WHEREAS , Dean W . Bitney and Jonell M . Bitney , his wife ;
Charles H . Grouws and Ellen L . Grouws , his wife ; Chester E . Nesheim
and Lillian M. Nesheim , his wife ; Ethel M . Neisheim ; and Lillian A .
McCleave are the owners of the following real property in the City
of Renton , County of King , State of Washington , described as follows :
Volume 17 , Page 74 ; Lots 1 through 12 and 20 through 2 / ,
block 35 , all in C . D . Hillman ' s Earlington Garden addition
to the City of Renton , Division No . 1 all situated in the
City of Renton , County of King , State of Washington .
WHEREAS , the owners of said described property desire to
impose the following restrictive covenants running with the land
as to use , present and future , of the above described real property
NOW , THEREFORE , the aforesaid owners hereby establish ,
grant and impose restrictions and covenants running with the land
hereinabove described with respect to the use by thQ undersigned ,
their successors , heirs , and assigns , as follows :
SETBACKS
No structures or buildings shall be permitted or located
a ) within thirty ( 30 ) feet of the property line adjacent
to State Highway FAI 405 on the north , and S .W . 16th Street
on the south ; and ( b) within thirty ( 30) feet of the prop-
erty line adjacent to Pacific Avenue S .W . on the east ;
c ) within twenty ( 20) feet of all other property lines ,
and the eastern right of way line of the P-1 channel .
LANDSCAPED AREAS
The first twenty ( 20) feet adjacent to all property lines
shall be appropriately landscaped and maintained continu-
ously in a neat and clean manner , except for designated
pedestrian and vehicular accessways . The remainder of the
setback area not required to be landscaped may be utilized
for off-street parking purposes as provided by the laws and
ordinances of the City of Renton .
STORAGE
The outside storage of materials , construction equipment ,
supplies and containers shall be permitted provided such
storage area is screened from all adjacent property lines
by a wall or view obscuring fence not less than eight (8)
feet nor more than ten ( 10) feet in height . Such screening
to be continuously maintained in a neat and clean manner .
DEVELOPMENT PLANS
Plans for development or redevelopment must be approved by
the City of Renton Planning Commission .
DURATION
These covenants shall run with the land and expire on
December 31 , 1995 .
Any violation or breach of these restrictive covenants may be
enforced by proper legal procedures in the Superior Court of King
County by either the City of Renton or any property owners adjoin-
ing subject property who are adversely affected by said breach .

drainage problems in the area which they feel are the
result of partial filling of the ravine and inquired regard-
iig plans to correct the situation . Ken Brown , a resident
of the area , also described damage due to drainage in the
vicinity .
Mr. Barton indicated that the drainage line is located approxi -
mately on the property line. Further discussion regarding
the problem ensued ; the Planning Director indicated that the

Assistant Planner Smith pointed out the site of the proposed
office and warehouse structure at S . W. 16th Street and High-
way 405 on the map . He noted Springbrook Creek , the proposed
P- 1 drainage channel and surrounding business properties .
He described adjacent zoning and reminded the Commission
of the restrictive covenants established by the City Council
at the time of rezoning of the property from GS- 1 to L- 1 .
Mr. Smith reviewed development plans , including an approxi -
mate 18 , 000 square foot office and warehouse building , park-
ing area to be installed in conformance with Parking and
Loading Ordinance standards , and landscaping as provided in
the restrictive covenants . Mr . Smith stated that landscaping
along the eastern boundary adjacent to Pacific Avenue S . W.
is being deferred until additional property can be acquired
and noted that a performance bond had been posted . A perform-
anceIbondhasalsobeenpostedforblacktoppingonthe
east , since the easterly line may change . Plans for parking
were also reviewed by the Assistant Planner , who noted
provisions for five percent interior landscaping in the
parking and circulation area .
Tre Chairman invited comment from the applicant , but Mr.

located on the corner of Taylor Place N . W. and N . W.
6th Street and indicated significant development in
the area. He reviewed existing land use and zoning
in the vicinity , noting that the general character
of the area is single family residential . The applicants
propose to subdivide the property into four single family
building lots averaging 7500 square feet .
Part of the ravine in back of the property in question
is zoned B- 1 and has been partially filled. The request
is in agreement with the Comprehensive Land Use Plan ,
which designates most of the property as single family
residential . Mr. Smith advised that the site is presently
zoned S- 1 . Photographic slides and aerial photographs
of the property were then viewed.
The Chairman invited comment from the applicants .
Alex C . Fleury , 8056 Stroud Avenue N . , Seattle , one of
the owners , offered to discuss future plans for the
property . Responding to Ken Brown , 305 N . W. Sixth St . ,
Renton , Mr. Fleury stated that it is their intention to
apply for a subdivision of the property for single family
hones .
Ronald P . Barton , 531 N . 75th , Seattle , stated that
they plan to develop the site into no more than four
single family residences and indicated that they have

items allow for more study . It was noted that all Planning
Commission meetings are open and that the matter of Planning
Commission administrative procedures and guidelines to be
developed by the Commission had been referred to the Community
Services Committee for study .

RE : Meeting on 11 / 15/ 74 with Bitney & Grouws
Regarding Site Approval .
Gordon Ericksen , Joan Lankford , and myself met
today with Mr. Bitney and Mr. Grouws to discuss their
proposed Site Development Plans . Several questions
were raised by staff with regard to the use , function
and design of the building and layout . Mr. Bitney
stated the total amount of office space intended will
be 3000 square feet . We indicated to him that if there
was at any time in the future more office area added ,
the appropriate parking would be required .
We also clarified the location of the loading
doors and office doors . There will be no loading
doors on the south side of the building adjacent to
S . W. 16th St.
The matter of off-site improvements was discussed
and we informed him of the options available . We told
him he should contact the Public Works Department to
discuss these improvements .
We also informed them that any major remodeling
or additions would require prior Planning Commission
approval .
The question of a twenty foot landscape strip
adjacent to all property lines was discussed . The
applicants indicated they would provide such landscaping
at this time on the north and south sides . However ,
they wished to defer installation on the east and west
side until they have acquired additional property . They
wish to apply for vacation of Pacific Avenue S . W. on the
east side , and acquire excess property from King County
on the west side . We indicated that this possibly could
be accomplished with the posting of a bond and agreement

not to pave those portions until the matter is resolved .
However , it was stated that the Bond would only defer
the installation for a maximum of 2 years . If it was
found that it would take longer to acquire the additional
property , a lease agreement to provide the twenty foot
landscaping strip may possibly be arranged with the
County .
They indicated that their landscape designer would
contact the department to review the requirements and
establish an estimate for the Bond .
We indicated if the problem on the side property
lines were sufficiently resolved we could recommend a
partial permit .
The 5% interior landscaping requirement of the
parking an.d loading ordinance was also mentioned . We
expressed the possibility of utilizing this*1290 square feet
around the building to help soften its appearance .
They agreed that this would be incorporated into their
plans .

Dear Mr. Smith:
Subject : Surplus property for the proposed
P-1 channel between SR 405 and
SW 16th Street
Reference is made to your letter dated November 18, 1974, and
your memorandum dated November 20, 1974, concerning Mr . Dean
Bitney's and Mr. Charles Grouws ' proposed development and how
it relates to the proposed P-1 Channel.
We have discussed with Mr. Grouws the possibility of the ad-
jacent land owner purchasing from King County any surplus
land we own in fee title not required for the proposed P-1
drainage channel between SR 405 and SW 16th Street . This is
possible, but the land, "if any", would not be declared surplus
until the proposed P-1 Channel is constructed in this area. We
estimate the earliest possible completion date for the proposed
P-1 drainage channel would be in the fall of 1977. The adjacent
property owner would be given the first opportunity to pur-
chase any declared surplus land in this area that is owned by
King County; and he would have to work through the King County
Property and Purchasing Division, which handles all such trans-
actions.

of the site of the short plat on Kennewick Avenue N . E .
south of N . E . 14th . He noted that street and curbs are
already installed , but a waiver is requested for installa-
tion of sidewalks .
Previous Commission action on an a .-,clication for waiver
of off-site improvements for the applicant ' s property
to the west was reviewed , and minutes of the proceei; ngs
were requested by the Commission .

1974 . Mr. Smith indicated that the applicant sub-
mitted a request to the Board of Public Works for deferral
of improvements along N . E . 8th Street for a maximum of one
year. The deferral was granted by the Board , as rel;ested ,
and a bond has been posted . A brief discussion folicwed .
REZONE

The rezone request was introduced by Secretary Gibson .
Assistant Planner Smith noted the 1 . 1 acre site situated
at the corner of N . W. 6th Street and Taylor Place N . W.
Mr. Smith described Comprehensive Land Use Plan and zoning
designations in the vicinity . The general topography of
the area , including a ravine on the property , was des-
cribed . He stated that it is anticipated that an appli -
cation will be submitted through the Subdivision Ordinance
to divide the property into three or four parcels .
Discussion followed regarding appropriate zoning for the
site and definition of the G zoning category . It was
noted that it is the intention of the staff to contact
the applicant to suggest revision of their application to
a rezone of the site from S- 1 to SR- 1 . It was requested
by the Commission that information be obtained regarding
access and ownership of lots two and four .

The November 1974 administrative meeting of the Renton Planning
Commission was called to order at 8: 00 p . m. by Commissioner
Ross , hairman .
1 • ROLL CALL was taken by Commissioner Wik , acting for Secre-
tary Gibson , who arrived at 8 : 05 p . m. It was noted that
Commissioner Morrison was not present . The Planning
Director advised that Mr. Morrison has submitted a letter
of resignation and will no longer be serving on the Commis-
sion .
ACTION:
MOVTD BY TEEGARDEN, SECONDED BY MOLA, THAT THE ABSENT COM-
MISSIONER BE EXCUSED. MOTION CARRIED.

The Chairman called for additions and corrections to the
minutes of the meeting of October 23 , 1974 .
It was noted by Commissioner Seymour that an incor-
rect correction had been made and approved to the
minutes of October 9 , 1974 , with regard to the
Washington Natural Gas Company site ( use ) approval
and special permit ( fill ) applications . Commissioner
Humble had voted against Commissioner Mola ' s amend-
ment of condition number three of the original motion
but had voted for the original motion with first
amendment by Commissioner Seymour.
With regard to committee reports on page six , Commis-
sioner Seymour requested that it be indicated that
the Vice Chairman had called for them rather than
the Chairman , who was absent .
ACTION:
MOVED BY SCHOLES, SECONDED BY SEYMOUR , THAT THE MINUTES BE
AP ROVED AS CORRECTED. MOTION CARRIED .

At the request of the Chairman , Secretary Gibson introduced
the application . Chairman Ross then invited a presentation

Smith noted that the site had been recently rezoned from
GS- 1 to L- 1 , and the applicants were seeking approval of
their site plans for the property. The 1 . 5 acre site was
pointed out on the map , and significant landmarks and devel -
opment in the vicinity were noted .
Mr. Smith described the proposed structure , a prefabricated
metal warehouse and office unit , and noted parking and land-
scaping proposals . The restrictive covenants included in
the approval of the rezone by the City Council on October 7 ,
1975 , were reviewed. It was noted that the applicants intend
to request the vacation of Pacific Avenue S . W.
Discussion followed with regard to the proposed site plan ,
as it relates to conditions established by the Council it
the time of rezone approval ; and it was requested that the
Commission be provided copies of Council action , including
the restrictive covenants , to assist in their study . It was
also requested that the authority of the Commission in the
review process under the covenants be defined by the City
Attorney .
It was noted that the applicants have requested approval of
landscaping in variance with the restrictive covenants on
the east and west . The Commission asked that a plan of the
building envelope on the site , indicating what does comply
with the covenants , be provided .
4 - ADMINISTRATIVE :
A. CITY COUNCIL REFERRAL: MODIFICATIONS TO MERCER ISLAND
FLOATING BRIDGE
At the request of the Chairman , the Planning Director intro-
duced a referral from the City Council for Planning Commis-
sion review with regard to proposed modifications to the
Mercer Island floating bridge by the Washington State High-
way Department . The Commission has been requested to review
the matter to determine specific impact on Renton to prepare
for future hearings to be held by the Coast Guard .
Discussion followed relative to the approach to follow in
studying the problem, specific concerns to be addressed by
the Commission , and the anticipated time available for Plan-
ning Commission review.
ACTION:
MOVED BY SEYMOUR, SECONDED BY HUMBLE, THAT THE MATTER BY
REFERRED TO THE COMMUNITY SERVICES COMMITTEE FOR STUDY AND
RECOMMENDATION.
Further discussion followed , and it was noted that there
was no request for date of report. On the question , MOTION
CARRIED UNANIMOUSLY.

B. COMMITTEE REPORTS
Chairman Ross invited reports from committee chairmen .
COMMUNITY SERVICES COMMITTEE
Commissioner Scholes , Chairman of the Community Services
Committee , referred Commission members to reports distri -
buted from the Committee with regard to the following
subjects that had been referred to them for study and
recommendation : the subject of artificial plantings
and landscaping and guidelines for waiver or deferral
of off-site improvements with regard to short plat
requirements . The reports were reviewed briefly , and
it was suggested that time for further Planning Commis-
sion study be provided.
Chairman Scholes also referred the Commission to their
proposed ordinance for the City of Renton , entitled ,
An Ordinance of the City of Renton , Washington , adding
a new Section 4-734 of Title IV (Building Regulations )
of Ordinance No . 1628 entitled ' Code of General Ordi -
nances of the City of Renton ' regulating Abandoned
Service Stations . " He suggested that the proposed ordi -
nance be studied by Commission members for review and
onsideration in January . It was requested that a copy
of the Tacoma ordinance with respect to abandoned serv-
ice stations be obtained for the Commission to assist
in their review of the Committee ' s proposal .
Discussion followed with regard to study time required ,
and it was decided that the recommendations of the Com-
munity Services Committee relative to the items listed
above not be acted upon at this time and that they be
placed on the agenda for the January 1975 administ,i-
tive meeting .
73NING COMMITTEE
Commissioner Mola , Chairman of the Zoning Committee ,
called for a meeting at 7 : 30 p . m. , November 14 , 1974 .
COMPREHENSIVE PLAN COMMITTEE
Commissioner Humble , Chairman of the Comprehensive Plan
Committee , reported that the Committee has been meeting
on a weekly basis and will probably continue to meet
every Wednesday evening through December to finalize
Committee opinions with regard to land use in the Green
River Valley . It was noted that the Committee will need
to include in their review a study of the environmental
impact statement relative to the Green River Valley ,
plans for channelization of the Valley , and recommenda-
tions by the Zoning Committee with regard to possible
modification of industrial zoning requirements . Dis-
cussion concerning these items followed and the feasi -
bility of a joint meeting with the Comprehensive Plan
Committee and the Zoning Committee , probably in Decem-
ber , was considered .
C. FIELD TRIP
It was decided to visit the sites of the public hearing
items to be considered November 27 , 1974 , on an individual
basis .
