renton is prepared to provide a full array of local urban services to the area
including police, fire, local government, and an array of other community services
such as parks and libraries. Water District#90 is the designated purveyor of water
and the Renton Wastewater Utility is the designated purveyor for sewer,both under
agreement with King County, for the entire annexation site.
B. Kin��Comprehensive Plan/Ordinances
1) King County Planning under the Growth Management Act.
The subject area is designated Urban Residential Medium - 4-12 du/ac, in
the King County Comprehensive Plan and is identified as being within
Renton's Potential Annexation Area on the County's Potential Annexation
Areas Map. King County planning efforts under the Growth Management
Act have included ensuring that development in the Urban Growth Area
occurs at urban densities and with urban level services available. The City
of Renton has planned for urban densities for this area and can provide
urban services within its negotiated service areas should annexation occur.
2) The following adopted King County Comprehensive Plan policies
specifically support the proposed annexation:
Chapter Two, Urban Land Use, Section II.B, Directin� Growth to Cities
and Urban Areas
U-203 King County should encourage most population and employment
growth to locate in the contiguous Urban Growth Area in western
King Counry, especially in cities and their potential annexation
areas.
Annexation would allow development of the subject properties to occur
within the City of Renton with urban services such as wastewater, police,
libraries, local government, and parks.

U-208 King County shall provide adequate land capaciry for residential,
commercial and industrial growth in the urban unincorporated
area. This land capacity shall include both redevelopment
opportunities as well as opportunities for development on vacant
lands.
Under Renton's Comp Plan the area is designated Residential Low Density
(RLD). RLD would allow net densities, with R-4 zoning, up to eight units
per net acre on the subject properties. These densities are less than those
permitted under the County's R-4 zoning since the latter bonus up to 6 units
per gross acre. Renton's proposed R-4 zoning calculates density based
upon net acreage and the County's calculates density based upon oss
acreage. If maximized out with bonuses, an estimated 85 units could be
provided under the County's zoning, and a maximum of 45 units could be
provided under Renton's proposed R-4 zoning. If the County's zoning were
fully bonused it would increase the permitted density from four units per
gross acre to six units per gross acre, for a total of 85 units. This is
approximately 89% more units than would be allowed under Renton's
currently proposed R-4 zoning.
Cha,.pter Two, Urban Land Use, Section III.A, Planning with KinQ
County's Cities for Future Annexation
U-301 King County should work with cities to focus countywide growth
within their boundaries and should support annexations within the
Urban Growth Area when consistent with the King County
Comprehensive Plan and Countywide Planning Policies.
U-304 King County should support annexation proposals when:
a. The proposal is consistent with the King County
Comprehensive Plan;
b. The proposed area is wholly within the Urban Growth Area
and within the city's designated Potential Annexation Area
(for annexations);
c. The city is planning for urban densities and efficient land
use patterns consistent with the Countywide Planning
Policies and King County land use plans;and,
d. Adopted Countywide goals and policies for urban services,
environmental and cultural resource protection will be
supported.
The Leitch Annexation is generally consistent with the King County
Comprehensive Plan and its Land Use Map. T'he area proposed for
annexation is wholly within the Urban Growth Area and within Renton's
Potential Annexation Area. The Renton Comprehensive Plan policies and
development regulations support countywide goals and policies for urban
densities, urban services and environmental and cultural resource
protection. T'he proposed R-4 zoning is urban, medium lot size zoning,
which will achieve urban densities and efficiencies consistent with adopted
countywide goals and policies for urban services.
3) Adopted Kin�.tY Comp Plan desi n�ation: As noted above, the adopted
King County Comprehensive Plan land use designations for the proposed

annexation area is Urban Residential Medium - 4-12 du/acre. This designation
is implemented with the County's R-4 zone. This residential zone has the
potential to bonus up by 50% and is based upon gross acreage. Using TDRs
and/or other bonuses, this zone would allow up to 85 units compared to a
maximum of 45 units under Renton's proposed R-4 zoning.
4) Comparison of City and Coun regulations for sensitive areas, etc.: With
annexation, King County ordinances and regulations would be supplanted with
those of the City of Renton. City of Renton ordinances and regulations
applicable to the proposed action include the following:
a. Regulations for the protection of sensitive areas: The City of Renton's
Critical Areas Ordinance (RMC 4-3-050) describes permitted and
prohibited activities and uses, waivers,modifications and variances,and
additional criteria and permit processes for development in critical
areas. Critical areas regulated by the Ordinance include aquifer
recharge areas, flood and geologic hazard areas, native habitat and
wetlands. Although specific regulations vary, Chapter 21A.24,
Environmentallv Sensitive Areas, of the King County Code, provides
comparable regulatory protection of sensitive areas. The City of Renton
Critical Areas Ordinance is available upon request.
b. Re�ulations for the preservation of a�ricultural or other resource lands:
Regulations preserving agricultural uses are not applicable to the
subject area, as the proposed annexation area is not within any of the
agricultural districts identified for first, second, or third priority for the
purchase of development rights. Further, the property is not designated
for agricultural production or other resource lands in the King County
Comprehensive Plan and is not currently under agricultural use. T'he
City of Renton does not have a program authorizing transfer or
purchase of development rights.
c. Preservation of Landmarks or Landmark Districts: The City of Renton
has no regulations comparable to Chapter 20.62, Protection and
Preservation of Landmarks, Landmark Sites, and Districts, in the King
County Code.
d. Surface Water Control: The City of Renton has adopted the 1990 KinQ
Countv Surface Water Design Manual, by reference, in the City's
Drainage (Surface Water) Standards (RMC 4-6-030) as the design
standard for surface water control in development projects. Higher
standards such as those of the2005 KinQ County Surface Water Desi�n
Manual, Level 2 standard, are often applied through environmental
and/or proj ect review.
C. Citv of Renton Comprehensive Plan/Franchise
1) CityPlanning Under the Growth Management Act
Renton City Council adopted the current Comprehensive Plan in 1995,
consistent with the requirements of the Growth Management Act. The 1995
Comprehensive Plan was updated in the 2004 Mandated Growth
Management Act Comprehensive Plan Review. The Comprehensive Plan

Land Use Map identifies Potential Annexation Areas, including the area
currently proposed for annexation, and shows land use designations for such
areas. (See Exhibit H, City of Renton Land Use Designations)
T'he proposal is consistent with the Land Use Element policies of the
Renton Comprehensive Plan that support annexation of lands:
• that are within Renton's Potential Annexation Area where the
availability of infrastructure and services allow for the development
of urban densities(Objective LU-1);
• that are available for urbanization under county comprehensive
planning, zoning, and subdivision regulations (LU-37.5);
• for which the City of Renton should logically be the primary
provider of urban infrastructure and services(LU-36); and,
• that would include those who already use City services or who
impact City infrastructure(LU-41); and
2) PAA status and PAA a�reements with other cities, if anv: The City of
Renton currently has three adopted Potential Annexation Areas. These
areas are shown on Renton's Comprehensive Plan and on the King County
Interim Potential Annexation Area Map. The City has also negotiated a
PAA boundary agreement with the City of Kent. No PAA agreement was
necessary for the area currently proposed for annexation.
3) Required Comprehensive Plan amendments, if anv: No amendment to
Renton's Comprehensive Plan is necessary to process the current proposed
annexation. Future amendments affecting this area may be made in the
2007 Comprehensive Plan Amendment cycle.
4) Comprehensive Plan approval date: Renton's current Comprehensive Plan
was initially adopted on February 20, 1995, with annual amendments in
subsequent years. The latest, 2004 Mandated GMA Comprehensive Plan
Review was completed in November 2004.
5) Required franchises to serve area: No &anchise will be required for the
City of Renton to provide services to the subject area.
6) Pre-annexation Zonin��reements: The subject area has not been the
subject of a pre-annexation zoning agreement.
7) Proposed land use desiQnation: The subject area is designated Residential
Low Density on the City's Comprehensive Plan Land Use Map. R-4 zoning
is proposed to supplant the existing King County R-4 zoning, consistent
with these adopted land use designations,upon annexation. Under Renton's
annexation process, zoning is adopted concurrent with the adoption of the
implementing annexation ordinance.
4. Planning data
A. Revenues/Expenditures
This analysis identifies the General Fund revenues and costs associated with
annexing the subject properties as they are currently developed, as well as
estimating the annual fiscal impact of their full development at some undetermined
point in the future. "Full development" does not equate to the absolute zoned

contract to this district and will take over fire service as a City
responsibility upon annexation. Renton's nearest station (Station No. 16) is
approximately one mile away to the northeast.
7) Estimated fire district expenditures reduced: The estimated savings to Fire
District No. 25, because of this annexation, is marginal based upon service
to an estimated 18 residents.
B. Services
1) Water Service
The proposed annexation is within Water District No. 90 and Renton's
Sewer Utility Service Area. These service areas would not change as a
result of the proposed annexation.
a) Direct/Contract: Future development will have to notify Water
District No. 90 regarding water availability and obtain a certificate
of water availability prior to future development.
b) Storage locations/Capacitv: The zoned residential capacity under
the existing King County R-4 zoning is higher than the capacity
under the proposed City of Renton R-4 zoning. This is because the
County zoning bonuses up to six units per gross acre and Renton's
R-4 has a maximum density four units per net acre. Since density
under the City of Renton's proposed zoning is approximately half
that allowed under the County's current R-4 zoning, the District's
capacity should be more than adequate for the water demand
generated by post-annexation development in the subject area.
c) Mains to serve the area: Water District No. 90 will require
developers to extend mains into the annexation area as part of their
future development proposals.
d) Financing of proposed service: This will be financed by developers
and normal user fees for existing and new residents.
2) Sanitarv Sewer Service
a) Direct/Contract: the City of Renton's Sewer Utility would provide
Sewer service directly to the proposed 14.59-acre annexation area.
b) Mains to service area: None of the annexation site is currently
being served by the City of Renton. The City will require
developers to extend sewer to the area if they wish to develop.
c) Disposal: Sewage disposal will be through METRO's treatment
facilities.
d) Capacity Available: The City's sanitary sewer system and Metro's
treatment facilities have sufficient capacity to accommodate full

buildout of the proposed annexation area, i.e. accommodate up to
44 new dwellings on sewer.
e) Financin� of proposed service: Improvements within this
annexation area are anticipated to be made through developer
extensions or, more likely, homeowner extensions in the future
when residents decide they want sewer hook-up.
3) Fire Service
a) DirectlContract: Fire District No. 25 currently provides fire service
to the subject site. Following annexation, the City of Renton would
directly provide prevention and suppression services to the subject
area. The City currently serves the area to the north and west, now
in the City.
b) Nearest stations: The annexation area is located approximately one
mile southwest of Fire Station #16. Fire Station #16 is located at
12923 156�'Avenue SE.
c) Response time: Response time to any point within the proposed
annexation boundaries could range from four to seven minutes since
Fire Station #16 is relatively close (1 mile) to the subject site and
will not change because of this annexation. Staff does not
anticipate any reduction in the response time due to this annexation.
d) Staffin�: Station #16 is fully manned, with three firefighters on
duty per shift.
e) Ma�,or equipment: Major equipment located at Station#16 includes
one 1,500 gallon per minute pumpers and one aid car.
� Certified EMT/D-Fib kersonnel: All shift personnel at Station #16
are certi�ed EMT/D-Fib.
g) Fire Ratin�: Renton's fire rating is three, as determined by the
Washington State Survey and Rating Bureau.

5. General
A) Annexation a�reements for extensions of service: No applicable annexation
agreements are in effect for the subject area.
B� TopoQraphv and natural boundaries: The middle portion of the site is relatively flat.
A small lrnoll exists on the western portion of the site and a ravine at the headwaters `
of the eastern branch of Maplewood Creek impacts a portion of the larger eastern

B) Projected 10- e�ar.growth: The area is too small to make reasonable inf ences from
�)�� large-area growth forecasts. The City projects a net increase of+3 units under
� ' , existing zoning, which is less permissive in terms of density, than the County's
X current R-4 zoning on the site. The County's R-4 zone is based on gross acreage

and bonuses up 6 units per gross acre. On the other hand, the City's Comp Plan
land use designations would allow R-4 zoning with the maximum allowed density
being four units per net acreage. As a consequence future density will be about half
of what is currently allowed in King County.
D) Municipal or communitv services: With annexation, the property owners and
residents would have access to a full range of urban services including police, fire,
parks, libraries, community services and classes, the senior center, the City's new
neighborhoods program, annual community events, and local, readily accessible,
government.
E) Potential delavs in implementing service deliverv: The area is currently
underserved in regards to park facilities according to the City's adopted level of
service standards. 'This shortfall is identified in the City's Parks, Trails and Open
Space Plan update. Staff estimates a one-time cost in excess of the parks/recreation
mitigation fees of$20,899 it would collect from new housing, as well as on-going
maintenance costs of$1,508 as the prorated cost for new parks associated with this
annexation.
The current waste hauler would continue to provide solid waste removal for seven
years after annexation, according to State law. At that time, the area would then be
included in the contract with the City's waste hauler. With the exception of parks
and solid waste removal,no delays are expected in implementing service delivery to
the area. City deparhnents reviewing the annexation proposal indicated that they
would be able to adequately serve existing and future development. Water District
No. 90 is expected to continue to provide water service to the subject area, and has
not indicated any major obstacles to providing sewer service to the area at this time.
F) Evaluation of adequacv, costs, or rates of service to area: Existing services to the
area appear to be generally adequate. As development occurs in the proposed
annexation area, demand for services will increase. It is assumed that the cost of
such services will be largely offset by property taxes, services charges, and other
revenues based on population. If the City were to assume this annexation at current
levels of development,it would have see a slight surplus in 2006 dollars of$451 per
year. At full development,this surplus is anticipated to increase to$19,144,in 2006
dollars. This is based upon new home values of$550,000, which have inflated over
the last few years at a rate higher than the cost of services.
King County is the only alternative service provider for services that would be
assumed by the City of Renton upon annexation. Fire suppression services are
currently provided by the City of Renton under contract with Fire District No. 25.
The City will take over these services upon annexation. School district boundaries
will not change, as school district boundaries are not affected by annexations. As a
result, the subject area will remain within the Renton School District. Residents
will continue to have water provided by the Water District No. 90 and pay the rates
established by that district. Renton will continue to be the designated sewer service
purveyor for the area.

III. OBJECTIVES
The proposed Leitch Annexation generally complies most of the objectives of the Boundary Review
Board. These include the following:
1) Preservation of natural neighborhoods and communities.
No detrimental impacts to existing neighborhoods or communities are anticipated to result
from the proposed action. The proposed annexation does not divide any existing
neighborhoods.
2) Use of physical boundaries, including but not limited to bodies of water, highways and
land contours.
The proposed annexation follows the existing city limits on its northern boundary. The
proposed annexation builds upon recent annexations to the north, including the Mosier II
Annexation that was brought into the City in early 2006. Also, the subject boundaries are
considered to be interim, since the area to its south and southeast is likely to come into the
City through in the foreseeable future. Also, a larger 1,475-acre annexation is proposed to
the east, going to election on February 6,2007.
3) Creation and preservation of logical service areas.
City staff that have reviewed the proposed annexation have stated that the proposed
boundaries appear to represent logical extensions for City of Renton services. Also,the
Countywide Planning Policies state that cities are the appropriate providers of local urban
services to Urban Areas. With the exception of water,Renton will be the provider of these
urban services, including local governance,police, fire, libraries,parks, and recreation. The
proposal therefore furthers both the intent of the City's and the County's planning policies.
4) Prevention of abnormally irregular boundaries.
The proposed boundaries are not abnormally irregular boundaries. The surrounding areas to
the south and southeast are also within Renton's Potential Annexation Area and anticipated
to be annexed into the City in the foreseeable future. Therefore,any irregularities are
considered to be interim until this happens.
5) Discouragement of multiple incorporations of small cities and encouragement of
incorporation of cities in excess of ten thousand population in heavily populated urban
areas.
Not applicable.
6) Dissolution of inactive special purpose districts.
Not applicable.
7) Adjustment of impractical boundaries.
This annexation is not being undertaken to adjust impractical city boundaries.
8) Incorporation as cities or towns or annexation to cities or towns of unincorporated
areas,which are urban in character.
King County has designated this area for urban development and it is located within
Renton's designated Potential Annexation Area.

SPECIAL PRESENTATION Tom Carlson,BuRSST for Prosperity Executive Director,explained that
Human Services: BuRSST for BuRSST is a new long-term initiative to strengthen communities and generate
Prosperity,Northwest Area prosperity for all residents of Burien,Renton,SeaTac,Tukwila,and the
Foundation community of Skyway. He noted that the Northwest Area Foundation
identified the following trend in this Central South King County area: the shift
in urban poverty from urban,inner-city neighborhoods to the "first ring"
communities at the larger city's edge.
Mr. Carlson reported that a community-developed and driven strategic plan was
developed to tackle poverty. The plan consists of four strategies: improve
family stability,enhance economic opportunity, invest in children and youth,
and build strong communities. He indicated that a team of community
advocates representing the diverse geographic and ethnic communities within
BuRSST is being deployed to build connections within and among the
communities. Additionally,a multi-cultural training institute is being launched
to help develop and train new community leaders.

PUBLIC MEETING This being the date set and proper notices having been posted and published in
Annexation:Leitch, SE 136th accordance with local and State laws, Mayor Keolker-Wheeler opened the
St & 140th Ave SE public meeting to consider the 10% Notice of Intent to annex petition for the
proposed Leitch Annexation; 14.6 acres bounded generally by 140th Ave. SE,
if extended, on the west, 143rd Ave. SE, if extended, on the east, SE 136th St.,
if extended, on the north, and SE 138th St., if extended on the south.
Senior Planner pon Erickson reported that eight single-family dwellings exist
on this site, which is virtually flat except for the southeast corner where
Maplewood Creek is present. Reviewing the public services, he noted the site
is served by Fire District#25, Water District#90, Renton sewer, and the
Renton School District. Existing King County zoning is R-4(four dwelling
units per gross acre), and Renton's Comprehensive Plan designates the site as
Residential Low Density for which R-4 (four dwelling units per net acre)
zoning is proposed.
Continuing, Mr. Erickson pointed out that improvements on SE 136th St., 140th
Ave. SE, and 143rd Ave. SE are needed to meet City standards, and will mostly
likely be paid for by developers. He also pointed out the potential drainage
problems, noting that King County's 2005 Surface Water Manual, Leve12
standards are recommended for new development. Mr. Erickson stated that the
fiscal impact analysis indicates a surplus of$450 at current development and a
surplus of$13,773 at full development, assuming an increase to 46 single-
family homes. Additionally, he noted the estimated one-time parks acquisition
and development cost of$20,984.
In conclusion,Mr. Erickson reported that the annexation proposal is generally
consistent with Renton policies and Boundary Review Board criteria. The
annexation serves the best interests and general welfare of the City, particularly
if it facilitates annexation of the unincorporated area to the west and south.

Annexation Policy, Perception the Four Creeks Unincorporated Area Council and a citizens advisory board
by Public that is advising on annexation open house and discussion events. Mr. Carpenter
expressed concerns that Renton's annexation policy is not perceived as positive
by the public, which is shown for example, by the lack of the City's name on a
flier advertising an upcoming annexation open house. He explained that in the
absence of a positive message, residents may feel that local governments are
abandoning them, thus perpetuating the feeling that they have no control over
their own destiny.

Mr. Carpenter stated that he is active in the development of the comprehensive

Management Act (GMA), he is a critic of its implementation. Noting that
residents in the growth areas have little say in the changes that affect their
neighborhoods,Mr. Carpenter emphasized that Renton has an opportunity to
deliver a positive message during this contentious GMA implementation
process.
Mayor Keolker-Wheeler stated that Renton is participating in the annexation
workshops, and pointed out that Renton supports annexations when they are in
the best interest of the City. Councilman Clawson noted the importance of
evaluating each annexation individually, and expressed his hope that Renton is
not inadvertently communicating a less than welcoming message to East
Plateau residents.
Citizen Comment: Bosair pouglas N. Owens, PO Box 25416, Seattle, 98165, stated that he represents Mr.
Lease at Airport,AcuWings and Mrs. Acuner and their company AcuWings, LLC, who are applying for an
Operating Permit and operating permit for a flight school and aviation supply and rental business at
Agreement Renton Airport in property leased by Bosair,LLC. He pointed out that the
Transportation(Aviation) Committee is recommending approval of the
AcuWings operating pernut, and the change to the Bosair lease to pernut the

UNFINISHED BUSINESS Councilman Corman reported on the Eastside Transportation Partnership's
Transportation: Bus Rapid (ETP)recommendation for Sound Transit Phase 2 (ST2), in particular the issue
Transit of I-405 Bus Rapid Transit(BRT). He explained that prior to a recent ETP
meeting, BRT was not an element of ST2, and thanks to the work of City staff
and elected officials,ETP was successful in the listing of the BRT stations and
capital improvements on the ST2 plan for evaluation by Sound Transit.
Councilman Corman gave a briefing on BRT, highlighting characteristics of the
bus, including its low floor design, configuration, capacity, and precision
docking capability. He noted BRT's streamlined fare collection system,and the
queue jump lanes and transit signal priority, which allows BRT to bypass
queues of general-purpose vehicles at intersections and to extend the signal
green time or reduce the signal red time at intersections. Mr. Corman displayed
conceptual drawings of the park and rides and inline stations, and drawings of
the potential alignment of this transit service.

Nick Afzali, Planning and Programming Supervisor, reviewed the potential
alignments> noting that they are the result of a June 16, 2005, I-405 South
Corridor BRT pre-design report,conducted as part of the I-405 Conidor
Program. Mr. Corman also pointed out that the I-405 Corridor Program
Executive Committee reviewed various treatments for the corridor and
determined that BRT was the best rapid transit option.
Utilities Committee Utilities Cortunittee Chair Corman presented a report recommending

Mayor Keolker-Wheeler stated for the record that the Administration
recommended denial of the action for the following reasons: 1)The precedent
that is created because the existing Bosair lease did not allow flight schools and
there are other locations at the airport that do allow flight schools. The
Administration did not want to a change an existing lease to allow a use that is
not normally allowed. 2)Concerns from residents regarding the impacts from
flight schools and the planes that circle the area, and Council's prior direction to
deal with those issues differently than proposed. 3)The presence of an Airport
Plan, which is another direction from Council, that proposes higher and better
uses for the Airport.
Councilwoman Pa(mer explained that AcuWings has shown that they are
concerned about the residents, will be a good tenant, and have participated with
the Airport Advisory Committee. She noted that the flight school has different
plans than the flight schools currently in place. Ms. Palmer stated for the
record that the decision was made with a great deal of thought and
investigation.

Peter Drogomiretskiy, Ukrainian American Club of Washington President,
accepted the proclamation with appreciation. Councilman Clawson noted that
the Ukrainian community is a vital part of this region.
SPECIAL PRESENTATION Puget Sound Regional Council Executive Director Bob Drewel and Director of
PSRC:Prosperity Partnership Economic Development Bill McSherry gave an update on the status of
Prosperity Partnership,an economic development effort that was launched over
two years ago. Mr. Drewel stated that the coalition consists of over 200
partners(including the City of Renton, Renton Technical College,and the
Greater Renton Chamber of Commerce),and is representative of the four-
county region(King,Kitsap, Pierce,and Snohomish).
Mr. Drewel reported that Prosperity Partnership has already accomplished 16 of
its !8 actions items for 2006,and he noted the coa(ition's plan to establish a
measurement system that will measure approximately 22 indicators. He
indicated that the regional economic strategy is a five-year plan,one goal of
which is to develop 100,000 new jobs in the four-county region.
Mr. McSherry reviewed Prosperity Partnership's foundation initiative
concerning education,which has the following goals: increase the percentage

in the workplace; and increase the number of bachelor and advanced degrees
awarded in Washington, with emphasis on applied sciences and engineering.
He noted that the Partnership will go before the legislature in 2007 asking for an
increase in college enrollments to fill capacity in high demand fields such as
computer specialists, engineers, life scientists, medical researchers, nurses, and
secondary teachers.
Mr. Drewel commented on the importance of technical and community cotleges,
noting that the Partnership wants 40 percent of the students who attend four-
year institutions to come from these types of colleges. He pointed out that the
region will need well-educated workers to replace retiring workers and to meet
the demands of the new economy. In conclusion, Mr. Drewel encouraged
attendance at the Prosperity Partnership luncheon on November 1.
In response to Councilwoman Briere's inquiry, Mr. McSherry stated that the
marketing pilot project is aimed at middle and high school students.
APPEAL Planning and Development Committee Chair Briere presented a report
Appeal: Rainier Mixed Use regarding the appeal filed by JDA Group, LLC. The Committee heard this
South Parking Lot,JDA appeal on 8/17/2006. The applicant,JDA Group, LLC, appealed the Hearing
Group, V-OS-133 & SA-04- Examiner's denial of its variance request and site plan. The Committee
093 reviewed the record, the written appeal, and the presentation and oral argument
by Neil Watts, Development Services Director, and Rich Wagner, Baylis
Architects, on behalf of the applicant/appellant. Having done so, the Committee
found that a substantial error in law exists, and accordingly, reverses the
decision of the Hearing Examiner and modifies the decision by adding a
mitigation measure.
The subject parcels are located west of Rainier Ave. S. and north of an existing
restaurant, Chang's Mongolian Grill. This site is zoned Commercial Arterial.
The applicant seeks to construct a 27-stall surface parking lot on approximately
20,000 square feet of a 1.55-acre parcel on the west side of Rainier Ave. N.,
which connects to Chang's existing parking lot. In order to create this parking
lot, the applicant would have to fill a small area of wetland and wetlaiid buffer.
The lot with a Category 3 wetland contains a partially culverted drainage
stream. The applicant seeks to further culvert this drainage in order to
accommodate the parking lot. In order to do so, the applicant needed to remove
the trees and vegetation within 25 feet of this water course area(City Code 4-4-
130). This required a variance.
Under the City Code, the Hearing Examiner reviews the variance request.
Accordingly, the site plan application was also put before the Hearing
Examiner. The Hearing Examiner held a hearing on 3/14/2006. He issued his
decision on 4/25/2006 denying both 1) the variance; and 2) the site plan
application. The Hearing Examiner found that the applicant's property failed to
meet the four criteria necessary for a variance. The Hearing Examiner further
concluded that the "[t]he proposal is not compatible with the environment
objectives of the comprehensive plan" in that the Hearing Examiner did not find
that culverting the creek would mitigate impacts.
Pursuant to City Code 4-8-110F(5) and (6), the Committee's decision and
recommendation is limited to the record, which consists of, but is not limited to
the Hearing Examiner's report, the notice of appeal, and the submissions by the
parties. Having done so, the Committee hereby finds substantial error in the
Hearing Examiner's denial of the variance request. The Committee finds that
the applicant's request meets the standard for a variance, is a reasonable use of
the property, and benefits the public interest. Further, extending the existing

culvert over the drainage stream will not harm the environment, and the
proposed remediation measures are adequate. However, the Committee
modifies the decision to include a mitigation measure to build a rockery, rather
than to fill a portion of the wetland area. This rockery structure will eliminate
the need to fill the portion of wetland area and further justify the variance
request. The placement and structure of the rockery will be subject to the
approval of the Development Services Division.

PUBLIC HEARINGS This being the date set and proper notices having been posted and published in
Annexation: Leitch, SE 136th accordance with local and State laws, Mayor Keolker opened the public hearin�
St& 140th Ave SE to consider the 60% Direct Petition to Annex and R-4 zoning tor the proposed
Leitch Annexation; 14.59 acres (including the abutting street right-of-way)
bounded general(y by 140th Ave. SE, if extended, on the west, 143rd Ave. SE,
ifextended, on the east, SE 136th St., ifextended, on the north, and SF. 13Rth
St., if extended on the south.
Senior Planner pon Erickson reported that eight sin�le-family dwellin�s exist
on the site, and noted that future development will most likely occur on the
larger under-developed parcels. He pointed out that Maplewood Creek flows
through the eastern portion of site, and except for the ravine on the eastern most
parcel, the site is relatively flat. Mr. Erickson indicated that public services for
the site are provided by Fire District#25, Water District #90, Renton sewer, and
the Renton School District.
Mr. Erickson stated that current King County zoning is R-4 (four dwelling units
per gross acre). Renton's Comprehensive Plan designates the site as Residential
Low Density, for which R-4 (four dwelling units per net acre)zoning is
proposed. He relayed issues raised by City staff as follows: l j Transportation
Division noted that portions of SE 136th St., 140th Ave. SE, and 143rd Ave. SE
will need to be widened and improved to meet City standards; 2) Utilities
Division recommended the use of King County's 2005 Surface Water Manual,
Leve12 for future development; and 3) Parks Division estimated a one-time
parks development cost of$20,984.
Reviewing the fiscal impact of the proposed annexation, Mr. Erickson reported
that the City will realize a surplus of$13,773 at full development, assuming an
increase to 46 single-family homes and an average assessed home value of
$450,000. He stated that the annexation proposal is consistent with City
policies and Boundary Review Board criteria, and serves the best interests and
general welfare of the City, particularly if it facilitates potential annexation of
the unincorporated area to the southwest.
Public comment was invited.
William Sweezey, 13636 143rd Ave. SE, Renton, 98059, opposed the
annexation, expressing concerns regarding the increase in density in the area,
the wildlife that use and inhabit the Maplewood Creek ravine, the
environmental impact of development on the ravine, and the close proximity of
homes to each other in nearby developments.
Councilwoman Briere noted that if the property is annexed, the zoning will be
less dense than it is now in King County. Councilman Clawson pointed out that
development must undergo a planning process, and environmental constraints
will be addressed.

Transportation: 2007-2012 TIP This being the date set and proper notices having been posted and published in
accordance with local and State laws, Mayor Keolker opened the public hearing
to consider the annual update of the Six-Year Transportation Improvement
Program (TIP), 2007 - 2012.
Peter Hahn, Deputy Planning/Building/Public Works Administrator-
Transportation, stated that the TIP is a multi-year work and funding plan for the
development of transportation facilities. The TIP is mandated by State law, and
consequently staff evaluates the plan and makes appropriate changes in
accordance with Renton's Comprehensive Plan, the Growth Management Act,
and the City's Business Plan.
Mr. Hahn highlighted the accomplishments of the past year, which include
completing the design and starting construction on the South Lake Washington
infrastructure improvements, starting the NE Sunset Blvd./Duvall Ave. NE
intersection improvements, completing Phase 1, Segment f of the S W 27th
St./Strander Blvd. connection, completing the S. 4th St./Burnett Ave. S.
intersection improvements, and installing unintenuptible power supplies at
signatized intersections such as Rainier A�e.
Continuing, Mr. Hahn noted that the plan contains 54 projects and pro�rams.
Five new projects have been added, including intersection safety and mobility
and Garden Ave. N. widening. He explained that TIP projects can undergo
various adjustments and changes over time. The projects are divided into five
categories, but may fall under multiple categories.
Mr. Hahn reported that the total expenditure plan for the TIP is $127,747,079 of
which $78,170,868 is funded and $49,576,211 is unfunded. Stating that the
funding package is heavily front-end loaded, he noted that of the $78 million
that is fu�tded, 90 percent will be spent in 2007, 2008, and 2009. He reviewed
the funding sources and the 2005-2006 grants obtained for projects such as the
SW 27th St./Strander Blvd. connection and the Sam Chastain trail, which total
$6,792,500. In conclusion, Mr. Hahn stated that 2007 will be one of the largest
construction years ever in Renton.
In response to Councilman Law's questions, Mr. Hahn explained that
amendments can be made to the TIP every year. In response to Council
President Corman's inquiry, Mr. Hahn stated that review of the one-way streets
does fall into a couple of TIP program categories, and he noted some areas
where the effect of one-way streets is being studied.

Gail Wolz, 6202 113th PI. SE, Bellevue, 98006, stated that she cepresents the
Stop Light Now Committee, and shared statistics of accidents that have
occurred at the intersection of NE Sunset Blvd. and Hoquiam Ave. NE.
Stressing the need for the installation of a traffic signal at this intersection, Ms.
Wolz expressed her happiness that the project has been included in this year's
TIP. She asked to be kept informed of the project's funding and prioritization.

ADMINISTRATIVE Chief Administrative Officer Jay Covington reviewed a written administrative
REPORT report summarizing the City's recent progress towards goals and work programs
adopted as part of its business plan for 2006 and beyond. Items noted included:
� The first annual Art& Antique Walk will liven up downtown Renton streets
with paintings,pottery, sculpture, and photography on August 29.
� Summer day camp programs came to an end last �veek. The two preschool
camps, four youth camps, and one teen camp provided summer fun and
activities to over I,200 participants.
� Due to the closure of the main runway at King County International Airport
(Boeing Field) to permanently repair damage caused by the Nisqually
earthquake, Renton Municipal Airport is experiencing an increase in aircraft
takeoffs and landings during the month of August.
AUDIENCE COMMENT Sandel DeMastus, Highlands Community Association (HCA) Vice President,
Citizen Comment: DeMastus - PO Box 2041, Renton, 98056, thanked those that attended the HCA meeting last
Highlands Community Thursday. She expressed her unhappiness with the rumors that are being spread
Association about HCA and the City, and stated that it is time to set aside differences and
work together.
Citizen Comment: John Middlebrooks, 510 Seneca Ave. NW, Renton, 98057, voiced concern
Middlebrooks - Business Jet regarding the potential development of a business jet center at the Renton
Center at Airport Municipal Airport. He stated that although outlawed for airlines, old generation
leer jets, which create a lot of noise, can be used by the business and private
communities. Pointing out that the airport cannot pick and choose the type of
airplanes used, Mr. Middlebrooks requested that the City slow this process
down and take time to evaluate the impacts on the community.
Citizen Comment: Snow-NE Mike Snow, 5002 NE 2nd St., Renton, 98059, expressed concern for the safety
2nd St, Pedestrian Safety of pedestrians once NE 2nd St. is opened up to be a connection between Jericho
Concerns and Duvall Avenues S. and it becomes a thoroughfare. He noted that the road is
narrow, lacks sidewalks and shoulders, and is used as a route for school
children. Relaying City staff concerns that stop signs will not slow people
down, Mr. Snow stated his belief that stop signs wi(I cause drivers to be more
aware of pedestrians. He indicated his preference for the installation of
sidewalks, but until that occurs, he suggested leaving the barricade in place or
installing stop signs.
Council President Corman agreed that sidewalks are needed, and he received
confirmation that the substandard road was obtained by Renton via a recent
annexation. Peter Hahn, Deputy Planning/Building/Public Works
Administrator-Transportation, described the situation, traffic patterns, and

available traffic control options, pointing out that the barricade is in place due to
development construction. Mr. Hahn explained that although it may seem
counterintuitive, stop signs are not a speed-control device and will not
discourage the cutting-through traffic.
Mr. Corman questioned the possibility of being able to handle these types of
high-safety situations differently with King County at the time of annexation.
Additionally, he commented on the possibility of usin� temporary traffic control
measures during temporary development patterns such as this.
Councilman Persson suggested keeping the barricade in place until the
sidewalks are installed. Planning/Building/Public Works Administrator Gregg
Zimil�erman noted that the barricade has not been forn�ally authorized.

Renton School District new superintendent of the Renton School District, saying that she was warmly
Superintendent welcomed to the Renton community. Having taken a tour of Renton's
recreational facilities, Ms. Heuschel indicated that she is impressed with the
City's recreational programs and services. She stated that she looks forward to a
very long relationship with the Renton community.
Citizen Comment: Beckley - Phil Beckley, 806 Index Ct. NE, Renton, 98056, shared his background in
Integrated Emergency emergency preparedness and disaster planning, noting that he has �vorked for
Management Course the American Red Cross. He referred to a recent article about Renton published
in the Fairwood Flyer, specifically the paragraph regarding emergency
management training. Mr. Beckley stressed that FEMA is the benchmark for
disaster planning, and he expressed his approval of Ciry official and staff
attendance at the week-long Integrated Emergency Management Course in
Maryland last Spring. He concluded that emergency preparedness is important
to everyone.
Citizen Comment: Beckley - Heidi Beckley, 806 Index Court NE, Renton, 98056, described her experiences
Highlands Area when picketing an adult book store in the Highlands in 1997, pointing out that
Redevelopment those who opposed her actions did not represent the majority. Referring to the
Highlands redevelopment effort, she opined that Council gave in to the vocal
minority, and the quiet majority was not represented by Council.

Ms. Beckley stated her fear that people will move away from the Highlands area
due to its deterioration. When the redevelopment effort is revisited, she asked

the Highlands Community Association. She noted the need for neighborhood
clean-up efforts. Ms. Beckley indicated her intention to forn� a neighborhood
organization called Citizens for a Better Renton.

of the Highlands area, noting that Councilmembers found themselves needing to

homes. He indicated that he is unsure which type of zoning will ultimately
bring more businesses to the area. Mr. Corman reported that he lives in the
neighborhood, and his long-standing position has been that he does not want
apartments next to his home.

per-acre zoning with eminent domain.

We hereby advise the City Council of the City of Renton that it is our desire to commence
annexation proceedings under the provisions of RCW 35A.14.120 of all or any part of the area
described below.
The territory proposed to be annexed is within King County, Washington, and is contiguous to
the City of Renton. A map (Exhibit 1) and legal descripdon (Exhibit 2) aze included as gart of

The City Council is requested to set a date not later than sixty days after the filing of this request
for a public meeting with the undersigned.
1. At such meeting, the City Council will decide whether the City will accept,reject or
geographically modify the proposed annexation;
2. The City Council will decide whether to require simultaneous adoption of a
proposed zoning reguladon, such a proposal having been prepared and filed for the
azea to be anneaed as provided for in RCW 35A.14.330 and 35A.14.340; and,

Not applicable. The proposed annexation is within the water service area of King County Water District
No. 90.

Developer's extensions of water mains will be required to provide water for fire protection and for
domestic use for development within the annexation area. The applicant shall obtain a certificate of water
availability from KCWD#90.

No. Ownership of water mains owned and operated by KCWD#90 District will remain the same within

The proposed Leitch Annexation is located in the Maplewood Creek Sub-basin of the Cedar River
Basin. Maplewood Creek flows through the eastern portion of the annexation, drains across the
Maplewood Golf Course and into the Cedar River. There are existing drainage problems within the
Maplewood Creek sub-basin, within and downstream of the proposed annexation area. These
problems consist of flooding, erosion, and degraded fish habitat, due to increased stream flows and
poor water quality caused by urbanization. This is illustrated on the attached map from the Cedar

River Conditions Report, 1993. The tributary that flows through the Leitch Annexation is labeled
"0303".
The flooding, erosion, water quality and aquatic habitat problems of Maplewood Creek (tributaries
0303, 0302) are described on the following pages of the Cedar River Conditions Report: p.4-16, 5-8,
6-12, 6-34, 6-52, and p.7-43. In the report, urbanization is described to contribute to non-point
pollution, which includes road runoff, and pollutant loadings to Maplewood Creek should increase
with further development. The report also states that erosion is likely to increase with further
development. The ravine slopes of tributary 0303 are unstable sandy soil overlying less pervious
hard silt. Immediately downstream of the Leitch Annexation is a reach of the stream that is very
susceptible to erosion and landslides. The report states that salmon migrate into the golf course reach
of tributary 0303 and that cutthroat trout thrive in reach upstream of the golf course. However, fish
habitat is severely impacted in the upper ravine by erosion and unstable banks. Therefore, �ve
recommend requirin use of the 2005 Kin Count urface Water Design Manual with level-2 flow
control or any new develonment within the proposed annexation area, or stricter standard, to
m�n�mtze increases to downstream impacts.
Wetland reports for the properties within the proposed annexation area may be needed to verify if
wetlands are present, at the time of development review.
2. Are you aware of any problems or deficiencies in existing infrastructure or service provision to
the area?
The King County Drainage problem and complaint inventory does not identify any drainage
problems within the proposed annexation area, but there may be a need to provide drainage system
infrastructure improvements to the area to provide better service.
3. Does this proposed annexation represent a logical extension of services provided by your
department/division?
The proposed Leitch Annexation is a logical extension of services provided by the Surface Water
Utility.
4. What additional facilities or staff would be required to serve this enlarged area? Can you
identify any other costs the City would incur as a result of this annexation?
The annexation of this area and eventual full build-out of this proposed annexation will
incrementally require additional resources for maintenance of infrastructure from this annexation. At
some point the City will need additional personnel and equipment for maintenance due to new
development and annexations.
Based on the current annual operation and maintenance cost of$238 per acre for the whole city, the
operation and maintenance for the 14.59-acre Leitch Annexation will be approximately $3,470 per
year.
Based on the current annual Capital Improvement Project cost of$227 per acre for the whole city,
the added CIP cost resulting from the Leitch Annexation is estimated to be approximately$3,310 per
year.
The total Surface Water Utility cost for O&M plus CIP is estimated to be $6,780 per year for the
proposed annexation area at the same level of O&M and CIP service that we currently provide within
City limits. The existing Surface Water Utility revenue for the 9 single-family residences is $582 per

The existing culverts, storm pipe systems and ditches do not appear to have been maintained on a
regular basis and are in need of maintenance. There may be a need to fund capital improvements to
address existing drainage problems or improve the capacity of major culvert crossings to prevent
flooding problems.

No, Storm drain facilities are minimal within the boundaries of the proposed annexation, and no new

General recommendation and comments:
The Culvert crossing at 136`h Street and 142"d Ave SE may require the need for the expenditure of Capital
Improvement Program funds. Other CIP improvements may be needed to address drainage problems in
the public right-of-way of SE 136`h Street and improve service to the area. We recommend that the 2005
King County Surface Water Manual, with Level 2 Detention, is required for storm water control design,
for any new development within the proposed Leitch Annexation.

annexation proceedings under the provisions of RCW 35A.14.120 of all or any part of the area

The territory proposed to be annexed is within King County, Washington, and is contiguous to
the City of Renton. A map (E�chibit 1) and legal description (Exhibit 2) aze included as part of

The City Council is requested to set a date not later than sixty days after the filing of this request
for a public meeting with the undersigned.
1. At such meeting, the City Council will decide whether the City will accept,reject or
