DESCRIPTION: The applicant is requesting an Administrative Tier 1 Temporary Use Permit in
order to construct two (2) model homes on future lots created as part of the
Mindy's Place Short Plat prior to the recording of the plat (Exhibit 1), RMC
4-9-240D,1 allows for the construction of the lesser of; 5 model homes or 20%
of the total number of lots with a Tier 1 Temporary Use Permit, The subdivisioN
of the site would result in 8-lots used for the eventual development of single
family residences; with two (2) tracts for critical areas and drainage/sewer,
Twenty percent of the 8 lots would amount to L6 lots, which rounds up to twc
(2) maximum allowed model homes pursuant to RMC 4-9-240D,L Therefore,
the applicant is limited to the construction of 2 model homes. The model
homes are proposed on future lots 2 and 7 of Mindy's Short Plat (Exhibit 2).
Access to the lots would be gained from 160th Ave SE via a new internal public
street.
The Temporary Use Permit is hereby Approved with Conditions* and subject to the following

Release and Indemnification Agreement for Model Homes
This agreement is made by and between the City of Renton, Washington, a municipal corporation of the
State of Washington ("City") and l tl Ire(/ dy e Oeve (o O l},(/,1f a:Gel.:::i-C

Recitals
The Owners own real property in the City legally described in Exhibit A, attached.
The Owners have submitted an application for building permit(s) and/or a Temporary Use Permit to
construct model homes on the real property prior to recording of a short plat or final plat. Since changes
to the short plat or final plat may be necessary after construction of the model homes rendering the
homes illegal, there is some risk in building the model homes.
In consideration of the inherent risks associated with the construction of buildings in advance of the
recording of the plat, the City requires the owner to execute an indemnification agreement prior to any
model home construction activities.
Agreement
The parties agree to the following:
1. The City authorizes the Owners to do the work as described in the Temporary Use Permit
Application No. once building permits have been obtained.
2. The owners assume the risk that the model home(s) must be removed or reconfigured and
therefore release and discharge the City and its representatives from all known and unknown
losses, claims, damages or causes of actions which the owners have or may have relating to
buildings or structures authorized by the Temporary Use Permit.
3. As a condition of granting Owner permission to construct model homes, Owner agrees to
indemnify, defend and hold the City of Renton Harmless from any claims or liens that may be
exerted against the property as a result of construction of model homes and use of the unrecorded
plat of /i/ihdy~ jJLtl e .
4. Owners understand and acknowledge that, should the model home construction not comply with
the proposed lot configuration of the final plat, no variances to development standards for either
the lots or the homes may be granted as such a situation would be considered a "self-induced
hardship".
5. Owners acknowledge that they understand that any construction begun prior to the recording of
the final plat must be in compliance with all City zoning and subdivision requirements (e.g.
setbacks, lot coverage, etc.) or removed prior to recording of the final plat. If the final plat is not
recorded prior to the expiration of the Temporary Use Permit, Owners acknowledge that the
homes must be removed unless complying with all applicable code requirements (e.g. one home
per lot, etc.).
6. Applicant will also provide an Abatement Agreement and a security device acceptable to the City
to ensure removal of any structures not in compliance with City regulations at the time of

expiration of the Temporary Use Permit and understands construction of the model homes is at
Owners' own risk.
7. The provisions of this agreement shall bind the parties, their legal heirs, representatives,

for critical areas and drainage/sewer. Twenty percent of the 8 lots would
amount to 1.6 lots, which rounds up to two (2) maximum allowed model home
pursuant to RMC 4-9-240D.l. Therefore, the applicant is limited to the
construction of 2 model homes. The model homes are proposed on future lots
4 and 7 of Mindy's Short Plat (Exhibit 2). Access to the lots would be gained
from 160th Ave SE via a new internal public street (SE 140th ST).

1. All model homes shall be connected to water, sewer, and storm before building permits are final.
2. The applicant shall provide a notarized original abatement agreement form, as provided by the City
The agreement assures the temporary use will ultimately be removed as required by the terms ofthe
permit. The applicant shall also provide an original signed Release and Indemnification Agreement.
Both agreements shall be provided to the Current Planning Project Manager prior to building permit
approval.
3. Only two (2) single family building permits shall be issued for Mindy's Place subdivision prior to
recording of the final short plat, regardless of what the underlying lots allow.
4. Applicant shall provide approved access and fire hydrants prior to construction of model homes.
Identification of such access and hydrants shall be provided with the building permit application for
review and approval by the Planning Division Project Manager and the Fire Plans Reviewer.
5. The proposed lot lines for the model homes (Lots 4 and 7) shall be staked and strung to ensure
proper assessment of setbacks prior to construction of model homes.

RECONSIDERATION: Within 14 days of the decision date, any party may request that the decision be
reopened by the approval body. The approval body may modify his decision if material evidence not
readily discoverable prior to the original decision is found or if he finds there was misrepresentation or
fact. After review of the Reconsideration request, if the approval body finds sufficient evidence to
amend the original decision, there will be no further extension ofthe appeal period. Any person
wishing to take further action must file a formal appeal within the 14-day appeal time frame.
APPEALS: Appeals of the permit issuance must be filed in writing on or before 5:00 p.m. on March 22,
2017. Appeals must be filed in writing together with the required fee with Hearing Examiner c/o City
Clerk, City of Renton, 1055 S Grady Way, Renton, WA, 98057. Appeals to the Examiner are governed by
City of Renton Municipal Code Section 4-8-110. Additional information regarding the appeal process
may be obtained from the Renton City Clerk's Office, 425-430-6510.
EXPIRATION: A Temporary Use Permit is valid for up to one year from the effective date of the permit,
unless the Community & Economic Development Administrator or designee establishes a shorter time
frame or an applicant can request that a permit be valid beyond the one year expiration, for up to five
years at the time of application or prior to permit expiration.
EXTENSIONS: Extension requests do not require additional fees and shall be requested in writing prior
to permit expiration to the Department of Community & Economic Development Administrator.

Classic Concepts VIII LLC in cooperation with Lak:eridge Development I LLC is in the process
of developing Mindy's Place 8 lot short plat located at 1601h Street SE and the new SE 140th
Street. The parcel number is 1457500160 and legally described as LOT 5 IN BLOCK 3 OF
CEDAR PARK FIVE ACRE TRACTS, AS PER PLAT RECORDED IN VOLUME 15 OF
PLATS ON PAGE 91, RECORDS OF KING COUNTY, WASHING TON
Classic Concept is proposing to build 2 model homes on lots 4 and 7 as proposed on the attached
plat map. Some of the plans are ready for submittal while other are still being updated for the
current code.
All houses are porch forward and designed per the Residential Design requirements for R-4 and
R-8 zones.
Lot one, two, three, five, six and eight plans are still in development
Lot four will be a M2823A3F-25 plan we refer to the Magnolia. The main floor plan entry and
garage are 1990square foot with a total impervious surface of 2642 square feet. It is a two story
house with a total of 3212 square foot plus garage of 618 and porches of 174 square foot.
Lot seven will be a Corona plan custom designed for this lot. The main floor plan, entry and
garage are 2231 square foot with a total impervious surface of 3136. It is a two story house with
a total of3541 square foot plus garage of655 and porches of 191 square foot.
Time frame for Temporary Use to be from receipt of building permits until such time as the plat
and parcels record at which time standard building permits and process will commence.
