He called me and said that after having reviewed the various material I gave him he felt that the maintenance bond as submitted would give the city suitable reassurance that the landscaping would be maintained. Sternoff CCS:jl Enclosure plant liquidators - brokers and dealers in non-ferrous metals and steel scrap.f 1011 AGREEMENT THIS AGREEMENT made and entered into this day of `2t)-0-e i.A:.C° 1973, by and between STERNOFF METALS CORPORATION, hereinafter referred to as "STERNOFF" , and JULIUS ROSSO WHOLESALE NURSERY CO. , hereinafter referred to as "ROSSO" , WITNESSETH : WHEREAS, STERNOFF presently operates a facility and is in the process of developing a new facility in Renton, Washington, and is required to meet certain landscaping requirements of the City of Renton in connection therewith, and WHEREAS, ROSSO is willing to undertake such necessary landscaping under this contract, NOW, THEREFORE, it is agreed by and between STERNOFF and ROSSO as follows: 1. On the Eastern and Southern boundaries of the existing facility, ROSSO will provide a five-foot wide landscape strip with Lombardy Poplar trees planted twelve (12) feet on center and six (6) to eight (8) feet high as planted along the outside of the entire existing fenceline. 2. STERNOFF is providing an eight (8) foot site screening fence around the entire proposed facility. ROSSO will provide a five-foot wide landscape strip with Lombardy Poplar trees planted twelve (12) feet on center, six (6) to eight (8) feet high as planted, along the outside of the entire fenceline. 3. ROSSO will also clean and grub the above areas, fertilize the, plants and apply weed control to such areas. 4. STERNOFF will pay ROSSO $ 2 77/ 4 ple sales tax f the above. In the event bark is to be added, it will be done on a time and material basis, using the rate of $5..50 per hour for a foreman and $3.50 per hour for laborer. 5. STERNOFF is attempting to purchase or obtain an easement over a five-foot strip of land outside its existing fence on the Northern boundary of the existing facility. As and when such strip is obtained, ROSSO will provide such five (5) foot landscape strip with Lombardy Poplar trees planted twelve 12) feet on center and six (6) to eight (8) feet high as planted, and will clean and grub the area, fertilize the plants and apply weed control, for a price of dz4, p ute sa esytax V r)S 6. He wished to provide substitutions for some of the photinia . The plant material available was : California Privet - 6 ' -8 ' English Laurel - 3 ' -4 ' Wax Privet - 3 ' -4 ' Portugese Laurel - 2 ' -3 ' Cotoneaster - ( to be used as ground cover) These substitutions are acceptable . I advised Mr. Jensen that the plants should be grouped and not planted in a random manner. Portugese Laurel could be used only if it is 3 feet or more in height. He referred the Planning Commis- sion to the Planning Department' s letter of September 24th to Mr. Carl Sternoff defining the points that needed to be resolved regarding their application , copies of the staff report and the supplemental report regarding landscape re- quirements . The Planning Director noted that regarding the northern boundary it was originally intended that there should be a five foot planting strip outside the screening fence , to be planted with poplars , similar to the southern bound- ary line. Representatives of the Railroad agree that such screening is necessary. They are investigating the pos- sibility of making five feet of their property available to Sternoff. There may be a problem with- reference to a proposed future spur track ; therefore , Burlington engi - neers are presently studying this , and the staff is await- ing their reply . The staff is specifying replacement of trees along the southerly and easterly property lines , requesting that spacing be maintained and that provision be made for water- ing for survival . However , he noted that in the past the site has been posted and advertised for public information and handled in the same manner as a public hearing item. Chairman Teegarden requested further assurance that screen- ing plans would be accomplished . In response , Mr. Carl Sternoff stated that they are going to hire professional landscapers to take care of screening and will install a proper water system. Commissioner Seymour questioned the urgency of the situation and stated that she felt unprepared to make a decision at this time . With reference to screening , it was noted by Mr . Ericksen that the poplars are approximately 10-12 feet on center and that spacing of 10 feet was desirable . He noted that the oricinal intent was that the storage area be entirely screened by the poplar trees , and for this reason no height restriction was imposed . The Planning Director reviewed the H- 1 requirements as they relate to Sternoff for the Commission : Pulverizing of junk is allowed , when the operation can be fenced and screened ; no storage is allowed outside the fencing ; and all activity is to be carried on within the screened area . Landscaping was an additional requirement specified by the Commission . Discussion ensued as to how the Commission could encourage the applicant to follow through on its original commit- ments to upgrade the facility . Commissioner Humble sug- gested that a bond be required to insure that the trees are planted and also that they make sure that they grow. Commissioner Scholes asked when the original covenants were drawn up on the existing operation . Mr . Erickson requested a recess to allow him to obtain the file . A recess was called at 10 : 30 p . m . The meeting resumed at 10 : 35 p . m. As all members were noted to be present , roll was not called . MEMORANDUM September 4 , 1973 TO : Files FROM: Mike Smith SUBJECT : Meeting with Mr. Sternoff Gordon Ericksen and I met today with Carl Sternoff and Allen Sternoff regarding the proposed addition to their existing facility . They expressed a need for expedi - ency in approving this proposed facility . They also presented a revised plan showing landscaping , lot lines , fence , new building , etc . They expressed a desire for an early hearing due to certain circumstances that have risen . We told them that we would upon receipt of a letter explain the situation to the Planning Commission Chairman and ask his opinion on this matter. However , we stated that the decision to allow any construction prior to the hearing or to allow an early hearing on the site approval application would be entirely up to the Commission or its chairman . Furthermore , the con- dition of the existing site with respect to the param- eters of the restrictive covenants would also be a determining factor in any decision . Sternoff , This is to acknowledge the meeting on August 24 , 1973 with Mr . Allen Sternoff of your company . As stated during this discussion there are certain elements of the present Sternoff development in Renton which do not agree with the covenants and conditions set forth at the time that the property was rezoned , January 28 , 1967 . These include ; 1) Storage of materials and wrecked autos outside the site screening fence . 2) Absence of landscaping in conjunction with the fence . 3) Insufficient maintenance of landscape strip . 4 ) Site screening fence and lanscaping not provided along west property line . As stated during this discussion work will begin immediately on alleviating these areas of concern . This will surely assist you in your present request to enlarge your facility . Upon receipt of your application for site approval the Plannning Commission will be scheduling a field trip to the facility . This is a standard procedure which gives the Commission an opportunity to become more familiar with the various as- pects of each particular request . Necessary procedures and forms were given to Allen Sternoff during the meeting , which included various maps , deadline dates , and any other information needed to make the application clear and complete . He in turn indicated he would notify the architect of the need for additional detailed landscape plans , plot plan , and vicinity map . He also felt that a fence and landscaping around the proposed facility would be an acceptable addition to the plans . In addition it was mentioned that Federal and State Law may require that an Environmental Impact Statement be submitted for the proposed project . This would be determined after the application is submitted in full . r It is our feeling that issuance of a partial permit for the construction of the foundation of the proposed building is an acceptable request . This permit , however would be allowable with the applicants clear understanding that it is not a final approval of the proposed facility , and thus the applicant undertakes this work with the risk that it may be changed or altered as a result of subsequent Planning Commission review. Plans of sufficient detail for thorough review would also be needed prior to the granting of such a request . Ericksen FROM: Mike Smith SUBJECT : Unsightly storage of wrecked auto at Sternoff Metals A field inspection was made of the situation at Sternoff Metals . It was found to be in gross violation of the provisions of the site plan approval. Literally there are thousands of wrecked cars and junk piled in variDus locations outside of the actual fenced area . Seen from a distance these piles look like mountains of ugly rusted junk creating an accute eyesore above the green valley floor. A number of slides were taken of this violation .
