The Planning Division of the City of Renton accepted the above master application for review on February 17th, 2017, and determined the application complete on February 23'd, 2017. The project complies with the 120-day review period. 2. The project site is located at 10321 SE 190'h Pl. 3. This home was legally constructed in 1990 within King County's Jurisdiction before the area was annexed into City of Renton via Ordinance #5327 on March 1, 2008. The existing home was built to standards that no longer apply and is not consistent with current front and side yard setback requirements. 4. The project site is currently developed with an existing, fire-damaged single family home. 5. Access to the site would be provided via an existing residential driveway extending from SE 190th St. 6. The property is located within the Residential Low Density Comprehensive Plan land use designation. 7. The site is located within the Residential -4 (R-4) zoning classification. 8. The applicant applied for building permit review on October 19th, 2016, under building permit number B16005721. The building permit could not be approved due to the structure's nonconforming setbacks. Per RMC 4-10-0SOA.5.a, any legally established single family dwelling damaged by fire or an act of God may be rebuilt to its same size, location, and height on the same site, subject to all relevant fire and life safety codes; however, restoration improvements shall commence within one year of the damage, and shall continue in conformance with approved building or construction permits, otherwise the structure shall lose its restoration authorization and status. The home was damaged by fire on August 30, 2014, and therefore exceeds the one year threshold and needs to comply with the current zoning regulations. Notice of the requested variance was mailed to surrounding property owners and posted in the vicinity of the property. No public comments were received. 10. Representatives from various city departments have reviewed the application materials to identify and address issues raised by the proposed development. These comments are contained in the official file, and the essence of the comments has been incorporated into the appropriate sections of this report and the Departmental Recommendation at the end of this report. 11. Comprehensive Plan Compliance: The site is designated Low Density (LD) on the City's Comprehensive Plan Map. The purpose of the MD designation is to allow a variety of single-family and multi-family development types, with continuity created through the application of design guidelines, the organization of roadways, sidewalks, public spaces, and the placement of community gathering places and civic amenities. The proposal is compliant with the following Comprehensive Plan Goals and Policies if .2!! conditions of approval are met: Policy HHS-8: Utilize the City's authority to rehabilitate housing to prevent neighborhood blight or eliminate unsound structures. Goal HHS-C: Increase the stability of neighborhoods by fostering long-term homeownership, property maintenance, and investments in existing housing. 12. Variance Analysis: (Describe requested variance). The proposal is compliant with the following variance criteria, pursuant to RMC 4-9-250. LUAl 7-000087 Staff Report v.3 That the applicant suffers practical difficulties and unnecessary hardship and the variance is necessary because of special circumstances applicable to subject property, including size, shape, topography, location or surroundings of the subject property, and the strict application of the Zoning Code is found to deprive subject property owner of rights and privileges enjoyed by other property owners in the vicinity and under identical zone classification. Staff Comment: The applicant contends that practical difficulties and special circumstances exist on the subject property and a variance from RMC 4-2-llOA is needed for the front and side yard setbacks in order to repair the existing, fire-damaged home to be compatible with other homes in the area, and to eliminate a blight from the neighborhood (Exhibit 4/. The required front yard setback is 30 feet, and the required side yard setback is a combined 20 feet with no Jess than 7.5 feet an either side. The existing front yard setback is 28 feet, and the existing side yard setback for both the east and west side yards is 5 feet. Compliance with the current front and side yard setback requirements would require that the applicant remove large portions of the existing home in order to repair the structure. The applicant contends that the home suffered fire damage in August of 2014, and has remained in disrepair for over two (2) years. Staff has reviewed the variance request and concurs that, while the size, shape, topography, location and surroundings of the subject property do not prevent the strict application of the Code, practical difficulties exist on the project site, · City of Renton Department of Cc mity & Economic Development Administrative Report & Decision WA17-000087, V-A KAR SINGLE FAMILY SETBACK VARIANCE March 20, 2017 Page 5 of8 which prevent the applicant from reasonably complying with the required front yard and side yard setbacks. For example, if the applicant were to remove 5 feet on both sides of the building in order to comply with the combined 20-foot side yard setback requirement, it would significantly impact the footprint of the upstairs master bedroom and bathroom, as well as downstairs dining and living room (Exhibit 7). The upstairs bathroom would be reduced to an approximate width of 3 feet 8 inches; the upstairs master bedroom would be reduced to an approximate width of 8 feet 3 inches; the downstairs dining room would be reduced to an approximate width of 5 feet 6 inches; and the downstairs living room would be reduced to an approximately width of 8 feet 7 inches. Compliance with the applicable setbacks would require either the removal of several rooms or a complete reconfiguration of the home interior in order to provide adequate livable space. In addition, removal of 5 feet of the side and 2 feet of the front of the attached garage would reduce the usable depth of the garage to approximately 17 feet, which would impact the potential space for interior parking for most vehicles. In this case, the special circumstances that are applicable to the subject property, include the configuration and location of the existing single family home on the lot. The home was legally constructed in 1990, within King County Jurisdiction. The owner is attempting to repair the structure to the same configuration as originally approved and constructed. The strict application of the Code would prevent the property owner from enjoying the rights that were previously enjoyed prior to the fire. That the granting of the variance will not be materially detrimental to the public welfare or injurious to the property or improvements in the vicinity and zone in which subject property is situated. Staff Comment: The applicant contends that the proposed variance to the front yard and side yard setbacks requirements would not be materially detrimental to the public welfare or injurious to property ar improvements in the vicinity. As stated above, the home suffered fire damage in August of 2014, and has been a ,/ neighborhood blight for over two (2) years. Therefore, repair of the existing structure would improve the public welfare, property, and community, by eliminated an unsightly, damaged building. Staff concurs with the applicant that the proposal would not be materially detrimental ta the public welfare or injurious to the property or improvements in the vicinity and zone. Repair af the fire damaged home would improve the value of the structure and property, and eliminate a damaged structure and improve the neighborhood character. The current setbacks of the existing structure are consistent with those of homes in the surrounding neighborhood. That approval shall not constitute a grant of special privilege inconsistent with the limitation upon uses of other properties in the vicinity and zone in which the subject property is situated. ,/ Staff Comment: As previously discussed above, the applicant contends that the proposed variance from RMC 4-2-llOA to the front and side yard setback requirements would not be a special privilege inconsistent with other properties in the LUAll-000087 Staff Report v.3 City of Renton Department of L unity & Economic Development Administrative Report & Decision LUA17-000087, V-A KAR SINGLE FAMILY SETBACK VARIANCE March 20, 2017 Page 6 of 8 vicinity, as other properties in the vicinity af the project site have similar setbacks. This home and the surrounding homes in the neighbarhaad were legally constructed in 1990 within King County Jurisdiction before the area was annexed into City of Renton via Ordinance #5327 on March 1, 2008. Most other existing houses in the area were constructed per the applicable King County Zoning and are also considered ta be nonconforming in regards to setbacks. Staff concurs that the requested variance would not be a special privilege inconsistent with other properties in the vicinity, as the current setbacks of the existing structure are consistent with the surrounding neighborhood. Based on the analysis provided above under a. and b., staff believes that approval af a reduced front and side yard setback would nat constitute a grant af special privilege and that other identical requests would be granted. That approval is a minimum variance that will accomplish the desired purpose. Staff Comment: The applicant contends that the requested 28-faot front yard setback and 5- faat side yard setback variance are the minimum needed to accomplish the desired purpose. Approval af this variance would allow the owners to repair the existing home in its current location. Staff have reviewed the request and agree that the 28-foat front yard setback and 5-foot side yard setback variance from RMC 4-2-llOA is the minimum variance necessary to allow for the repair of the existing single family home. While removing portions of the home would satisfy the required front and side ./ yard setbacks, the requested 28-footfront yard setback and 5-foot side yard setbacks is the minimum variance that would accomplish the applicant's desired purpose of repairing the damaged structure to be consistent with the surrounding neighborhood development pattern and character. Staff concurs with the applicant that the requested 28-foot front yard setback and 5-foat side yard setback variance would be the minimum variance necessary to accomplish the applicant's desired purpose. Therefore, staff supports the variance from RMC 4-2-llOAfor a 28-footfront yard and 5-foot side yard setback for the subject site in the R-4 zone. Staff recommends as a condition of approval that this variance only apply ta the existing structure in its current location, and any future additions ar expansions to the structure shall comply with current code. i I. CONCLUSIONS: 1. The subject site is located at 10321 SE 190'" Pl. The site is within the Residential -4 (R-4) zoning classification. 2. The applicant's proposal is to repair an existing, fire-damaged single family residence with existing setbacks (28-foot front yard setback and a 5-foot side yard setbacks for both the east and west side yards). 3. A 30-foot front yard setback and combined 20-foot side yard setback (with no less than 7.5 feet on either side) is required in the R-4 Zone (RMC 4-2-llOA). 4. The analysis of the proposal was evaluated according to variance criteria and is found in the body of the Staff Report. The project would comply with all four variance criteria if all conditions are met. Having to remove large portions of the existing structure will be a hardship. This house has suffered fire damage as August of 2014, and has been a safety hazard and eye soar for the neighborhood for over 2 years. We are requesting a variance for the front yard and side yard requirements. The required front yard set back is 30 ft, the proposed/existing set back is 28ft The required east and west side yard set back is a combined 20ft set back with no less than 7.5ft on either side. The proposed/existing set back for both east and west side yard is 5ft on each side. Our rear yard set back is already in compliance, the requirement is 25 feet and we have a 26 ft rear yard set back. Our Building Coverage is already in compliance, the requirement is maximum of 35% and we are at 28.4%. Our impervious Surface Area is already in compliance, the requirement is limited to maximum of 50% and we are at 44.32%. This property was previously zoned RS when it was built in 1990. All of the homes in the neighborhood were built around the same time and they have the same side yard sets backs and front yard set backs that this home currently has. Granting the Variance will not be materially detrimental to the public welfare or injurious to the property and/or improvements in the vicinity and zone in which subject property is situated. Per the Renton Fire Incident Report, the fire occurred on August 30, 2014. The permit application was not received within one year of the fire, thus current street standards apply. 2. Per RMC 4-6-060, street frontage along any site that is proposing new construction or additions valued at $50,000 or greater is required to conform to the Street Standards found in Renton Municipal Code {RMC) Section 4-6-060. The project site totals 7,535 square feet in area; and is zoned Residential-4 (R-4). Development Standards: The project is subject to RMC 4·2·110A, "Development Standards for Residential Zoning Designations" effective at the time of complete application {noted as "R-4 standards" herein). Minimum lot Size, Width and Depth -The minimum lot size permitted in the R-4 is 9,000 square feet. The lot sizes proposed would meet this requirement. A minimum lot width of 70 feet is required for interior lots and 80 feet for corner lots. A lot depth of 100 feet is required. Not applicable, no subdivision Is proposed. The existing lot is legal,. nonconforming and does 110t meet minimum lot width by 2 feet or minimum lot size by l,465 square feet. Building Setbacks -Setbacks are the minimum required distance between the building footprint and the property line and any private access easement. The required setbacks in the R-4 zone are 30 feet for the front yard, 25 feet for the rear yards, side yards along-a-street would be required to have a 30 foot setback, and interior side yards are required to have a combined 20-foot setback with not less than 7 .5 feet on either side. The applicant is requesting a variance from the side yard and front yard setback requirements for the proposed home restoration. Building Height -The maximum wall plate height is 24 feet and 2 stories. Roofs with a pitch equal to or greater than 4:12 may project an additional six (6) vertical feet from the maximum wall plate height; common rooftop features, such as chimneys, may project an additional four {4) vertical feet from the roof surface. Non-exempt vertical projections (e.g., decks, railings, etc.) shall not extend above the maximum wall plate height unless the projection is stepped back one-and-a-half (1.5) horizontal feet from each fa~ade for each one (1) vertical foot above the maximum wall plate height. No variance from building height requirement was requested. Building height would be verified at the time of building permit review. Building Coverage -R-4 zone allows a maximum building coverage of 35% of the lot area. Building coverage requirements would be verified ot the time of building permit review. Impervious Surface Area -The maximum impervious surface would be limited to 50%. Impervious surface requirements would be verified at the time of building permit review. Residential Design and Open Space Standards: The single family home would be subject to the Residential Design Standards outlined in RMC 4·2·115. The tree retention plan must show preservation of at least 30 percent (30 %) of significant trees, and indicate how the proposed building footprint would be sited to accommodate preservation of significant trees that would be retained. The Administrator may authorize the planting of replacement trees on the site if it can be demonstrated to the Administrator's satisfaction that an insufficient number of trees can be retained. In addition to retaining 30 percent of existing significant trees, the lot would be required to provide a minimum tree density of 2 trees per 5,000 square feet of lot area onsite. Significant trees shall be retained in the following priority order: Priority One: Landmark trees; significant trees that form a continuous canopy; significant trees on slopes greater than twenty percent (20%); Significant trees adjacent to critical areas and their associated buffers; and Significant trees over sixty feet (60') in height or greater than eighteen inches ( 18") caliper. Priority Two: Healthy tree groupings whose associated undergrowth can be preserved; Other significant native evergreen or deciduous trees; and Other significant non-native trees. Priority Three: Alders and cottonwoods shall be retained when all other trees have been evaluated for retention and are not able to be retained, unless the alders and/ or cottonwoods are used as part of an approved enhancement project within a critical area or its buffer. The Administrator may require independent review of any land use application that involves tree removal and land clearing at the City's discretion. The required east and west side yard set back is a combined 20ft set back with no less than 7.5ft on either side. Having to remove large portions of the existing structure will be a hardship. This house has suffered fire damage as August of 2014, and has been a safety hazard and eye soar for the neighborhood for over 2 years. We are requesting a variance for the front yard and side yard requirements. The required front yard set back is 30 ft, the proposed/existing set back is 28ft. The required east and west side yard set back is a combined 20ft set back with no less than 7.5ft on either side. The proposed/ existing set back for both east and west side yard is 5ft on each side. Our rear yard set back is already in compliance, the requirement is 25 feet and we have a 2 6 ft rear yard set back. Our Building Coverage is already in compliance, the requirement is maximum of 35% and we are at 28.4%. Our impervious Surface Area is already in compliance, the requirement is limited to maximum of 50% and we are at 44.32%. This property was previously zoned RS when it was built in 1990. Granting the Variance will not be materially detrimental to the public welfare or injurious to the property and/or improvements in the vicinity and zone in which subject property is situated.
