REQUEST: Applicant requests site approval for proposed indus-
trial laundry facility in Earlington Park .
COMMENTS : 1 . Planning Commission should only approve that
portion of the site proposed for development at
this time .
2 . Parking required - 32 spaces ; Parkina provided
41 spaces .
3 . Applicant agrees to 5 foot minimum landscape strip
along east property line .
4 . Applicant agrees to continue landscape strip on
west side .

Avenue . He discussed the landscaping which will be put in
and stated that the applicant is working with the staff
landscape architect at the present time. Mr. Ericksen stated
that staff is recommending approval subject to posting of a
bond for installation and maintenance of landscaping and an
approved landscape plan .
Commission comments were invited . Seymour questioned if the
15 parking spaces more than required were necessary at this
time , or could the area be landscaped instead . Mr. Ericksen
said it would be conceivable that the parking on the south
could be eliminated and put into landscaping . The Chairman
noted that one parking space every 50-feet or so could be
taken out and the area landscaped . Mola suggested a turn-
around on the east side of the south parking lot .
The Chairman asked for audience comments . None were made .
SCHOLES MOVED THAT THE PUBLIC HEARING BE CLOSED , SECONDED
BY MOLA. MOTION CARRIED UNANIMOUSLY .
ACTION :
SEYMOUR MOVED , SECONDED BY MOLA, THAT THE SITE PLAN SUBMITTED
BY ELLING HALVORSON , INC . BE APPROVED SUBJECT TO THE FOLLOWING
CONDITIONS :
1 . POSTING OF A PERFORMANCE BOND FOR THE INSTALLATION
AND MAINTENANCE OF LANDSCAPING ( 150%) .
2 . THAT THE APPLICANT WORK OUT WITH STAFF ADDITIONAL
LANDSCAPING TO THE PLAN SUBMITTED TO CONVERT A LARGE
PORTION OF THE 15 EXTRA PARKING SPACES TO LANDSCAPING.

Chairman Teegarden read a letter dated July 31 , 1973 , from
Dave Benoliel of the Morris Piha Company requesting that the
application of Buffalo Sanitary Wipers Company be withdrawn
from the agenda as they have decided not to proceed with
building plans in Earlington Park at this time .
D, HIGHLANDS COMMUNITY CHURCH ; Appl . No . SA-738-73 ; site
approval for an addition to provide space for religious
education and recreation in an R-1 zone ; property located
on Kirkland Ave . N . E . between N . E . 9th and N . E . 10th Streets .
Chairman Teegarden presented the application , and the Planning
Director described it in detail and pointed out the property
location . The request involves a site of approximately 2-2
acres in an R-1 zone . The Comprehensive Plan , however , indi -
cates the area as a future medium-density multiple use , and
the property to the west is zoned B-1 . There is a public
right-of-way along the west side of the property , and a sig-
nificant change in elevation from the lower to the upper por-
tion of the property. The property to the north is zoned R-3 ,
and the property to the east and south is R-1 .
The Planning Director noted there is no proposed expansion of
the existing sanctuary . The proposed addition would require

93 additional parking spaces and the plan does meet the
requirements of the Parking and Loading Ordinance . He
stated that applicant will provide landscaping along all
abutting public.. right-of-ways , which requires. a minimum
of 5 feet within the property lines . Staff is ecommend-
ing a change in the parking proposed on the upper parking
lot at the entrance to the sanctuary for safety reasons .
There would have to be some changes to the landscape plan
of a minor nature . With those exceptions noted in the
staff report of August 1st , the plan does meet the require-
ments of the Zoning Ordinance and the Parking and Loading
Ordinance .
Lyman Houk , of the Public Works Department , explained the
deed restrictions on this property ( in regard to mineral
resources ) and the fact that when the property was turned
over to the City they assumed the repair and maintenance
of the water system, sewer system , etc . , as well as the
streets themselves .
Discussion ensued as to whether applicant is proposing to
landscape the northern side of the property. Mr. Ericksen
replied he did not think it was their intent to do so . In
reply to a question by Seymour , he stated he did not think
the landscaping requirement of the Parking and Loading
Ordinance could be applied retroactively to the existing
development (since there was no landscape requirement at
the time it was developed ) , but would only apply to the
portion to be newly developed.
Commissioner Ross arrived at 9 :00 p .m.
Discussion then followed on the possibility of the vacation
of Jefferson Avenue to the west of subject property , and
Lyman Houk explained the procedures which would be involved .
Seymour questioned if off-site improvements would be re-
quired , and the Planning Director stated in his opinion
it might be more appropriate to put in additional land-
scaping rather than off-site improvements on the west
property line , and he felt it might be feasible for the
church to request that the off-site improvements requirement
be waived in view of existing improvements .
Slides of the property were shown , as well as the surround-
ing uses and the proposed plans . Mr. Ericksen pointed out
that it would be a two-story structure from the ground
level (the lowest level ) , and would probably be about
32 plus feet in height. He also showed the south eleva-
tion view in relation to the existing church structure .
Chairman Teegarden asked for comments from a representa-
tive of the church . Mr. John Nason , 11807 S . E . 192nd St . ,
stated he had been working with the church in coordinating
the design , and that they had gone to the flat roof because
of the height problem. From the mean grade , he noted , they
would be within the 35 foot limit. Mr. Ericksen said the
mean grade level would probably be taken on the east ele-
vation . Mr. Nason stated this structure is being stepped
down one level from the existing building , and the top of
of this structure will be 10-ft . below the existing building .
The question of landscaping the north side of the property
was discussed , and Chairman felt if the landscaping and
parking areas were defined as indicated on the drawing it
would be a much better situation both from a traffic and
appearance standpoint.

A question was raised in regard to off-site improvements ,
and the Planning Director stated it would have to he
determined if they would be required . Mr . Ericksen noted
it might be preferable to suggest that the bus storage and
parking facilities be located on the vacant propert • adjoin-
ing the church if this would not conflict with the future
development plans .
WAIVER OF OFF-SITE IMPROVEMENTS :

The Planning Director presented the application and pointed out
the property location , which is in the vicinity of the previous
waiver requests . The proposal involves the division of an
existing parcel of land into three parcels . Mr . Ericksen noted
there are no off-site improvements in the area at the present
time but there will be in the near future when the Crescent
View plat is completed .
5, ADMINISTRATIVE :
A) COMMITTEE REPORTS :
1 . Zoning Committee :
Chairman Ross called a committee meeting for July
18th , at 7 : 30 p . m . , to discuss the Recreational
Vehicle Ordinance , the Rushmore rezone and the
downtown parking requirements .
2 . Community Services Committee :
Chairman Scholes reported the committee had met with
staff and the Engineering Department in an attempt
to finalize the wording for guidelines for waiver/
deferral of off-site improvements . Scholes reported
that Engineering had suggested these requests be
referred to the Board of Public Works .
Regarding the Environmental Awards , Scholes reported
the committee will be viewing the places nominated
and will try to report on this at the September meeting .
3 . Comprehensive Plan Committee :
Don Humble , Chairman , reported the committee is
recommending that the Planning Commission hold a
public hearing as soon as possible to consider the
Broadacres application for Open Space Classification .
Due to the six-months requirement , Chairman Teeqarden
suggested the hearing be set for July 25th and called
for a motion .
ACTION :
MOVED BY HUMBLE , SECONDED BY SEYMOUR , THAT THE BROAD-
ACRES PUBLIC HEARING DATE BE SET FOR JULY 25TH .
In view of the probable length of the July 25th meeting ,
the Chairman asked that it start at 7 : 30 rather than
8: 00 p . m. , and the Planning Director suggested the
Broadacres application be the first item on the agenda .
On the question , MOTION CARRIED UNANIMOUSLY .

Mr. Ericksen pointed out the location of the property and
described the application . He noted the structure will
contain approximately 25 ,000 square feet and will be
adjacent to the Hormel property . The proposed develop-
ment complies with the requirements of the M-P zone . He
noted a landscape plan has been submitted . Staff has
proposed some changes to the plan , and the applicant has
no objections to the proposed changes .
Slides of the property were shown and Seymour questioned
if the grove of trees is on the undeveloped portion of the
property . Mr . Ericksen said this would be checked out.
F. HIGHLANDS COMMUNITY CHURCH ; Appl . No . SA-738-73 ; site
approval for an addition to provide space for religious
education and recreation in an R- 1 zone ; property
located on Kirkland Ave . N . E . between N . E . 9th and
N . E . 10th Streets .
The Planning Director described the application and pointed
out the location . The proposal is for an extension to an
existing structure , including a classroom-recreational
facility , and parking on the remaining portion of the
property. The zoning is R-1 , with B-1 directly to the west .
The parking as proposed meets the ordinance requirements .
Ross questioned if it is mandatory that the Planning Com-
mission conduct a public hearing for a site approval or
a special permit. The Planning Director stated that the
Planning Commission has the right of approval and he felt
a committee could make a recommendation ; however , it is
desirable to hold a public hearing . Chairman Teegarden
stated that he thought a public hearing should be held.

G . RENTON ASSEMBLY OF GOD; Appl . No . SA-739-73 ; site
approval for a bus storage garage and bus parking
facility in R-1 and R-3 zones ; property located on
S . W . corner of Taylor Ave . N .W . and N . W . 2nd Place .
The Planning Director presented the application and pointed
out the property location . The proposed use is for a bus
storage garage and bus parking area and it involves both
R-1 and R-3 zoned property. The church is located on the
east side of the street between Taylor and Hardie Avenues .
The proposed development would be enclosed by cyclone
fencing for security purposes , and would be screened .
Mr . Ericksen displayed the site plan and landscape plan ,
and showed slides .
Mr . Ericksen noted retaining walls would be required , and
they are to be constructed in such a manner that the fencing
and landscaping will be above the walls .

Gentlemen,
This letter is a reminder that the Planning Commission
will be holding a special hearing this Wednesday, August 1st, at
8:00 p.m. in the Municipal Building's second floor Council
Chambers. As you know the agenda for the regular public
hearing last Wednesday, July 25th was so lengthy and
involved that a number of items were refered to this
special meeting. This was done so that people would
not have to sit through the meeting only to have it
adjourn before their particular request was heard.

I talked with Mr. Benezera of the Buffalo Sanitary Wipers
Company and he informed me that they were concerned about
saving the trees also. He felt that the group of fir
trees in question were on the undeveloped portion of the
site. This portion would only be used for rail spur access ,
as required by the railroad.
