The applicant is requesting a Shoreline Exemption to remove one (1) black
cottonwood tree located within Black River Riparian Forest (parcel number
1323049089). The property (See Exhibit 2) is 254,003 square feet, zoned
Commercial Office (CO), and is located in Black River/Springbrook A,
designation Natural. The proposed tree for removal is located in wetland and
shoreline buffers. The tree is located along the street edge of Naches Ave SW,
within 60 feet of the wetland and approximately 448 feet away from Black
River. The City's Urban Forester, Terry Flatley has assessed the tree's health
and states that the tree exhibits severe lean into the street with root ball
partially uplifted. Terry Flatley concludes that the tree is dangerous and
recommends immediate removal. As a condition of approval, staff recommends
that the stump be retained (if possible) and the tree left as large woody debris
on the site.

EXEMPTION JUSTIFICATION: An exemption from a Shoreline Management Substantial Development Permit
is hereby Approved with Conditions* on the proposed project in accordance with RMC 4.9.190C
'Exemption from Permit System' and for the following reasons:
The project meets the requirements of an emergency as the trees are classified as an Extreme Hazard
threatening public heath and safety.
The proposed development is:
Consistent with the policies ofthe Shoreline Management Act.
Consistent with the guidelines of the Department of Ecology where no Master Program has been finally
approved or adopted by the Department.
Consistent with the City of Renton Shoreline Master Program .
CONDITIONS: PLN -Administrative Decision Condition
1. The tree stump shall be retained (if possible) and the tree left as large
woody debris on the site.

RECONSIDERATION: Within 14 days of the decision date, any party of record may request that the decision
be reopened by the approval body. The approval body may modify his decision if material evidence not
readily discoverable prior to the original decision is found or if he finds there was misrepresentation of fact.
After review of the reconsideration request, if the approval body finds sufficient evidence to amend the
original decision, there will be no further extension of the appeal period. Any person wishing to take further
action must file a formal appeal within the 14 day appeal time frame.
APPEALS: The administrative land use decision will become final if not appealed in writing together with
the required fee to: Hearing Examiner, City of Renton, 1055 South Grady Way, Renton, WA 98057 on or
before 5:00 pm, on March 23, 2017 (RCW 43.21.C075(3); WAC 197-11-680). RMC 4-8-110 governs appeals to
the Hearing Examiner and additional information regarding the appeal process may be obtained from the
Renton City Clerk's office, Renton City Hall -7th Floor, (425) 430-6510.

Removal of one black cottonwood tree. Tree is 24 inches in diameter at 54" above the ground. Tree has
a severe lean into the street and root ball partially uplifted. This is a dangerous tree. This is an
emergency tree removal.

PURPOSE: Exempt activities provided with a letter of exemption from the Development Services
Administrator may intrude into a critical area or required buffer (Subject to any conditions or
requirements provided by the Administrator).

critical areas regulations. More specific descriptions of the activities are contained in the Critical Areas
Regulations. Some of the listed activities may not be exempt in certain critical areas. The Planning
