C. Project Description/Background:
Proposal to construct a wireless communication tower to monitor sub-regional transmitters for a paging
system. The applicant will sell in-block services to companies retailing paging systems. A 48 foot 'Rohn'
tower would be bracketed to the northwest corner of Building 18 on the Washington Technical Center site. A
6 foot fiberglass antenna would be mounted on top of the tower. The project would have a maximum height
of 54 feet.
The tower is a triangular shape, 18 inches on each side. The footing of the tower would require
approximately 3 to 4 feet of ground at its base and it would be bracketed to the building at the roofline and at
the base. The applicant is not proposing any additional improvements to the site except the proposed tower.
The tower would face the parking area behind Building 18. There are tall buildings in the vicinity of the
subject site which would serve to shield the tower from long-distance views in most directions. Directly north
of the site is Building 17, the Social Security building, which is approximately 46 feet. To the west are 54 foot
buildings along Oaksdale Avenue. To the south, near the intersection of Powell Ave. and Grady Way, is the
Eagle Hardware building headquarters, approximately 50 feet in height. The applicant claims that the tower
would not create any view obstructions to existing buildings or facilities and has checked with the Airport
Manager concerning the proposal.
The proposed communication tower operates in the 157 mega-hertz range. Personal Communication
Systems (PCS) operate in the 900 mega-hertz frequency.

FINDINGS, CONCLUSIONS & DECISION
Having reviewed the written record in the matter,the City now makes and enters the following:
G. Findings
1) CONSISTENCY WITH CONDITIONAL USE CRITERIA
Section 4-31-36 lists 11 criteria that the Hearing Examiner is asked to consider, along with all other relevant
information, in making a decision on a Conditional Use application. These include the following:
A. CONSISTENCY WITH THE COMPREHENSIVE PLAN,ZONING CODE&OTHER ORDINANCES:
The proposed use shall be compatible with the general purpose, goals, objectives and standard of the Comprehensive Plan,
the Zoning Ordinance and any other plan,program, map or ordinance of the City of Renton.
(1) COMPREHENSIVE PLAN, ITS ELEMENTS AND POLICIES
The proposed project is generally consistent with the elements and policies contained within the
Comprehensive Plan. Wireless communication facilities are not specifically addressed as a use
in Comprehensive Plan designations. Below are listed policies which generally address wireless
communication facilities as utilities.
Policy U-1: Utility facilities and services should be consistent with the growth and development
concepts directed by the Comprehensive Plan.
The proposed communications tower would provide services to all present and future users in
the City and near region. Residential, commercial and industrial users will benefit from the
infrastructure necessary for a quality mobile communication system.
Policy U4: Strive to protect the health and safety of Renton citizens from recognized harmful
effects of utility generated environmental hazards.
There is some public concern about the potential health impacts of low level radiation signals.
However, at this point the evidence of potential risk is inconclusive and the City has not
established policies or regulations regarding these facilities. The proposed communication tower
operates in the 157 mega-hertz range while Personal Communication Systems (PCS) operate in
the 900 mega-hertz frequency.
The FCC is responsible for regulating health hazards associated with communication tower
facilities such as the type proposed. The FCC has ruled that local jurisdictions have only limited
authority to regulate facilities, according to criteria adopted by the FCC. The proposed
equipment would meet adopted State and Federal standards regarding radiation emissions.
Policy U-100: Require that the siting and location of telecommunications facilities be
accomplished in a manner that minimizes adverse impacts on the environment and adjacent land
uses.
The facility is proposed behind an existing building on the Washington Technical Center site.
The developed site is in an industrial zone and the communications tower would not result in
adverse impacts to the environment or adjacent land uses.
The proposal would be required to comply with airport zoning and the FAA regulations regarding
safety of aircraft and efficient use of navigable airspace by aircraft.
Policy U-101: Require that cellular communication structures and towers be sensitively sited
and designed to diminish aesthetic impacts, and be collocated on existing structures and towers
wherever possible and practical.
The communications tower would be located behind an existing building, facing out to the
parking lot. The 48 foot high tower would be visible considering the building to which it would be

attached is only 18 feet high. However, there are tall buildings in the vicinity of the site which
would shield the facility and the tower would not completely stand out as the tallest structure in
the area. The applicant has not provided information if efforts were taken to collocated the
proposed facility on an existing tower.
(2) ZONING CODE
The project site is zoned Medium industrial (IM). Telecommunication facilities are considered
"medium utilities"which require approval of an Administrative Conditional Use Permit.
There is no maximum building or structure height listed in the IM zone. The facility includes a 48
foot tall tower with a 6 foot fiberglass antenna mounted on the tower. The maximum height is 54
feet.
As the proposed facility would be attached to an existing building, it complies with all setback
and other development standards of the IM zone.
B. COMMUNITY NEED:
There shall be a community need for the proposed use at the proposed location. In the
determination of community need, the Hearing Examiner shall consider the following factors,
among all other relevant information:
(1) The proposed location shall not result in either the detrimental over concentration of a
particular use within the City or within the immediate area of the proposed use.
The Federal Communications Commission (FCC) regulates wireless communication facilities
and limits the number of licenses issued to operate. This would prevent a detrimental
overconcentration of the particular use within the City and immediate area. The proposed tower
would function to monitor transmitters for paging systems. This is a different type of facility and
operates at a different frequency than other wireless communication facilities such as Personal
Communication Systems (PCS).
(2) That the proposed location is suited for the proposed use.
The proposal site is within an industrial zone and the proposed use would have little impact on
adjacent uses. Therefore,the proposed site may be considered well-suited for the proposed use.
As previously mentioned, there are other tall buildings in the vicinity of the site shielding or
breaking up long-distance views of the tower.
C. EFFECT ON ADJACENT PROPERTIES:
The proposed use at the proposed location shall not result in substantial or undue adverse effects on
adjacent property. The following site requirements shall be required:
(1) LOT COVERAGE Lot coverage shall conform to the requirements of zone in which the
proposed use is to be located.
Not applicable to proposal.
(2) Yards: Yards shall conform to the requirements of the zone in which the proposed use is
to be located. Additions to the structure shall not be allowed in any required yard.
The communications tower would be located behind and attached to an existing building. The
proposed structure meets yard setbacks requirements of the IM zone.
3) Height: Building and structure heights shall conform to the requirements of the zone in
which the proposed use is to be located. Spires, belltowers, public utility antennas or

similar structure may exceed the height requirement upon approval of a variance.
Building heights should be related to surrounding used in order to allow optimal sunlight
and ventilation, and minimal obstruction of views from adjacent structures.
There is no maximum building or structure height listed in the IM zone. The facility includes a 48

feet.
D. COMPATIBILITY:
The proposed use shall be compatible with the residential scale and character of the neighborhood. (Ord 3599, 1-11-82)
The subject site and the surrounding area are zoned and developed with industrial and office uses, so there is not
an issue of residential compatibility for the proposed use. Communication towers and antennas are frequently
mounted to industrial or commercial structures and the facilities are generally considered as necessary
infrastructure, compatible with uses permitted in industrial and commercial zones.
E. PARKING:
Parking under the building structure should be encouraged. Lot coverage may be increased to as much as seventy-five
percent (75%) of the lot coverage requirement of the zone, in which the proposed use is located, if all parking is provided
underground or within the structure. (Ord. 3903, 4-22-85)
The tower facility would be unattended and only occasional maintenance visits are anticipated. There is ample
parking adjacent to the proposed facility and the Parking Ordinance does not specify additional requirements for
telecommunication facilities.
F. TRAFFIC:
Traffic and circulation patterns of vehicles and pedestrians relating to the proposed use and surrounding area shall be
reviewed for potential effects on, and to ensure safe movement in the surrounding area.
The communication tower would not generate a significant amount of traffic. After construction, vehicular access
would be limited to maintenance needs of the facility.
G. NOISE, GLARE:
Potential noise, light and glare impacts shall be evaluated based on the location of the proposed use on the lot and the
location of on-site parking areas, outdoor recreational areas and refuse storage areas.
The proposed tower and antenna would not result in noise, light, or glare impacts. According to the applicant, no
lighting on the tower will be required by the FAA.
H. LANDSCAPING:
Landscaping shall be provided in all areas not occupied by building or paving. The Hearing Examiner may require additional
landscaping to buffer adjacent properties from potentially adverse effects of the proposed use.

1. ACCESSORY USES:
Accessory uses to conditional uses such as day schools, auditoriums used for social and sport activities, health centers,
convents, preschool facilities, convalescent homes and others of a similar nature shall be considered to be separate uses and
shall be subject to the provisions of the use district in which they are located.
The proposed tower may be considered an accessory use to the primary use of the building and as necessary
utility or infrastructure. However, it is included as a separate use under "Medium Utilities" in the code and is
therefore subject to approval under this conditional use permit.

J. CONVERSION:
No existing building or structure shall be converted to a conditional use unless such building or structure complies, or is
brought into compliance, with the provisions of this Chapter.

K. PUBLIC IMPROVEMENTS:
The proposed use and location shall be adequately served by and not impose an undue burden on any public improvements,
facilities, utilities, and services. Approval of a conditional use permit may be conditional upon the provision and/or guarantee
by the applicant of necessary public improvements, facilities, utilities, and/or services.
The proposal would not generate the need for additional public improvements beyond those which presently exist
on the site.
2) Request: The Applicant, William G. White, has requested approval for an Administrative Conditional Use
Permit for the Tower Installation TCC, a wireless communication tower.
3) Administrative Conditional Use: The applicant's administrative conditional use application complies with
the requirements for information for a conditional use. The applicant's site plan and other project drawings are
entered as Exhibits No. 2 thru 6.
4) Comprehensive Plan: The subject proposal is consistent with the Comprehensive Plan designation of
Employment Area-Valley.
5) Zoning: The Conditional Use as presented, complies with the zoning requirements and development
standards of the Medium Industrial (IM) zone.
6) Existing Land Use: Land uses surrounding the subject site include: North: Social Security building/office;
East: Industrial/distribution use; South:Office uses; and West:Offices.
H. Conclusions
1) The subject proposal complies with the policies and codes of the City of Renton.
2) The proposal complies with the Comprehensive Plan designation of Employment Area-Valley; and the Zoning
designation of Medium Industrial.
3) The proposed facility would be located in an industrial zone and surrounded by industrial and office uses. The
proposal is generally compatible with surrounding uses and would not adversely impact adjacent properties. The
proposed facility may be considered as necessary infrastructure for the area.

Land Use Action Appeals&Requests for Reconsideration
The administrative land use decision will become final if the decision is not appealed within 14 days of the date of the decision. An
appeal of the decision must be filed within the 14 day appeal period(RCW 43.21.C.075(3);WAC 197-11-680).
REQUESTS FOR RECONSIDERATION must be filed in writing on or before February 24, 1997. Any aggrieved person feeling
that the decision is based on erroneous procedure, errors of law or fact, error in judgment, or the discovery of new evidence which
could not be reasonably available at the prior meeting, may make a written request to the Zoning Administrator for review within
fourteen (14)days of the decision. This request shall set forth the specific errors relied upon by such appellant, and the Zoning
Administrator may, after review of the record, take further action as it deems proper. If an appeal is made to the Hearing Examiner,
requests for reconsideration will be forwarded to that office for consideration at the same time as the appeal.
AN APPEAL TO THE HEARING EXAMINER is governed by Title IV, Section 4-8-11.B,which requires that such appeals be filed
directly with the Hearing Examiner. Appeals must be made in writing before 5 p.m.on February 24, 1997. Any appeal must be
accompanied by a$75.00 fee and other specific requirements.
THE APPEARANCE OF FAIRNESS DOCTRINE provides that no ex parte(private one-on-one)communications may occur
concerning the land use decision. The Doctrine applies not only to the initial committee decision, but to all Requests for
Reconsideration as well as Appeals to the Hearing Examiner. All communications after the decision date must be made in writing
through the Zoning Administrator. All communications are public record and this permits all interested parties to know the contents
of the communication and would allow them to openly rebut the evidence in writing. Any violation of this doctrine could result in the
invalidation of the request by the Court.

(6) Project Narrative:
923 Powell Ave S.W. is located in building 18 on the Washington Technical Center site which is a
4.3 acre development that is located west of Powell Ave S.W. and south of S.W. Seventh Street
in Renton, WA.
Currently the site is zoned for IM (medium industrial) and does not require any additional
improvements to facilitate the addition of our proposed tower.
This site does not contain any special site features.
The addition of this communications tower should not create any view obstruction(s) to existing
buildings and/or other facilities.
Our proposed project, "Tower Installation Seattle TCC", consists of adding a 48' Rohn Bracketed
45G communications tower to the northeast side of building 18. This tower requires
approximately 3 to 4 square feet of ground at its base and will be used to mount communications
antenna(s) for the purpose of monitoring our paging system performance in the Seattle area.
We do not propose any off-side improvements. •
(16) Justification for the Conditional Use Permit Request:
A. Comprehensive Plan: This proposed communications tower installation is
compatible with the general purpose, goals, objectives, and standards of the
comprehensive plan as developed for the Washington Technical Center plus all zoning and
other ordinances of the City of Renton.
B. Community Need:
1. This proposed location for our communications tower shall not result in either
the detrimental over concentration of a particular use within the City or within the
immediate area.
2. The proposed location is suited for the proposed addition of a 48' bracketed
Rohn 45G communications tower.
C. Effect on Adjacent Properties: This proposed communications tower addition to
building 18 in the Washington Technical Center will not result in adverse effects on
adjacent property.
