This would include a fueling facility with four dispensers, two underground tanks, and an overhead canopy of 2,332 square feet. Because this portion of the site is currently developed, the applicant proposes few site improvements. Striping for 11 parking spaces would be installed. Two landscape islands would be installed in the parking area south of the existing building. The applicant proposes no changes to the existing landscaping on the corner of Rainier Avenue S. and S. 3rd Street. Two new stormwater catch basins and a new oil/water separator under the gas station canopy would be added to the site. Phase 2 of the proposal would construct a 2,121 square foot fast-food restaurant with a drive-up window, located on the,site to the south of the existing building. Both of the facilities proposed on the site are expected to be operated 24 hours per day. The site would be accessed via three existing curb-cuts off Rainier Avenue South and one curb-cut off of S. 3rd Street. 12 parking spaces are proposed for the convenience store and 40 parking spaces for the fast-food restaurant. PART TWO: ENVIRONMENTAL REVIEW In compliance with RCW 43.21 C.240,the following project environmental review addresses only those project impacts that are not adequately addressed under existing development standards and environmental regulations. A. Environmental Impacts The Proposal was circulated and reviewed by various City Departments and Divisions to determine whether the applicant has adequately identified and addressed environmental impacts anticipated to occur in conjunction with the proposed development. Staff reviewers have identified that the proposal is likely to have the following probable impacts: 1. Earth Impacts; The proposal site is basically flat with a maximum slope of about 2%. The north part of the site is presently developed with an existing building and paved parking. Phase 1 construction of the gas station would require excavation of approximately 600 cubic yards for underground tanks and piping. Backfill of approximately 225 cubic yards would be provided from an approved source. Phase 2 would require approximately 300 cubic yards of fill material. Erosion could occur during clearing and grading of the site. Potential erosion impacts would be mitigated by City Code requirements for approval of a Construction Mitigation Plan and a Temporary Erosion and Sedimentation Control Plan (TESCP) prior to issuance of Construction Permits. Mitigation Measures: No further mitigation is recommended. Nexus: NA 2) Air Impacts Impacts to air quality can be anticipated during construction and with the operation of the proposed project. Impacts during construction would include increased levels of airborne particulates (especially dust) from disturbance of exposed soils. The applicant should submit a revised Construction Mitigation Plan listing measures that would be used to minimize air-borne dust impacts during construction. Construction impacts would be short term in nature and would be mitigated through best management practices of the required TESCP and with the Construction Mitigation Plan. Emissions from construction equipment exhaust would have a minor impact on local air quality. Exhaust from construction vehicles is regulated by State and City Codes. These air impacts would be relatively minor in nature and not considered significant to warrant special mitigation measures. Fuel vapors from the gas station pumps would be controlled per State and Federal regulations. Mitigation Measures The applicant shall submit a revised Construction .Mitigation Plan listing measures that would be used to minimize air-borne dust impacts during construction. Policy Nexus Environmental Ordinance. 3) Water Impacts There is no surface water or wetlands located on the site or in the immediate vicinity of the project site. The site does not lie within a 100-year floodplain. There are existing stormwater facilities,catch basins and an oil/water separator draining the existing asphalt paved area on the north part of the site which would be developed with the gas station/convenience store. These catch basins are proposed to remain unchanged. The gas fueling area is located under a canopy and this area would drain to a new catch basin which would discharge to a new oil/water separator connected to the existing sanitary side sewer main. Two additional catch basins would be added on the south part of the site for Phase 2 development of the fast food restaurant. These would be connected to the existing storm drainage system. : The stormwater system will be required to meet the standards of the 1990 King County Surface:Water Design Manual as adopted by the City of Renton. The applicant has proposed mitigation measures in their environmental checklist to reduce potential impacts of fuel spills or accidents resulting in impacts to the groundwater from both the fuel dispensing area and from the underground fuel.tanks. The proposed measures are adopted by reference and are sufficient for mitigating the potential impacts. Separate plans and permits are required by the Renton Fire Department for the installation of underground tanks and tank monitoring systems. Mitigation Measures No further mitigation is recommended. Policy Nexus NA 4) Fire Protection Impacts The proposal would add new construction (Phase 2) to the City which would potentially impact the City's Fire Department. A Fire Mitigation Fee applies to all new construction. The required mitigation fee is based on a rate of$0.52 per square foot of new construction. For the proposed development the fee is estimated at $1,102.92 (2,121 square feet X $0.52 = $953.16). The Fire Mitigation Fee is payable at the time that Building Permits are issued. Mitigation Measures The applicant shall pay the appropriate Fire Mitigation Fee at a rate of $0.52 per square foot of new construction. This fee is estimated at $1,102.92. The Fire Mitigation Fee is payable prior to the issuance of Building Permits. Policy Nexus Fire Mitigation Fee Resolution and adopting Ordinance, SEPA Ordinance. 5) Transportation Impacts The site would be accessed via three existing curb-cut driveways off Rainier Avenue South and one curb-cut off of S. 3rd Street. The proposed uses would result in an increase in the number of traffic trips on the local street system. A Traffic Mitigation Fee is assessed based on the number of average daily trips that are attributed to the proposed development. The number of trips is based on standards from the ITE Trip Generation Manual. The net increase in the number of traffic trips is calculated including credit for the previous use on the site. The Transportation Mitigation Fee is calculated to be$75 per average daily trip. The traffic mitigation fee is estimated to be$16,822.50 for Phase 1 and $29,160 for phase 2 development. The applicant has submitted a Construction Mitigation Plan which describes the hauling and transportation routes to the site. Construction-related truck traffic could impact traffic flows if occurring during.peak traffic flow periods. Staff recommends a mitigating measure to ensure that truck traffic is limited to off-peak hours. Mitigation Measures: The applicant shall be required to pay a Traffic Mitigation Fee of$75 for each average daily trip associated with the project. The traffic mitigation fee is estimated to be $16,822.50 - ::for Phase 1 and $29,160 for phase 2 development. This fee is payable prior to the issuance of building permits. The applicant shall revise the Construction Mitigation Plan to provide a traffic control plan and . indicate construction hours. Because these notes are provided as information only, they are not subject to the appeal process for environmental determinations. BUILDING Gas pumps must be 20 feet from the store. Two exits are required from the store. Canopy over gas pumps must maintain 13 foot 6 inch clearance. Freestanding sign should be removed. FIRE 1. The preliminaryrequired fire flow is 2250 GPM. This requires one fire hydrant within 150 feet of the building and two additional fire hydrants within 300 feet of the building. 2., Separate plans and permits are required for the installation of the kitchen hood fire suppression system. 3. Separate plans and permits are required for the installation of the underground storage tanks and tank monitoring systems. PLAN REVIEW Surface/Wastewater 'The existing building (300) Rainier Avenue South is connected to the sewer,the new building (320) Rainier Avenue South will require a side sewer connection with permit cost at$80/connection: Sanitary sewer(SDC)fees of $0.078/sq. ft: of gross site area is:required if this property has never paid. The pump island will require a drainage system to collect and direct runoff to an oil/water separator and discharge to the sanitary sewer. Surface water drainage system designed in accordance with the 1990 KCSWDM as adopted by the City of Renton will be required. Biofiltration will be required if more than (5,000 sq. ft) of new impervious surface subject to vehicular use is constructed on site. The project will be subject to pay storm drainage (SDC) fees of$0.129/sq. ft. of new impervious surface installed on the site. Water New water main and additional fire hydrants will be required to meet fireflow requirements, current Fire Codes, and Fire Regulations. Any new water main, fire hydrants or water meters located on private property will be required to be in easements that will be held by the City of Renton. New water meters for domestic and irrigation must meet UPC Standards for size. Water(SDC)fees of$0.113/sq. ft. of gross site area is required if this property has never paid. The site is located outside of the Aquifer Protection Zones. Transportation This project has existing street improvements in place (curbs, gutters, sidewalk, street paving and street light). However, existing driveways to the site need to meet current City Codes/Standards. AIRPORT The Comprehensive Plan should identify the land use as Compatible with the operation of the airport and the take off and landing of aircraft of all types'7 days per week, 24 hours per day at low altitudes. The approach zone currently extends 5,000 feet south of the runway end. The project site is located approximately 600 feet west of the extended airport runway centerline, and approximately 2,000 feet south of the airport boundary. No use may be made within any airport approach zone or turning zone as identified in Sec. 4-31-17C, Use Restrictions. GENERAL CRITERIA: A. CONFORMANCE WITH THE COMPREHENSIVE PLAN, ITS ELEMENTS AND POLICIES; The subject site is designated Employment Area- Commercial (EAC) in the Comprehensive Plan. Land uses intended for the EAC designation are those that require large amounts of land and high visibility and access to large volumes of automobile traffic. Developments should provide appropriate treatment(e.g. landscaping, improved building facade) along major arterials to mitigate adverse visual impacts. Policy LU-174. Parking areas should be landscaped(including street trees, buffers, berms), especially along the roadways, to reduce the visual impacts. The proposal is basically consistent with the above policies as the two buildings and businesses on the site have coordinated access, internal circulation, and parking. The parking behind the convenience store along the east property boundary should be screened or buffered from the adjacent property with landscaping. Streetscape Policy LU-289. Aesthetic improvements along street frontages should be provided, especially for properties abutting major streets and boulevards..,Incentives should be provided for the inclusion of streetscape amenities.including:-landscaping themes, street furniture, paving, signs and planting strips in developing and redeveloping areas. Policy LU-290. Street trees should be used to reinforce visual corridors on major boulevards and streets. _ _. :_ Policy LU-291..:Beautification and screening of parking.lots:should be encouraged through appropriate landscaping, fencing and berms. Policy LU-293.. Private development projects should be encouraged to orient toward the streefand to:encourage creativity in project design'and landscaping in.the abutting right-of- way. Gateways Policy LU-274. City gateways should have identifying design treatment in terms of landscaping, building design, signage, street furniture, paving, and street width. The subject site is a major gateway to the Renton downtown. There is a wide landscape area which is comprised mostly of City right-of-way along the site frontage of S. 3rd Street. The area is presently lawn and the applicant is proposing to maintain the existing condition. Because of the prominence of this gateway into the downtown area, staff recommends that the applicant improve the landscaping with additional plantings and be responsible for the maintenance of the landscaping along the entire site frontage on South 3rd Street and Rainier Avenue South. B. CONFORMANCE WITH EXISTING LAND USE REGULATIONS; The subject site is located in the Commercial Arterial (CA) zone. Gas stations with mini- marts or convenience stores are allowed as a secondary use in the CA zone subject to the condition that the size and location be reviewed as part of site plan approval. The fast-food restaurant is allowed as a primary permitted use in the CA zone. A minimum 10 foot front/street building setback is required. A minimum 10 foot wide landscape strip is required abutting public streets. There are no side or rear yard setbacks required. The proposal complies with the setback and street frontage landscape requirements. The CA zone requires a pedestrian connection/sidewalk between a building entry and the street. There is a pedestrian connection provided to the new fast food restaurant. However, the applicant should revise the site plan to provide a sidewalk or painted asphalt crosswalk from the street sidewalk to the convenience store building entry. The CA zone allows a maximum building coverage of 65%. The CA zone allows a maximum building height of 50 feet. There is no indication on the site plan submittal of the maximum building height, but the one story buildings appear to be less than the code requirement. The Parking and Loading Ordinance requires 1 parking space per 75 square feet of gross floor area for combination sit-down/drive-in restaurants and a:convenience store requires a minimum of 4.and a maximum of 5 parking spaces per 1;000 square feet of gross floor area. The applicant is proposing 29 parking spaces for the fast-food restaurant and 11 spaces for the convenience store, fora total of 40 parking:spaces. This complies with the Parking Code requirements. It appears that the parking:stalls in front of the fast-food restaurant may;not comply with the code standards for parking stalls, for 90 degree head-in parking the required stall dimensions are 9 x 20 feet with a 24 foot wide aisle width. The applicant should submit a revised site plan verifying that the parking meets the code requirements. The fast-food restaurant has 7 stacking spaces wrapped around the building for the drive- up window. It is configured so the queuing for the drive-up window does not extend into the public right-of-way and it is separate from the parking,area. The drive-through area complies with code requirements. C. MITIGATION OF IMPACTS.TO SURROUNDING PROPERTIES AND USES; The project site is surrounded by other commercial development which is of a similar intensity: The proposed uses would be not adversely_impact surrounding properties and uses. The Phase 2 site plan shows a row of 17 parking spaces directly abutting the east property boundary. In order to reduce glare and buffer the aesthetic impacts of head-in parking on the adjacent property to the east, the applicant should install a landscape strip a minimum of 5 feet wide along the east property boundary. Construction of the proposal would result in temporary impacts to surrounding properties. These impacts are addressed and would be mitigated by measures included in the Construction Mitigation plan which addresses the hours of construction, hauling and transportation routes, and construction mitigation measures. The application does not include a lighting plan. It is a code requirement that parking lot lighting be directed inward on a site to avoid glare impacts on adjacent properties. This will be evaluated with the building permit application submittal. D. MITIGATION OF IMPACTS OF THE PROPOSED SITE PLAN TO THE SITE; The proposal would re-develop the site with modifications to the existing building and adding a building for a fast-food restaurant on the south part of the site. The construction and operation of the proposed uses is not expected to adversely impact the subject site. The proposed gas station facility includes safeguards to prevent potential impacts of fuel spills and accidents. The proposed site plan would not create adverse impacts on the site. SAFETY AND EFFICIENCY OF VEHICLE AND PEDESTRIAN CIRCULATION; The site would be accessed via three existing curb-cuts off.Rainier Avenue South and one curb-cut off of S. 3rd Street.. The closest driveway curb cuts along.Rainier Avenue South are separated by 30 feet. Transportation staff has not commented with concerns about the . . .. :number or location of driveway curb cuts. The driveways-comply,with code standards with • one.exception::-The applicant proposes to enlarge one of the existing driveways on Rainier = Avenue South to a 35 foot width. The code specifically limits'driveway widths.to a maximum of 30 feet. The applicant may apply for a deviation from this standard by requesting approval in writing from the Administrator of Planning/Building/Public Works, according to the criteria listed in Section 4-14-1.C.1.a. of the code. On-site circulation, the location of parking, and the design of the drive-thru for the fast food restaurant appear to function adequately. G. PROVISION OF ADEQUATE LIGHT AND AIR; -The:buildings are setback from property boundaries sufficient to.allow-for..adequate light and air to reach the buildings. H. MITIGATION OF .NOISE, ODORS AND OTHER HARMFUL . OR UNHEALTHY CONDITIONS; Noise, dust and odors may result with construction of the project. These impacts would be short-term and relatively minor in nature. Construction-related impacts would be mitigated through measures required in the Construction Mitigation Plan and with best management practices. The operation of the proposed uses are not expected to result in noise, odors or other harmful or unhealthy conditions beyond those impacts expected of commercial uses permitted by the zoning. The applicant has proposed mitigation measures in their environmental checklist to reduce potential impacts of fuel spills or accidents resulting in impacts to the groundwater from both the fuel dispensing area and from the underground fuel tanks. Separate plans and permits are required by the Renton Fire Department for the installation of underground tanks and tank monitoring systems. I. Phase 1: There are existing catch basins and an oil/water separator draining the existing asphalt paving. These catch basins will remain unchanged. One catch basin will be added to drain the southwest corner of the property where asphalt paving will be added. The existing building has an existing roof drain system. Entire storm water runoff system will be designed and installed as required by the City of Renton storm water ordinance. This will control the quality of water discharged underground. 2. Dispensing areas are under an overhead metal canopy. Surfaces surrounding the concrete dispenser islands are concrete. This area will be sloped to a drain system which is conveyed through an oil/water separator,discharging to the sanitary sewer system. 3. Underground tank fill connections are surrounded by containment manholes. Any fuel trapped in the container can be discharged into the tank. 4. Underground tanks fill and vent systems are designed to stop the flow into the tanks at a predetermined level below the top of the tank. This is a prevention system. 5. Underground tanks are a double wall system with an inert outer wall. Should the inner tank leak, fuel will enter the interstitial space between tanks, activating an electronic alarm system. 6. Tank mounted pumps are installed within sumps attached to the tanks. All product and vent pipes connect to these sumps. 7. All product pipes are double-wall design and slope downward from the dispensers to the tank sumps. Should the product pipe leak, fuel would enter the outer pipe and be conveyed to the tank sump. 8. Inert containers will be installed under all dispensers. These containers will trap any fuel which might leak at the dispenser area. 9. Electronic equipment will be installed to monitor the tank interstitial spaces,tank sumps and dispenser containers. Fuel vapors in any of these spaces will activate an alarm.
